It - was moved by Commissioner SNOW and seconded by Commissioner COLLINS to
approve Case No. WS-01 02, a request for approval of a six-lot combined preliminary and
final subdivision glat for Residential-Three and Residential-Two zoned property located
at 11680 West 46 Avenue, 11690 West 46 Avenue and tr t property located-
south of 11680 and 11690 West 46 Avenue for the following reasons:
1. All minimum standards of the R-2 and R-3 regulations have been met or exceeded.
2. All requirements of the Subdivision Regulations have been met.
With the following conditions:
F. Case No'. WZ-00-12: An application submitted by Skitzo Offshore LLC dba Trailer
Source for approval of a rezoning from Agricultural-One (A-1) and Planned
Commercial Development (PCD) to Planned Commercial Development (PCD) and for
approval of an outline development plan. Said properties are located at 4651 Tabor
Street, north of 4651 and 4601 Tabor Street.
This case was presented by Meredith Reckert. She reviewed the staff report, entered all
the case, Slides and overheads of the subject property were presented, Staff recommended
approval of the case for the reasons and with conditions outlined in the staff report. ,
Commissioner SNOW expressed concem about access to the property and was surprised that
the 11ighway Department once sold this piece of land and is now going to buy it back for r to
to 1-70. Alan White stated that the proposed ramps would not tie into Tabor Street , c
wot�d remain in its current condition, The proposed ramps would replace those ramps
presently in existence west of the truck stop.

Motion by Mr. Schneider to override the Rules and allow Mr. Gokey more time for
questions; seconded by Mr. Hanley; carried 7-1 with Mr. DiTullio voting no.
Kim Stewart was sworn in by the Mayor;, she lives right next to the Turgeon property. This
has been a long, tedious and acrimonious process. She gave background on traffic
problems and asked for passage of traffic calming devices.

This case was heard by the Planning Commission on October 3, 2002 and was continued in order for
staff to provide additional information. Additional information was provided at the last hearing on tattoo
parlors and consisted of:
The Commission requested that the ordinances dealing with these establishments be brought back
separately. This hearing will focus on palm readers, fortune tellers, etc. and pawn shops, The first
recommendation is to groui ialm readers, fortune tellers, card readers- and all similar services under

Surrounding communities generally allow these establishments in commercial districts where retail uses
are allowed, There are no special requirements for these uses in the municipalities surveyed.
1. Allow as a special use in RC, C-1, and C-2 zone districts; grandfather existing uses at
existing locations.
2. Allow as a permitted use in RC, C -1, and C-2 with spacing requirements.
3. Allow as a permitted use in RC, C-1, and C-2, or just C -1 and C-2.
There are at least two options to consider with pawn shops:
I Do not change the current regulations: permit pawn shops as special uses in the C-2
zone district; existing uses are legal non-conforming uses.
2. Add pawn shops as a special use in the c -1 zone district.
The two items have been advertised as for public hearing. Recommendations to Council are requested.
Planning Commission's 60 days to act on an item referred by Council is up on November 25th.

Industrial Districts, as follows:

procedures shall be allowed to continue. Any expansion, addition, or site modification shall

This memorandum is in regard to proposed revisions to Section 26-222. D. • the Streetscape
Overlay District - Enhanced Design and Construction Requirements. Attached in ordinance form
are our recommended changes. As usual, additions are shown in bold type and deletions are

Staff has been administering the regulations for over a year now and has realized that'many times
strict application of the regulations has had a negative affect on potential projects. Typical
streetscape improvements may vary I in price from installation of 3" caliper street trees at $525
each to installation of special pedestrian lamps at $3920 each.
Staff is recommending the following changes.
