APPROVE MINUTES Commissioner McMILLIN requested an arivendment to paragraph 7 on page 3. The first sentence should read Commissioner DAVIS asked the size ...... rather than Commissioner McMILLIN. It was moved by Commissioner McMILLIN and seconded by Commissioner WEISZ to approve the minutes of May 15,2003 as amended. The motion passed 7-0 with Commissioner BERRY abstaining. 6. PUBLIC FORUM There were none present to address the Commission during this portion of the meeting. A. Case No. ZOA-03-05: An ordinance amending portions of Chapter 26 of the Code of Laws of the City of Wheat Ridge concerning Family Foster Homes and Residential Group Homes. The case was presented • Alan White. He advised the Commission there was jurisdiction to hear the case and reviewed the staff report. Commissioner BERRY commented that the ordinance specifies the agency responsible for licensing group homes, but does not spell out the agencies responsible for licensing family foster homes and asked if the ordinance should include the licensing agencies for family foster homes. Alan White replied that the Commission could recommend approval with a condition that the city attorney review the matter to decide whether or not family foster home licensing agencies should • included in the ordinance. Commissioner McMILLIN pointed out that Arvada's ordinance states family foster homes are licensed by the State of Colorado for the County Department Human Services. Chair McNAMEE asked if any individuals were present who wished to address this matter. Case No. ZOA-03-09: An ordinance amending Chapter 26 of the Wheat Ridge Code I • Laws pertaining to heights and setbacks for residential accessory structures and exceptions thereto. This case was presented by Alan White. He advised the Commission they had jurisdiction to hear the case. He reviewed the staff report and digital presentation which included a survey of regulations in effect for neighboring jurisdictions. Even though this case is a public hearing, at the June 19' or July 17 meetings. Discussion points included: Chair McNAMEE asked if there were individuals present who wished • address this case. OLD BUSINESS The city has settled the lawsuit with John Elway AutoNation and the final development plan was approved with modifications to lighting and clarification regarding groundwater pumping. 0 The SUP process was approved by City Council at its last meeting. Staff will present a comparison of the old code and new code concerning special uses in thc NC zone district for consideration by the Commission at a later date. The Conservation Zone District located at 4650 Parfet was approved without the right-of-way vacation. a all II. 2. Commissioner McMILLIN asked for a status report on the replacement of trees on the Phillips 66 property at 38 th and Kipling. Alan White will look into this and report back to the Commission. Commissioner PLUMMER commented that the same situation exists at the kitchen shop at 41 " and Kipling. 3. Commissioner DAVIS commented that the minutes were improved in relation to M utlining reasons for the Commission's decisions. I Alan White informed the Commission that nothing is scheduled for the July 3 d meeting. It was moved by Commissioner PLUMMER and seconded by Commissioner DAVIS that the July 3, 2003 Planning Commission meeting be canceled. The motion passed 8-0. The purpose of the subdivision is to allow conveyance of Lot 2 to a family member. Although the property is addressed as 6900 West 38 Avenue, it is located south of West 38 Avenue behind the old "Marc's" restaurant. The property is zoned Residential-Three with a 10' wide strip of Commercial-One zoning running along the northern property line. (Exhibit 1, Vicinity Map) There are two accesses into the property. An access easement recorded in 1982 with the adja�j property owner crosses the parking lot to the north allowing access from West 38 Avenue. other access is to the intersection • Quay Street and West 37 Avenue. The existing single family home was built in 1940. Another structure, the "barn", was built in 1998 with an apartment on the upper level. The lower level originally consisted of a large, open it to be utilized for family gatherings. An administrative planned building group plan was 1998 -allow—i-n-g the two %dmge structures pursuant to Case No. PBG- 98-02. In 2000, the lower level was converted to an additional living unit. 111. PLAT REVIEW This plat would subdivide the property into two lots. The "L-shaped" lot, Lot 1, would be approximately 36,207 square feet and would contain the existing single-family residence. Lot 2 would be approximately 18,652 square feet in size and would contain the duplex "barn" structure. (Exhibit 2, Plat) Both lots are oversized according to the R-3 zone district development standards. Lot I will contain the existing single family residence but has a lot area exceeding 36,000 square feet. A summary • the meeting and sign-in sheet have been included as Exhibits At the neighborhood meeting, the design document shown to the neighbors contained three lots — one lot for each structure and a vacant lot to be developed in the future. Prior to application submittal, the plat was redesigned reducing the number of lots from three to two. All outside service agencies that currently serve the property will continue to serve the property. The City Surveyor has reviewed the document and requested changes have been incorporated.
