Melody Homes, Inc. for approval of a 38-lot subdivision plat for property located at
10285 Ridge Road.
The cases were presented by Alan White, He entered all pertinent documents into the record
and advised the Commission there wasjurisdiction to hear the case, He reviewed the staff
report and digital presentation. Staff recommended approval of the applications for reasons
outlined in the staff report.
In reply to a question from Commissioner McMILLIN, Mr. White explained that the light
industrial portion of the development does not constitute spot zoning. Further, the area wi e
used more for commercial uses than light industrial.
Commissioner McMILLIN expressed concern about the lack of nearby parks for residents of
this development and suggested that one of the retention ponds be used for a playground.
Commissioner McMILLIN referred to the Comprehensive Plan which had designated the
sul�lect areas as large lot residential and asked what changes have occurred to change this
situation. Mr. White explained that all of the adjacent Arvada development has ta en p ace
since the Comprehensive Plan was adopted. Further, the proposed development will contain
27% open space and will utilize enhanced design standards.

Mr. Pennington was sworn in by Vice Chair WEISZ. He presented an overview of the
proposed development.
In response to a question from Commissioner WITT, Mr. Pennington stated that the proposed
light industrial site is not owned by Melody Homes.

In response to a question from Commissioner STITES, Mr. Pennington stated that Melody
Homes had no ob ection to installing sidewalk along Ridge Road. Commissioner STITES
complimented the developer and staff for working together to create a fine residential area.
Commissioner PLUMMER commented that this single-home development with yards and 2,5
acres of open space does not compare with the Garrison Street project which was comprised of
multi-family dwellings.

Case No. WZ-02-13, a request for approval of a Final Development Plan for the
residential area of the property located at 10285 Ridge Road, he approved for the
following reasons.-

With the following conditions:
1. Since the Final Development Plan pertains to the residential portion only, the
Industrial Standards section on sheet I should be eliminated.
2. The typical front landscape detail needs to address any irrigation provided by the
developer.
The amendments were accepted by Commissioners PLUMMER and STITES. The
motion passed 6-0 with Commissioners BERRY and McNAMEE absent.
With the following condition:
1. The 37 residential lots shall be subject to the City's park land fee in lieu of land
dedicatiM n and will be collected upon issuance of individual building permits.
The motion passed 6-0 with Commissioners BERRY and McNAMEE absent.

• Alan White reported that City Council approved the Melody Homes rezone with changes
recommended by Planning Commission.
It was moved by Commissioner PLUMMER and seconded by Commissioner DAVIS to
adjourn the meeting at 8:30 p.m. The motion passed unanimously.

1. REQUEST
The applicants are requesting approval of a six-lot consolidation plat with an alley vacation. This
plat would allow the construction of a Walgreen's drug store.
11, CASE ANALYSIS
The properties in question are located at 5208 W 38 Avenue, 5250 W. 3 W" Avenue, 5280 W.
38` Avenue, 3749 Sheridan Boulevard, 3718 Ames Street and APN 39-251-01-038, and
collectively are approximately 1.49 acres in area. The properties are zoned Commercial One
(Exhibit 1, Vicinity Map).
111. PLAT REVIEW
This consolidation plat would combine the subject properties into one large property (Exhibit 2,
Plat). The alley that currently runs east to west halfway through the property will be vacated.
Typical utility easements will be located on the east, west and south property lines. Existing
easements that were granted as part of the streetscape project will remain on the north property
line, and may be used as utility easements.
The consolidation plat meets all requirements as specified in Article IV of the Code of Laws.
IV. NEIGHBORHOOD MEETING
A neighborhood meeting was held on September 11, 2003. About 25 attendees voiced their
opinion regarding the proposed use, most notably in regard to increase in traffic and
neighborhood safety.
V. AGENCY REFERRALS
All outside service agencies that currently serve the property will continue to serve the property,
and have indicated that the property owner will incur any associated costs of improvement. An
existing sanitary sewer easement is being vacated as a part of this request. The existing easement
contains ,a sanitary sewer line and is located on the western half of the alley. The applicants are
aware that the sanitary sewer line must be relocated. There has been no response to date from the
Sanitation District.
The Water and Fire Districts have indicated that one existing fire hydrant will need to be
relocated, and an additional fire hydrant will be required at the time of site development,
The Public Works Department has reviewed and approved the consolidation plat.
Vt. STAFF CONCLUSIONS AND RECOMMENDATIONS
Staff concludes that this consolidation plat meets the requirements as described in Article IV,
Chapter 26 of the Code of Laws. Therefore, staff recommends APPROVAL of Case No. WS-O' )-
01.

Corridor Redevelopment Plan
DATE.- September 25, 2003
A proposed modification to the 38 Avenue Corridor Redevelopment Plan is attached along with a
L-# - iroposed resolution finding conformance with the Comprehensive Plan.
State Urban Renewal Law provides that the Planning Commission review the Redevelopment Plan
modification for compliance with the Wheat Ridge Comprehensive Plan. The First Modification to
the Plan proposes to initiate tax increment financing for a proposed retail redevelopment at the
southwest comer of 38 Avenue and Sheridan. Both property and sales tax increments are propose4
for only the redevelopment project area.
Because this review is limited to the tax increment financing question, the future land use
designation is not relevant.
- I move to adopt Planning Commission Resolution 01, series of 2003, finding the First Modification
to the 38 Avenue Corridor Redevelopment is in compliance with the City of Wheat Ridge
Comprehensive

The 38' Avenue Corridor Redevelopment Plan ("Plan") is amended
by adding Sections 5.1 c., d. and e.

redevelopment plan for the 38 Avenue Corridor redevelopment area is in

Development Task Force will hold a breakfast for the business community at the Wheat
Ridge Recreation Center on November 15 at 7:30 a.m. Planning Commissioners are
invited to attend. She also reported that an educational seminar for small business
owners, or prospective owners, will be conducted some time in January.
