A request filed by William Lyons, Jr. for approval of a 14-lot major subdivision with right-of-way dedication for property zoned Residential-One (R-1) located at 3301 Quail Street and 3345 Quail Street. Ms. Reeked presented the case. She entered into the record the contents of the case file and packet materials, the zoning ordinance, the comprehensive plan and the digital presentation. She stated the public noticing and posting requirements have been met. Planning Commission will make a recommendation to City Council which is the final authority. She reviewed the staff report and digital presentation. Ms Reckert added a condition to the recommended motion regarding ifications and review by the Army Corps of Engineers. Commissioner OHM asked for confirmation of , the 2014 tloodplain map and if any lots exist in it. Ms. Reckert stated none of the lots are in the 166#yer floodplain. Commissioner TIMMS had questions about proposed Lot 12 in rod rds to flag lots. Ms. Reckert stated that the subdivision regulations were modified to exclude the flag pole portion of the Lot in the area calculation but has not done the calculati r remaining lot size for Lot 12 Commissioner TIMMS wonders, if any other design options were discussed because it looks like a leftover and is not part ' of the nest of the subdivision, Ms. Reckert stated different plat design options were considered and left this was the best option. Chair BRINKMAN asked if street parking would be available since the roads will be considered fire lanes per Wheat Ridge Fire Department. Ms. Reckert stated Wheat Ridge Fire Department did approve on-street parking. The cul-de-sac bulb will be most affected. Chair BRINKMAN stated it will not actually be a fire lane as read into record. Ms. Reckert stated that will function as a fire lane but will be allowed to have parking. Chair BRINKMAN asked if any future plat reviews would be administrative. Planning Commission Minutes - 2 — June 1 9, 2014 Ms. Reckert replied any major changes would be reviewed by Planning Commission. Chair BRINKMAN inquired about the tributary to Lena Gulch that dissects the property. Ms. Reckett deferred to the developer. Chair BRINKMAN inquired about the drainage for the Applewood Baptist Church (ABC) parking lot to the south of the project. Ms. Reckert stated when the ABC property was originally subdivided, a drainage pond was built to the north with a conveyance pipe running along the west side to Lean Gulch. Chair BRINKMAN inquired if the property to the yc eveloped can they use 33" Avenue to connect to Routt Street? Mr. Bishop stated he was hoping for approval of the plat in concept and will continue working with the Army Corps. They hope to get City Council approval but cannot be recorded until the Anny pennit is received. Planning Commission Minutes -3— June 19, 2014 Commissioner BUCKNAM asked if the case should be continued. Ms. Reckert answered that if Planning Commission feels comfortable with moving forward with the plat in concept, then the plat can be forwarded to City Council. Commissioner DORSEY asked now that wetlands are being created within the development will it be open area or will it connect to walking trails along Lena Gulch. Mr. Reckert stated Lena Gulch currently is just a wildlife corridor and not designated as a walking trail. Commissioner DORSEY asked if a Homeowners Association will maintain this new area, Mr. Bishop replied yes. Chair BRINKMAN asked if fill will be added for the lots. Discussion continued regarding past storm events and impact on the property and the neighborhood. Commissioner BUCKNAM stated he was at Prospect Valley Elementary last fall just previous to the September floods and saw how heavy the water can get on Quail Street. He wonders do we need to take into consideration the amount of drainage down Quail along with the proposed wetland mitigation to help this. Planning Commission Minutes - 4 — June 19, 2014 Mr. Brink stated the proposed drainage pipes are very large and will provide relief to the area that they previously have not had in the past. Mr. Bishop readdressed the Commission and citizens stating that in this project they have designed it to also improve the Quail Street drainage issues to get the water to Lena Gulch. Also with the added curb, gutter and sidewalks in this subdivision, water that has been flowing down Quail Street should now be directed to 33 Avenue. Commissioner OHM asked what would have happened if we didn't know about this change from the Army and approved the plan as is, would it come back to Planning Commission and City Council. Ms. Reckert stated it depends if it needs to have a new plat or not. When it becomes more of an impact to the overall area, then they would be reviewed by Planning Commission and City ,,, Mr. Brink also stated that the new pro consistent with the past plan and is really not a large change as far as Public Worm - ncei tied. The motion was seconded by Commissioner OHM. A. Commissioner TIMMS asked whether Sally Payne is still employed with the City. Ms. Reckert answered the she accepted a job in Washington state and that Lauren Mikulak has been promoted to Senior Planner and will pick up several of Ms. Payne's duties. B. Chair BRINKMAN asked whether there would be any upcoming code revisions. Ms. Reckert replied negatively due to the heavy land use case load being experienced, Planning Commission Minutes June 19, 2014 - 5 - C. Chair BRINKMAN stated she is being contacted about the property at 38"' and Wadsworth. Ms. Reckert stated that there is a developer looking at the entire property from 35 to 38 Avenue which is all zoned MU-C. A neighborhood meeting was held for concept plan a month ago which was attended by approximately 50 people. D. It was noted that there is still an opening on Planning Commission in District IV. 9. I. REQUEST The applicant is requesting approval of a 4 -lot subdivision on property zoned Industrial - Employment (I -E) to accommodate the Wheat Ridge Ward. Road commuter line rail station at 12000 Ridge Road. Because there are right -of -way dedications involved, Planning Commission will be providing a recommendation to City Council who will be the final authority for approval. A Special Use Permit (SUP) application is being reviewed by staff as public transit stations are a special use in the Industrial - Employment (I -E) zone district. SUP's are reviewed administratively but may require a public hearing in front of City Council based on response to a 10 -day noticing period. II. EXISTING CONDITIONS /PROPERTY HISTORY Subject Property The subject property is located in the northwest quadrant of the City of Wheat Ridge, east of Ward Road and north of the BNSF railroad tracks. The site will be developed into the end -of- line station for the Regional Transit District (RTD) Gold Line. (Exhibit 1, Aerial photo) In 2004, Colorado voters approved the expansion of mass transit across the Denver metropolitan region. The $2.2 billion project known as Eagle P3 is comprised of the East and Gold rail lines, a commuter rail maintenance facility and the Westminster segment of the Northwest Rail Line. The Gold Line is an 11.2 -mile electric commuter rail transit line that will connect Union Station to Wheat Ridge, passing through northwest Denver, Adams County and Arvada. The Gold Line has eight stations: Union Station, 41" and Fox, Pecos Junction, Clear Creek/Federal, 60th & Sheridan, Arvada Gold Strike, Olde Town Arvada, Arvada Ridge and Wheat Ridge/Ward. The entire line is scheduled to be in operation in 2016. (Exhibit 2, FasTracks map) Surrounding zoning and land use Surrounding the subject property are a variety of land uses. Immediately to the east is a residentially zoned Alpaca ranch and a residential neighborhood zoned R -2. To the southwest are parcels zoned I -E. Directly west of the site are parcels zoned I -E and used for general industrial use. Land to the northwest was rezoned to Mixed -Use Commercial Transit- Oriented Development (MU -C TOD) several years ago and is currently vacant. The subject property is adjacent to the City boundary; north of W. 52nd Avenue is the City of Arvada, and across Ward Road to the west and northwest is unincorporated Jefferson County. (Exhibit 3, Zoning map) III. STATION DESIGN RTD is proposing a new commuter railway station at the end of the RTD Gold Line. The station will include a commuter train platform, plaza area, parking lot, bicycle parking, and two bus loops. The platform and plaza areas will include ticket kiosks, benches, trash receptacles, a driver relief station, and equipment enclosure. (Exhibit 4, Station rendering) Planning Commission 2 MS- 14- 02/Wheat Ridge Ward Road Station Roadway improvements will include the extension of several streets, including construction of Ridge Road (formerly named W. 50 Place) east to Tabor Street and the construction of Taft Court south from W. 52 " Avenue. The proposal includes construction of curb, gutter and sidewalk on Ridge Road and Taft Court, and restriping Ridge Road to include a bike lane. The only proposed structures are accessory to the rail line. The structures include a driver relief station, electrical and mechanical rooms, and storage space. Two kiosks and two platform canopies will be located in the plaza and platform areas. A screened equipment enclosure is proposed adjacent to the relief station. The proposal also includes irrigated landscaping throughout the site. Lighting will include pedestrian and parking lighting. Signage will include two monument signs as well as informational /way finding signs. Staff is in the process of reviewing a site plan as it relates to the Special Use Permit application. If not approved administratively, a public hearing will be held in front of City Council. IV. SUBDIVISION PLAT RTD has been working with the property owners in the area to purchase parcels that will comprise the development site. Several parcels have been acquired through purchases and other court proceedings. The platting area, including right -of -way, encompasses 8.95 acres. Ultimately, the site, including the station and the associated parking lot, will include about 5.9 net acres. Since the development is comprised of numerous parcels, a plat is required to subdivide and consolidate the ultimate development site. Some of the right -of -way is being dedicated by the plat and other portions will be dedicated by separate instrument. The proposed plat document is comprised of two sheets. (Exhibit 5, Subdivision Plat) Sheet 1 is the declaration page and contains the legal description, required signature blocks for property owners, recording and notes. The notes, among other things, contain information regarding Tracts A and B. The design of the plat shows four lots; one lot to the north of Ridge Road (formerly W. 50" Place) and three on the south side of Ridge Road. The northern lot corresponds with the parking lot improvements on the north side of Ridge. Two of the lots on the south side of Ridge encompass a vacant landscaped area directly adjacent to the street. The other lot contains a plaza area, the ticket kiosk, bus pull - through lanes and the drivers' relief station. Right -of -way for Taft Court and Ridge Road running east to Taft Street will be dedicated by this document. Right -of -way for Ridge extending east from Taft Street to align with and transition to Tabor Street was purchased by separate instrument from the owners of 11818 W. 52 Avenue. This property was previously platted as the Hance's Subdivision. The RTD purchase includes portions of Lots 5, 6, 7, 8 and 9 of the Hance's Subdivision. The applicant will dedicate this portion of the right -of -way separately to the City so that the owners of this property do not need to be a party to the plat document application. Tracts A and B are unbuildable tracts that will eventually be owned by the City of Wheat Ridge and will be used for grading and drainage. These tracts will also be conveyed separately. Planning Commission 3 MS- 14- 02/Wheat Ridge Ward Road Station An existing easement (17' in width) for the old Jolly Rancher railroad spur runs diagonally across Lot 1. A 20' wide sanitary sewer easement benefitting Fruitdale Sanitation District also follows this diagonal alignment. Both of these easements will be vacated separately so the easement beneficiaries do not have to be party to the plat application. V. AGENCY REFERRALS All affected service agencies were contacted regarding their ability to serve the property. The developer will be responsible for any needed upgrades to accommodate the proposed development. Specific referral responses follow. Valley Water District: Can serve the property with improvements installed at the developer's expense. Fruitdale Sanitation District: The district has already extended a sanitary sewer mainline in Ridge Road (formerly W. 50`" Place). An additional main will be installed when Taft is built. Arvada Fire Protection District: Can serve the property. The district has commented that where parking isn't allowed on Taft Court, it must be posted as a fire lane. Wheat Ridge Police: No concerns. Wheat Ridge Public Works: Has reviewed the plat and a drainage plan and report. All of these documents have been approved. Xcel Energy: Can serve. VI. STAFF CONCLUSION Staff concludes that all requirements of the subdivision regulations have been met and that approval of the subdivision will facilitate construction of the end of line station for the Gold Line. Because all internal and external agencies can provide service to the property with improvements installed at the developer's expense, a recommendation of Approval is given for Case No. MS -14 -02 with one condition listed in the recommended motion. VII. RECOMMENDED MOTIONS OPTION A: "I move to recommend APPROVAL of Case No. MS- 14 -02, a request for approval of a four -lot subdivision plat for property located at 12000 Ridge Road, for the following reasons: 1. All requirements of the subdivision regulations have been met. 2. The proposed plat will facilitate construction of the end of line Gold Line commuter rail station. 3. Utility districts can serve the property with improvements installed at the developer's expense. With the following conditions: 1. A Subdivision Improvement Agreement be executed with a cost breakdown for public improvements installation and surety at the time of recording."
