I. This permit was issued based on the information provided in the permit application and accompanying plans and specifications and is
subject to the compliance with those documents, and all applicable statutes, ordinances, regulations, policies and procedures.
2. This. permit shall expire 365 days after the date of issuance regardless of activity. Requests for extension must be made in writing and
received prior to the date of expiration. An extension of no more than 180 days made be granted at the discretion of the Chief Budding
Official and may be subject to a fee equal to one-half of the original permit fee.
3. If this permit expires, a new permit may be required to be obtained. Issuance of a new permit shall be subject to the standard
requirements, fees androcedures for approval of any new permit. Re -issuance or extension of expired permits is at the sole discretion of
the Chief Building Official and is not guaranteed.

This agreement made this 3 day of 44= 2812, by and between the
City of Wheat Ridge and Dave Hoss (property owner) to provide a letter of
credit in the amount of Four Hundred and fifty dollars ($450.00) for the design
and installation of permanent soil stabilization being held by the City of
Wheat Ridge until all improvements relating to the installation of the
permanent soil stabilization are fully implemented at:

In the event that the design and installation of the proposed soil stabilization
required by Colorado Department of Health and Environment (CDPHE) and the
Wheat Ridge Public Works Department and /or as agreed to by the property
owner is not installed to stabilize the soil (seeding) by April 30 2012, and if the
stabilization of the soil is not successful to meet CDPHE stabilization criteria the
City of Wheat Ridge or its designee shall have the right to enter upon said
property to construct and /or install such improvements or do other such work to
accomplish that purpose as may be necessary, provided that the City of Wheat
Ridge shall first give notice in writing to the property owner of its intent to do so.
If the City of Wheat Ridge exercises its right to perform work of any nature,
including labor, materials and use of equipment either by force account or
contract, the City shall have the absolute right to withdraw the escrow funds to
complete said improvements. The only precondition to the City's right to
withdraw the letter of credit funds for this purpose shall be a letter from the Public
Works Director, stating that the improvements have not been completed or
provided and that the compliance date of April 30 2012 has expired.

Fencing Improvement Escrow Agreement

All permits shall be applied for through the Public Works Department. An approved permit is effective for a
period of one (1) year from date of issue and may be renewed. All fees shall be in accordance with those fees
established by the Uniform Building Code or other applicable City adopted Resolutions or Ordinances.
Note: AM public improvements, when constructed, shall be maintained (by the respective individual(s) and/or
company responsible for the construction of that public and/or private improvement in the respective
development) on a daily basis, or as needed, such that they are free of mud and other construction debris
tracking from the site. Failure to comply with this requirement will result in the enforcement of Article III,
Specified Nuisances, Section I5 -16 (4) of the City of Wheat Ridge Code of Laws.
MINOR GRADING EXCAVATION, AND FILL PERMITS
1. 1 -50 Cubic Yards: No permit is required for dumping or excavation of earth materials, which do not exceed
50 cubic yards, provided, however, that any fill deposited is on natural terrain of less than three (3) horizontal
to one (I) vertical slope, or such fill is less than three (3) feet in depth and is not intended to support
permanent structures, and in addition, such fill or excavation does not obstruct or otherwise adversely affect
any drainageway. Should any of the above standards be exceeded, or a drainage way be affected, a permit
shall be required under the guidelines for No. 2.
2. 51 -500 Cubic Yards: Dumping or excavation of earth materials not exceeding 500 cubic yards may be
allowed with a permit approved by the City Engineer. All applications are to be submitted on the appropriate
completed application form and shall be accompanied by the appropriate fee and sketch plan indicating the
following information before the permit will be issued.
A. Location and dimensions of all property boundaries and structures on the site.
B. Location and extent of areas to be filled and/or excavated.
C. Location of existing and proposed drainageways, irrigation ditches, etc., and indication of how and where
historic run -off will be maintained on and through the site.
D. Cross - section area to be filled and/or excavated indicating original slope, new slope and depth of fill.
E. Statement that indicates the proposed use or purpose for said fill or excavation.
F. Relative elevation of adjacent properties.
G. Erosion control plan showing placement of control devices such as hay bales, etc.
3. 501 - 10,000 Cubic Yards: Operations in which earth material fill or excavation exceeds 500 cubic yards, but
does not exceed 10,000 cubic yards, may be allowed by a permit issued by the City Engineer after review of
an application and supporting information. The following information shall be submitted with the required
application form:
A. A site plan, prepared and signed by a Colorado registered professional engineer, at a scale of no less than
1 inch to twenty feet (1:20) which illustrates the following:
B. Location and dimensions of all property boundaries and structures on the site.
C. Location and extent of areas to be filled and/or excavated.
D. Location of existing waterways and drainage courses indicating any changes. (for a site containing an
established irrigation ditch, a letter of approval from the appropriate ditch company shall be required).
E. Location of existing and proposed points of ingress.
F. Location and extent of existing vegetation, proposed changes in such vegetation and methods of
rehabilitation on site vegetation after earthwork operations are complete.
G. Erosion control plan.
H. Grading plan with existing (dashed lines) and proposed (solid Iines) ground contours with contour
intervals of 2 feet and spot elevations.
At least two cross sections (east to west and north to south) through the site showing depth of fill and/or
excavation.
J. A drainage report may be required if site runoff characteristics are changed.
K. Relative elevations of adjacent properties and structures.
L. Statement of purpose of intended fill and/or excavation.
4. Performance Standards: The following provisions shall apply to all Minor Grading, Excavation and Fill
Permits:
A. Rehabilitation: Within thirty (30) days after cessation of filling and/or excavation, rehabilitation for the
site shall have been completed in accordance with the approved plans. Rehabilitation shall consist of
Ieveling, grading, landscaping or any combination thereof to minimize potential erosion and be acceptable
to the City Engineer.
B. Debris: Debris and/or contaminants shall not be used except with the approval of the City Engineer.
"For the purpose of this Section, the term debris shall have the same meaning as the terms "garbage, trash
or junk" as defined in the Wheat Ridge Code of Laws, Section 15-4."
In no case shall debris or contaminates identified or classified as hazardous waste by local, state or federal
agencies be used as fill in any fill areas within the City of Wheat Ridge.
C. Excavation and/or fill areas shall be graded to facilitate weed control until final grades are set and site
rehabilitation and use occur (must be leveled with side slopes not to exceed 3 to 1).

after cutting or filling operations on site are in progress shall be subject to a double fee and other penalties as
prescribed by Wheat Ridge Code of Laws, Section 26 -1004. Any fill requested under this permit within the 100
year flood zone MUST COMPLY WITH WHEAT RIDGE CODE OF LAWS, SECTION 26 -801, FLOOD
PLAIN ZONING ORDINANCE.

Please let this letter serve as a response regarding property owned by David floss at 51,30 Parfet Street.
'rhe property in question was rezone(] from Agriculture -One to Planned Industrial Development in
2002 upon application by your client. A final development plan was approved which showed an
existing 3200 s.f, structure with screened outside storage on the western portion and a future
office/warehouse structure with 7300 s.f, on tire eastern portion, Property zoned planned
development must be used in accordance with the approved, recorded final development plan,
A site inspection performed on January 24, 2008 revealed numerous code violations on the
property. A warning notice was sent to Mr. Floss dated.lanuary 28 which identified the following
violations: violation of the approved Planned Industrial Development final development plan, the
keeping ofriurnerous storage containers, the keeping of four modular buildings on the property,
storage of as semi trailer, violation of'required surfacing of drives and parking areas and fire
access code violations.
At a meeting held on February 6, 2008, with John Schumacher and Kristy Shutto, Mr. Floss indicated that
lie would like to be able to keep several of the pre -fabricated structures on the property as they are
actively being used for business operation. "rhese types of ternporary structures are not permitted on a
permanent basis. A, week or so later, a packet of information was sent to Mr. Floss describing the
terriporary building approval process.. temporary penrut can be approved for up to as year by the Board
of Adjustment at a public hearing. No renewals of the teniporary permits are allowed. A deadline of
March 15 was given for the rest of the violations to be ceased.
On March 13, 2008, Ms. Shutto and myself met with Mr. I -loss again where he indicated that he could not
comply and wanted to amend the existing Final Development Plan on the property to allow additional
outside storage. In order to proceed with a land use application, a mandatory pre -application meeting is
required with the developirient review team. I gave Mr. Floss the informational sheet about pre-

application meetings and schedule(i him for as meeting on April 10, 2008.
Once a pre -application meeting is held, the applicant can submit an application for amendment to the
existing Final Development Plan. Professional assistance by a land planner or landscape architect will be
required to prepare the required documents.

Upon submittal ofthe application, the assigned staff iriernber will send the submitted docurnents out on
referral to other departments and outside utility companies f6r their comments. The project ject will
simultaneously be reviewed by the staff planner who will also iriake comments on the proi eCt.
When the review is complete the staff planner will send back all comments and redlines frorn planning,
other departments and outside agencies to the applicant. It is the responsibility of the applicant or their
representative to correct all mistakes and respond to the conurients made before resubmitting the required
documents. This stage of the review can continue a number of times and will do so until all comments
have been addresses.
When all requirements are to the satisfaction of Community Development Staff the amended FDP can be
approved, approved with conditions, or denied administratively. It may be possible that public hearings
will be required in front of Planning Commission and City Council
Application for anictidnient of the FDP document will not solve all of Mr. Hoss' existing code violations.
We will not allow the temporary buildings to remain unless Mr. I -loss applies for and is granted temporary
permits from the Board of Adjustment discussed above,
We do not allow any commercial properties to use storage containers for warehousing supplies. If Mr.
floss amends the FDP to allow more outside storage, we may allow hitri to keep some containers on the
property within the designated screened outside storage area to be transferred to active construction sites.
They are not to be used for warehousing materials. There are other fire code violations relative to paving
and surfacing which will not be ignored, nor can other building code violations.
On occasion, we will back off on future enibreernent when we see a property owner is willing to work
with the City to mutual benefit. I am unsure where we discussed deadlines of March 24 and April 7. Prior
to scheduling a Planning Cornmission public hearing, a complete land use application with all required
supporting materials must be Submitted to our office.

2. Immediately submit all applications, tees, and required documentation to obtain
the required permits for the illegally erected additions and structures.
3. Make immediate contact with the Building Division of the City of Wheat Ridge
to express your intent to comply with this notice and order.
You are hereby ordered to initiate the above actions and repairs unmediately.
You are further notified that if the required permits are not obtained within ten (10)
days of the date of this notice, the Building Official may proceed with legal action to
remove the structures and charge the property owner with violations of the 2003
International Building Code and City of Wheat Ridge Municipal Code.
Any person having any record title or legal interest in the building may appeal from
the notice and order or any action of the Building Official to the Board of Appeals,
provided the appeal is made in writing as provided in the 1997 Uniform Code for the
Abatement of Dangerous Buildings and filed with the Building Official within 30

Please take notice that the Department of Community Development has determined that the property
described below is in violation of the Wheat Ridge Code of Laws:
Specifically, violations existing on such property because of the following conditions and use:
Sec. 26-614, (D) Temporary construction durTipsters and temporary storage containers may be allowed in all zone
districts at active construction projects only, and must be located on private property. If impractical to locate on
private property, a right-of-way permit may be obtained from the public works department pursuant to Article III of
Chapter 21 of the Wheat Ridge Code of Laws, Temporary construction dumpsters and temporary storage
containers shall not be located so as to create sight, traffic, or safety obstructions. Temporary construction
dumpsters and temporary storage containers must be removed within fourteen (14) days of construction
completion.
Sec. 26 — Article IL Metal accessory structures are not permitted in any zone district,
Planned Industrial Development (PID): In current condition there are violation(s) to the recorded PID plan.
Sec. 26-618. Parking of truck -tractors and semi -trailers.
A. It shall be unlawful for any person to park or store, or allow the parking or storing of, truck -tractors or semi-
trailers upon any property located and situated within the City of Wheat Ridge, or upon any dedicated public street
or road, or private street or road, or public right-of-way or easement or park within the City of Wheat Ridge except
as permitted by subsection B of this section.
Sec. 5-33. Required.
(a) No person nor the federal, state, county or city government or any agency, subdivision or department thereof
shall erect, construct, enlarge, remodel, alter, repair, move, improve, remove, convert, demolish or change type of
occupancy of any building, structure or utility or perform any other work regulated by this chapter or cause the same
to be performed, without first having obtained a permit for the specific work to be erforined from ,the building
ins ection division. Permits shall not be transferable.
Sec. 5-86. Fire code.
503.2.1 Dimensions. Fire apparatus access roadways in other than residential streets shall have an
unobstructed width of not less than twenty-four (24) feet (7315mm) and an unobstructed vertical clearance
of not less than thirteen (13) feet six (6) inches (4115mm). Private streets shall not be less than twenty-six
(26) feet (7935mm) wide and shall have an unobstructed vertical clearance of not less than thirteen (1 3)
feet six (6) inches (4115mm).

Questions/Comments I have: (also to help me understand the process more)
• You mention that the application will address "the keeping of four modular structures only." Did you speak to Sparky
about the lower two structures for the TUP? We (the Board) can't issue a Temporary Use Permit on something that
the F.D, wouldn't approve at all. I believe they'd have to pave the drive down to the lower lot for the F.D., make sure
there is water availability (hydrant), as well as making sure the width is there for the turn radius, etc...
• After the one-year TUP, can Hess Electric get rid of everything, or is it a requirement of the TUP that they have to
begin their improvements per their PID?
Outstanding violations compliance date:
• I've been giving people 14 days to get rid of metal storage containers and giving them a 1-2 week extension if
requested, depending on circumstances. (I'm not sure what to set for a date with all of his containers, He was told in
the meeting that metal storage containers are not allowed, period. In other words, he has been aware of this violation
since the Warning Notice was posted & mailed on Jan. 28th, and it was reiterated in our meeting with him, I think he
has had ample time — a month - to figure out what he can do with them already,)

This letter is in regard to your property at 5130 Parfet Street in the City of Wheat Ridge. The
property in question was rezoned to Planned Industrial Development ill 2001 A final development
plan was approved which showed all existing 3200 s.f structure with screened outside storage on
the western portion and a future office/warehouse structure with 7300 s.f oil the eastern portion.
Property zoned planned development must be used in accordance with the approved, recorded
final developirient plan.
A site inspection perft)nried on January 24, 2008 revealed numerous code violations oil the
property. A warning notice was sent to you dated January 28 which identified the following
violations: violation of the approved Planned Industrial Development final development plan, the
keeping of 12 storage containers, the keeping of four nodular buildings oil the property, storage
of a semi trailer, violation of required surfacing of drives and parking areas and fire access code
violations.
At our February 6, 2008, meeting with John Schumacher andristy Shutto, you indicated that you
would like to be able to keep several of the pre -fabricated structures oil the property as they are
actively being used to operate your business. A week or so later, as packet of information was sent
to you describing the temporary building approval process. A temporary permit call be approved
for up to a year by the Board of Adjustment at a public hearing, No renewals of the temporary
permits are allowed,
With the submittal of an application for a temporary permit for your property, the following will
be required:
I. Completed land use application.
1 Fee in the amount of $480.
3. A "to scale" site plan showing existing site conditions including building locations,
parking and drives and landscaping and location of the proposed temporary structures.
4. A narrative addressing your interim need for the temporary buildings and plan for
resolution for the need for temporary buildings including a construction schedule.
Keep in mind that if the request for temporary buildings is approved, the following must occur for
the approved structures: building permits for all structures meeting all electrical, building and fire

The application for temporary buildings will address the keeping ofthe f1DUr modular structures
only. It does not address the storage containers or any other existing violations on the property.
As such, all other outstanding violations must be ceased by March 15.1 2008 or a summons to court
will be pursued.
