There has been a history of compliance of the property with the provisions of the Zoning and Development Code. 6. The special use will not create or contribute to blight in the neighborhood and will not over burden the capacities of the existing streets, parks, schools, and other public facilities and services. 7. There were no comments or objections received during the required posting period. With the following conditions: 1. The special use will be granted solely to LightSquared LP. 2. The CMRS facility shall be screened or camouflaged as appropriate from view from adjacent property lines. 3. The antennas shall extend no more than seven (7) feet above the parapet. 4. I. REQUEST Case No. SUP -11 -01 is an application by LightSquared LP requesting the approval of an administrative Special Use Permit to allow rooftop commercial mobile radio service (CMRS) facilities on property zoned Commercial -One at 2890 Ames Street. Based on Section 26 -615.B of the zoning code, construction of roof - mounted CMRS facilities in the C -1 zone district must receive a special use permit. Pursuant to Ordinance No. 1291, the Community Development Director has the ability to decide upon applications for administrative special use approval, without a public hearing, provided the following conditions have been met: I. A completed application package has been submitted and fee paid. 2. The Community Development Department has notified adjacent property owners by letter and the site has been posted for at least ten (10) days. 3. No written objections have been received in such ten day period. 4. The Community Development Director concludes that the criteria for approval, as set forth below, are substantially complied with and support the request. The Community Development Director can impose conditions or stipulations upon the approval, which may include physical design, operational, and maintenance considerations to ensure compliance with the criteria for review. The Community Development Director shall also decide the following: 1. Whether the SUP runs with the land in perpetuity; 2. Whether the SUP is personal to the applicant and may or may not be inherited; and /or, 3. Whether the SUP is granted only for a defined period, after which time the special use shall expire unless renewed subject to all of the requirements of this section. H. CASE ANALYSIS The applicant, LightSquared, is requesting a Special Use Permit to allow rooftop CMRS facilities on property at 2890 Ames Street (Exhibit 1, Letter ofReduest). The property is zoned Commercial -One (C -1), a zoning district that provides for a wide range of commercial uses including office, general business, and retail sales and service establishments. The property immediately to the south is also zoned C -1, but the site is primarily surrounded by residential zone districts. Adjacent parcels are zoned R -3 to the north and east, R -1 C to the south, and R -2 to the west (Exhibit 2, Zoning Map) One block to the east is the City boundary, beyond which is the City of Denver. The property at 2890 Ames Street is a corner lot, with frontage on Ames Street and West 29 °i Avenue. The site has an area of 13,040 square feet, and includes a two -story warehouse with two apartments on the second floor. The existing building has a flat roof with an approximate 2' -4" parapet. A surface parking lot exists on the northern half of the lot, and there are currently no CMRS facilities on the site. Landscaping improvements include a tree lawn along both street frontages (Exhibit 3, Aerial, Exhibit 4 Site Photos). Reduced landscaping and parking requirements were approved for the property pursuant to SUP- 83 -09. The applicant, LightSquared, is proposing to locate two (2) rooftop CMRS facilities on the existing building at 2890 Ames Street. The two rooftop sled mounts will include a total of six (6) antennae and four (4) 26" microwave dishes. One sled mount will be on the northeast corner of the roof; the second will be on the south side of the roof. The proposed antennae and microwave dishes will provide new wireless service for LightSquared in an area in which their network lacks coverage (Exhibit 5, Coverage Map). The applicant has selected the site because of its elevation and its geographic relationship to network facilities. A rooftop mount— instead of a building mount —is being proposed to achieve extra height. The applicant is also proposing a 7' x 7' rooftop equipment cabinet and an access ladder on the east face of the building. The access ladder will provide the applicant with unrestricted access to the proposed rooftop facilities (Exhibit 6, Site Plan). The applicant is required to comply with Section 26 -615 of the City Code which requires rooftop CMRS facilities to be screened from view from adjacent property lines. Roof - mounted CMRS panel antennas and accessory structures shall extend no more than seven (7) feet above the parapet of the flat roof to which they are mounted. According to plans submitted by the applicant, the proposed facilities are in compliance with these regulations. The antennas and microwaves will be located behind architecturally - compatible screening, and all equipment will meet height regulations as prescribed by City Code (Exhibit 7, Photo Simulat ion; Exhibit 8, Building Elevations). During the public notification period, one neighbor contacted Staff for more information regarding the SUP request. No objections were filed during the posting period. III. SPECIAL USE PERMIT CRITERIA Staff uses the following criteria to evaluate special use permit requests and shall determine that the majority of the "criteria for review" listed in Section 26 -114.D of the City Code have been met. The applicant has provided their analysis of the application's compliance with the variance criteria (Exhibit 9, Applicant Response to Criteria). Staff provides the following review and analysis of the special use criteria: 1. The special use will not have a detrimental effect upon the general health, welfare, safety and convenience of persons residing or working in the neighborhood. The proposed special use will not affect the health, welfare, safety, or convenience of any person working or residing in the area. The proposed use will be located on the top of a two -story office building and will be screened from view; it will not increase the intensity of current land use. Staff finds this criterion has been met. 2. The special use will not create or contribute to blight in the neighborhood by virtue of physical or operational characteristics. The property is developed and does not currently contribute to blight in the neighborhood. The building on site is well maintained. The addition of a CMRS facility will not contribute to blight in the area. Screening will help to camouflage the proposed and antennas and minimize the visual impact of the rooftop facility. Staff finds this criterion has been met. 3. The special use will not create adverse impacts greater than allowed under existing zoning for the property. Staff has not identified any adverse impacts greater than what are allowed under the existing zoning. The applicant's proposal does not include expansion of the building footprint, and the CMRS facility will not impact the light, air, or water quality of the adjacent properties. The C -I zone district allows for a wide range of land uses, some of which are more intense than the proposed use. Staff finds this criterion has been met. 4. The special use will not result in undue traffic congestion or traffic hazards, or unsafe parking, loading, service or internal traffic conflicts to the detriment of persons whether on or off the site. The proposed use will not create undue traffic congestion or hazards. All parking and loading areas are currently provided on the property. Staff finds this criterion has been met. 5. The property is appropriately designed, including setbacks, heights, parking, bulk, buffering, screening and landscaping, so as to be in harmony and compatible with the character of the surrounding areas and neighborhood, especially with adjacent properties. The adjacent properties will be minimally impacted by the proposed special use. Architecturally compatible screening will be provided by the applicant to reduce the visual impact of the proposed antennas. The property is developed and in harmony with the surrounding area. The existing structure is considered non - conforming because it does not meet rear setback requirements for the C -I district. Reduced landscaping and parking requirements were approved for the property pursuant to SUP- 83 -09. The proposed CMRS facility will not increase the nonconformity or affect the property's landscaping and parking. Staff finds this criterion has been met. 6. The special use will not over burden the capacities of the existing streets, utilities, parks, schools, and other public facilities and services. 4 Parks, schools, streets, and other public facilities will not be negatively impacted. Utility agencies are already serving the property, and any improvements required by the utility companies will be completed during the building permit process. Xcel Energy and the Wheat Ridge Fire Protection District reviewed the SUP request and have no concerns regarding provision of service. Staff finds this criterion has been met. There is a history of compliance by the applicant and /or property owner with Code requirements and prior conditions, if any, regarding the subject property. Neither the applicant, nor the property owner has a history of code violations. Staff finds this criterion has been met. 8. The application is in substantial compliance with the applicable standards set forth in the Architectural and Site Design Manual. The Architectural and Site Design Manual (ASD11) applies to all new construction and major additions (except one- and two - family residential structures). Because there is no addition or expansion of the existing building associated with the proposal, the ASDM does not apply. Staff finds this criterion is not applicable. IV. NEIGHBORHOOD MEETING Prior to submittal of an application for a Special Use Permit, the applicant shall be required to hold a neighborhood meeting in accordance with the requirements set in City Code, Section 26 -109A. A meeting for neighborhood input was held on February 2, 2011 in accordance with Section 26 -109A. In addition to the applicant and staff, the property owner and a Lightsquared RF Engineer were in attendance. Two members of the public also attended the neighborhood meeting and had concerns related to the possibility of additional CMRS facilities in the future. Their concerns were addressed during the meeting and are documented in the neighborhood meeting minutes (Exhibit 10, Neighborhood Meeting Minutes). No objections were filed during the 10 -day noticing period. V. AGENCY REFERRAL All affected service agencies were contacted regarding the ability to serve the property. Their specific referral responses follow. City of Wheat Ridge Building Division: No comments or objections. City of Wheat Ridge Public Works Department: No comments or objections. Xcel Energy: • Applicant must contact the Builder's Call Line and complete the application process for any new gas or electric service, or modification to existing facilities. Wheat Ridge Fire Protection: • Applicant to verify that the proposed LightSquared disconnect on the east wall will de- energize all proposed rooftop equipment to be installed. • Provided the proposed access ladder is secured with a lock or locking mechanism, and provided the facility has an existing installed Knox Box, the Applicant shall provide the Fire District with a key or code necessary to unlock the roof access ladder. VI. STAFF RECOMMENDATIONS /FINDINGS OF FACT Having found the application for Case No. SUP -11 -01 /LightSquared —a Special Use Permit to allow a rooftop commercial mobile radio service (CMRS) facility in a C -I zone district —to be complete and in compliance with the majority of the applicable review criteria, staff recommends APPROVAL of the special use request. Staff recommends APPROVAL for the following findings of fact: 1. Two members of the public, Fania Gordon and Ben Powhrs, also attended the neighborhood meeting. Ms. Gordon and Mr. Powlus reside one block north of the subject property. Ms. Gordon was in attendance to express her concerns related to the precedent that might be set for additional CMRS facilities to locate on the site in the future. • Staff discussed the site, its zoning and future land use. • The applicant and members of the public were informed of the process for the Special Use Penuit. • The members of the public were infonned of their opportunity to make comments during the process and at the public hearing, if required_ The following issues were discussed regarding the SUP request and proposed development: How was this location chosen and why isn't the CMRS facility being located at the top of the hill, further north on Sheridan'? This location was chosen based on the location o folher sectors that are olreadv part of the LiglrlSgaared nehvork. Locating at the top of the hill would be too close to other facilities and would cause interference with other LightSguared Why does the proposal include a rooftop mount instead of a building mount? Because there are so rnanv homes and trees in the neighborhood, the CMRSfaciliq- needs to be as high above the "clutter" as possible to overcome these barriers. In addition, the facility is creeds to be able to serve areas rip the hill, and a higher•facility helps to achieve this goal. For whom does Lightsquared provide service? L, ghtScpiared is a new provider that allows other carriers to use its network. For example, instead of having Veri =on, AT &T, and Sprint install their own facilities on the property, LightSguared installs a network and allows these carriers to use their network. Will approval of this SUP open the door for additional CMRS facilities on the site'? In addition, though research on the health impacts of CMRS facilities has been inconclusive, the EPA does have emission regulations that serve to limit the number of antennae on a site. Will the proposed screening adequately hide the antennae from view from the north? LightSguared can look into this, brit given the number of mature trees in the area and the height and location of the CMRS, facilities, the antenna should be adequately screened from all directions under the c711•1-ent proposal. Plan: Neighborhood Existing Site Conditions: The property is a comer lot located at 2890 Ames Street, with frontage on Ames Street and West 29 Avenue. The lot is zoned Commercial -One (C -1), but the site is primarily surrounded by residential zone districts. Adjacent parcels are zoned R -3 to the north and east, RAC to the south, and R -2 to the west. The site has an area of 13,040 square feet, and includes a two -story office /warehouse with two apartments on the second floor. A surface parking lot exists on the northern half of the lot. The existing building has a flat roof with an approximate 2'- 4" parapet. Applicant /Owner Preliminary Proposal: The applicant, LightSquared, is proposing to locate two (2) rooftop CMRS facilities on the north and south sides of the existing building at 2890 Ames Street. The two rooftop sled mounts will include a total of six (6) antennae and four (4) 26" microwave dishes. The rooftop facilities will be screened with an architecturally compatible material. The applicant is also proposing a 7' x 7' rooftop equipment cabinet and an access ladder on the east face of the building. The proposed antennae and microwaves will provide new wireless service for LightSquared. An access ladder on the east side of the building will provide the applicant with unrestricted access to the proposed rooftop facilities. The applicant's proposal requires a Special Use Permit (SUP). The following is a summary of the neighborhood meeting: • In addition to the applicant and staff, the property owner and a Lightsquared RE Engineer were in attendance. Two members of the public, Fania Gordon and Ben Powlus, also attended the neighborhood meeting. Ms. Gordon and Mr. Powlus reside one block north of the subject property. Ms. Gordon was in attendance to express her concerns related to the precedent that might be set for additional CMRS facilities to locate on the site in the future. • Staff discussed the site, its zoning and future land use. • The applicant and members of the public were informed of the process for the Special Use Permit. • The members of the public were informed of their opportunity to make comments during the process and at the public hearing, if required. The following issues were discussed regarding the SUP request and proposed development: How was this location chosen and why isn't the CMRS facility being located at the top of the hill, further north on Sheridan? This location was chosen based on the location of other sectors that are already part of the LightSquared network. Locating at the top of the hill would be too close to other facilities and would cause interference with other LightSquared facilities. Why does the proposal include a rooftop mount instead of a building mount? Because there are so many homes and trees in the neighborhood, the CMRS facility needs to be as high above the "clutter" as possible to overcome these barriers. In addition, the facility is needs to be able to serve areas up the hill, and a higher facility helps to achieve this goal. For whom does LightSquared provide service? LightSquared is a new provider that allows other carriers to use its network. For example, instead of having Verizon, AT &T, and Sprint install their own facilities on the property, LightSquared installs a network and allows these carriers to use their network. Theoretically, this would limit the number of other- CMRS facilities on a site because they can all share the LightSquared facility. Will approval of this SUP open the door for additional CMRS facilities on the site? All,future CMRS proposals would need to apply through the same SUP process and would be subject to the same notification requirements and review. Are there a maximum number of allowed CMRS facilities on a single site? The City's code does not set a number, but structural limitations can restrict the number of CMRSfacilities allowed on a site. In addition, though research on the health impacts of CMRS facilities has been inconclusive, the EPA does have emission regulations that serve to limit the number of antennae on a site. Will the proposed screening adequately hide the antennae from view from the north? LightSquared can look into this, but given the number of mature trees in the area and the height and location of the CMRS facilities, the antenna should be adequately screened from all directions under the current proposal. Aside from the two neighbors at the meeting, staff received no comment from others in the area regarding the proposal. The purpose of this meeting is to allow the applicant to present his proposal to the neighborhood and to give the neighborhood a forum to express their concerns, issues and desires. A Staff Planner will attend the meeting to discuss City policies and regulations and the process involved, however, the Planner will remain impartial regarding viability of the project. The lot is zoned Commercial -One (C -1), but the site is primarily surrounded by residential zone districts. Adjacent parcels are zoned R -3 to the north and east, R -1C to the south, and R -2 to the west. The site has an area of 13,040 square feet, and includes a two -story warehouse with two apartments on the second floor. A surface parking lot exists on the northern half of the lot. Applicant/Owner Preliminary Proposal: The applicant, LightSquared, is proposing to collocate two (2) rooftop CMRS facilities on the north and south sides of the existing building at 2890 Ames Street. The two rooftop sled mounts will include a total of six (6) antennae and four (4) 26" microwave dishes. The applicant is also proposing a 7' x 7' rooftop equipment cabinet and an access ladder on the east face of the building. The proposed antennae and microwaves will provide new wireless service for LightSquared. The applicant is proposing a rooftop mount — instead of a building mount —to achieve extra height. The access ladder will provide the applicant with unrestricted access to the proposed rooftop facilities. Will a neighborhood meeting need to be held prior to application submittal? Yes, the request for a Special Use Permit does require a neighborhood meeting. Planning comments: The site is zoned Commercial -One (C -1). Section 26 -615 of the Wheat Ridge Zoning Code states that roof - mounted CMRS facilities in the C -1 zone district are allowed only after a Special Use Permit (SUP) is obtained. The required SUP process is outlined below. The applicant will also need to meet the following requirements for roof - mounted CMRS facilities as established in Section 26 -615 of the Wheat Ridge Zoning Code: • Roof - mounted CMRS facilities shall be screened or camouflaged as appropriate from view from adjacent property lines. • Such facilities shall be architecturally compatible with and colored to match the building or structure to which they are attached. • Roof - mounted CMRS panel antennas and accessory structures shall extend no more than seven (7) feet above the parapet of the flat roof to which they are mounted. As part of the SUP application, the applicant should include a proposed site plan, elevations, and a photo - visualization of the proposed facilities and building. Please also include a service map with the application. SUP Process This request will require a Special Use Permit (SUP). The first step in the SUP process began with the pre - application meeting on December 16, 2010. The second step required by the Community Development Department will be to conduct a neighborhood meeting. For this meeting, the applicant must notify all property owners within a 600 foot radius of the property of the meeting. Notification may be via mail or hand delivery. The Community Development Department will supply the applicant with a list of all property owners within the 600 foot radius. A sample notification letter is attached and can be used as a template. Please make changes to the template to fit your specific project. The letter will need to be approved by a planner before it is mailed. It is recommended that the project's RF engineer be present at the neighborhood meeting. The meeting should be coordinated with the assigned staff member. A fee of $100 is required for staff to be present at this meeting. Meetings can be held at city hall or any location the applicant desires. All costs associated with meeting, its location, and mailings will be paid by the applicant. The meeting will be led by the applicant and should inform those who are in attendance what is being proposed. After the neighborhood meeting is held, the applicant may submit their application for the SUP. Upon the submittal of the application for the Special Use Permit, the application will be reviewed by the case manager and sent to outside agencies for review. A 15 day time period is given for the agencies to respond with and corrections or revisions to the application. Once the review of the application is complete, the property must be posted for a minimum of 10 consecutive days. If no legitimate complaints are received regarding the request within the 10 day period, the application for a Special Use Permit will be reviewed administratively. If a complaint is received by the Community Development Department, then the request for the Special Use Permit will be decided upon at a public hearing before the City Council. If the application is reviewed administratively and denied, the applicant can be appeal the decision to the City Council. If a hearing before City Council is required for any reason, staff will present evidence to recommend the approval, approval with conditions, or denial of the Special Use Permit. The public will also be allowed to present evidence or give testimony in support or in opposition of the project. The City Council will approve, approve with conditions, or deny the project based on the testimonies given by staff, applicant and the public.
