On January 25, 20111 partially approved your January 10, 2011 Flood Plain Development Permit
application, denying your request to convert an existing 16' X 12' shed to a pavilion. On or about
January 28, 2011 you delivered a revised design for the conversion of the shed. The new design
shows removal of all of the shed walls and support of the roof with treated 4X4 posts and metal
straps.
I have processed a new Flood Plain Development Permit application for your new shed
conversion design. I have waived the permit fee for this application. This application is approved
with the following conditions:
All construction materials must be resistant to water damage a minimum of four feet (4')
above the existing ground elevation.
2. Obtain a building permit for the proposed construction.

I initially reviewed your January 10, 2011 Flood Plain Development Permit application and
submittals and found the application to be lacking an acceptable site plan. I contacted Mike
McDermid, your engineer, and he provided a suitable site plan yesterday, January 24, 2011.
Your application requests permission to:
1. Elevate a 38' X 20' existing shed, such that the floor of the shed is at elevation 5360.5. Fill
would be placed under and around the elevated shed.
2. Remove three (3) outside walls of a 16' X 12' existing shed, converting the shed to a garden
pavilion. The pavilion would remain at existing grade, which is below the 100 year flood
elevation.
Your application, as requested, is denied. The request to elevate the 38' X 20' shed will be
approved, subject to the final floor elevation being at, or above, elevation 5362. This approval is
for a Flood Plain Development Permit only and you are hereby advised that a building permit is
also required for your project.
The request to modify the 16' X 12' shed and leave it at its existing elevation is denied because:
1. By definition, a pavilion is a building and a building of this size in the flood storage district
must be elevated one (1) foot above the base flood elevation.
2. All construction materials subject to possible flood damage must be resistant to flood damage.

SUBJECT: Case No. WF- 09 -11/ 4152 Kipling Street
An application for a Flood Plain Development Permit dated October 1, 2009 concerning
construction of a expansion of a residential house at 4152 Kipling Street has been recently re-
submitted showing a different design of the house expansion and includes construction of a shed
and pavilion. The building site is in the Clear Creek and Lena Gulch floodplains.
Chief Building Official, John Schumacher, has verbally indicated that the proposed addition to
the house is not considered a "substantial improvement" to the structure as defined in Section 26
of the City Code. Upon written confirmation of Mr. Schumacher's determination, the addition of
a second floor to the house, as shown on the February 1, 2010 plans, is permitted in the Clear
Creek Floodplain, subject to compliance with the development standards outlined in the flood
plain regulations. The regulations require that all electrical, heating, ventilation, plumbing and
air conditioning equipment and facilities be designed and located to one (1) foot above the base
flood elevation. That elevation is 5363 for this property.
The plans for the addition to the house include the addition of a deck accessed from the proposed
new second floor. The deck is shown to include three (3) support posts at nine foot (9') spacing.
The deck is permitted as designed.
The new submittal includes a minimal sketch for a new 20' X 14' shed with a gable roof. A
recent discussion with the applicant, Barton Buctow, indicated that he wanted to remove the
walls from an existing shed built at grade elevation, leaving a roof supported by posts. By
definition, a shed is a structure used for shelter or storage. The flood plain development
standards require that structures greater than one hundred twenty square feet (120 sf) be elevated
one (1) foot above the base flood elevation. It appears that the applicant's intent is to store
materials in the shed. The objective of the Flood Plain regulations is to minimize flood losses.
This shed, as proposed, does not meet those objectives, and, therefore, the request for its
construction in the flood plain is denied.
The new submittal also includes a minimal sketch for a new 24' X 16' pavilion. A recent
discussion with the applicant, Barton Buetow, indicated that he wanted to remove the walls from
an existing pavilion built at grade elevation, leaving a roof supported by posts. By definition, a
pavilion is a structure used for exhibition of materials. The flood plain development standards
require that structures greater than one hundred twenty square feet (120 sf) be elevated one (1)
foot above the base flood elevation. It appears that the applicant's intent is to display materials
in the pavilion. The objective of the Flood Plain regulations is to minimize flood losses. This
pavilion, as proposed, does not meet those objectives, and, therefore, the request for its
construction in the flood plain is denied.
