I contacted Mike McDermid, your engineer, and he provided a suitable site plan yesterday, January 24, 2011. Your application requests permission to: 1. Elevate a 38' X 20' existing shed, such that the floor of the shed is at elevation 5360.5. Fill would be placed under and around the elevated shed. 2. Remove three (3) outside walls of a 16' X 12' existing shed, converting the shed to a garden pavilion. The pavilion would remain at existing grade, which is below the 100 year flood elevation. Your application, as requested, is denied. The request to elevate the 38' X 20' shed will be approved, subject to the final floor elevation being at, or above, elevation 5362. This approval is for a Flood Plain Development Permit only and you are hereby advised that a building permit is also required for your project. The building site is in the Clear Creek and Lena Gulch floodplains. Chief Building Official, John Schumacher, has verbally indicated that the proposed addition to the house is not considered a "substantial improvement" to the structure as defined in Section 26 of the City Code. Upon written confirmation of Mr. Schumacher's determination, the addition of a second floor to the house, as shown on the February 1, 2010 plans, is permitted in the Clear Creek Floodplain, subject to compliance with the development standards outlined in the flood plain regulations. The regulations require that all electrical, heating, ventilation, plumbing and air conditioning equipment and facilities be designed and located to one (1) foot above the base flood elevation. That elevation is 5363 for this property. The plans for the addition to the house include the addition of a deck accessed from the proposed new second floor. The deck is shown to include three (3) support posts at nine foot (9') spacing. The deck is permitted as designed. The new submittal includes a minimal sketch for a new 20' X 14' shed with a gable roof. A recent discussion with the applicant, Barton Buctow, indicated that he wanted to remove the walls from an existing shed built at grade elevation, leaving a roof supported by posts. By definition, a shed is a structure used for shelter or storage. The flood plain development standards require that structures greater than one hundred twenty square feet (120 sf) be elevated one (1) foot above the base flood elevation. It appears that the applicant's intent is to store materials in the shed. The objective of the Flood Plain regulations is to minimize flood losses. This shed, as proposed, does not meet those objectives, and, therefore, the request for its construction in the flood plain is denied. The new submittal also includes a minimal sketch for a new 24' X 16' pavilion. A recent discussion with the applicant, Barton Buetow, indicated that he wanted to remove the walls from an existing pavilion built at grade elevation, leaving a roof supported by posts. By definition, a pavilion is a structure used for exhibition of materials.
