Adoption of the attached council bill on first reading set the public hearing to consider the annexation of property owned by Jefferson County for April 25, 2011. The property in question, currently located in unincorporated Jefferson County, was the former home to the Table Mountain Animal Center addressed as 4150 Youngfield Road. The structure on the property was recently demolished as a new facility has been built at another location. The majority of the property is under contract to be sold by Jefferson County to Cabela's and Longs Peak Metropolitan District and included in a regional commercial development. The sales contract does not include a piece of right -of -way owned by CDOT which is being annexed but not incorporated into the proposed development for the property. The total area of the annexation is 36 acres. Case No. ANX -I 1 -01 /Table Mountain Animal Center Council Action Form April 25, 2011 Page 2. Staff is recommending Planned Commercial Development zoning be placed on the development property and Agriculture -One zoning be placed on the right -of -way subsequent to the annexation action on April 25, 2011. PRIOR ACTION: An IGA obligating the City to certain actions regarding the property was approved by City Council on January 10, 2011. The IGA includes the provision that the annexation will not be finalized until a purchase agreement is approved between Jefferson County and the buyer(s), and if the property is not sold, the City agrees to disconnect the land. FINANCIAL IMPACT: No fees were collected for this process. If the property is annexed and incorporated into the adjacent development parcel it could be developed into a major commercial node which would be an advancement of the City's goals for economic development and a diverse and resilient tax base. Upon development of the annexed property, the City will be immediately responsible to provide police protection and street maintenance. BACKGROUND: The property is 36 acres in size, has frontage on Youngfield Service Road and includes the property to the north within the Clear Creek trail corridor. The northern and western portions of the property are encumbered with a 100 -year flood plain. Approximately nine acres of the site are developable. The majority of the property is currently owned by Jefferson County. The County is selling the property, as a new animal shelter was built on the Jefferson County Fairgrounds parcel. The County and the City entered into an IGA regarding the annexation and zoning. The property is currently zoned Planned Development with some small pieces of A -l. A development plan by the name of Table Mountain Gateway was approved in 2007. The property is divided into different use areas. The "buildable" portion of the lot is allowed to have general commercial and light industrial uses. The "non- buildable" portions are limited to passive recreational uses. Guiding documents The City of Wheat Ridge's Three -Mile Plan is an addendum to Envision Wheat Ridge, the City's comprehensive plan adopted in October 2009. The intent of a Three -Mile Plan is to show property outside the current City limit which may be considered for annexation or be developed, and which may impact the City. The Three -Mile Plan designates the proposed annexation area as Regional Commercial on the southern one -third and open space on the northern two - thirds. The plan speaks to these designations with the intent for the Regional Commercial to include retail, employment, restaurants and hotel uses. The designation of "open space" is a designation to indicate the land should not be developed; but may not necessarily be owned by a public entity. Council Action Form April 25, 2011 Page 3 Proposed zoning Thirty two acres of the property will be rezoned to Planned Commercial Development pursuant to Case No. WZ -11 -01 with an accompanying Concept Outline Development Plan. This case is scheduled to be heard on April 25, 2011, the same night as the annexation hearing. A Specific Outline Development Plan (Case No. WZ- 11 -02) will be heard that night as well. A small portion of CDOT right -of -way, comprising 2.7 acres, is part of the annexation parcel. Adoption of the attached council bill on first reading sets the public hearing to consider the annexation of property owned by Jefferson County on April 25, 2011. The property in question, currently located in unincorporated Jefferson County, was the former home to the Table Mountain Animal Center addressed as 4150 Youngfield Road. The structure on the property was recently demolished as a new facility has been built at another location. The property is Linder contract to be sold by Jefferson County to Cabela's and Long's Peak Metropolitan District and included in a regional commercial development. Staff is recommending Planned Commercial Development zoning be placed on the property subsequent to the annexation action on April 25. Case No.ANX -11 -01 /Table Mountain Animal Center Council Action Farm March 14, 2011 Page 2 PRIOR ACTION: An IGA obligating the City to certain actions regarding the property was approved by City Council on January 10, 2011. The IGA includes the provision that the annexation will not be finalized until a purchase agreement is approved between Jefferson County and the buyer(s), and if the property is not sold, the City agrees to disconnect the land. FINANCIAL IMPACT: No fees were collected for this process. If the property is annexed and incorporated into the adjacent development parcel it could be developed into a major commercial node which would be an advancement of the City's goals for economic development and a diverse and resilient tax base. Upon development of the annexed property, there will be an immediate responsibility of the City to provide police protection and street maintenance. BACKGROUND: The property is 36 acres in size, has frontage on Youngfield Service Road and includes the property to the north within the Clear Creek trail corridor. The northern and western portions of the property are encumbered with 100 -year flood plain. Approximately nine acres of the site are developable. The property is being disposed of by Jefferson County as a new animal shelter was built on the Jefferson County Fairgrounds parcel. The County and the City entered into an IGA regarding the annexation and zoning. The property is currently zoned Planned Development with some small pieces of A -1. A development plan by the name of Table Mountain Gateway was approved in 2007. The property is divided into different use areas. The "buildable" portion of the lot is allowed to have general commercial and light industrial uses. The "non- buildable" portions are limited to passive recreational uses. Guiding documents The City of Wheat Ridge's Three -Mile Plan is an addendum to Envision Wheat Ridge, the City's comprehensive plan adopted in October 2009. The intent of a Three -Mile Plan is to show property outside the current City limit which may be considered for annexation or be developed which may impact the City. The Three -Mile Plan designates the proposed annexation area as Regional Commercial on the southern one -third and open space on the northern two - thirds. The plan speaks to these designations with the intent for the Regional Commercial to include retail, employment, restaurants and hotel uses. The designation of "open space" is a designation to indicate the land should not be developed; but may not necessarily be owned by a public entity. Proposed zoning The property will be rezoned to Planned Commercial Development pursuant to Case No. WZ -11- 01 with an accompanying Concept Outline Development Plan. This case is scheduled to be heard Council Action Form March 14, 2011 Page 3 on April 25, 2011, the same night as the annexation hearing. A Specific Outline Development Plan (Case No. WZ- 11 -02) will be heard that night as well. EXHIBIT A Intergovernmental Agreement INTERGOVERNMENTAL AGREEMENT THIS INTERGOVERNMENTAL AGREEMENT is made and entered into by and between the CITY OF WHEAT RIDGE, COLORADO, a Colorado municipal corporation, (hereinafter referenced as "City "), and the COUNTY OF JEFFERSON, STATE OF COLORADO, a body politic and corporate (hereinafter referenced as "County "), together sometimes referred to herein as the "Parties." RECITALS A. The County acting by and through its Board of County Commissioners, is the owner of certain real property located in the unincorporated portion of Jefferson County and more particularly described on Exhibit A, attached hereto and fully incorporated herein by this reference, with an approximate area of 32 acres (the "Property "). B. The Property has been fully surrounded by the municipal boundaries of the City of Wheat Ridge for more than three years, rendering it eligible for annexation as an enclave pursuant to C.R.S. 31 -12- 106(1). C. The City wishes to annex the property pursuant to C.R.S. 31 -12- 106(1), and the County wishes to consent to such annexation, on the terms and conditions contained herein. AGREEMENT NOW THEREFORE, in consideration of the recitals, covenants, and promises herein set forth and other good and valuable consideration herein received, the Parties agree as follows: 1. City Annexation of the Property The City will initiate annexation of the Property by adoption of an ordinance pursuant to C.R.S. § 31 -12- 106(1). The City shall give notice of such annexation pursuant to C.R.S. § 31 -12- 108(2). The City agrees not to finalize annexation of the Property by final adoption of the ordinance until the Property is simultaneously rezoned substantially similar to either (a) the Table Mountain Gateway ODP recorded November 15, 2007, at Reception No. 2007127527, the zoning presently applicable to the Property, or (b) the Clear Creek Crossing Outline Development Plan with respect to Parcel 1 as submitted to the City in January 2011 by Cabela's Wholesale, Inc. or another Cabela's entity and /or Longs Peak Metropolitan District. 2. Annexation Impact Report Pursuant to C.R.S. § 31 -12- 108.5(1) an annexation impact report shall not be required for annexations when the municipality and the board of county commissioners governing the area proposed to be annexed agree that the report may be waived. Pursuant to the authority granted by C.R.S. § 31 -12- 108.5(1) the City and the County hereby waive the requirement of the preparation and delivery of an annexation impact report. 3. Waiver of Right to Challenge So long as the City shall be in compliance with its obligations pursuant to this Agreement, the County agrees that it shall not commence any action pursuant to C.R.S. § 31 -12 -116 for review of the final annexation by the City of the Property. 4. Renegotiation a. In the event that: (i) the County is unable to reach an acceptable agreement with Cabela's Wholesale, Inc., another Cabela's entity and /or Longs Peak Metropolitan District with respect to the purchase of the Property; or (ii) the purchase agreement between the County and Cabela's Wholesale, Inc., another Cabela's entity and /or Longs Peak Metropolitan District is terminated for any reason, then the City agrees to renegotiate this Agreement with the County and to continue the annexation process without final action on the annexation ordinance until permitted under the terms of such renegotiated Agreement. b. In the event that the Property has already been annexed into the City pursuant to Section 1 above, and Cabela's Wholesale, Inc., another Cabela's entity or Longs Peak Metropolitan District do not purchase the Property, then the City agrees to disconnect the Property from the City upon receipt of such a request from the County. 5. Compliance with Colorado Constitution Article X Section 20 The obligations of the Parties hereunder are expressly subject to annual appropriation of amounts necessary in the sole and exclusive discretion of their respective governing bodies. Nothing in this Agreement constitutes or is intended to create a multi -year fiscal obligation or debt of either Party within the meaning Article X, Section 20 of the Colorado Constitution. 6. Entire Agreement This Agreement shall constitute the entire agreement between the Parties and shall supersede all prior contracts, agreements, proposals, representations, negotiations and letters of intent, whether written or oral, pertaining to the subject matter of this Agreement. No changes, alterations or modifications to any of the provisions hereof shall be effective unless contained in a written agreement signed by both Parties. 9. Governing Law; Severability The laws of the State of Colorado shall govern the interpretation, validity, performance and enforcement of this Agreement. For the resolution of any dispute arising hereunder, jurisdiction and venue shall be proper and exclusive in the District Court of the County of Jefferson, Colorado. 10. Effective Date This Agreement shall take effect upon execution of this Agreement by both Parties, whichever event occurs last. 11.
