SUBJECT: Zoning Map Correction
DATE: February 24, 1998
Pursuant to the Code of Laws, I am forwarding notice of a Zoning Map correction to Council
through your office. The rezoning was approved by Council, but for some reason was never
reflected on our zoning maps. Attached is a map showing the area rezoned and the ordinance
adopting the rezoning.
The Code of Laws states that unless there are protests or Council initiates a rezoning, staff shall
make the correction. Since neighbors in the areas brought this to our attention and Council
adopted an ordinance, there should not be action against this change.

In 1989, City Council passed ordinance #783 which rezoned properties located within Blocks 1
and 2 of the Rolling Hills Subdivision (except Lot 7, Block 2 which was a duplex prior to the
rezoning), from Residential -Two to Residential -One A. There were 24 lots involved (a list of
said lots has been attached).
However, following the approval of the rezoning, the maps were not amended to properly reflect
the change of zone. Pursuant to Section 26 -3 (F) of the Wheat Ridge Code of Laws, it is Staff s
intention to correct the zoning maps to accurately reflect City Council's action.
A certified letter has been sent to the owners in regard to the proposed map correction. If no
protest is received from the owner and if City Council does not initiate a rezoning action within
30 days, the correction will be made.

SS.C 2• Vented Proper Rights. Approval of this mass rezoning
does not create a vested property right. Vested property rights may
only arise and accrue pursuant tc the provisions of Section 26(c) of
Appendix A of the Code of Laws of the City of Wheat Ridge.
section ;'. - BGtRjy Clause. The City council hereby finds, determines,. -:..
and declares that this ordinance is promulgated under the general
police power'of the City of Wheat Ridge, that it in promulgated for
the health, safety, and welfare of the public,'and - that this ordinance
is necessary for the preservation of health and safety and for the
protection of public convenience and welfare. The City Council
further determines that the ordinance bears a rational relaticn to the
proper legislative object sought to be attained.
Section a. Severebility. If any clause, sentence, paragraph, or part
of this ordinance or the application thereof to any person or
circumstances shall for any reason be adjusted by a court of competent
jurisdiction invalid, such judgment shall not affect, impair or
invalidatethe remainder of this ordinance or its application to other
persons or circumstances. -
Section 5. This ordinance shall take e`fect 1 day after final
publication.

0 on this 9th day of January , 1989, ordered published in full
in a newspaper of general circula in the City of Wheat Ridge end
Public Hearing and consideration on final passage set for F ebruary 13
1989, at 7t30 p.m., in the Council Chambers, 7500 West 29th Avenue,
Wheat Ridge, Colorado.
