Dear Mr. Feroldi, I have completed the first review of the above referenced plat received on December 13, 2011, for the lot line adjustment and consolidation plat revising the lot lines of the previously recorded plat for the property located at 3430 Simms Street, and I have the following comments: 1. Please show the previously platted lot line between Lots 1 & 2 of Freimuth Subdivision, and identify as "LOT LINE HEREBY REMOVED BY THIS PLAT." 2. Double -check the interior dimension of the easterly line of Lot 1 (it is the old dimension). 3. On the AutoCAD drawing file, please include the storm sewer info across Lot 1. 4. Need to provide an interior distance for the easterly boundary line of Lot 2. 5. Rename the plat, " Freimuth Subdivision, Second Filing ", and rename all lots accordingly. 6. You may wish to include a reason for this plat under the notes (i.e., to adjust the previously platted boundary line between Lots 1 & 2). Please submit for approval 2 electronic files of the revised Plat, one electronic file in PDF and one in AutoCAD 2007 DWG format on CD/DVD -ROM or by e-mail. However, instead of removing just the PC signature block, you removed the entire City signature block, including the mayor with City Clerk attestation and the blocks for the Public Works and Community Development Directors. Those need to be on there, I If Bev wants to do a group signing when the mylar is brought in to City Hall, make sure she sets up an appointment with Kathy Field who can be reached at 303-235-2846. Please show the proposed new lots as Lots 1 & 2 of Freimuth Subdivision. 2. Note 12 needs to modified to include the following datum information on the plat: a. The Current City Datum Coordinate System used is a ground -based modified form of the NAD83/92 State Plane Coordinate System, Colorado Central Zone 0502. b. Vertical Datum used is the North American Vertical Datum of 1988 (NAVD88). c. The Current City Datum uses the Ground to Grid Combined Scale Factor of 0.99974780300, scaled from base point PHAC 1 (Permanent High Accuracy Control Point #1) having the following NAD83/92 State Plane coordinates: PHAC 1: Northing: 1701258.75, Easting: 3118217.58, Elevation: 5471.62. 3. The Basis of Bearings statement (Note #2) differs from the basis shown on the graphical portion of the plat. Plan: Neighborhood Existing Site Conditions: 'The subject properties are located at 3310 Routt Street and 3430 Simms Street, between 32"" Avenue and Lena Gulch. Both properties are zoned Residential-One (R-1) and are surrounded by properties zoned R- I and R- IA. To the east and north are undeveloped, privately-owned properties that surround Lena Gulch, To the south and west are properties with single family homes. The property at 3430 Simms Street is part of the Mackey Subdivision and is being purchased by the applicant. The lot is currently 61,648 square feet in size (1.4 acres) and includes a new single family home. In May 2006, a Class 11 Floodplain Exception Permit was issued for the new home, and construction began in late 2006. Since that time, drainage improvements were made oil the north side of the property and along Lena Gulch; the ]ionic now sits outside of the regulatory floodplain. The property at 33 10 Routt Street is currently under separate ownership and is part of the Applewood Brookside Subdivision. The lot is comprised of 102,105 square feet (2.34 acres), and includes a single family home oil the southern portion of the property. Lena Gulch bisects the northern part of the lot, and as a result, a significant portion of the lot Is in the floodplain and is undevelopable. All property (lata is from the Jeffersm County Assessor. Applicant/Owner Preliminary Proposal: The applicant, Beverly Freimuth, is proposing to purchase the northern two-thirds of the property at 3310 Routt Street and to consolidate it with the parcel at 3340 Simms Street. The northern portion of the Routt Street parcel is undevelopable because of the floodplain and because of existing drainage and utility easements. The property will provide an expanded backyard and private open space for the Simms Street lot. Will a neighborhood meeting need to be held prior to application submittal? No, a neighborhood meeting will not be required for this proposal. Planning comments: The following items were discussed based on the applicant's proposal: Lot Line Actinstment & Consolidation Plot The proposal requires a lot line adjustment and consolidation plat. In this case, the plat is the document that will adjust the lot lines between ;3310 Routt and 3340 Simms. The plat does not create additional lots, but will effectively make 3310 ROUtta smaller lot and 3430 Simms as larger lot. The property at 3430 Simms includes easements for the maintenance of Lena Gulch and underground sanitary sewer infrastructure. These easements will remain in place, despite the transfer of ownership of the property. The plat must be prepared by a surveyor who is licensed in the State of Colorado. The process of creating and approving the plat is described below. Building Division comments: The building division was not present at the meeting and has no comments at this time. Public Works comments: F'l000ll,.71ain In March 2008, the City Council adopted new floodplain boundary maps for the City of Wheat Ridge, With the adoption of these new maps, the floodplain boundaries around Lena Gulch were altered. The new maps, Flood Hazard Area Delineation (FHAD), were. developed by the Urban Drainage and Flood Control District in conjunction with the City of Wheat Ridge and other local agencies, These maps will replace the previous flood maps that were first developed in the late 1970s. unfortunately, the FHAD maps have not yet been adopted by FENIA, For that reason, the older and newer maps are both used for different purposes: - The older maps are used by FEMA for flood insurance purposes. - The new (FHAD) maps are based on more accurate topographic information and updated engineering methods. These maps are used locally to determine if new construction requires floodplain permits. At some point, FEMA is expected to adopt the new maps, and ultimately one set of maps will determine both flood insurance and floodplain permits. After reviewing the older and newer floodplain maps in the pre-application meeting, nappears both single ftamily homes are outside of the newer FIIAD floodplain, For insurance purposes, however, the I ]ionic at 3430 Strums is entirely within the older floodplain area. Based on aerial imagery, it is possible that a small portion of the home at 3310 Routt is also within the older floodplain. The ]ionic was constructed in 1993/1994, and there is no indication of a floodplain determination in the buildin permit files for the original construction, nor is there record of all elevation certificate. Application & Review Process: The first step in the lot line adjustment and consolidation process began with the pre-application meeting oil October 13, 2011. The next step will be to proceed with a land use application. When only two lots are involved in the lot line adjustment and consolidation process, the plat review is an administrative process. An application for the lot line adjustment and consolidation may be submitted as soon as the plat is prepared by a surveyor who is licensed in the State of Colorado. After a complete application is submitted, a staff planner will be assigned to handle the case, This person is the project manager for tile case and will be the contact at the City throughout the entire process. The case manager will review tile submittal application for content and the proposal will be referred to affected service agencies (Xcel Energy, water district, sewer district, etc.) and other City agencies (Public Works, Building Division, etc.) for their review and comment for a period of 15 days. After all comments have been received, the case manager will forward those to the applicant. Modifications to the plat document may be required as a result of these comments. This review and comment process can occur more than once. Once all comments have been addressed, a blackline nlylar will be submitted to the Community Development Department with appropriate recording fees. Findings will be prepared by the case manager for the Community Development Director who will sign the plat document mylar for recordation, When the plat is recorded with the Jefferson County Clerk and Recorder the lot consolidation becomes official.
