Currently, ADUs are not permitted in the City of Wheat Ridge. In 2017, zoning and building officials visited the property and cooking facilities were removed from the accessory unit to bring it into compliance. That correspondence is enclosed. Recently, in November 2022, City Council gave policy direction to allow ADUs in Wheat Ridge, but that direction has not yet been codified. Council has directed staff to create regulations to allow new ADUs and also to establish a process by which legal and illegal existing units, such as yours, may be able to be legitimized. It will likely still be a couple of months before ADUs are permitted. The property is zoned R-113, allowing for only one dwelling unit on the property. Additionally the City does not contemplate any sort of accessory dwelling units. The owner was given explicit direction for the conversion of the illegal dwelling unit into an accessory structure. On June 1, 2017 a residential remodel building permit (#201701318) was obtained for the property with the following description: Repair handrail to code, apply sheetrock to opening under stairs, eliminated 220 v circuit to stove, insulate and fire foam opening areas in ceiling, install GFCI outlets in bathroom and break room area. This description is consistent with Staff requirements for the conversion of the rear shed from an illegal dwelling unit back to an accessory structure. The focus of the inspection was on the two-story accessory structure that was approved by the City in the 1970s as a storage shed and has transitioned in the intervening years into a separate dwelling unit, with a bathroom and kitchen. The City only recently became aware that the structure had been converted into a dwelling. As you know, the property's zoning does not allow a second dwelling unit and as such, this structure also needs to be modified to remove the cooking facilities and the kitchen. Had the City reviewed the building modifications that have been made as part of a building permit prior to construction/modification, no kitchen facilities would have been allowed, other than possibly a utility sink and a refrigerator. Accessory structures can, however be used for something more than a storage shed, such as an artist's studio or even as sleeping quarters, provided those individuals sleeping in the structure are part of the family unit residing in the main structure and take meals as such. Alternatively, occasional guests of the residents of the house could use the structure for sleeping quarters, provided such occupancy was not done for compensation. Bathrooms are also permitted. In addition to the issues related to the property's zoning, the intent of today's inspection was also to identify any building code matters that would have been addressed through a typical building permit/inspection process. The attached letter is from Allen Posey from Charles Abbot Associates, the City's contract building inspection firm. The representations in the letter constitute the City's position on building code related issues that are required to be corrected to bring the structure into compliance for public safety purposes. We are also only relying on what can be viewed without conducting investigative work involving removal of drywall. The corrective work noted in the letter should be conducted through a City issued building permit to ensure all items are correctly properly. This will also provide a good record for you, future owners and the City regarding the agreed upon uses of the accessory structure. No corrective work was identified for the single story accessory structure. Please note that Allen is still reviewing the electrical usage information that you provided to determine whether we have any concern with the amount of loading on your 150 -Amp electrical service. I have also briefed our City Attorney on these matters and he is considering whether any additional paperwork is necessary to formalize our mutual understanding as to the permissible use of the accessory structure. We hope to have an opinion from him by the end of the week. I understand that the current tenant/resident of the accessory structure has a lease through the end of May and will be moving out at that time. Location: 3555 Chase Street, Wheat Ridge, CO 800033 Ken, I inspected the above referenced building today and offer the following observations; 1. The structure is a two story accessory building that was originally permitted as a storage shed in the rear yard. 2. It is a wood building of type VB construction with asphalt shingles and wood shake siding built in the form of a barn. 3. The outside appeared to be intact and no rot or other physical evidence of damage was noted. 4. The interior first floor contained a living room, a small kitchen with an electric stove, a mechanical closet with gas furnace and water heater and misc. storage areas. A carbon and smoke detector were present. 5. A set of steps led to the second floor and emptied into a sleeping area with a bed. 6. The second floor also contained a full bathroom with closet. 7. The sleeping area has two window openings for emergency egress. 8. The building has 1- 50 amp electrical circuit for the stove, 1- 15 amp circuit for the furnace and 2 - 15 amp general purpose circuits for receptacles and lighting. There was no electrical panel in the building. The circuits were fed from the homes outside electrical panel. 9. The building has a fresh water service provided to it. 10. The building has a 4" sanitary sewer provided to it. No clean -outs were observed. 11. The building has a 3/4" natural gas line provided to it. 12. All utilities to the building were under ground. Material and condition could not be verified. 13. The interior systems were behind sheetrock and could not be visually inspected. Material and condition could not be verified. Recommendations; 1. The hand railing for the steps needs to be reinforced and extended to the first floor level. 2. The under side of the steps needs to have a layer of 1/2" sheetrock applied to the open cavities for protection. 3. The 220 Volt 50 Amp stove circuit needs to be removed or repurposed as a 120 Volt 15 or 20 amp outlet. 4. The mechanical closet containing the furnace and water heater needs to have any open areas to the joist space or attic space sealed. 5. The smoke and carbon detectors for both floors need to be tested and placed in working order. 6. GFCI protection should be installed in the bathroom area and the break room area. The recommendations stated above are then minimum requirements for safety for this building. My name is Ryan Lunt. My wife and I are the property owners for 3555 Chase Street. We are currently dealing with the City on a permitted "storage shed" that was established by the previous owner (Rita Bitter) in 1973. At some point, she added electrical, plumbing, and kitchen appliances to the "storage shed". My guess would be she did this between 1973 and 1976 since the Wheat Ridge Sanitation District put the property at two units in 1976. Knowing how Ritta cared about this place, I just do not see her going rogue and not gathering permits. We have lost several buyers due to the the City (according to the buyers agents) informing the buyers that this structure (storage shed) will incur fines and potentially torn down even though the "storage shed" was granted a Certificate Of Occupancy in 1973. To date, I have not received a letter from the City informing me know my options. The City people I have spoken with have not provided any information on what we need to do. The only thing I keep hearing is from buyers saying the property will incur fines and possibly torned down. Is that morally right? How can we even get a buyer with this information. We will already lose a significant amount of money, but I just need to know what we need to do so we can move on and stop the bleeding. What I don't understand is how something of this nature has gone unnoticed for 42 years. When we bought in 2012 it was not an issue. We have paid taxes to the City, not occurred any fines with the City, only did cosmetics to the place (i.e. paint), and have no criminal records. We keep the front clean and updated because this neighborhood meant allot to us. Lastly, our property is less than 25 feet from a zoned multiple family along Depew Street and four/five families living at 3530 Chase Street in R-1 B zone. I would completely understand if we built this "storage shed" or turned the "storage shed" into an ADU, but this was built in 1970s. When we purchased the house, the "storage shed" had a Kitchen, stove, bathroom, and shower already in place. This situation is still just blowing my mind. After further review of the City's building permit records, there is no evidence of any City -approved permit for conversion of the accessory structure from a storage shed into a residential unit. There is a Certificate of Occupancy (CO) on file from 1973 denoting the structure as a storage shed, not a residential unit. Aerial imagery indicates that this CO is associated with the subject structure in the northwest corner of the property. Building permit records indicate numerous property maintenance permits issued over the years including for plumbing, roofing, and furnace replacements, however, there is no indication that these are related to the shed. Even if any of these permits could be linked to the accessory structure, minor property maintenance permits cannot be considered approval of conversion of the structure from a shed to a dwelling unit. Ultimately, there is no Building Permit or Certificate of Occupancy on file for the residential conversion of the accessory structure. The property is zoned Residential One -B (R-113), a zone district that only allows for single family homes. Accessory dwelling units are currently not allowed in the City of Wheat Ridge, so the zoning would not allow us to have previously approved this this second dwelling and will not allow us to approve it at this time. Based on existing records, it is clear this structure was originally built as a storage shed in 1973. With no permits or CO indicating a residential conversion, the unit is not eligible for legal nonconforming status and is considered illegal from a building and zoning perspective. In terms of next steps, the kitchen must be removed in order remove the possibility that the structure be used as a dwelling. Because there were no building permits pulled to convert the structure from a shed, you must coordinate with the Chief Building Official if you wish to obtain a Certificate of Occupancy for the structure to be used for any purpose www.ci.wheatridge.co.us other than a shed (e.g. for an art studio, office, etc.). Based on the April 27 courtesy inspection, it appears there may be building code violations. Further inspections and/or building permits may be necessary, related, but not limited, to the wiring, sewer, furnace, and support structures for the upper story loft. Additionally, the City of Wheat Ridge does not allow accessory dwelling units. Due to the age of the home (built in 1948 according to County records) Staff reviewed our internal building permit archives to determine the legitimacy of the accessory residential structure, since the City of Wheat Ridge was not incorporated until 1969, and would have been subject to Jefferson County zoning regulations at the time of construction. Our records revealed two building permits for storage sheds, one in 1973 on the northwest side of the property, and one in 1991 on the southwest side of the property. Both Certificate of Occupancy documents (attached) indicate the structures were constructed and approved as storage sheds. Besides those permits, our records only include a reroofing permit, water heater permit, and fence permit. We have no record of a storage shed being converted to a residential structure. We frequently receive calls from appraisers questioning the legitimacy of structures, and the ability to rebuild in the event of casualty. Based on the information on hand, we would inform an appraiser or other interested party that there is no record of the shed being converted to a residential structure, nor does it have a Certificate of Occupancy for a residential structure. This could cause major issues with the sale and financing of the home.
