This letter is to inform you that the property located at 4202 -4262 Wadsworth Boulevard is
located within the corporate limits of the City of Wheat Ridge, Colorado. The property
comprises the Time Square Subdivision, recorded under reception number 82081495.
The subject property is zoned Mixed Use - Commercial (MU -C). This zone district, generally
located along major commercial corridors and at community and employment activity centers, is
established to encourage medium to high density mixed use development. In addition to
residential and civic uses, it allows for a wide range of commercial and retail uses.
I have enclosed with this letter, a copy of Article XI (Mixed Use Zone Districts) of the zoning
code which establishes permitted uses, site development standards, and parking requirements for
development in the Mixed Use - Commercial zone district. Also enclosed is a copy of the zoning
map that indicates the MU -C zoning designation on the subject property.
The existing service and retail land uses on the property are considered permitted uses in the
MU -C zone district. Because the property was originally developed under a different zoning
designation, the structures are considered legal nonconforming. Per section 26 -1103 of city code
(enclosed), these structures may continue to exist and may be enlarged, altered or added to
provided that the alteration or addition does not increase the nonconformity. Any new addition
or expansion to a nonconforming structure shall comply with all provisions of the Mixed Use
Zoning Code, where practical.
For the structure at 4202 Wadsworth, two certificates of occupancy are enclosed: the original
1977 C.O. and one associated with the most recent tenant finish, dated 2009. The larger building
on the property was originally constructed in 1969 prior to the incorporation of the City of Wheat
Ridge. Enclosed is the C.O. associated with the most recent remodel. Countless tenant &rushes

have occurred over the last 40 years, those C.O.s are not included. Please note that the C.O.
states the address of the property as 4200 Wadsworth; this address has been commonly used to
refer to all tenants withinthe shopping center (4210- 4262).
Regarding land use cases, a variance request was approved in 1982, per Case No. WA -82 -30 for
the property at 4202 Wadsworth (lot 2). The approval allowed a 5 -foot variance from the 5 -foot
rear yard setback requirement, resulting in a 0 -foot rear setback. There is no evidence of any
other approved variances, special use permits, or conditional use permits for the subject property
While it is difficult to ascertain if any violations are present on the site, it should be noted that
currently there are no open code enforcement cases for the property.
