Pursuant to Section 26-407.c. of the subdivision regulations, if an applicant fails to provide a recordable mylar within 60 days of final action, a public hearing should be scheduled to reconsider the original approval. The sixty-day window for recording was over at the end of April. However, based oil the fact that construction is moving forward, a public hearing for revocation of the plat approval has not been initiated. At your earliest convenience, please provide a blackline copy of the mylar with original signatures of the property owner and surveyor, An $11 per page recording fee is required at the time of submittal of the mylars. A recommendation of approval was given for the following reasons: 1, All requirements of Article IV of the zoning and development code have been met. 2. 1 ll utility providers can serve the property. Case No. MS -11 -06 February 27, 2012 Page 2 There were no conditions associated with the approval recommendation and no members in the audience at the public hearing who testified against the application. FINANCIAL IMPACT: One-time fees in the amount of $950 for the consolidation plat were submitted with the application. The proposed plat will consolidate the property from three lots into one lot. No right-of-way dedications are required for 29"' and Fenton except for a radius at the comer. The public alley to the east is required to be dedicated in the amount of eight feet. The property owner will be required to pay fees to the City in lieu of construction for the cost of public improvements along both Fenton and West 29 Avenue as part of the building permit process. Staff concludes that the proposed consolidation plat is compliant with Article IV of the zoning and development code. The application has been through a standard City and outside agency referral process. No issues of concern have been raised. The Planning Commission staff report is attached for additional background on this application. The applicant is requesting approval of a three lot consolidation plat on C- I zoned property located at 5795 West 29"' Avenue. The purpose of the request is to remove internal property lines to accommodate building remodel and expansion. Lot consolidations for 5 lots or less follow the minor subdivision process. However, because there is a right-of-way dedication occurring for the alley adjacent to the property, City Council will be the filial authority for approval with Planning Commission providing a recommendation. If. EXISTING CONDITIONS The property is located at the northeast comer of W. 2W A venue and Fenton Stre et and is zoned Commercial -One (C -1). The subject property is comprised of three parcels, that total 15,295 square feet. The site currently contains a one-story concrete block building that was built in 1958 and has a floor area of 1,520 square feet. The building contains a convenience store on the west side and a carwash on the east side. The property owner is proposing demolition of the existing carwash with reconstruction to allow interior remodel and expansion with liquor sales. A convenience store with gas pumps is typically a special use in the C -1 zone district but is considered an existing condition and can remain without going through an SUP process, Liquor sales in a C- I -one district is a permitted use. The applicant received approval of a retail liquor license in July 201 L A building permit review for remodel and expansion is in process and no liquor sales can occur until construction, is complete and a Certificate of Occupancy is issued. Because the city does not allow new construction on multiple parcels, a consolidation plat is required. (Exhibit 1, Aerial photo with existing lot tines) The surrounding properties include a variety of land uses and zoning, To the north is the Wheat Ridge Manor Nursing Home which is zoned It- A. Residential properties zoned R-IC abut the property across the alley to the east. To the south is an auto repair shop zoned C -1 and across Fenton Street to the west is Denver Water's Ashland Reservoir. The purpose of the request is to remove internal property lines to accommodate building remodel and expansion. Lot consolidations for 5 lots or less follow the minor subdivision process. However, because there is a right-of-way dedication occurring for the alley adjacent to the property, City Council will be the final authority for approval with Planning Commission providing a recommendation. [I= The property is located at the northeast comer of W. 29 Avenue and Fenton Street and is zoned Commercial-One (C-1). The subject property is comprised of three parcels that total 15,295 square feet. The site currently contains a one-story concrete block building that was built in 1958 and has a floor area of 1,520 square feet. The building contains a convenience store on the west side and a carwash, on the east side. The property owner is proposing demolition of the existing carwash with reconstruction to allow interior remodel and expansion with liquor sales. A. convenience store with gas pumps is typically a special use in the C-1 zone district but is considered an existing condition and can rernain without going through an SUP process. Liquor sales in a C- I zone district is a permitted use. The applicant received approval of a retail liquor license in July 2011. A building pen review for remodel and expansion is in process and no liquor sales can occur - until construction is complete and a Certificate of Occupancy is issued. Because the city does not allow new construction on multiple parcels, a consolidation plat is required, (Exhibit 1, Aerial photo with existing lot lines) The surrounding properties include a variety of land uses and zoning. To the north is the Wheat Ridge Manor Nursing Home which is zoned R-3A. Residential properties zoned R-IC abut the property across the alley to the east. To the south is an auto repair shop zoned C -1, and across Fenton Street to the west is Denver Water's Ashland Reservoir. The proposed plat will consolidate the property from three lots into one lot (Exhibit 2, Plat). Planning Commission 2 NIS-11-06/Varma No right-of-way dedications are required for 29' and Fenton except for a radius at the comer. The public alley to the east is required to be dedicated in the amount of 8'. The property owner will be required to pay fees to the city in lieu of construction for the cost of public improvements along both Fenton and West 29"' Avenue as part of the building permit process. The surrounding properties include a variety of land uses and zoning. To the north is the Wheat Ridge Manor Nursing Home which is zoned R-3A. Residential properties zoned R-IC abut the property across the alley to the east. To the south is an auto repair shop zoned C-1, and across Fenton Street to the west is Denver Water's Ashland Reservoir. The subject property includes three parcels that total 15,295 square feet. The site currently contains a one-story concrete block building that was built in 1958 and has a floor area of 1,520 square feet. The building contains a convenience store on the west side and a ca ash on the west side. To the north and west of the building is a landscaped area, and the remainder of the lot is paved with two freestanding gas pumps located in the middle of the paved area. Three curb cuts provide access to the site--one off of Fenton Street and two off of W. 29th Avenue. A streetscape project was completed by the City in 2003 which included installation of curb, gutter, and sidewalk on both frontages, a decorative wall on Fenton, and three tree grates on W. 20 Avenue. Applicant/Owner Preliminary Proposal: The property owner is proposing to replace the carwash portion of the building with an expanded retail area. The carwash is outdated and underutilized, so the applicant is proposing to demolish and rebuild the eastern half of the structure to accommodate a liquor store. The existing building is 1,520 square feet. The retail portion of the building will remain at 770 square feet. The 750 square foot carwash will be demolished and replaced with a 1,546 square foot addition. The total building size after the renovation will be 2,316 square feet (a net increase of 796 square feet or a 52% increase in floor area). In addition to a liquor store, the addition will also include a new accessible bathroom. A screened, noncombustible trash area will be located on the east side of the addition, adjacent to the alley. Proposed facade improvements include a new stucco finish and parapet wall that will screen rooftop equipment. Additional landscaping is proposed along the east property line, and along the Fenton and 29ti, frontages. The western curb cut on W. 29 Avenue will be closed. The owner has already received a liquor license and is ready to move forward with construction in order to open by the end of the year. Will a neighborhood meeting need to be held prior to application submittal? No, a neighborhood meeting is not required. Planning comments: This proposal was first discussed at a pre-application meeting about a year ago on September 2, 2010. This (October 6, 2011) meeting serves as a follow-up to provide feedback on the site and civil plans that have been developed over the past year. The following items were discussed: Landscape The landscape requirement far commercial properties is 20% of the lot area. This includes only landscaping within the property boundaries; it does not include the streetscape which the owner is responsible for installing, but is typically located outside of the property boundary. Required landscape is proportional to the size of the addition, which is a 52% increase in floor area. Therefore half of the landscape requirements apply. Required new landscaping includes at a minimum I tree and 15 shrubs. In addition, one street tree is required for every 30 feet of street frontage within the minimum setbacks abutting public right-of-way. The total frontage along Fenton and W. 29"' Avenue is 2 linear feet. Half of this requirement applies; therefore 4 street trees are required. All trees and shrubs shall meet the minimum caliper and size requirements as established in Section 26-502.F of the city code. M Porous landscape areas can be used to simultaneously meet site drainage requirements. Please see Public Works comments below. in the meantime, the western curb cut on 29"' Avenue will need to be closed off with a new curb. The area behind this curb cut includes monitoring wells, but landscaping will still be required in the area between the sidewalk and parking area near the southern lot line. Spreading Juniper plants will be an acceptable ground cover. Use of the tree grate on the southeastern comer of the property may be discontinued and it may be backfilled. Lot Consolidation The property is currently comprised of three parcels. As discussed in 2010, the parcels will need to be consolidated in order to eliminate the internal lot lines. Any consolidation that includes more than two parcels requires public hearings. This process is described below. Process This request will require a building permit and a consolidation plat. The Chief Building Official, John Schumacher, has confirmed that a building permit may be issued before the consolidation plat is recorded. The consolidation plat must be recorded, however, before issuance of a Certificate of Occupancy. wilding Permit The building permit application will need to include a site plan, landscape plan, building elevations, and the necessary drainage documents required by Public Works (see more below). A photometric plan is also required if outdoor lighting is proposed. An escrow agreement for the future streetscape improvements will be required before the building permit is issued. The Public Works Department will review the drainage documents as part of the building permit review. The Planning Division will review the plans for compliance with zoning and landscape standards. A commercial plan review can take up to six weeks in length. INM= The first step in the process began with the pre-application meeting on October 6, 2011. The next step will be to proceed with the consolidation plat application. 9 An application for the lot consolidation may be submitted at any time. After a complete application is submitted, a staff planner will be assigned to handle the case. This person is the project manager for the case and will be the contact at the City throughout the entire consolidation process. Please note: Depending on the outcome of the November I elections, staff is expecting some disruption to the normal meeting schedules of the Planning Commission and City Council.
