that landscaping and parking are allowed over drainage easements, Buildings are
not allowed.

Commissioner TIMMS asked if a site plan review has taken place. Ms. Reckert
stated preliminary reviews have taken place; however, the applicant may not
apply for a building permit until consolidation occurs. The public will have
opportunity to give input on the liquor license when it is heard before the Liquor
Authority.

All notification and posting requirements have been met; therefore, there is jurisdiction to hear this
case.

The applicant is requesting approval of a four lot consolidation plat on C- I zoned property located at
5560 West 29 Avenue. The purpose of the request is to remove internal property lines to
accommodate building remodel and expansion.
Lot consolidations for 5 lots or less follow the minor subdivision process; therefore, Planning
Commission will be the final authority for this land use process.
There are currently two primary structures on the property. On the east side of the lot is a one-story,
stucco and brick commercial building that is located at the front property line. It was constructed in
1930 and is 1,292 square feet in size.

Staff concludes that the proposed consolidation plat is compliant with Article IV of the zoning and
development code.
All affected service agencies were contacted regarding the ability to serve the property. All have
indicated that they can serve the property subject to required improvements constructed by the
property owner with the building expansion. Specific referral responses follow.

Wheat Ridge Public Works: The Public Works Department has reviewed and approved the
proposed plat. An casement dedication for the alley is being required. They have reviewed and
approved a drainage report for future construction which is being accommodated by the plat.
Wheat Ridge Police: No concerns.

Staff concludes that the proposed subdivision meets all of the requirements of Article IV of the zoning
and development code and all service agencies can accommodate the proposed building and site
modifications. Therefore, Staff recommends approval of Case No. MS-12-01.

liquor license (to a bar, for example) then a new license would be required which means a new hearing.

The subject property is 13,373 square feet (0.3 acres) in size and is made up four separate lots that are
each 25 feet by 133 feet. There are currently two primary structures on the property. On the east side
of the lot is a one-storv stucco and brick commercial building that is located on the front property line
(an 11-C indicates a possible encroachment over the front property line). According to the Jefferson
County Assessor it was constructed in 1930 and is 1,292 square feet in size.

Planning comments:
The following items were discussed base on the applicant's proposed development:
Zonin,g
The site is zoned Commercial-One (C- I ), a zone district that provides for a range of commercial land
uses including office, general business, and retail sales and service establishments. The proposed
restaurant is a permitted use in the C- I zone district. The residential use is also permitted as a legal
nonconforming use because the dwelling unit has been in existence since before 1997.
Subdivision
The subject property is made up of four separate lots. Neither the zoning code, nor the building code
allow new construction across lot lines, so the applicant will need to remove the interior lot lines
before a building pen-nit may be issued. The way in which lot lines are removed is through the
subdivision process, or by "platting." Several options are available for platting:
Option 1: Consolidate the four lots to one. This is processed as a minor subdivision and will
require a single public hearing before Planning Commission. The zoning code allows for only
one primary structure in most zone districts, so approval of a Planned Building Group (PBG)
will also be required to allow two primary structures on a single lot. Through the PBG process
a recordable plat document is administratively approved.
Option 2: Consolidate the four lots to two. Subdividing the property From four lots to two
lots---one for the restaurant and one for the residential property—would also be processed as a
minor subdivision. Again, this would require only one public hearing before Planning

Commission. If a separate lot is created for the residential use, there is no minimum lot size,
but the newly created lot lines must be at least 5 feet from the exterior walls of home. This
option results in one primary structure per lot, so no PBG is required.
In addition, the zoning code also recognizes shared parking agreements. The applicant may consider a
'
shared parking agreement with the shoppette on the southwest corner of W. 29 'Avenue and Depew
Street. Shared parking provides options for nearby users with different peak parking dernands and
operating hours.

All signs will need to conform to the sign code; section 26 -'710 of the municipal code includes a table
that summarizes sign standards for commercial uses. Among the permitted signs are freestanding,
wall mounted, and projecting signs. Applicable size and setback requirements apply and are included
in the summary table.
Process—Minor Subdivision
This request will require a minor subdivision. The first step in the process began with the pre-
application meeting on August 18, 2011.
The subdivision process officially begins with the submission of a complete land use application and
fee. After a complete application is submitted. a staff planner will be assigned to handle the case.
This person is the project manager for the case and will be the contact at the City throughout the entire
process.
After all comments have been addressed, a public hearing before, Planning Commission will be
scheduled. Because no public right-of-way needs to be dedicated for this project, Planning
Commission is the deciding authority. Once the plat is approved, it must be recorded with Jefferson
County.
Building Division comments:
The building division was present at the meeting and has the following comments:
• Engineered plans will be required for the new foundation.
• If a new HVAC system is installed, a plan will be needed to demonstrate that the exhaust and
intake are at least 10 feet apart.

• Accessible restrooms will be required; the number of required restrooms is determined by
occupancy in the IPC. Please consult with the Building Division if occupancy is near the
threshold for additional facilities,
• If a separate lot is created for the residential use, lot lines should be located at least 5 feet away
from the house.

Public Works comments:
Public Works was present at the meeting and has the following comments:
The applicant may use a combination of water quality features, including porous landscaping, porous
pavers, or other innovative designs. Staff requests a detention easement be indicated on the
subdivision plat to ensure that water quality features can be maintained by the City if the property is
ever vacated.
A grading and erosion control plan will be required to be submitted with the building permit.

Access
The existing curb cut on W. 29 Avenue is about 10 feet wide and may be widened if necessary. A
pedestrian light is located immediately to the west of the curb cut. To request the light be relocated,
the applicant may submit a proposed design to the Public Works Department and the engineering
manager will determine if or where the light may be moved.

The house on the west side of the property will be retained as residential property
and fixed-up on the exterior to complement the overall development scheme. A new white
picket fence, nice planting beds, and a fresh coat of paint will make this structure a visual
asset to the overall development and reinforce the rural, small town ambiance of the
property.
This redevelopment should be seen in the context of a larger neighborhood
revitalization strategy. West 29th Avenue from Sheridan to Fenton is a commercial district
ripe for rejuvenation. It is a central entry corridor into Wheat Ridge and will benefit from
western expansion of the Highlands area. This project should be viewed as a pioneer
property in the revitalization of this commercial district,
