Commissioner OHM asked if the proposed reduction in shrubs will set a precedent for the
future. Ms. Mikulak explained that variances do not set a precedent, each variance must
be evaluated on its own.

landscaping and a reduction in shrubs but increase in trees will actually make the

All notification and posting requirements have been met; therefore, there is jurisdiction to hear this case.
The applicant is requesting approval, of a five-lot consolidation plat on property zoned Public Facilities
(PF) and located at 1121 0 W. 45 Avenue. The purpose of the request is to remove internal property
lines in preparation for an expansion of the existing maintenance facility to accommodate both Public
Works and Parks maintenance equipment and personnel.
A consolidation for 5 lots is processed as a minor subdivision. In this case, because there is no right-
of-way dedication, Planning Commission is the final authority for approval.
The property is zoned Public Facilities (PF) and is located at 1121 W. 45"' Avenue--north of W. 44"
Avenue, between Patfet and Quail Streets NOW". The site is referred to as the Wheat
Ridge Maintenance Facility (WRMF) and has served as an operations center for the Public Works
Department for over 40 years. The WRMF has gradually expanded with the purchase of adjacent
properties, and has several structures including an office building, auto repair shop, salt/sand barn,
fueling stations, and several outbuildings.
All five parcels that make up the property are city-owned, and the total area of the site is 5 acres. Only
two of the parcels have been previously platted: Lot I of Hall Subdivision Third Filing to the west and
Lot 2 of Pumpkin Patch Subdivision to the north. The middle three lots are unplatted.
The subject site has minimal street frontage. The cast side of the property has 50 feet of right-of-way
frontage where. West 45th Avenue dead ends into the site; this frontage serves as the primary access
into the property. Similarly, the west side of the property has 50 feet of right-of-way fi where
West 46th Avenue dead ends; this frontage has been gated and closed, used only for emergency access.

Pursuant to section 26-116 of the code of laws, a PBG site plan is required in all zone districts other
than planned development and mixed use districts for properties on which more than one primary
structure exists. Applications for more than four main structures require approval by the Planning
Commission at a public hearing.
11. EXISTING CONDITIONS
The property is zoned Public Facilities (PF) and is located at 112 10 W. 45' Avenue—between Parfet
and Quail Streets, north of W. 44' Avenue The site is referred to as the Wheat
Ridge Maintenance Facility (WRMF) and has served as an operations center for the Public Works
Department for over 40 years.

Architecture
The existing structures on the property range in age, with the oldest being over 60 ears old. The
exterior treatment of the proposed buildings will be similar to the existing structures horizontal
clapboard siding, natural and earth tones, and gable or shred roofs
While this architectural style is not typical of a heavy commercial or light industrial operation, the
treatment is more consistent with the surrounding semi -rural and residential area.
Parking
The site plan provides 83 standard size vehicle spaces for employees" private vehicles, as well as for
police or fleet vehicles that may be on site for fueling or maintenance. Large city vehicles, such as
snow plows, trucks, and mowers will primarily be stored within the proposed open or covered
buildings.
Currently, the southern portion of the property is paved and the northern portion is undeveloped. An
all - weather surface of recycled asphalt pavement (RAP) will be installed on the northern portion of the
site. When the administration building (E) is complete, permanent hard surfacing will be installed and
the parking lot will be striped.
Section 26- 502.D.3.b requires 10 shrubs per every 1,000 square feet of required landscape area. ;Based
on a 5 acre lot size, the site needs 1 acre of landscaping and would need 436 shrubs to satisfy code

requirements. Part of this application is a request for a variance from this requirement. The following
table is a comparison of the required and provided landscape materials. The variance criteria are
analyzed in section VI below.
As with the construction of new buildings, landscaping is proposed to be installed in phases. All
perimeter landscaping on the northern portion of the site will be installed when the first building (A) is
constructed. This includes landscaping in the detention pond area. On the southern portion of the site,
landscaping will be installed with the construction of adjacent buildings.
All affected service agencies were contacted for comment on the PBG site plan, and the property can
be served. Specific referral responses follow:
Valley Water District: A water casement is provided on the consolidation plat to provide a
future water line connection between W. 45 111 and W. 46 Avenues. This water line extension
and a new water tap will be installed when the administration building (E) is constructed.
Arvada Fire: When the water line is extended and the administration building (E) is

realm. In this case, the WRMF property has no public street frontage, is not a public
destination, and is entirely surrounded by a wood privacy fence. Therefore, shrubs provide no
benefit to the public view and provide no effective screening.
It is the taller landscaping material—such as trees—that will contribute to the character of the
area, and additional trees are proposed to compensate for a reduced number of shrubs, Shrubs

have been included at locations that are visible from within the property in order to enhance the
aesthetics of the site for employees and visitors.

3. The applicant is proposing a substantial investment in the property with this application,

The applicant is proposing a substantial investment in the property. The demand from citizens
and businesses in Wheat Ridge for public services including police protection and park and
road maintenance will continue to increase, and the proposed facilities will ensure continued
provision of these services. It is not in the best interest of the city or the citizens to commit
resources to additional shrubs which render no public benefit.
The hardship described above relates to the location of the property in relation to the
surrounding land uses. The configuration of the site within a semi-rural/residential setting and
without a proper front yard was not created by any person currently having an interest in the
property.

compensate for the reduced number of shrubs, however, 28 additional trees are provided and do
serve to meet the applicable screening guidelines of the ASDM.
Staff finds that this criterion has been met.
Staff concludes that the proposed planned building group meets the requirements of the Public
Facilities zone district and will promote development of the Wheat Ridge Maintenance Facility site in
an efficient and orderly manner. Further, staff finds the request for a landscape variance is in
compliance with the majority of the review criteria. Staff recommends approval of the planned
building group and accompanying variance request.

General Phasing Schedule:
This planned building group establishes a site plan for the implementation of the City of Wheat
Ridge Public Works / Parks Maintenance Master Plan which the City Council adopted in 2004. The
proposed buildings are expected to be constructed in the following phases based on need and City
budget over the next 20 years.
Phase l:
Buildings A, B, C, and D. Building A is proposed to be constructed in 2012. All perimeter and
detention pond landscaping will be installed with the construction of Building A. Access aisles will

have reviewed the third submittal of the plat and PBG and have the following comments. Please also

1. Easetrients—A water line easement has been added to allow for the future connection of water
lines between W. 45 'x' and 46"' Avenues. Do you see any need for a note regarding the easement?

The project is scheduled for a public hearing on August 1C, 2012 before Planning Commission. I will
work on the staff report next week and provide a copy for you to review. Additionally, I will provide
you with two posting signs that will need to be on the property no later than 5p on Thursday,
August 2. Once we have determined that all comments are addressed, I will need 16 copies of the
full-sized plat and PBG for the Planning Commission public hearing.

however, that there is not enough landscaping and not enough information on the PBG regarding
landscaping. We had previously discussed reducing the number of shrubs in exchange for
providing more trees. Based on my calculations for the current design, three variances would be
required from the landscape requirements of the zoning code:

Please consider that you are requesting a near complete waiver of the building design
requirements of the ASDM for a site that is entirely embedded in a residential neighborhood. A
sufficient landscape buffer may help to compensate for this architectural waiver. Please also
consider that a similar heavy commercial use on private property would be required to comply
with the same standards of the zoning code —being a city shops facility does not in itself
constitute a hardship, nor warrant automatic relief from the zoning code. Staff recommends
meeting with Margaret regarding the proposed design and maintenance of landscaping on the
property. Please also note that the code requires irrigation; below I have recommended a note for
th over page. The amount landscape area has been increased to just over 20% and the number of
ees has been increased well over the required amount. The only variance that will be needed is
for the number of shrubs, see the attached variance request and criteria discussion.
Architectural elevations — In my last comment letter dated May 8, I requested a line drawing of a
typical elevation that exhibits the architectural style and materials of the existing/proposed
buildings. This drawing has not been provided. It will be acceptable to submit a drawing as an
exhibit and not record it on the PBG. This exhibit will need to be provided with the next cl-

Formatting— Please standardize the formatting of the PBG document utilizing a siptle for the
declaration, certification blocks, notes, tables and legend on both pages of the PBG document. For
example, the plat document utilizes a single sans -serif font in a uniform size for all notes and
certifications. Sentence case is acceptable, as long as it is still legible when reduced to an 11 x 17
document. This has been done.

Explanation of Planned Building Group
This planned building group establishes a site plan for the implementation of the City of
Wheat Ridge Public Works /Parks Maintenance Master Plan that City Council adopted in
2004. Proposed buildings are expected to be constructed in the following phases based on
need and City budget over the next — years.

5. Architectural elevations— In my last comment letter dated May 8, 1 requested a line drawing of a
typical elevation that exhibits the architectural style and materials of the existing/proposed
buildings. This drawing has not been provided. It will be acceptable to submit a drawing as an
exhibit and not record it on the PBG This exhibit will need to be provided with the next
submittal.
6. Formatting--Please standardize the formatting of the PBG document utilizing a single font for the
declaration, certification blocks. notes, tables and legend on both pages of the PBG document.
For example, the plat document utilizes a single sans-serif font in a uniform size for all notes and
certifications. Sentence case is acceptable, as long as it is still legible when reduced to an I IxI 7
document.

The parcel immediately to the north does not have an assigned address, but is known as lot 2 of the
Pumpkin Patch subdivision (PIN 39-212-19-001). The parcel was purchased by the City in 2008
specifically for the purpose of expanding the maintenance facility. This northern parcel is 64,770
square feet in size or 1.49 acres.

Because the ASDM Could change, detailed requirements were not discussed in the pre-application
meeting. Please plan to meet with planning staff to discuss architectural requirements prior to
selection of a building design.
Zoning
The site currently has two zoning designations. The southern half of the site (including PIN 39-212-
00-044 and 39- 212 - 07.010) was zoned to Public Facilities (PF) in 2006, per (,ase No. WZ-06-04, 'rhe
northern portion (Pumpkin Patch Lot 2) is currently zoned Agricultural-One (A-]). See image below.

While the proposed parks tacility may be constructed under the A-] zoning, staff recommends a zone
change for the northern parcel (Pumpkin Patch Lot 2) from Agricultural-One (A-1) to Public Facilities
(PF). A zone change to PF is consistent with the zoning to the south and is appropriate for the
proposed land uses in the Public Works and Parks master plan. The public facilities district provides
for property devoted to public and quasi-public buildings and facilities.
The zone change will be processed as a private rezoning per section 26-112, as was done in 2006 for
the southern portion of the site (WZ-06-04). A planned development zoning designation will not be
required. The review and approval process for a zone change is further described below,
Consolidalian
The maintenance facility site is currently comprised of several separate lots, including lots in two
different subdivisions (Pumpkin Patch and Hall). The middle of the property is unplatted and includes
the parcel identified by PIN 39-212-00-044.
Regardless of the status of the middle, unplatted parcel a consolidation plat will be needed in order to
eliminate all internal lot lines. Because the property includes more than two lots, the consolidation
plat will be reviewed by planning commission. If no public dedications are required, planning
commission is the final authority. The entire process is outlined below.
Planned Building Grou
In conjunction with the consolidation plat, a planned building group (PBG) will be required. Per
section 26-116 of the city code, a PBG document is required for all zone districts except planned
development zone districts and mixed use zone districts,

The primary purpose of a PBG is to allow flexibility and diversification in the location of structures
and the design of a lot by permitting more than one (1) primary structure, on a parcel. The design of the
site should promote better overall utilization of the site by promoting improved circulation and access,
more efficient layout of parking, and a better overall landscape and architectural design for the site.
Until now, it appears that no PBG has been required because the maintenance facility is composed of
several lots, each of which with its own primary and accessory structures. With the consolidation,
several primary structures will result. Review of the PBG will be by the planning commission, the
process for which is described below. The PBG may be processed simultaneously with the
consolidation plat and will be comprised of the entire, five acre site.

The second reading of the ordinance is a public hearing. The same requirements for landowner
notification and posting will be followed as for the planning commission public hearing. A staff
report with recommendations will be presented at the public hearing. If approved, the zone change
ordinance goes into effect 15 days following the final publication of the ordinance.
C'onsolidation Plat
The next step for the consolidate plat is to proceed with submittal of subdivision application.
There are at least three parcels that make up the Wheat Ridge Maintenance Facility. When three lots
are being consolidated, the consolidation plat review is a non-administrative process. The platting
process removes all interior lot lines and leaves only the exterior or "boundary" lot lines. A
professional surveyor who is licensed in the State of Colorado must prepare and stamp the
consolidation plat.
An application for the lot consolidation may be submitted at any time, although staff recommends
submitting it with the planned building group application. After a complete application is submitted, a
staff planner will be assigned to handle the case. This person is the project manager for the case and
will be the contact at the City throughout the entire consolidation process.
After all comments have been addressed, a public hearing before planning commission will be
scheduled. The requirements for landowner notification and posting will be the same as described
above. The notifications and postings must occur at least 15 days prior to the public hearing.
The case manager will prepare a staff report with findings and a recommendation which will be
presented at the planning commission public hearing. For a consolidation plat with no dedications,
planning commission is the final authority.
Once the plat is approved, it must be recorded with Jefferson County. Within 60 days of approval, a
blackline mylar of the plat with original signatures and fees must be provided to the City for recording
with the Jefferson County Clerk & Recorder's office.
Pkinned Building Gtwul,2 (PBQ)
The next step for a planned building group is to complete a site plan for the entire property and submit
a PBG application. Staff recommends submitting the application with the consolidation plat, however
this is not required.

Upon submittal, the application will be reviewed by the case manager for completeness. As described
above, the application will be sent on a 15 day referral to affected agencies, If the PBG and
consolidation applications are submitted at or around the same time, they will likely be sent on referral
at the same time. All comments will be forwarded to the applicant and modifications may be required.
Because the PBG will include more than four (4) main structures on the property, the planning
commission will review the application and be the final authority. The requirements for landowner
notification and posting will be the same as described above. The case manager will prepare a staff
report with findings and a recommendation which will be presented at the planning commission public
hearing.
Once a planned building group is approved, it must be recorded with Jefferson County. Within 60
days of approval, a blackline mylar of the PBG with original signatures and fees must be provided to
the City for recording with the Jefferson County Clerk & Recorder's office.
Building Division comments:
The Building Division was not present at the meeting and has no comment at this time.

Sherman Williams Exterior Super Paint or approved equal.
• Building roof material will be 40 year minimum composite roofing or bid as alternate
metal screw less standing seam roofing. Commercial 6-7 inch gutters /downspouts to
drain to back side of building, with 4 foot foldable extensions.
• Building accesses and controls must conform to ADA title two 2010 regulations.
• Electric and gas utilities installed and hooked up as specified for building type.
Utility tie in points to be determined. Electrical service installed.

• Vandal resistant motion activated lighting for building exterior.

• At back wall of each bay of three sided storage building Contractor shall

• All garage doors commercial grade metal 10'x 10'mimmurn, insulated and
lockable with inside and outside handles, automatic lift for each door bid as
alternate,
• Vandal resistant motion sensor lighting for building exterior. Interior
switched area lighting. All interior lighting to be cold start up commercial
type florescent lighting.
• At back wall of each bay Contractor shall include two GFC1 20 amp circuits
to allow for vehicle block heaters to be plugged in.
• Extra (4) 20 amp circuits location to be determined.
• Interior heated with thermostat controlled gas warehouse /commercial type
ceiling mount heater(s). Interior area should be heated to non-freezing
average temperatures of 55 degrees minimum in cold months.
o Thermostat/manual controlled commercial attic fan(s) installed to vent
enclosed building.
o Manual controlled commercial ceiling fan(s) installed as needed.
o Exterior door(s) to be pre hung 36 inch wide minimum commercial smooth
finish metal door with metal stiffened/nietal frame with typical deadbolt,
door handle holes included.
