I. REQUEST The applicant, the City of Wheat Ridge Parks and Recreation Department, is requesting approval of a 30 -day temporary permit to allow a temporary parking lot located north of Discovery Park on property at approximately 3751 Johnson Street and zoned Planned Commercial Development (PCD). The purpose of the request is to provide temporary overflow parking and to accommodate the increase in park users that is anticipated with the summer 2012 opening of the Discovery Park skate park facility. Section 26-115.13 (Temporary permit for uses, buildings, signs and nonoperative vehicles) of the Wheat Ridge City Code empowers the Director of Community Development to decide upon applications for thirty (30) day temporary permits without requirement of a public hearing. II. CASE ANALYSIS The property is located at southwest corner of Johnson Street and W. 38 Avenue and is zoned Planned Commercial Development (PCD). The subject property is Lot 3 of the 38 & Kipling Park Subdivision and has an area of 25,378 square feet or 0.58 acres. The subject lot is currently vacant, undeveloped land. Discovery Park is located immediately to the south of subject site. The park is nearly 6.5 acres in size and provides several amenities including several playground areas, a water splash pad, a picnic pavilion that can accommodate up to 100 users, and a grass playfield. In June 2012 a 12,000- square foot skate park will be opening and is expected to attract additional users to the park (Exhibit 1, Aerial). An off - street parking area in Discovery Park accommodates 43 vehicles, but does not always meet the demands of park visitors. Heavy use of the park often results in visitors parking along the west side of Johnson Street. The Parks and Recreation Department has worked with the adjacent neighbors to the south and east to mitigate on- street parking throughout the neighborhood. No parking signs have been installed along the east side of Johnson Street. The applicant anticipates an increase in park users this summer associated with the opening of the skate park area, and has proposed a temporary parking lot to absorb the potential increase in vehicular traffic. The parking area is located on the southern portion of the subject site and will provide temporary parking for up to 24 vehicles. Access to the lot will be provided via a curb cut along Johnson Street. The first 25 feet from the edge of pavement will be surfaced with asphalt or concrete; the remainder of the lot will be surfaced with either gravel or recycled asphalt. If recycled asphalt is used, a water quality facility will be provided. Parking blocks will be used to delineate each parking space. The lot will not include handicapped parking spaces —two accessible spaces are provided in the permanent parking lot within the park (Exhibit 2, Site Plan). Case No. TUP -12 -02 /Discovery Park Signage will indicate that the lot is temporary overflow parking for Discovery Park. Use of the lot and access to it will be discontinued when the temporary pennit expires. Staff anticipates that the number of users will diminish after the initial surge associated with the skate park opening. If additional permanent off-street parking is required, the Community Development and Parks and Recreation staff will collaborate to identify a long term solution. One option may be an amendment to the planned development to expand the existing parking lot. Code Anal ysis—Chapter 26 While an off-street parking area is a permitted use on the subject property, section 26-501.E.5 of the city code requires that all areas subject to wheeled traffic for parking be surfaced with concrete, asphalt, or brick pavers. Because the applicant is proposing a parking lot that does not meet these surfacing requirements, the only relief available is to seek a temporary permit. If granted, the pen would temporarily allow the unpaved parking area which is not otherwise permitted. The applicant may request up to two (2) renewals of a one -month temporary permit, thereby extending the use for no more than a total 90 days, Public NotVication During the public notification period one phone call was received regarding the temporary permit request. A neighborhood stated that she supported the request for the temporary parking area. No additional comments were received. 111. FINDINGS OF FACT In order to approve a 30-day temporary permit, the Community Development Director must determine that the request is in substantial compliance with the "findings of fact" listed in Section 26-115.D.4. Staff provides the following comments regarding the findings of fact. 1 The proposed temporary use will not have a detrimental effect upon the general health, welfare, safetN and convenience of persons residing or -working in the neighborhood of the proposed use. The temporary parking lot is not expected to have a detrimental effect upon the general health, welfare, safety and convenience of persons in the surrounding area. The intent of the parking area is to minimize the impact to the neighborhood that may be caused by increased park visitors this summer. 2. The proposed temporary use will not adversely affect the adequate light and air, nor cause significant air, water or noise pollution, or cause drainage problems for the general area. The temporary parking lot is not expected to adversely affect the adequate light and air, nor cause significant air, water or noise pollution, or cause drainage problems for the general area. 4. The proposed temporary use will be appropriately designed, including setbacks, heights, parking, bulk, buffering, screening and landscaping, so as to be in harmony and compatible with character of the surrounding areas and neighborhood, especially with adjacent properties. The proposed parking area is appropriately designed so as to be compatible with the character of the area. While no additional landscaping or screening is proposed, the intent of the parking area is to protect the character of the surrounding neighborhood by accommodating vehicles that may otherwise park on the streets throughout the area. 5. The proposed temporary use will not overburden the capacities of the existing streets, utilities, parks, schools, and other public facilities and services. Tile proposed parking area will have no impact on the capacity of streets, utilities, parks, schools, and other public facilities and services. In fact, the parking area is intended to ensure that existing streets are not overburdened by park visitors. IV. STAFF CONCLUSIONS AND RECOMMENDATIONS Having found the application in compliance with the findings of fact, staff recommends APPROVAL of a 30-day temporary pen-nit to allow a temporary parking lot on property at approximately 3751 Johnson Street (Lot 3, 38"' & Kipling Park Subdivision) and zoned Planned Commercial Development (PCD). Work may commence to install the improvements as of the date noted below; however the starting date of the 30 -day temporary permit shall be the first day the parking lot is open for general public use. The amenities contained within the park include several playground areas, a water splash pad, a picnic pavilion that can serve up to groups of 100, a grass playfield and soon to be completed 12,000 square foot skate park. NO PARKING signs have been installed on the east side of Johnson Street due to the location of the playground and the number of park users parking on the street. On street parking exists along Johnson Street on the west side to accommodate park users. Due to the heavy user response to the park and the soon to be completed skate park, the current parking lot located in Discovery Park (approx 49 spaces) combined with the on street parking is not projected to be large enough to accommodate the park user demand for parking. I am requesting a temporary use permit to construct a temporary parking lot of 24 spaces to accommodate this projected demand. One of the alternative areas for parking, if the demand meets projections is for park visitors to use the on street parking in the neighborhood to the east of the park. Generally, in other park locations this solution has not proven to be a well received solution by the residents affected. An analysis of the parking needs will be completed at the end of the summer season. A long term solution will be made at that time in response to the use at the temporary lot.
