HomeMy WebLinkAboutZOA-12-04COUNCIL BILL NO. 21 ORDINANCE NO. 152 Series • 2012 TITLE: AN ORDINANCE AMENDING CHAPTER 26 CONCERNING THE CREATION OF AN INDUSTRIAL-EMPLOYMENT ZONE DISTRICT WHEREAS, in the exercise of that authority, the City Council of the City of Wheat Ridge has previously enacted Chapter • • the Wheat Ridge Code of Laws (the "Code") pertaining to zoning, land use, and development; and 'IZ"HEREAS, the City's Comprehensive Plan, Envision Wheat Ridge, recommends that the City amend the Code to update the Light Industrial (1) zone district and to develop a zone district that promotes employment uses; and WHEREAS, the City wishes to amend the Code to create an Industrial- Employment zone district that will accomplish the goals in the Comprehensive Plan. RNMM-1 The proposed ordinance addresses the recommendations in Envision Wheat Ridge by modifying the current Light-Industrial (1) zone district into a combined Industrial-Employment (I-E) zone district. The modifications would address all of the recommendations in the comprehensive plan mentioned above, including the addition of modem uses and ensuring that a wide range of employment uses (light ZOA- 1 2-04/ Industrial-Employment Zoning I manufacturing, flex space, office, and office services) are allowed. This is preferable to creating a new Employment (E) zone district since most of the employment uses recommended by Envision Wheat Ridge are already included in the I zone district and because there would need to be large rezonings to apply the E zone district in employment areas. By updating the current I zone district and renaming it I- E, all properties zoned I would become I-E without requiring a City-initiated rezoning. Overview of Proposed Changes The proposed changes to the I zone district are summarized below. The attached document shows a draft of the proposed changes to the code. New language in the proposed ordinance is bold, capitalized and highlighted. Deleted language is designated by strike- through and highlighting. Staff recommends adoption of these changes since they are recommended in Envision Wheat Ridge and will create a more modern and appropriate industrial zoning option. The only substantive comment that came up was concern that the existing side and rear yard setback requirements where not high enough where adjacent to residential. The current code reads: (1) Side yards "Where a side yard abuts property zoned residential, or where zoned agricultural and there is a residential structure within fifteen (15) feet of the commercial property, a five-foot-per-story landscape buffer meeting the requirements of section 26- 502E. (landscape buffering for parking lots), shall be required," (2) Rear yards: "Where a rear yard abuts property zoned residential, or where zoned agricultural and there is a residential structure within fifteen (15) feet of the commercial property, a five-foot-per-story landscaped buffer meeting the requirements of section 26- 502E. (landscape buffering for parking lots), shall be required." Planning Commissioners said that the minimum five-foot buffer does not seem enough for permitted uses. They did agree that we could remove the automatic increased setbacks for special uses, which are currently 25 feet for side setbacks and 20 feet for rear setbacks, as long as there is language allowing staff to require greater setbacks where needed (and especially where adjacent to residential). These proposed changes are shown in the attached draft changes to the I zone district description and development standards (Section 26-220). Sec. 26 -220. - U9M Industrial EMPLOYMENT District (I -E). A Intent and purpose. Principal permitted and accessory uses: Ten (10) feet for a one -story building and an additional five (5) feet per each additional story thereafter, except as follows: (1) Any rear yard which abuts a public street shall have a minimum setback of fifteen TEN (10) feet for all structures. (2) Any rear yard which abuts a public alley shall have a minimum setback for all structures of five (5) feet from the edge of the alley. (3) Where a rear yard abuts property zoned residential, or where zoned agricultural and there is a residential structure within fifteen (15) feet of the commercial property, a five - foot - per -story landscaped buffer meeting the requirements of section 26 -502E. (landscape buffering for parking lots), shall be required. b. Special uses: The minimum depth of a rear yard shall be twenty (20) feet except as follows: (1) Thirty (30) feet where adjacent to a dedicated public street. (2) Seventy -five (75) feet where a side yard abuts property zoned residential, or where zoned agricultural and there is a residential structure within twenty -five (25) feet of the industrial property. There shall be a six - foot -high solid decorative wall or fence and ten (10) feet of landscaping adjacent to the property line. (3) Where a rear yard abuts a railroad right -of -way, no rear yard setback shall be required. 8. Parking requirements. See section 26 -501 9. Landscape requirements. See section 26 -502 10.
