Conditions of approval for the SUP included the following: 1. The special use permit shall be prescribed to the property and may be inherited. 2. The dumpster in the northwest comer, which is currently screened on the west and south sides, shall be screened on all four sides so that it is not visible to any adjacent residential property. 3. The applicant shall construct a 6' tall privacy fence where the northwest portion of the property abuts residential uses. This shall include the 128' of property line running east-west adjacent to the single- family home to the north and the 101' of property line running north-south adjacent to the multi- family residence to the northeast. 4. In order to demonstrate compliance with conditions number 2 and 3, the applicant shall submit a site plan drawing and elevation drawing showing the fence and dumpster screening to the Community Development Department by April 15, 2013, which shall be reviewed by staff and, upon approval, be placed on file with the SUP -1 2 -02 case file to demonstrate completion of the SUP requirements. The fence and dumpster screening shall be constructed no later than May 31, 2013. 5. The site shall be improved in compliance with the Site Plan in Exhibit 4, which includes the installation of a 6-foot landscape buffer with street trees and an irrigation system. This will require issuance of a right-of-way pennit from Public Works since the landscaping and irrigation will be in the Ingalls Street right-o-way. The applicant shall apply for the right-of-way permit no later than April 15, 2013 and the work shall be completed no later than May 31, 2013. 6. No vehicles may drive or be parked on the unimproved surface area. 7. The maximum number of rental trucks on the property will be eight, to be parked in the spaces shown on Exhibit 5, Site plan. 8. The special use permit shall comply with all material representations, commitments and operation restrictions as depicted in the application materials and documents maintained in the case file in the Community Development department On July 12, 2013, a site check was performed to evaluate compliance with the conditions of approval for the SUP. • Condition #2: The dumpster in the northwest comer of the site is screened from all sides with a 6' high solid wooden fence. • Condition #3: A 6' high solid wood privacy fence has been built along the north and east property lines to provide screening for adjacent residential development. • Condition #6: It appears that parking is occurring in the fenced area to the northwest on areas where concrete was put down. www.d.wheatridge.coms • Condition #7: Eight rental trucks were parked on the eastern side of the building in accordance with this condition. I. REQUEST Case No. SUP -12 -02 is an application by Spectrum Inc., care of Shawn Kordouni, requesting approval of an administrative Special Use Permit to allow a truck rental facility on property zoned Commercial -One (C -1). Under the C -1 zoning, automobile and light -duty truck sales and rental are a special use, which means that a Special Use Permit (SUP) must be obtained in order for this use to be permitted at this property. Pursuant to Ordinance No. 1291, the Community Development Director has the ability to decide upon applications for administrative special use approval, without a public hearing, provided the following conditions have been met: 1. A completed application package has been submitted and fee paid. 2. The Community Development Department has notified adjacent property owners by letter and the site has been posted for at least ten (10) days. 3. No written objections have been received in such ten day period. 4. The Community Development Director concludes that the criteria for approval, as set forth below, are substantially complied with and support the request. The Community Development Director can impose conditions or stipulations upon the approval, which may include physical design, operational, and maintenance considerations to ensure compliance with the criteria for review. The Community Development Director shall also decide the following: 1. Whether the SUP runs with the land in perpetuity; 2. Whether the SUP is personal to the applicant and may or may not be inherited; and/or, 3. Whether the SUP is granted only for a defined period, after which time the special use shall expire unless renewed subject to all of the requirements of this section. II. CASE ANALYSIS The applicant is requesting the Special Use Permit to allow a truck rental business at 6065 W. 48` Avenue Exhibit 1, Aerial Map). The property, about 0.9 acres in size, is adjacent to the I -70 and Harlan Street interchange. It is bounded by Harlan Street on the east, Ingalls Street on the west, W. 48` Avenue on the south, and multi - family and single - family residential uses to the north. The property is on the boundary of the City, which falls along the center of Harlan Street. The property is zoned C -1, a commercial district established to provide for areas with a wide range of commercial land uses which include office, general business, and retail sales and service establishments. The zoning surrounding the property is C -1 to the east and northeast, with R -1 B bordering the site to the northwest. The interstate right -of -way is zoned A -1, with PCD zoning south of the highway �EExhibit 2, Zoning Map). Case No. SUP -12 -02 /Spectrum Inc. 2 There is a mix of surrounding uses in the area. Immediately to the north is a multi - family property, zoned C -1, and a single - family home, zoned R -1B. Further to the north is a residential neighborhood with single -and two- family homes, zoned R -2 and R -3. To the west of the site, across Ingalls Street, is a large unimproved lot with a small home that has been converted to a commercial use. Further to the west are other commercial uses, including a mini - storage facility. The property immediately east of the site, on the east side of Harlan, is a vacant commercial property in the City of Denver. The property in question contains a single -story commercial structure with a gas station and car repair garage. According to City of Wheat Ridge building permit files, the property was developed in 1970 as a Texaco gas station and car repair facility. Although the ownership has changed, the use of the property as a gas station with car repair garage has remained the same since 1970. There are some landscaped islands on the perimeter of the site along Harlan Street and W. 48` Avenue (Exhibit 3, Site Photos). The site also contains a dumpster in the northwest corner, which has recently been screened, and two small sheds located in the rear of the main building. There are vehicular access points on all streets that border the site. The applicant is requesting permission to operate a truck rental company on -site. The proposal is to allow up to eight rental trucks to be parked on the site at a time, with a small rental office inside the existing gas station/car repair building. No new construction is proposed. As part of the proposal, the applicant will construct a 6 -foot landscaped buffer just west of the property line to buffer the parking area from Ingalls Street (Exhibit 4, Site Plan). The western half of the property will be utilized for the parking of cars to be repaired (13 parking spaces), as well as customer and employee parking (eight parking spaces). The trucks to be rented are proposed to be parked on the east side of the property, along the northern edge. There are eight parking spaces reserved for the trucks and this aisle of parking is screened from the Harlan Street right - of -way by a 10 -foot landscaped island. The site also contains an unimproved area in the northwest corner. Per the City's code of laws, unpaved surfaces may not be used for any type of vehicular traffic or storage. The applicant recently paved a small portion of this area, immediately north of the service station, to allow for three parking spaces for cars waiting for repair. The remainder of the area will remain unpaved and unused. III. NEIGHBORHOOD MEETING Prior to submittal of an application for a special use, the applicant is required to hold a neighborhood meeting in accordance with the requirements set in City Code, Section 26 -109A. A meeting for neighborhood input was held on June 30, 2010 in accordance with Section 26- 109A. One resident, who lives at 4885 Gray Street in Denver, attended the meeting and expressed support for the application. The required 10 -day noticing period for an administrative SUP was conducted from December 13` to December 24` 2012. During this time, staff received two phone calls of inquiry and one written letter. The letter was from the owner of 4830 Ingalls Street, the single - family home Case No. SUP -12 -02 /Spectrum Inc. immediately north of the site (Exhibit S, Letter from 4830 Ingalls St). The letter requested that any permit for the site include stipulations to screen it from the residential use to the north. IV. AGENCY REFERRAL All affected service agencies were contacted regarding the ability to serve the property. Public Works responded with recommendations to pave a portion of the unimproved area north of the main building for existing vehicular access and to consolidate the access points along Ingalls. The applicant has made these changes and they are shown on the site plan. Economic Development requested that the SUP not be approved until back taxes on the truck rental business were submitted to the City. Since that time, the Sales Tax Division confirmed that the applicant has been remitting sales tax monthly for the truck rental business since it began operation and no back taxes are owed. All other affected agencies either did not respond or stated that they have the ability to serve the property. V. SPECIAL USE PERMIT CRITERIA Staff has the following criteria to evaluate special use permit requests and shall determine that the majority of the "criteria for review" listed in Section 26 -114.13 of the City Code have been met. The applicant has provided their analysis of the applications compliance with the Special Use criteria (Exhibit 6, Applicant Response to Criteria). Staff provides the following review and analysis of the special use criteria: 1. The special use will not have a detrimental effect upon the general health, welfare, safety and convenience of persons residing or working in the neighborhood. The proposed special use will not affect the health or welfare of any person working or residing in the area. The proposed use will not negatively affect the safety and convenience of people living and working in the area. The property currently has a gas station and auto repair use and the addition of rental trucks should not negatively impact the safety or general health of the area. Staff finds this criterion has been met. 2. The special use will not create or contribute to blight in the neighborhood by virtue of physical or operational characteristics. The proposed truck rental business will not create or increase blight in the area. The proposal includes site improvements that will improve the look of the property. By adding a landscaped buffer along Ingalls Street, the applicant will bring the property into better conformance with the City's code and will provide a visual buffer between Case No. SUP -12-02 /Spectrum Inc. 4 the western parking area and the Ingalls Street right -of -way. In order to diminish negative visual impacts on the residential uses to the north, staff is recommending that the SUP be conditioned upon full screening of the on -site dumpster and the construction of a 6 -foot privacy fence where the western half of the abuts residential uses. Staff finds this criterion has been met. 3. The special use will not create adverse impacts greater than allowed under existing zoning for the property. Staff has not identified any adverse impacts greater than those allowed under the existing zoning, especially because there is no new development. The truck rental use should not have any impact on the light, air, or water to the adjacent properties. Staff finds this criterion has been met. 4. The special use will not result in undue traffic congestion or traffic hazards, or unsafe parking, loading, service or internal traffic conflicts to the detriment of persons whether on or off the site. The use will not create undue traffic congestion or hazards. Because of the existing auto repair and gas station on the site, there is the potential for some internal, on -site conflicts with traffic and parking. The applicant has addressed this by proposing designated parking stalls for various uses on the site (employee parking, parking spots for cars to be repaired, and parking spots for the rental trucks). Public Works reviewed the application and did not have any concerns about traffic congestion. Staff finds this criterion has been met. 5. The property is appropriately designed, including setbacks, heights, parking, bulk, buffering, screening and landscaping, so as to be in harmony and compatible with the character of the surrounding areas and neighborhood, especially with adjacent properties. The property is already developed and is generally compatible with the surrounding area, which abuts a highway interchange. The current site design was approved with the original building permit, issued in 1970 for a gas station and auto service shop. Because the use has not changed and there has been no development since that time, the property has not been improved to meet the current requirements for buffering and landscaping within the C -1 zone district. The roperty does have some landscaped buffers along Harlan Street and W. 48` Avenue. The addition of the landscape buffer along Ingalls street will improve the quality of the property and make it more conforming with the landscape and screening requirements in the current code. Staff is also recommending a condition to require full screening of the dumpster and a 6 -foot privacy fence along the northwest property line so that the site is more compatible with the residential neighborhood to the north. Case No. SUP -12 -02 /Spectrum Inc. 5 The character and design of the property is very consistent with the other commercial properties in this neighborhood. Staff finds this criterion has been met. 6. The special use will not over burden the capacities of the existing streets, utilities, parks, schools, and other public facilities and services. Parks, schools and other public facilities will not be negatively impacted since the proposed use will not have an effect on the number of residents or workers in the area. Because there is no expansion of the building, no utility upgrades should be required. The existing streets have the capacity to handle the minimal additional traffic that would be generated by a maximum of eight rental trucks. Staff finds this criterion has been met. 7. There is a history of compliance by the applicant and/or property owner with Code requirements and prior conditions, if any, regarding the subject property. This property has a history of code compliance issues. The applicant began operation of the truck rental business before receiving an SUP and originally parked the rental trucks on the unimproved area in the northwest corner of the property. The site also had weeds, an unscreened dumpster, and an illegal accessory structure in 2012. In recent months, the applicant/owner has been cooperative in addressing and removing these code violations. They have demonstrated a willingness to comply with City code and maintain a quality property. Part of the purpose of this SUP is to set conditions for operation of the property and to ensure that the property remains in compliance in the future. Staff finds this criterion has not been met. 8. The application is in substantial compliance with the applicable standards set forth in the Architectural and Site Design Manual. The Architectural and Site Design Manual applies to all new construction except single and two family residential structures and those existing structures undergoing major additions. No new buildings or additions are being proposed for this site. Staff finds this criterion is not applicable. VI. STAFF RECOMMENDATIONS /FINDINGS OF FACT Having found the application for Case No. SUP 12 -02 /Spectrum Inc., a Special Use Permit to allow a truck rental facility on property zoned C -1, to be complete and in compliance with the majority of the applicable review criteria, staff is granting APPROVAL of the special use request based on the following findings of fact: Case No. SUP -12 -02 /Spectrum Inc. 6 1. This request for an administrative Special Use Permit meets all applicable conditions as required by Section 26 -114 of the City of Wheat Ridge Code of Laws. 2. There will be no detrimental effect on health, safety, welfare, or convenience to the public in the area. 3. The special use will not create adverse impacts greater than allowed under existing zoning for the property. 4. There will be no impact on the light, air, or water to adjacent property owners. 5. The special use will not create or contribute to blight in the neighborhood and will not over burden the capacities of the existing streets, parks, schools, and other public facilities and services. 6. Although the property has had code violations in the past, the applicant has recently cooperated with the City to remove these violations. 7. No formal objections were received during the 10 -day noticing/comment period. With the following conditions: 1. The special use permit shall be prescribed to the property and may be inherited. 2. There are no parks or schools around our facility. 7) We strive to be in compliance with all and any rules and regulation and Spectrum Inc. has always been cooperative and wants to maintain a positive relationship with the city and county and serve our community to best of our ability. 8) Truck rental business has sufficient transparency and is in substantial compliance with all standard and has no negative impact on any architectural and the design of the current site. She said it is in bad shape and she would like the city to require the tenants of the property to replace it with a privacy fence. She said they should do so to separate commercial from residential. Zoning regulates what land uses are allowed and establishes rules for how property can be developed. There are many different zone districts within the City including residential, commercial and industrial. Each zone district lists both permitted uses and special uses. Permitted uses are allowed uses "by right'. Special uses are land uses that may or may not be compatible with the surrounding neighborhood and require a special review to ensure there will be minimal impact. The special use permit (SUP) process is the process by which a proposed special use is reviewed and approved. Factors under consideration for review of a special use can include design of the property, operation of the special use and whether there is a void in services in the neighborhood that the special use will fill. Special Use Permits have the ability to be approved to: • Run with the land in perpetuity. o Allows the use to be permanently permitted on the property. • Be granted to the owner or specific user of the property. • The Special Use Permit expires at the change of ownership or tenants • If granted to a property owner, ability of the special use has the ability to be inherited by the tenants. • A specific amount of time after which the use would expire. STEPS IN THE SPECIAL USE PERMIT PROCESS All Special Use Permit applications BEGIN as an administrative process. This means that every Special Use starts without the requirement of having any public hearings before City Council or other board. However, a City Council hearing may be required. Read the process guide below for further information. Prior to application for an SUP, the applicant will need to schedule a pre - application meeting. Staff has initiated this meeting as a means of reviewing the proposal and to provide input on the amendment process and requirements. There is a $200 fee for the pre - application meeting. After the pre - application meeting, but prior to application, the applicant will need to hold an informal neighborhood meeting. The purpose of the meeting is to provide the opportunity for citizens to become aware of the proposed use in their neighborhood, and to allow the applicant to respond to citizen concerns regarding the proposed project. All residents and property owners within 600 feet will need to be notified of the meeting. Staff will provide the applicant with the notification list of all properties and property owners within the 600 foot radius. It will be the responsibility of the applicant to coordinate with staff to notify area residents of the date, time, and location of the meeting. There is a $100 fee for the neighborhood meeting. Special Use Permits A staff planner will attend the meeting to discuss City policy and regulations, and the process involved; however, the planner will remain impartial regarding viability of the project. SUBMITTAL REQUIREMENTS Once the neighborhood meeting is held, a formal application may be submitted. A special use permit application must include the following items: A. Completed Land Use Case Application including an explanation of the request. B. Proof of ownership (i.e., copy of deed). C. A certified survey of the property. E. A legal description of the property. F. Mineral rights certification form. G. Responses to the Special Use Permit criteria. H. A "to scale" site development plan for the property (if required). I. Fees: Administrative Application Fee with Site Plan $300 + $300 /acre Application Fee without Site Plan $200 Non - administrative - Hearing Required " Processing Fee $200 Publication /Public Notice Fee $240 "`If a special use permit receives a denial at the administrative stage, the initial processing fee paid will be credited to the fees required at the public hearing stage. THE APPLICATION WILL NOT BE ACCEPTED UNLESS ALL SUBMITTAL REQUIREMENTS ARE MET. STAFF WILL BE UNABLE TO ACCEPT THE APPLICATION UNTIL IT IS COMPLETE. SUBMITTAL REVIEW When the application is submitted, a staff planner will be assigned to handle the case. This person is the project manager for the case and will be the contact at the City throughout the entire SUP process. The case manager will review the submittal application for content. If all submittal requirements have been met, the proposal will be referred to outside service agencies (Xcel Energy, water district, fire district, etc.) and other City agencies (Public Works, Economic Development, etc.) for their review and comment, generally for a period of 15 days. After all comments have been received, the case manager will forward those to the applicant. Note: Modifications to the Special Use Permit application may be required as a result of these comments. PROCESS FOR ADMINISTRATIVE APPROVAL If the application does not require a referral to other departments or after comments by the referral agencies have sufficiently been addressed, a neighborhood notification and 10 -day property posting period is required. The posting and notification inform the surrounding neighborhood of the request. Special Use Permits The Community Development Department will prepare a sign that must be placed on the property by the applicant. In addition to the sign being posted, the Community Development Department will simultaneously notify adjacent property owners of the request. During the 10- day posting and notification any person may submit objections, concerns or comments in writing to the Community Development Department. If no written objections to the SUP request are received during this 10 day period, the Community Development Director can take action on the SUP application without requiring a Public Hearing before City Council. The Community Development Director can approve, approve with conditions, or deny the SUP. Conditions of approval may be placed upon the SUP to ensure that the special use will have a minimal impact on the surrounding area. If the SUP is denied by the Community Development Director, the applicant may appeal the decision to the City Council. Upon receipt of a written objection, the SUP request will be heard by the City Council through a public hearing process. Any written objections received during the 10 -day posting must be directly related to the Special Use request. Objections regarding existing land use conditions or issues not related to the request will not be considered a valid reason for objection. A public hearing would also be required upon the appeal by an applicant of a decision by the Community Development Director CITY COUNCIL HEARING Fifteen days prior to the hearing the Community Development Department will prepare the sign that must be placed on the property by the applicant informing citizens of the public hearing. The sign must remain in place until 5:OOp.m. the day of the hearing. In addition to the sign being posted, the Community Development Department will simultaneously notify property owners within a 300 foot radius of the hearing by certified letter. At the hearing, a staff report will be presented to the City Council by the case manager. After the staff report is presented, the applicant and members of the audience will be given a chance to give testimony regarding the application. The City Council can approve, approve with conditions, or deny the SUP. NEXT STEPS Depending on the nature of your special use approval, you may need to proceed with building permit applications. A decision of approval by the Community Development Director or City Council relates only to the use of the property. There may be other city departments or outside agencies which may need to be addressed once the special use is granted. Please be aware that this information is only a general overview of the process and submittal requirements for the Special Use Permit Process. There may be additional requirements specific to each case and the overall length of the process can vary greatly depending on the circumstances of the case.
