When the property was rezoned, staff thought it prudent to require a platting document to graphically designate the boundaries of the two zonings which bifurcated the property. The applicant agreed to these conditions. Conditions placed on the zone change approval were the following: It was not the intent of the recommended conditions to process a plat for development as construction on the property was not imminent, nor was there a specific development proposal. Case No. MS -11 -04 was the attempt by the applicant for preparation of the zoning document to fill the requirement of #2 above. The attached, recorded document does not define two lots for individual sale, nor does it dedicate right-of-way. Upon a specific development scenario, a plat will be required to be processed which meets all of the requirements of the subdivision regulations. We agreed to do that. I believe it can be done as follows: 1, We will provide a scaled drawing with legal descriptions of the two zoned areas. The City can use this document to revise the City's Zoning Map. This should meet the condition of the rezoning. 2. The drawing, as described above, could be recorded. In light of recent requests by the City, we could add a note, stating the obvious, that upon redevelopment of the property, all City requirements related to platting and subdividing will be adhered to. This too will meet the condition of the rezoning. I am not sure where the request to provide a zone document for the purposes of describing a zone boundary got expanded to include a subdivision of the property complete with a subdivision agreement. Clearly, this is in excess of our intentions and abilities at this time. We request that Mr. Sach not be held to these requirements.
