been great.People are stopping in asking who we are and say it's nice to have car guys in the local area to be able come
ask questions etc.The large dealers have become cold and layered to the point that you need to make an appointment
just have somebody poke there head under the hood for 2 seconds.When remodeling I took in account the neighbors to
the south side and added foam noise pads to the interior south wall and also put in it 15 ft. maple bushes to act as a
buffer.As far as I know there have been no complaints and only positive feed back from the people around us.

All application requirements have been met; therefore, there is jurisdiction to make an administrative
decision for this Conditional Use Permit request.
I. REQUEST
Case No. CUP -13 -01 is an application by Steven Pelletier requesting approval of a Conditional Use
Permit to allow an auto restoration business on property zoned Mixed Use - Neighborhood (MU -N) and
located at 6700 W. 44` Avenue (Exhibit 1, Aerial).
The MU -N zone district allows for the repair, rental and servicing of automobiles (with no outdoor
storage) as a Conditional Use. Pursuant to Section 26 -1118 of the Code of Laws, the Community
Development Director has the ability to decide upon applications for Conditional Use Permits without
a public hearing, provided the following conditions are met:
1. A pre - application meeting has been held with the applicant and City staff.
2. A completed application package has been submitted and fee paid.
3. The proposed application has been through the City's standard agency referral process.
4. The Community Development Director concludes that the criteria for approval, as set forth
below, are substantially complied with and support the request.
The Community Development Director can impose conditions or stipulations upon the approval, which
may include physical design, operational, and maintenance considerations to ensure compliance with
the criteria for review.
II. EXISTING CONDITIONS
Subject Property
The property is located at 6700 W. 40 Avenue which is in the northeast quadrant of the City, between
Pierce and Otis Streets. The property was recently rezoned to Mixed Use - Neighborhood (per Case No.
WZ- 13 -01), and it is surrounded by a variety of land uses and zoning. To the north, east, and west are
properties zoned Restricted Commercial (RC) including a cigar shop, a nonconforming self -serve car
wash, and a multi -tenant commercial building. Immediately to the south is a residential neighborhood
zoned Residential -Two (R -2) (Exhibit 2, Zoning Map).
The subject property is comprised of Lot 22 of Lillian's 0 Addition Subdivision and Lot 21 of Lionel
Subdivision. Based on Jefferson County Assessor records, the total size of the property is 44,678
square feet (1.03 acres). The existing building spans both lots and was originally constructed in 1979.
Currently, the west side of the property is used for professional offices; and the east side of the
building is a warehouse space which the applicant is proposing to use for the auto restoration business.
The two use areas are connected by an enclosed hallway.
The property has frontage on three public streets: Otis, Pierce and W. 44` Avenue. Separate parking
lots on the east and west sides of the property serve each use area. The remainder of the parcel is
landscaped '(Exhibit 3, Site Photos).

HL CASE ANALYSIS
The applicant has purchased the property and is proposing to relocate his automotive restoration
business, Cameros Plus, in the east side of the subject property and building
The business is currently located in Arvada, but the applicant is seeking more'spac'e to
provide additional indoor storage. The business specializes in locating and providing specialty parts
for restoring early American cars and Camaros, Full vehicle restorations make up only a small portion
of the business; the applicant completes about 5 to 6 high end full restorations per year. The business
includes up to four employees (including the applicant), and there is no intent to expand.
While restoration does entail painting and installation of parts, the business is not based on providing
traditional auto repair and maintenance. Higher intensity uses associated with the business typically
occur off-site. For required maintenance or motorwork, the applicant sends vehicles to a traditional
auto repair shop. The applicant's inoperable vehicles and outdoor storage areas are located on an
industrially-zoned lot in Arvada,
A tenant finish will be required to accommodate the new business and the indoor functions. The
applicant is seeking to occupy about 9,000 square feet in the eastern part of the building. A retail
component and paint booth will be located on the north side of the building, a work area will be in the
middle, and indoor storage would be located in the southern portion of the warehouse

At this time, no new development is proposed on the site. The applicant had submitted a request for a
fence height variance to allow an 8•foot fence along the southern property line; that request has been
withdrawn. Instead of a taller fence, new landscaping has been proposed to achieve a buffering effect
for the neighbor to the south. Because of overhead utility lines, staff has recommended that plants be
more centered between the building and fence and that the species selected have a mature height of 20
feet or less
IV. CRITERIA FOR REVIEW
The Community Development Director shall use the following criteria from Section 26-1118 to
evaluate each application for a Conditional Use Permit. Staff provides the following review and
analysis of the CUP criteria.
A. The compatibility of the proposed use with the Comprehensive Plan.
West 44 Avenue is a primary east-west thoroughfare in the City which is classified as a minor
arterial and is commercial in character. The City's comprehensive plan, Envision neat Ridge,
identifies the roadway as a Neighborhood Commercial Corridor which is envisioned as a small-
scale, pedestrian-triendly, mixed-use corridor.

Staff finds this criterion has been met.
B. The compatibility of the proposed use with existing and proposed adjacent uses in terms of
scale, site design, and operating characteristics (including traffic generation, lighting, noise
and hours of operation).
The proposed use is compatible with the adjacent land uses. As stated above, there is no new
development being proposed, so site and building design will remain unchanged. Any lighting
fixtures installed in the future would need to comply with city code and be downcast to reduce the
spillover of light onto adjacent properties.
Hours of operation are proposed to be compatible with other commercial service and retail uses.
Although hours vary slightly, the applicant has expressed that a typical schedule is usually about
7:00 am. to 5:00 p.m., so most noise and activity will be generated during the day. In the MU-N
zone district, auto repair functions are not permitted to include outside storage.
Staff finds this criterion has been met.
C. The ability to mitigate adverse and undesirable impacts to the surrounding areas including
but not limited to visual impacts, air emissions, vibrations, gjare, heat, odors, water
pollution, and other nuisance effects.
The proposed use is not anticipated to produce undesirable impacts such as noise, glare, pollution
or odors. The applicant is proposing to install a paint booth, but noise and odor nuisance has been
reduced by modem technology. Additionally, the paint booth is proposed to be located at the
north side of the building away from the residential neighbors to the south.
Because the business is not based on providing traditional auto repair and maintenance, impacts
related to noise and vibration are limited. Major auto repairs occur off-site. In additional to the
existing privacy fence, an enhanced landscape buffer is proposed along the southern property line
to help to screen the use from adjacent residences.
Staff finds this criterion has been met.

D. The amount of traffic generated and capacity and design of roadways to handle anticipated
traffic.
The proposed use is not expected to generate significantly more traffic than already exists on the
adjacent streets. The capacity and design of existing roadways can serve the proposed business.
Staff finds this criterion has been met.

As mentioned above, most improvements to the site will be associated with an interior remodel.
Exterior improvements are proposed to include enhanced landscaping along the southern property
line. A conceptual landscape plan was included with the application, and staff is recommending a
condition related to landscaping to ensure all adequate buffer between the proposed use and the
residential properties to the south.
Staff finds this criterion has been met.
All affected service agencies were contacted for comment on the zone change request and regarding
the ability to serve the property. Specific referral responses follow:

Wheat Ridge Police: No concerns.
Wheat Ridge Economic Development: No concerns, supportive of the proposed use.
Xcel Energy: No objections, contingent upon maintaining all existing rights and ability for future
expansion.
Wheat Ridge Fire District: No objections, Fire Department permits may be required in
association with the interior remodel.
Wheat Ridge Sanitation District: No objections; the applicant has been notified that the district
may require sanitary pretreatment facilities (such as an oil/sand separator) depending on proposed
business operations.
No comment was received from the water district or Building Division; the applicant has been in direct
contact with the fire district and Building Division regarding the proposed use.
Having found the application for Case No. CUP- 13-01 / Carnaros Plus - a Conditional Use Pennit to
allow an auto restoration business in the Mixed Use-Neighborhood (MU-N) zone district—to be

Business Description
We are requesting the CUP to solidify the purchase and relocation of Camaros Plus, an automotive
restoration business, to the City of Wheat Ridge. Our business specializes in sourcing and selling
specialty parts for early American cars focusing • primarily • Camaros. We do full restorations that
are very labor intensive and complete only up to 8 in one year. Although our business does require
painting and a paint booth, it is not the primary focus of our business.
Exterior Changes
There will be no major changes to the exterior of the buildings. We will be doing a general cleanup of
the vines that are attached and growing up the side of both buildings. The buildings themselves appear
to be in good condition so as of now we intend to just re-paint the exterior with a more neutral color. We
will be installing new garage doors in the existing openings on the East side of the building but leaving
the West building primarily as it is, until occupied.
Interior Changes
In the East building we intend to remove the majority of the interior walls to facilitate additional storage
2nd retail space. The mechanical room and bathrooms will remain in the same location for ease and
cost effectiveness, The front, South and West sides of the building will see no changes as we plan on
using the existing front entrances and existing doors. Please see attached proposed floor plan for a
more detailed visual view, We will also rehab and intend to rent the West building for single tenant or
multi-tenant office. Those changes are still unknown until we are more familiar with who will be
occupying the space.

I included some upright Junipers although his neighbors didn't want any conifers.
Shrubs will be less costly than trees
Labels will need to be read in the nursery to know the variety purchased will obtain the characteristics desired
• Some species will be less costly
• Most • these listed are drought tolerant but will need water to establish them for a few years and then water
during drier periods possibly even in winter
• I left most fruit bearing varieties off - mess and clean up- seemed to be a concern

We are requesting the CUP to solidify our the purchase and relocation of Cameros Plus,
an automotive restoration business, to the City of Wheat Ridge. Our business special-
izes in sourcing and selling speciality parts for early American car's focusing on primarily
on Cameros. We do full restorations that are very labor intensive and complete only up
to 8 in one year. Although our business does require painting and a paint booth, it is not
the primary focus of our business.
Exterior Changes
There will be no major changes to the exterior of the buildings. W e will be doing a gen-
eral cleanup o f the vines that a r e attached and growing up the side of both buildings.
The buildings themselves appear to be In good condition so as of now we intend to
just re-paint the exterior with a more neutral color. We will be installing new garage
doors in the existing openings on the East side of the building but leaving the West
building primarily as it is, until occupied.
Interior Changes
In the East building we intend to remove the majority of the interior walls to facilitate ad-
