June 6, 2007 Rolly Sorrentino 4175 Teller Street Wheat Ridge, CO 80033 Dear Mr. Sorrentino This letter is in regard to your request for information regarding vacant property located directly south of your property at 4175 Teller Street. Pursuant to Section 26-120B of the zoning and development codes nonconforming regulations, a vacant non - conforming lot of record can be issued a building permit for construction of a single family residence provided that the lot is in separate ownership and not of continuous frontage with other lots under the same ownership. All zoning standards for setbacks and lot coverage would have to be met with the new construction. A permit for single family construction would be issued for the adjacent parcel with the following required improvements: • Extension of and connection to public water set-vice. • Extension of and connection to public sanitary sewer service. • Extension of the existing curb and gutter and street on the west side of Teller to the property frontage. • Execution of a maintenance agreement with Public Works obligating the property owner to maintain the road way. • Installation of a 10' wide hard surfaced driveway into the property. • Fire access as recommended by the Wheat Ridge Fire Protection District. Other items to be aware of: The front building setback would be 30' from the north side as public street access is from the north. Side setbacks (east and west) would need to be a combined setback of 15' with not less than 5' on one side. The rear setback (south) would be required to be 10'. Maximum building coverage on the lot cannot exceed 40%. In conclusion, the property is not buildable under current conditions. A building pen for new construction would be issued only with the installation of the improvements described above. If the vacant property were consolidated with your existing parcel (4175 Teller Street), the City would consider vacating the 20' "tail" of excess right-of-way. A consolidation plat would be required to combine the two parcels. CITY MANAGER'S MATTE notified City Council that the City has received the Distinguished Budg] Presentation Award from the Government Finance Officers Association (GFOA). Kristi Davis congratulated the WRHS graduates of the Class of 2013, She attended this year's ceremony and watched the sixth generation of her family graduate from Wheat Ridge High. As a graduate of WRHS herself, she was pleased to still hear the references to "Farmers" and "bringing it back to t Farm", etc, I Joyce Jay attended the summer food service program for children ages 3-17 at Healing Waters Church, the Middle School, Kullerstrand and Holy Cross Lutheran Church. Children of all ages get both breakfast and lunch and a program for free. This is funded by the US Dept. of Agriculture and Hunger Free Colorado. She thinks it's wonderful, - She reminded folks to come to the Garden Tour this Saturday, June 15, 9:00-3:00. it includes 9 gardens of various types and a lunch provided by Pietra's. FINANCIAL IMPACT: Fees in the amount of $950 were collected for the review and processing of Case Nos. V -13 -01 and MS- 13 -01. Surrounding properties are also zoned R-2 and include single- and two-family homes. To the southeast is property owned by the Jefferson County School District which has on it a large playfield, Stevens Elementary School and further to the south, Wheat Ridge Middle School. The combined area of the three parcels will be over 21,000 square feet. Consolidation would allow the owner to enlarge the existing home or add an additional residential unit to the single family home. Staff concludes that the proposed consolidation plat is compliant with Article IV (Subdivision Regulations) of the zoning and development code. I. REQUEST The applicant is requesting approval of a right -of -way vacation for an unused portion of Teller Street adjacent to 4175 Teller Street. An associated application has been filed pursuant to Case No. MS -13- 01. This is a request for a three lot consolidation plat. The purpose of the request is to enlarge an existing parcel with adjacent vacant property and the vacated right -of -way. Lot consolidations for 5 lots or less follow the minor subdivision process but all right -of -way vacations must be considered by City Council; therefore, Planning Commission will be making a recommendation to City Council. II. EXISTING CONDITIONS The parcels in question are located at 4175 Teller Street and are zoned Residential -Two (R -2). To the southeast is property owned by the Jefferson County School District which has on it a large playfield, Stevens Elementary School and further to the south, Wheat Ridge Middle School. (Exhibit 1, Aerial photo of neighborhood) Surrounding properties are also zoned R -2 and include single and two - family homes. (Exhibit 2, Zoning map) The subject property is made up of two parcels located at the end of Teller Street. The northern parcel contains a single family residence built in 1952 and is 12,362 square feet in size. The southern parcel which is vacant is 8297 square feet in size. Neither parcel has ever been platted. The applicant in this case owns both parcels. (Exhibit 3, Aerial photo of parcels) As part of this application, the applicant is requesting the City vacate an unused portion of Teller Street and if approved, is proposing to consolidate the two parcels and vacated right -of -way into one lot. The portion adjacent to the applicant property is 20' in width, covering only the western side of Teller Street. The right -of -way proposed to be vacated is at the southern terminus of Teller Street and is about 660 square feet in size. There is existing street paving and curb walk in front of the existing house. These improvements stop at the northern line of the proposed vacation request. The existing conditions can be viewed on the applicant's vacation exhibit. (Exhibit 4, Right -of -way drawing) The consolidation will enable the property owner to expand his home in the future and/or convert it to a two - family dwelling. (Exhibit 5, Property photos) III. STREET RIGHT -OF -WAY VACATION CRITERIA The applicant is requesting a right -of -way vacation for an unused portion of Teller Street right -of -way. Before a street right -of -way vacation can be approved, the following findings of fact must be made: 1. That the proposed vacation will not leave any adjoining land without access to an established public right -of -way. Planning Commission 2 WV -13 -01 and MS -13 -01 /Sorrentino 3. That the proposed vacation will not have a negative impact on the infrastructure of the City of Wheat Ridge. All responding utility and responding service agencies have indicated they have no concerns regarding the vacation. There should be no negative impact on the infrastructure of the City. 4. That adequate easements have been reserved for use and/or maintenance by the city or other utility agencies. IV. PROPOSED SUBDIVISION PLAT The proposed plat will consolidate the property from three lots into one lot. (Exhibit 6, Consolidation plat) The two larger parcels are, owned by the applicant and if the vacation is approved, ownership will vest with the owner as well. The R,-2 zone district standards for single family lots are 9000 square feet of area with 75' of lot width. A duplex lot requires 12,500 square feet of area with 100' of lot width. The combined area of the three parcels will be over 21,000 square feet. Consolidation would allow the owner to add an additional residential unit to the existing single family home. No right-of-way dedications are required for Teller Street. Staff concludes that the proposed consolidation plat is compliant with Article IV of the zoning and development code. Planning Commission 3 WV-13-01 and MS- 13- 01/Sorrentino All affected service agencies were contacted regarding the ability to serve the property. Specific referral responses follow in regard to both the plat and r-o-w vacation. Jefferson County Public Schools: No comments or concerns at this time. Xcel Energy: Can serve. Wheat Ridge Sanitation District: Has an existing dead end line and manhole in Teller Street in front of the applicant's house. There should be adequate right-of-way after the vacation for maintenance. Wheat Ridge Fire: Can serve. Wheat Ridge Police: No concerns. Wheat Ridge Public Works: The Public Works Department has no objections to the vacation. They have reviewed and commented on the proposed plat. Vt. STAFF CONCLUSIONS AND RECOMMENDATION Staff concludes that all outside agencies can continue serving the property and that the vacation evaluation criteria have been met. Staff further concludes that the proposed subdivision meets all of the requirements of Article IV of the zoning and development code. For these reasons, Staff recommends approval of Case Nos. WV -13 -10 and MS- 13 -01. VII. SUGGESTED MOTIONS: RIGHT-OF-WAY VACATION Option At "I move to RECOMMEND APPROVAL of Case No. WV- 13 -01, a request for approval of a vacation of an unused portion of Teller Street right-of-way adjacent to 4175 Teller Street, for the following reasons It is unlikely that the street will be extended south. Planning comments: The following items were discussed based on the proposal: Zoning The site is currently zoned Residential-Two (R-2) which allows for single- and two-family homes. Once the property is consolidated, the home may be expanded to the south. The applicant has considered converting the home to a two-family dwelling, and the resulting lot size after the consolidation will be large enough to allow a duplex on the property. Consolidation A lot consolidation essentially combines two or more, adjacent parcels and creates a single larger lot. In this case, a subdivision plat is the document that will remove all interior lot lines and leave only the exterior or "boundary" lot line. The plat will also consolidate the vacated right-of-way into the lot. The consolidation plat must be prepared by a surveyor who is licensed in the State of Colorado. The process for approval is outlined below. Public Works comments: The following items were discussed based on the proposal: Rigfil-qf-ival (ROR' ) Vacation The Public Works Department will support the request for vacation of the southern 660 square feet (approx.) of Teller Street right-of-way. Typically, ROW is vacated by plat or by ordinance. In this case staff recommends vacation by plat, so that the right-of-way can simultaneously be vacated by the City, conveyed to the owner, and consolidated into the applicant's lot. A right-of-way vacation requires City Council approval, the process for which is described below. In regards to the vacation, please add the following note on the cover page of the plat: With the approval of this subdivision plat, an unused portion of Teller Street right-of-way is hereby vacated by the City of Wheat Ridge, as shown, and is conveyed to the owner of Lot I and shall become a part of Lot 1, platted hereon. Building Division comments: The building division was not present at the meeting. A building pennit for expansion of the home may be obtained after the plat is approved. IQ Process This request will require two public hearings, and the first step in the process began with the pre- application meeting on September 21, 2012.
