It is understood, however, that ADUs may exist in the community for one reason or another. Per Section 26-646.F of the City Code, owners of property currently containing structures or portions of structures which may fall within the definition of ADU are granted the right to apply to the City for approval of an ADU. There is a two-year grace period within which to submit an application; applications must be submitted by August 15, 2024. Some existing units may be approved as is, some may require modifications to comply with life safety codes, and some may not be able to be legalized as independent dwelling units. These possible outcomes depend on the history of the unit and whether there is evidence of the unit being legally nonconforming or not. The purpose of this memo is document findings on the history of the existing unit and to determine the status of the dwelling unit and if/how it may obtain legal ADU status. BACKGROUND An application was filed by Luke Kende on September 14, 2022 seeking to legalize an ADU on property at 3605 Gray Street. • The property is zoned Residential -One C (R-IC). • The property currently contains a single -unit home which according to the Jefferson County Assessor was constructed in 1950. • Per the Jefferson County Assessor the site is 11,970 square feet in size. FINDINGS OF FACT The applicant provided information and staff has reviewed City and County files to understand the history of the property and of the secondary unit: • The applicant describes the second unit as a garden -level "mother-in-law" suite with a full kitchen, full bath, living room and one bedroom, with its own outside access door as well as a shared hallway and laundry space. All utilities and HVAC are shared. • The home predates the City of Wheat Ridge, so detailed building permit records are not available. • There have been no major additions or improvements to the house of record. Permits were obtained for the shed and garage. • The basement contains a separate entry through the rear yard; however, the entry also gives access to a shared hallway and laundry facilities. The primary home contains a second door on the other side of the shared laundry facilities. • The current homeowner purchased the home in 2018 in its current condition and is under the impression that the basement was finished around 2013. There are no permits of record for the basement finish. • Based on the photos supplied by the applicant and real estate listings, the basement and 2°d kitchen do not appear to be original suggesting that the basement was finished without permits within (approximately) the last decade. • Jefferson County Assessor records acknowledge the presence of two kitchens. • A second address was not assigned indicating it was not intended as an independent unit. CONCLUSION Based on these findings, the existing unit is determined to be unsanctioned. Based on these findings, there is not sufficient evidence that the City or County previously approved the existing unit as an ADU. It may still be possible to legalize the unit as an ADU. The next step to explore legalization will require a courtesy inspection by the Building Division to determine what, if any, work may be required to meet minimum code and life/safety requirements.
