Artificial turf is not permitted in the City of Wheat Ridge. I am okay with approving with the condition that the artificial turf would need to be removed. The only other option would be to proceed with a variance that would have to go to the Board of Adjustment for approval. Can you give me a call so we can discuss the approach forward? Below please find Planning's comments and attached redlines pertaining to your application documents: 1. Please provide bulk plane elevations as discussed previously, illustrating bulk plane from the front and side. R-3 zoning requires development to be within the bulk plane for each elevation. Measurement of bulk plane can be found here. Please include elevations with a bulk plane analysis to include in your building permit set. I don't foresee any issues here, but can't be certain until I have the information needed to evaluate. 2. Please confirm height of all structures, measured from finished average grade to roof mid -point (for pitched roofs). The house is allowed to be up to 35 feet and the garage is allowed up to 15' in height. 3. Major accessory structures (i.e. the garage) are limited to 600 square feet in size. Your plan shows that the garage (with the addition that was never permitted), exceed 600 square feet at 613.67 square feet. Please confirm the total area of the garage with addition. If you are indeed exceeding 600 square feet for the garage, 4 A 7 you'll need to apply for a variance. It appears that this could be considered an administrative variance since it does not exceed fifty percent of the maximum standard. The cost of a variance is $200. The variance checklist and process information can be found here. Please confirm that the 2nd shed on the property is to be removed and not a part of this application. The old shed encroaches into the 10' minimum rear setback but is an existing condition that was looked at with previous permits, so does not require a variance. Please revise your floor plan to show what is being removed versus what is proposed. For example, call out locations of existing ovens/stoves and state "oven and hook-ups to be removed, to be replaced with cabinet" or similar. Confirm that the floor plans are existing and not proposed to change. Revise labels on the floor plan of the additions to be clear as to what is currently being reviewed. All we are really looking at here is what has clearly not been permitted, which is the addition off of the garage. Change the "new addition inside existing structure" of the garage to "previous addition", and change the "new addition" to original existing structure to "previous addition". If these areas are being remodeled at this time, please show what is changing. 8. Please show any hardscape and landscaped areas on the plans. For example, please show trees, turf areas, concrete drive, sidewalk and streetscape. Hatching is usually a good way to show the different surfacing types. Show that you are meeting that 100% of the front yard and 25% of the entire lot are landscaped; and that the driveway is paved for at least the first 25'. 9. Include a site data table showing lot coverage for building, landscaped, and hard -surfaced areas in square footage and percentage of total site area. For the buildings (inclusive of decks), I'm measuring a total of 2,373.59 or 30.7% building coverage. I don't have enough information to determine landscaped and hard surface areas though (also see comment 8 above). 10. Identify gross floor area of all structures existing versus proposed. Assuming nothing has changed in terms of floor area on the main structure and it's addition, existing would include everything except the garage addition since that's the only thing that wasn't permitted previously. 11. Provide a signed, written authorization from the property owner giving you the okay to submit the application on their behalf, to state something similar to: "I, Jerry and Linda McKim, do hereby authorize Brent McKim (contractor) to submit for building permit with the City of Wheat Ridge on our behalf". All else appears to meet requirements, so the biggest hurdle here will likely be the administrative variance identified in item 3 above. We appreciate you coming forward and doing what you can to make things right. Randy and I did some digging in the permit files of record, and it looks like the addition to the garage was never permitted, or possibly was submitted but never inspected. So, we need a building permit application to review that structure in particular. We have to base our review on current R-3 zoning standards for any structures that have not been properly permitted. From a zoning perspective, I'll be looking for a couple things: 1. As I referred to this morning, R-3 zoning allows for a maximum of 40% building coverage. Based on preliminary calculations, it appears that you are under the 40%, but we'll need a site plan or Improvement Location Certificate (ILC) with your building permit to confirm. 2. R-3 zoning also requires development to be within the bulk plane for each elevation. Measurement of bulk plane can be found here. Please include elevations with a bulk plane analysis in your building permit set. I don't foresee any issues here, but can't be certain until I have the information needed to evaluate. 3. Required minimum setbacks in R-3 are as follows: 25' front, 5' sides, and 10' rear. It appears that the garage addition may be encroaching into the 5' setback, but again, we'll know more once we see a site plan or ILC. If any of the minimum or maximum development standards are exceeded, this will trigger the need for a variance application to bring the site up to legal, non -conforming status. As long as the variance does not exceed 50% of the applicable standard, the variance could be processed administratively (meaning that it could be reviewed and acted upon by the Planning Director, without Planning Commission or City Council Hearings). The cost of a variance is $200 (+$220 noticing/processing fees if it winds up being greater than 50% variance). The variance checklist and process information can be found here. I don't think you need to begin pursuing the variance quite yet (unless you find it glaringly clear that you need one), until we are able to evaluate the building permit application for compliance with R-3 zoning standards, but I didn't want you to be caught off guard if the need for a variance is found. All information pertaining to use and the independent dwelling unit situation that we discussed this morning remains applicable. Please devise a plan to rid of the stove/oven for each of the additions as this classifies the additions as independent dwelling units since they have full kitchens. Lastly, our Comprehensive Plan designates this area as a Primary Commercial Corridor which is envisioned to contain a broad mix of activities, heavily focused on accommodating multiple transportation modes and exemplifying high quality urban design and appearance. Below please find Planning's comments and attached redlines pertaining to your application documents: 1. Please provide bulk plane elevations as discussed previously, illustrating bulk plane from the front and side. R-3 zoning requires development to be within the bulk plane for each elevation. Measurement of bulk plane can be found here. Please include elevations with a bulk plane analysis to include in your building permit set. I don't foresee any issues here, but can't be certain until I have the information needed to evaluate. 2. Please confirm height of all structures, measured from finished average grade to roof mid -point (for pitched roofs). The house is allowed to be up to 35 feet and the garage is allowed up to 15' in height. 3. Major accessory structures (i.e. the garage) are limited to 600 square feet in size. Your plan shows that the garage (with the addition that was never permitted), exceed 600 square feet at 613.67 square feet. Please confirm the total area of the garage with addition. If you are indeed exceeding 600 square feet for the garage, you'll need to apply for a variance. It appears that this could be considered an administrative variance since it does not exceed fifty percent of the maximum standard. The cost of a variance is $200. The variance checklist and process information can be found here. 4. Please confirm that the 2nd shed on the property is to be removed and not a part of this application. 5. The old shed encroaches into the 10' minimum rear setback but is an existing condition that was looked at with previous permits, so does not require a variance. 6. Please revise your floor plan to show what is being removed versus what is proposed. For example, call out locations of existing ovens/stoves and state "oven and hook-ups to be removed, to be replaced with cabinet" or similar. Confirm that the floor plans are existing and not proposed to change. 7. Revise labels on the floor plan of the additions to be clear as to what is currently being reviewed. All we are really looking at here is what has clearly not been permitted, which is the addition off of the garage. Change the "new addition inside existing structure" of the garage to "previous addition", and change the "new addition" to original existing structure to "previous addition". If these areas are being remodeled at this time, please show what is changing. 8. Please show any hardscape and landscaped areas on the plans. For example, please show trees, turf areas, concrete drive, sidewalk and streetscape. Hatching is usually a good way to show the different surfacing types. Show that you are meeting that 100% of the front yard and 25% of the entire lot are landscaped; and that the driveway is paved for at least the first 25'. 9. Include a site data table showing lot coverage for building, landscaped, and hard -surfaced areas in square footage and percentage of total site area. For the buildings (inclusive of decks), I'm measuring a total of 2,373.59 or 30.7% building coverage. I don't have enough information to determine landscaped and hard surface areas though (also see comment 8 above). 10. Identify gross floor area of all structures existing versus proposed. Assuming nothing has changed in terms of floor area on the main structure and it's addition, existing would include everything except the garage addition since that's the only thing that wasn't permitted previously. 11. Provide a signed, written authorization from the property owner giving you the okay to submit the application on their behalf, to state something similar to: "I, Jerry and Linda McKim, do hereby authorize Brent McKim (contractor) to submit for building permit with the City of Wheat Ridge on our behalf". All else appears to meet requirements, so the biggest hurdle here will likely be the administrative variance identified in item 3 above. We appreciate you coming forward and doing what you can to make things right. Randy and I did some digging in the permit files of record, and it looks like the addition to the garage was never permitted, or possibly was submitted but never inspected. So, we need a building permit application to review that structure in particular. We have to base our review on current R-3 zoning standards for any structures that have not been properly permitted. From a zoning perspective, I'll be looking for a couple things: 1. As I referred to this morning, R-3 zoning allows for a maximum of 40% building coverage. Based on preliminary calculations, it appears that you are under the 40%, but we'll need a site plan or Improvement Location Certificate (ILC) with your building permit to confirm. 2. R-3 zoning also requires development to be within the bulk plane for each elevation. Measurement of bulk plane can be found here. Please include elevations with a bulk plane analysis in your building permit set. I don't foresee any issues here, but can't be certain until I have the information needed to evaluate. 3. Required minimum setbacks in R-3 are as follows: 25' front, 5' sides, and 10' rear. It appears that the garage addition may be encroaching into the 5' setback, but again, we'll know more once we see a site plan or ILC. If any of the minimum or maximum development standards are exceeded, this will trigger the need for a variance application to bring the site up to legal, non -conforming status. As long as the variance does not exceed 50% of the applicable standard, the variance could be processed administratively (meaning that it could be reviewed and acted upon by the Planning Director, without Planning Commission or City Council Hearings). The cost of a variance is $200 (+$220 noticing/processing fees if it winds up being greater than 50% variance). The variance checklist and process information can be found here. I don't think you need to begin pursuing the variance quite yet (unless you find it glaringly clear that you need one), until we are able to evaluate the building permit application for compliance with R-3 zoning standards, but I didn't want you to be caught off guard if the need for a variance is found. All information pertaining to use and the independent dwelling unit situation that we discussed this morning remains applicable. Please devise a plan to rid of the stove/oven for each of the additions as this classifies the additions as independent dwelling units since they have full kitchens. Lastly, our Comprehensive Plan designates this area as a Primary Commercial Corridor which is envisioned to contain a broad mix of activities, heavily focused on accommodating multiple transportation modes and exemplifying high quality urban design and appearance.
