CITY COUNCIL MINUTES
CITY OF WHEAT RIDGE, COLORADO
September 24, 1990
The City Council Meeting was called to order by the Mayor at 7 30 p m
Councilmembers present Elise Brougham, Kent Davis, Don Eafanti, Phil
Edwards, Tony FIasco, Larry Merkl, Ron Selstad, and Bill Shanley Also
present City Clerk, Wanda Sang, City Administrator, Mike Smith, City
Attorney, John Hayes, Public Works Director, Bob Goebel, Director of
Planning & Development, Glen Gidley, Director of Parks & Recreation,
Gary Wardle, Chief of Police, Jack Hurst, staff, and interested
citizens
APPROVAL OF MINUTES of September 10, 1990
Motion by Mr Eafanti for the approval of the Minutes of September 10,
1990, seconded by Mr Merkl, carried 8-0
CITIZENS' RIGHTS TO SPEAK
Binh Ho, 183 S Dale Court, Denver, stated that, as instructed by the
Liquor Authority, he tried to take a liquor course through the State,
but was told that such a course was not available he asked what he was
to do next Mayor Wilde advised him to read the liquor laws and follow
the instructions he had received from Chief HJrst
PUBLIC HEARINGS AND ORDINANCES ON SECOND READING
Item 1
Council Bill 65 - An Orainance amending Chapter 13 of the Code
of Laws of the City of Wheat Ridge by adopting the Colorado
Department of Public Safety Rules and Regulations concerning
minimum safety standards for the operation of commercial
vehicles and amending the Model Traffic Code provisions
controlling the use by commercial vehicles of the City's
streets and providing a penalty for violation thereof
Council Bill 65 was introduced on second reading by Mrs Brougham, title
read by the Clerk, Ordinance No 842 assigned
Chief Hurst gave background on this ordinance and referred to his memo
attached to the agenda Various officers were present to answer
Council's questions
Motion by Mrs brougham for approval of Ordinance 842 on second reading
with the deletion of the weight limit l'egarding trash trucks, seconded
by Mr FIasco
Mr Merkl asked to amend this motion because he doesn't agree that we
delete the whole section He would like to put the weight limit on
trash trucks, single-axle trash trucks, back in the Ordinance, with an
18 months period to meet the weight standards set forth in the
Ordinance, seconded by Mr Edwards, carried 5-3 with Councilmembers
Brougham, Davis anj Flasco voting No

ORDINANCES ON FIRST READING
Item 2
Council Bill 73 - An Ordinance re~ealing and reenacting
Sections 16-127 and 16-177 of the Code of Laws of the City of
Wheat Ridge, involving offenses related to the possession and
consumption 0f alcoholic beverages by minors and aaults in
public places within the City
Council Bill 73 was introduced by Mr Selstad on first reading, title
read by Clerk Motion by Mr Selstad that Council Bill 73 be approvej
on first reading, ordered published, public hearing be set for Monday,
October 2c, 1990 at 7 30 p m in City Council Chambers, Municipal BIdg ,
and if approved on second reading, take effect 15 days after final
publication, seconded by Mr Edwards
Motion by Mr FIasco to strike any and all references to accepting the
label on open bottles as prima facie evidence, seconded by Mr Davis
Mr Selstad accepted Mr FIasco's motion as a friendly amendment to his
motion, second accepted Motion as amended carried 8-0
DECISIONS, RESOLUTIONS, AND MOTIONS
Item 3
Authorization of premium payment for Boiler and Machinery
Insurance
Motion by Mr Eafanti that $4,817 00 be paid to Sedgwick James for
Boiler and Machinery insurance from Hartford Steam Boiler to be paia
from Account #01-610-781, seconded by Mr Davis, carried 7-1 with Mr
FIasco voting No, because it was not put out to bid
Item 4
Contract Aware for 1990 Local Street Improvements
Mr Goebel gave overview of the streets that will be affected
Motion by Mr Merkl that the c0ntract for the 199U Local Streets
Improvement Project, ~-LS-90 (RFB #90-39) be awarded to Concrete
Express, Inc in the amount 0f their c0rrected bid of $179,091 15 That
an incentive amount bonus of $3,582 00 be establishea That a
contingency fund of $8,732 OU be established That a force account in
the amount of $2,000 00 be established That $20,000 00 be transferred
from Capital Projects Fund Account 3U-3U3-851, Miscellaneous Street
Projects, int0 Account 30-303-840, Local Streets Improvement
That the Director of Public Works be authorized to issue change orders
up to the total project cost of $193,405 15 and that all costs
associated with this project be charged to Account Number 30-303-840
That the funds be encumbered for the length of the project, which
expressly allows the expenditure of funds in 1991 for the project in
accordance with Ordinance #787, 1989 Series, seconded by Mr Eafanti

Mr FIasco asked for a friendly amendment that the Depew Street Project
be done first Mr Merkl and second accepted this Motion carried 8-0
Item 5
Contract Award f~r PrJ[essiona] Landscape Architectural
Services (Panorama and Randall Parks)
Gary Wardle gave overview of this project and answereo Council's
questions
Motion by Mr Edwards that the contract for Professional Landscape
Architectural Services (RFP #90-011) be awarded to Bucher, Willis &
Ratliff in the amount of their bid of $6,540 00 and that all costs
associated with this contract be charged to the Conservation Trust Fund
Account No 54-601-877 That the funds be encumbered for the lenbth of
the project, which expressly allows the expenditure of funds in 1991 for
this project in accordance with Ordinance #7b7, 1989 Series, seconded by
Mr Selstad, carried 8-0

Employee Recreation Program
Motion by Mr Shanley that the City employees, their spouses and
childre1 be allowed to use the City recreation facilities, and
participate in organized activities anj cl~sses at no cost I further
move that contracts with instructors include a clause that states that
it is possible that some participants might be City employees or their
families and that they understand that as part of their contract with
the City they must not charge these people I further move that a class
can be limited to 40% eOJployee and family to ensure that the instructor
is making a fair wage and this is at the option of the instructor In
case the instructor says I don't mind if 50% or 60% of them are
employees, that is up to the instructor Seconded by Mr Eafanti
Mr Shanley withdrew his motion and made the following motion
I move that the City employees, theil' spouses and children be allowed to
use the City recreation facilities, and varticipate in organized
activities and classes at no cost, seconded by Mr Eafanti
Mr Merkl moved to amend Mr Shanley's motion to aod after "at no cost"
at a space permitting basis after the cut-off date for recreation
classes and programs, seconded by Mrs Brougham, carried 7-1 with Mr
Shanley voting no
Motion by Mr FIasco to amend the motion further to state that the limit
would be at 30% of the employees of the City, seconded by Mr
Selstad, carried 5-3 with Council members Brougham, Merkl, and Shanley
voting No
Vote on original motion as amended carried 8-0

Item 7
Solar Heating System Review
Mr Gidley explained the deficiences of the current system and the work
it would take to c~rrect them He introduced Mr Johansen from Gordon,
Gumes~n & Associates, who was present to answer Council's questions
Motion by Mr ~lasco that the solar heating system review report be
accepted and that Step 1, as set forth in such report, be approved for
action The Mayor is authorized to sign a contract for engineering
services and construction administration for an amount not to exceed
$1,500 with Gordon, Guweson and Associates, and the contractor and City
staff should proceed to bid for related construction All costs shall
be charged to Acct No 30-610-811 These funds shall be encumbered for
the length of this project which expressly allows the expenditure of
funds in 1991 for this project in accordance with Ordinance #787, 1989
Series, seconded by Mr Merkl, carried 8-0
CITY ADMINISTRATOR'S MATTERS
Mike Smith referred to an information packet on Chlorofluorocarbons,
that was available for review prior to next week's Study ~ession
CITY ATTORNEY'S MATTERS
John Hayes reported on the negotiation session with Lutheran Medical
Center
ELECTED OFFICIALS' MATTERS
Elise Brougham asked that a left-turn signal be installed on 26th Avenue
& Kipling This is to be a temporary measure during the 32nd Avenue
reconstruction
Vent Davis asked that the Police Department concentrate on writing
tickets auring the "Taco Express" from 11 30 to 1~ 30 on 32nd Avenue
Tony FIasco gave Zip Coae update Wheat Ridge residents who live at
Denver or Lakewood Zip Codes, can use "Wheat Ridge 80215, or 80212" and
the mail will be delivered without any delays All Wheat Ridge
residences, regardless of Zip Coae, will be listed under Wheat Ridge
Motion by Mr Flasco that the Mayor write a letter requesting that the
Post Office look into this for us as soon as possible, seconded by Mr
Merkl, carried 8-0

a special prosecutor for liquor violation hearin~s, this should be
addressed at a Study Session Consensus was 8 in favor to look into
this
Motion by Mr Shanley to adjourn, seconded by Hr Davis, carriea 8-0
