We recently received a phone call asking if two (2) dwelling units are allowed in the Residential -One (R-1) zone district. Based on the zoning of the property you can only have one (1) dwelling unit on the property. They City is aware that the County Assessor has the property listed as a duplex because they assess what is currently there. Through research of microfilm and Laserfiche there are no building permits showing the addition of a 2nd kitchen in the basement. Also, the County Assessor's office says a change from single family home to duplex was done in 1999, but we have no evidence of that change. The 2nd unit might have been converted before your ownership of the house, but there is no documentation to support the addition. You will need to contact the Building Division to schedule a courtesy inspection of the converted structure to assess any life safety issues and to determine what action must be taken to remedy the unpermitted conversion on the property to a duplex dwelling. Eventually, you will need to obtain a building permit to remove cooking elements from the second dwelling unit. For more than a year the title in the bathroom at the stated address above has been deteriorating allowing for moisture and the growth of toxic mold. The owner was notified as soon as the title started to fall from the bathroom walls, approximately February 2003. Since that time the owner has made excuses and broken promises that have resulted in this letter for action. Furthermore, I have been suffering from respiratory problems, aches and pains and chronic fatigue which I feel has been a result of the airborne effects of the toxic mold. I sincerely believe the owner has had more than enough time to handle the repairs, his negligence has caused me over exposure to harmful toxins that could effect my long-term health. CONDmONS & CONCERNS: Basement: 3300 Kipling Street Wheat Ridge, CO 80033 12 January 2005 Mice - Within the last week Gerald has killed 8 mice. (1 a day) You can hear the mice run through the basement ceiling in the bathroom and kitchen. It's possible that the mice have taken over the space between the upstairs floor and the basement ceiling. In the past had mice in the washroom and front room upstairs. Mold - Bathroom (shower) crawling with mold. Can't shower barefoot need shower shoes to take a shower. Shortly after Gerald moved in he wasn't aware that shower shoes were needed in order to take a shower so he would take a shower barefoot. After about a month Gerald developed a serve case of Athletes Feet, which required a trip to the emergency room. Possible mold in the Iivingroom where the roof was leaking. Plumbing - Shower backs-up and floods pretty much a daily occurrence. Vents The heating vents need to be cleaned especially with all the airborne pollution's, mold and mice particles. Please note Gerald has many of the same symptoms that I do. (See attached sheet for the most recent symptoms.) Upstairs: Mold - Shower title and mold needs to be cleaned and replaced. A fan should be installed to eliminate humidity. Fence - The wind blew down the fence in the southwest corner, needs to be fixed to prevent possible injury. Patio Roof - The patio roof is about to collapse. Mice - See basement. Difficulty in breathing at times. My heart feels like it has to work harder it sometimes hurts_ Mood changes Highly emotional Memory Loss Get extremely cold, can't get warm. Experience sudden chills. Skin conditions sores on eyes, small bruising for no reason. Change in eating habits. Lightheadedness (sometimes) Chronic Fatigue No Energy Depressed Want to sleep all day NOTE: I experienced similar symptoms last year at this time. I just recently discovered I have been exposed to black mold for over a year now.
