Pei Pursuant to the above referenced stop work orders; I am writing this letter to have the association and connection to my company removed. Based on recent communication with your building department (permits and contractor licensing), I have learned that there are two stop work orders linking James Company Enterprises, Ltd. to the subject property. As informed by your licensing/permit technician, I cannot obtain any construction permits until this matter is resolved. In light of that; I would like to do so by your acceptance of this letter. On, or about July 5`h, 2018, 1 was contacted by the property owner's representative to assist in progress to move forward on this residential remodel project which had received a stop work order previous to my involvement. I met with a man by the name of Vladimir, whom was representing a real estate investment company I have recently learned to be "ASJ". My first action was to walk the property for familiarization and to review any drawings that may have existed. When this occurred, I could see that work had previously commenced, so I asked to see the drawings. Upon my review and realization of the intended scope of work; I informed Vladimir that Architectural/Structural, Mechanical, Electrical and Plumbing drawings would need to be generated in more detail and submitted for approval to the City of Wheat Ridge prior to permitting. In anticipation of becoming the General Contractor for this project, I submitted and payed for a Class -B General Contractor's License with the City of Wheat Ridge on July 10, 2018. Following my license application, I once again informed the Owner's Representative (Vladimir) that he would need to coordinate and submit for review and approval, all required drawings and documentation to move forward with that project. Also, I informed him that if/when all was ready, submitted and approved; I could review the approved drawings and provide a cost estimate for contracting the work. That was the last I heard from the Owner's Representative (Vladimir). He was the only contact I had at the time who was associated with that project. As mentioned above, I recently contacted your contractor licensing department (April 02, 2019) to request a copy of the License I had been previously granted as I wanted to submit it along with others in an effort to obtain licensing with another municipal entity which reciprocates as most do for James Company Enterprises, Ltd. This is when 1 was informed that a second stop work order had been issued against the 3400 Kipling Street property just this year, in early 2019. She explained that since I initiated the plan submittal process and applied for licensing for that property, that 1 had been listed as the contractor on record. The licensing/permit technician went on to inform me that since I am the listed contractor on record, subsequently, these two stop work orders are associated with my company (James Company Enterprises, Ltd). Also, that I would not be able to obtain permits until the two existing stop work order issues have been resolved. To do this, the technician told me that I would need to compose a letter addressed to the Building Official for Wheat Ridge to clarify this matter. In an attempt to clarify and clear this issue, I found the owner through a realtor that was listing the property for sale. It was sold to another investment company (The Vulcani Group) and closed on April 5`h, 2019. Jacob (of ASJ), the previous owner, no longer has business dealings with Vladimir who was handling the remodel of this property. In closing, I would like to reiterate that my company (James Company Enterprises, Ltd.) has never exercised a bit of work whatsoever at/on the referenced property. I am currently, as well as have been a licensed Class -B General Contractor in many other Cities along Colorado's Front Range and have never performed, been involved or been issued a stop work order for exercising work without a permit. I own and operate a legitimate general contracting business with the utmost professionalism, ethical mindset, moral and legal standards. With no offense intended, and truly, with all due respect, it seems a bit like putting the proverbial "cart before the horse" to list James Company Enterprises, Ltd. as the contractor on record in association to a property prior to obtaining permits under my licensing privileges. All I did was obtain licensing in anticipation of contracting a remodeling project that never came to fruition. As a suggestion; Perhaps Wheat Ridge would consider, like most other municipalities, to list a contractor for record after obtaining an actual permit. The ACM consisted of wall and ceiling surfacing materials located in the basement of the single-family residence. A post -abatement visual inspection and air monitoring by an independent consulting firm were requested to determine if the work area was sufficiently clean and the post-removal air quality was within the maximum allowable asbestos level (MAAL) of 0.01 fibers per cubic centimeter (f/cc) of air. This clearance level is established by the Colorado Department of Public Health and Environment (CDPHE). Methodology The visual inspection and clearance air monitoring were conducted by a Colorado certified air monitoring specialist. The air samples were collected using aggressive sampling techniques and analyzed using phase contrast microscopy (PCM) methods. Analysts reading PCM samples have been NIOSH 582E trained and are considered proficient under the ANA Proficiency Analytical Testing (PAT) Program. PCM analysis was performed using the NIOSH 7400 Method, which presents sample results in fibers per cubic centimeter (f/cc) of air. PCM analysis is advantageous with many types of projects since it provides quick results and is recognized by the State of Colorado as a method for clearing asbestos abatement work areas. PCM analysis does not differentiate between asbestos and non -asbestos fibers. Had initial PCM analysis indicated elevated fiber levels, re -cleaning and possibly re -testing by TEM methods (which count and report only asbestos fibers) would have been recommended. Page 1 Results Results of the final visual inspection ascertained the work area was acceptably clean and ready for final air samples. Results of all air samples collected to clear the work area were below the MAAL of 0.01 f/cc. Please see the table below for a summary of the clearance air sampling. INTRODUCTION On March 261h, 2016 Mr. Josh Berard with All Clear Environmental Consulting conducted a full - building asbestos inspection and collected asbestos bulk -samples of suspect asbestos -containing materials (ACM) within the entire single-family residence located at 300o Kipling St. Wheatridge, Co. The purpose of the inspection was to identify and sample potentially hazardous friable and non -friable ACM within the residence that would be impacted. Mr. Berard is Accredited by the Environmental Protection Agency (EPA) and certified by the Colorado Department of Public Health and Environment (CDPHE) as an Asbestos Building Inspector. A copy of his accreditations and certifications can be found in section XI of this report. Il. SITE DESCRIPTION The one structure is a single family, 2 story home with basement III. SCOPE OF WORK Renovations will be taking place throughout entire basement along with the kitchen and family areas on main level. Bulk samples were taken of suspect ACM for assurance of following appropriate safety measures. The full -building asbestos inspections conducted on March 26th constituted a full building inspection and fulfills the asbestos inspection requirements for structures that are to be renovated. IV. SAMPLING & ANALYTICAL PROCEDURES (a) Sampling Procedures: Random bulk -samples representative of the suspect ACM of each homogeneous area were collected according to the guidelines published as EPA Final Rule: Title II of the Toxic Substances Control Act (TSCA), 15 USC, Sections 2641 through 2654 and in compliance with 40 CFR, Part 763 and CDPHE Regulation Number 8, Part B - Asbestos (Reg. 8). All Clear Environmental has collected the appropriate number of bulk -samples to meet all regulatory requirements for the classification and quantity of each homogeneous area. Note some minor destructive sampling was conducted. 3 (b) Analytical Procedures: Bulk samples collected were analyzed utilizing the EPA's Method for the Determination of Asbestos in Bulk Building Materials (EPA 600/R/116, July, 1993) and the McCrone Research Institute's The Asbestos Particle Atlas as methods references. All bulk -samples were analyzed by a National Voluntary Laboratory Accreditation Program (NVLAP) accredited laboratory using the Polarized Light Microscopy (PLM) method for asbestos content (see X for laboratory report). V. INSPECTION PROTOCOL The asbestos inspection was conducted by an Environmental Protection Agency (EPA) and CDPHE certified Building Inspector. The inspection procedures included identifying and sampling suspect ACM within pre -defined areas. Suspect materials alike in appearance and application were sampled as HAs. After identifying the appropriate suspect ACM, random samples of (Specific Material here) were taken in (Specific HA here) and sent to an NVLAP accredited laboratory for analysis. See lab results in section IX VI. HOMOGENOUS AREAS (a) Suspect materials are divided into three classifications: 1. Thermal systems insulation (TSI)`; any type of duct, boiler, tank, or pipe insulation. 2. Surfacing material (SM): sprayed or troweled onto structural building member. 3. Miscellaneous (Mist.): other suspect materials ie. flooring, ceiling tiles, insulation, and finishing materials. (b) Friable material is one that, when dry, can be pulverized, or reduced to powder by hand pressure, a non -friable material cannot. A non -friable material may become friable if its condition had deteriorated or has been impacted by forces that have rendered it friable. L1 (c) The three categories in which sampled materials are placed are as follows: Good: None to very little visible damage or deterioration Damaged: The surface is crumbling, blistered, water -stained, gouged, marred or otherwise abraded over less than one-tenth of the surface if the damage is evenly distributed, or one-quarter if the damage is localized Significantly Damaged: The surface is crumbling, blistered, water -stained, gouged, marred or otherwise abraded over greater than 10% of the surface if the damage is evenly distributed, or %25 if the damage is localized (d) All Clear Environmental collected at least the minimum number of samples from each homogeneous area necessary to meet all regulatory requirements for the quantity of material to be disturbed. The quantities listed in this report are approximate and on-site verification of the exact quantity of each material is required. The following outlines the minimum sample quantities required per homogeneous area: Thermal System Insulation (TSI): Each homogeneous area requires a minimum of three (3) samples; at least one (1) sample must be collected from each patch; and collect enough samples sufficient to adequately assess the material and determine the asbestos content for TSI fittings such as pipe elbows or "T's". CONCLUSION & RECOMMENDATIONS Asbestos was identified within the materials in the basement of the residence that were within the scope of the limited inspection and bulk -sampling performed on March 26th, 2018; therefore, professional abatement activities are required to remove or disturb the above -sampled building materials. All Clear Environmental (ACE) recommends that when ACM is removed/abated, that only a licensed asbestos abatement contractor using personnel trained in the handling of ACM be allowed to conduct such activities using appropriate methods (NEPA-filtered vacuuming, wet cleaning methods, respiratory protection, protective clothing, personnel decontamination, negative -air enclosures, air monitoring, etc.) XI. LIMITATIONS All reports and recommendations are based on conditions, practices observed and information made available to All Clear Environmental (ACE) by the client and the designated site on the days sampling was conducted.
