Dear Chris:
This letter is in regard to the landscaping on the property located at 3850 Kipling Street.
At the time you requested a final Certificate of Occupancy on the property, I did a field
inspection where I informed you that the landscaping installed on the property was not only
insufficient in regard to the number of plant materials but also that the plant materials used were
insufficient in size.
Generally, I have the authority to act on behalf of the Zoning Administrator and am allowed to
negotiate with property owners on design issues such as this. However, the Zoning
Administrator feels that in this situation, the intent of Section 26-32 of the Wheat Ridge Code of
Laws is not being met. I have been instructed to work with you to resolve the deficiencies as
enumerated below:
1. Pursuant to Section 26-32(D)(3), one street tree shall be installed for every 30' of
street frontage on the property. With a 100' frontage, four street trees measuring
two inches in caliper would be required. If aspen trees with less than a two-inch
caliper are used, each two aspen trees may be counted as single street tree.
Therefore, eight aspen trees would be required where only six exist.
2. Pursuant to Section 26-32(D)( 4), in addition to the street tree required, one tree or ,
shrub is required for every 1000 square feet of lot area or 22. Including existing
plant materials, there are only 18 additional trees or shrubs.
3. In addition to the the minimums referenced above, the zoning code requires
landscaping on the property shall not be made up of more than 20% non-
living materials within a two year growth period. Staff has concluded that the
landscaping most visible (along Kipling) will not meet this standard and more
plants must be added in this area. Staff has concluded that if the deficient street
trees and shrubs, providing they are the spreading variety, are added in the
streets cape area, the intent of the ordinance will be met.

Dear Mr. Romberg,
This letter is amend the original approval date of February 21,
1996 due to the revision to the final drainage study, and to
inform you that the final drainage study, and the erosion control
plan for the above referenced project have been reviewed and
approved for construction. Please be aware of the following
items regarding the construction of the project:
1. The proposed drainage facilities shall be constructed and
approved by the City of Wheat Ridge prior to issuance of the
Temporary Certificate of Occupancy.
2. Erosion control for the project shall be placed in conformance
with the approved drainage/erosion control plan and shall be
maintained as needed during the course of construction.
3. All drainage improvements shall be constructed in conformance
with the approved drainage report and plan.
4. It will be the responsibility of the contractor for the
project to repair any damage to the existing public
improvements on Kipling Street as a result of related
construction traffic in the area. Also, the contractor will
be responsible for maintaining Kipling Street on a regular
basis such they are free of construction debris and tracking
from construction traffic accessing the site.
5. Upon completion of the drainage improvements the engineer,
Lane Engineering Service, Inc. shall provide to the City of
Wheat Ridge a letter of certification stating that the various
improvements, as defined in the drainage report and plan, have
been accurately surveyed to confirm that their construction is
in accordance with these documents. The certification letter
shall be written and stamped by the engineer who prepared the

Approval
Dear Mr. Zanon,
As you are aware, a copy of the letter dated February 21, 1996 to
Mr. Richard Romberg, P.E. was sent to you which approved the
final drainage study and erosion control plan for the above
referenced project. On February 28, 1996, I received a copy of
the letter dated January 9, 1996 from Mr. Gary Prentiss of the
Colorado Department of Transportation to Mr. Richard Romberg.
This letter stated that the proposed drainage design was not
acceptable to the State and there were revisions needed.
The City's acceptance of this project is contingent upon the
State's acceptance. Because of this new information, that was
not known when the City approved this project, the City can not
allow any onsite work to continue until such time as the State
has formally approved this project, and the City receives written
confirmation from the State of this approval. Upon receipt and
acceptance of this information, the City will issue a new letter
of approval.

Dear Mr. Romberg,
This letter is to inform you that the final drainage study, and
the erosion control plan for the above referenced project have
been reviewed and approved for construction. Please be aware of
the following items regarding the construction of the project:
1. The proposed drainage facilities shall be constructed and
approved by the City of Wheat Ridge prior to issuance of the
Temporary Certificate of Occupancy.
2. Erosion control for the project shall be placed in conformance
with the approved drainage/erosion control plan and shall be
maintained as needed during the course of construction.
3. All drainage improvements shall be constructed in conformance
with the approved drainage report and plan.
4. It will be the responsibility of the contractor for the
project to repair any damage to the existing public
improvements on Kipling Street as a result of related
construction traffic in the area. Also, the contractor will
be responsible for maintaining Kipling Street on a regular
basis such they are free of construction debris and tracking
from construction traffic accessing the site.
5. Upon completion of the drainage improvements the engineer,
Lane Engineering Service, Inc. shall provide to the City of
Wheat Ridge a letter of certification stating that the various
improvements, as defined in the drainage report and plan, have
been accurately surveyed to confirm that their construction is
in accordance with these documents. The certification letter
shall be written and stamped by the engineer who prepared the
