The contractor is responsible for the coordination of all required information indicated on the Structural Contract Documents & incorporating these requirements into the shop drawings of all other disciplines prior to submittal to Sundance Structural Consultants, LLC — Information provided within the Structural Contract Documents is subject to all requirements specified within the governing building code. The contractor shall be familiar w/ all portions of the governing building code that impact the type of construction being performed. For conditions where the Structural Contract Documents conflict w/ the governing building code, the more stringent requirements shall apply. The contractor shall keep a copy of the governing building code on site at all times during the construction phase of the project for reference. All proprietary connections shall be installed in accordance w/ the manufacturers' recommendations. All work shall be accomplished in a workmanlike manner & in accordance w/ the IRC & local codes & ordinances. The general contractor is responsible for coordination of all work, including layout & dimension verification, materials coordination, shop drawing review, & the work of subcontractors. Continuation of work without notification of discrepancies relieves the architect & engineer from all consequences. Dear Ms. Anderson, I have reviewed the list of code violations that Bob Gaspar, Combination Building Inspector found during an inspection of the above referenced address. The most crucial items on the list are the basement ceiling height, finish door height and header height at the basement stair. In order for the basement to be considered as a habitable space, it must be provided with a ceiling height of 7'-6" with some exceptions for under beams and furred ceilings of7'-O" but never less than seven feet. All three of these items are considered as life safety issues and do not meet the requirements for a safe means of egress from the basement. You expressed a thought of selling or renting the property as a single family dwelling. This would still not change the fact that the basement is considered as an uninhabitable space. The basement with its current ceiling height could only be used for storage and an area for the furnace and water heater. I would also like to inform you that we cannot issue a permit to improve the bathroom until these issues are corrected. The building official is hereby authorized and directed to enforce all of the provisions of this code. For such pur- poses, the building official shall have the powers of a law enforceM ment officer. The building official shall have the power to render interpreta- tions of this code and to adopt and enforce rules and supplemental regulations to clarify the application of its provisions. Such inter- pretations, rules and regulations shall be in confonnity with the in- tent and purpose of this code. 201.2 Right of Entry. When it is necessary to make an inspec- tion to enforce the provisions of this code, or when the building official has reasonable cause to believe that there exists in a build- ing or upon a premises a condition that is contrary to or in violation of this code that makes the building or premises unsafe, dangerous or hazardous, the building official may enter the building or prem- ises at reasonable times to inspect or to perform the duties imposed by this code, provided that if such building or premises be occu- pied that credentials be presented to the occupant and entry re- quested. If such building or premises be unoccupied, the building official shall first make a reasonable effort to locate the owner or other person having charge or control of the building or premises and request entry. If entry is refused, the building official shall have recourse to the remedies provided by law to secure entry. 201.3 Responsibilities Defined. Owners remain liable for vio- . lations of duties imposed by this code even though an obligation is also imposed on the occupants of the building, and even though the owner has, by agreement, imposed on the occupant the duty of furnishing required equipment or of complying with this code. Buildings and structures and parts thereof shall be maintained in a safe and sanitary condition. The owner or the owner's desig- nated agent shall be responsible for such maintenance. To deter- mine compliance with this subsection, the building may be reinspected. Owners, in addition to being responsible for maintaining build- ings in a sound structural condition, shall be responsible for keep- ing that part of the building or premises which the owner occupies or comrols in a clean, sanitary and safe condition, including the shared or public areas in a building containing two or more dwell- ing units. Owners shall, when required by this code, the health ordinance or the health officer, furnish and maintain such approved sanitary facilities as required, and shall furnish and maintain approved de- vices, equipment or facilities for the prevention of insect and ro- dent infestation, and when infestation has taken place, shall be responsible for the extermination of any insects, rodents or other pests when such extermination is not specifically made the re- sponsibility of the occupant by law or ruling. Occ;upants of a dwelling unit, in addition to being responsible for keeping in a clean, sanitary and safe condition that part of the dwelling or dwelling unit or premises which they occupy and con- trol, shall dispose of their rubbish, garbage and other organic waste in a manner required by the health ordinance and approved by the health officer. Occupants shalt, when required by this code, the health ordi- nance or the health officer, furnish and maintain approved de- vices, equipment or facilities necessary to keep their premises safe and sanitary. SECTION 202 - SUBSTANDARD BUILDINGS Buildings or portions thereof that are determined to be substand- ard as defined in this code are hereby declared to be public nui- sances and shall be abated by repair, rehabilitation, demolition or removal in accordance with the procedure specified in Chapter 11 of this code. SECTION 203 - HOUSING ADVISORY AND APPEALS BOARD 203.1 General. In order to hear and decide appeals of orders, de- cisions or determinations made by the building official relative to the application and interpretations of this code, there shall be and is hereby created a housing advisory and appeals board consisting of members who are qualified by experience and training to pass upon matters pertaining to building construction and who are not employees of the jurisdiction. The building official shall be an ex officio member and shall act as secretary to said board but shall have no vote upon any matter before the board. The housing advi- sory and appeals board shall be appointed by the governing body and shall hold office at its pleasure. The board shall adopt rules of procedure for conducting its business and shall render all deci- sions and findings in writing to the appellant with a duplicate copy to the building official. Appeals to the board shall be processed in accordance with the provisions contained in Section 1201 of this code. Copies of all rules of procedure adopted by the board shall be delivered to the building official. who shall make them accessi- ble to the public. 203.2.. Limitations of Authority. The housing advisory and ap- peals board shall have no authority relative to interpretation of the administrative provisionsof this code and the board shall not be empowered to waive requirements of this code. SECTION 204 - VIOLATIONS It shall be unlawful for any person, firm or corporation to erect, construct, enlarge, alter, repair, move, improve, remove, convert or demolish, equip, use, occupy, or maintain any building or struc- ture or cause or permit the same to be done in violation of this code. 3 . . 1997 ABATEMENT OF DANGEROUS BUILDINGS 301 302 Chapter 3 DEFINITIONS SECTION 301 - GENERAL For the purpose of this code, certain terms, phrases, words and their derivatives shall be construed as specified in either this chap~ ler or as specified in the Building Code or the Housing Code. Where terms are not defined, they shall have their ordinary ac- cepted meanings within ,the context with which they are used. Webster S Third New International Dictionary of the English Lan- guage, Unabridged, copyright 1986, shall be construed as provid- ing ordinary accepted meanings. Words used in the singular include the plural and the plural the singular. Words used in the masculine gender include the feminine and the feminine the mas- culine. BUILDING CODE is the Uniform Building Code promul- gated by the International Conference of Building Officials, as adopted by this jurisdiction. DANGEROUS BUILDING is any building or structure deemed to be dangerous under the provisions of Section 302 of this code. HOUSING CODE is the Uniform Housing Code promulgated by the International Conference of Building Officials, as adopted by this jurisdiction. SECTION 302 - DANGEROUS BUILDING For the purpose of this code, any building or structure which has any or all of the conditions or defects hereinafter described shall be deemed to be a dangerous building, provided that such condi- tions or defects exist to the extent that the life, health, property or safety of the public or its occupants are endangered. 1. Whenever any door, aisle, passageway, stairway or other means of exit is not of sufficient width or size or is not so arranged as to provide safe and adequate means of exit in case of fire or pan- ic. 2. Whenever the walking surface of any aisle, passageway, stairway or other means of exit is so warped, worn, loose, torn or otherwise unsafe as to not provide safe and adequate means of exit in case of fire or panic. 3. Whenever the stress in any materials, member or portion thereof, due to all dead and live loads, is more than one and one half times the working stress or stresses allowed in the Building Code for new buildings of similar structure, purpose or location. 4. Whenever any portion thereof has been damaged by fire, earthquake, wind, flood or by any other cause, to such an extent that the structural strength or stability thereof is materially less than it was before such catastrophe and is less than the minimum requirements of the Building Code for new buildings of similar structure, purpose or location. 5. Whenever any portion or member or appurtenance thereof is likely to fail, or to become detached or dislodged, or to collapse and thereby injure persons or damage property. 6. Whenever any portion of a building, or any member, appur- tenance or ornamentation on the exterior thereof is not of suffi- cient strength or stability, or is not so anchored, attached or fastened in place so as to be capable of resisting a wind pressure of one half of that specified in the Building Code for new buildings of similar structure, purpose or location without exceeding the work- ing stresses permitted in the Building Code for such buildings. 7. Whenever any portion thereof has wracked, warped, buckled or settled to such an extent that walls or other structural portions have materially less resistance to winds or earthquakes than is required in the case of similar new construction. 8. Whenever the building or structure, or any portion thereof, because of (i) dilapidation, deterioration or decay; (ii) faulty con. struction; (iii) the removal, movement or instability of any portion of the ground necessary for the purpose of supporting such build- ing; (iv) the deterioration, decay or inadequacy of its foundation; or (v) any other cause, is likely to partially or completely collapse. 9. Whenever, for any reason, the building or structure, or any portion thereof, is manifestly unsafe for the purpose for which it is being used. 10. Whenever the exterior walls or other vertical structural members list, lean or buckle to such an extent that a plumb line passing through the center of gravity does not fall inside the middle one third of the base. 11. Whenever the building or structure, exclusive of the foun- dation, shows 33 percent or more damage or deterioration of its supporting member or members, or 50 percent damage or deterio. ration of its nonsupporting members, enclosing or outside walls or coverings. 12. Whenever the building or structure has been so damaged by fire, wind, earthquake or flood, or has become so dilapidated or deteriorated as to become (i) an attractive nuisance to children; (ii) a harbor for vagrants, criminals or immoral persons; or as to (iii) enable persons to resort thereto for the purpose of committing un- lawful or immoral acts. 13. Whenever any building or structure has been constructed, exists or is maintained in violation of any specific requirement or prohibition applicable to such building or structure provided by the building regulations of this jurisdiction, as specified in the Building Code or Housing Code, or of any law or ordinance of this state or jurisdiction relating to the condition, location or structure of huildings. 14. Whenever any building or structure which, whether or not erected in accordance with all applicable laws and ordinances, has in any nonsupporting part, member or portion less than 50 percent, or in any supporting part, member or portion less than 66 percent of the (i) strength, (ii) fire-resisting qualities or characteristics, or (iii) weather-resisting qualities or characteristics required by law in the case of a newly constructed building of like area, height and occupancy in the same location. 15. Whenever a building or structure, used or intended to be used for dwelling purposes, because of inadequate maintenance, dilapidation, decay, damage, faulty construction or arrangement, inadequate light, air or sanitation facilities, or otherwise, is deter- mined by the health officer to be unsanitary, unfit for human habi- tation or in such a condition that is likely to cause sickness or disease. 16. Whenever any building or structure, because of obsoles- cence, dilapidated condition, deterioration, damage, inadequate exits, lack of sufficient fire-resistive construction, faulty electric wiring. gas connections or heating apparatus, or other cause, is de- tt:rmined by the fire marshal to be a fire hazard. 17. Whenever any building or structure is in such a condition as to constitute a public nuisance known to the common law or in eq. uity jurisprudence. 5 1997 UNIFORM HOUSING CODE , 501 504.3 Chapter 5 SPACE AND OCCUPANCY STANDARDS SECTION 501 - LOCATION ON PROPERTY All buildings shall be located with respect to property lines and to other buildings on the same property as required by Section 503 and Chapter 6 of the Building Code. SECTION 502 - YARDS AND COURTS 502.1 Scope. This section shall apply to yards and courts having required window openings therein. 502.2 Yards. Every yard shall not be less than 3 feet (914 mm) in width for one- and two-story buildings. For buildings more than two stories in height, the minimum width of the yard shall be in- creased at the rate of 1 foot (305 mOl) for each additional story. Where yards completely surround the building, the required width may be reduced by I foot (305 mm). For buildings exceeding t4 stories in height, the required width of yard shall be computed on the basis of 14 stories. 502.3 Courts. Every court shall not be less than 3 feet (914 mm) in width. Courts having windows opening on opposite sides shall not he less than 6 feet (1829 mm) in width. Courts bounded on three or more sides by the walls of the building shall not be less than 10 feet (3048 mm) in length unless bounded on one end by a public way or yard. For buildings more than two stories in height, the court shall he increased I foot (305 mm) in width and 2 feel (610 mm) in length for each additional story. For buildings ex- ceeding 14 stories in height, the required dimensions shall be com- puted on the basis of 14 stories. Adequate access shall be provided to the bottom of all courts for cleaning purposes. Every court more than two stories in height shall be provided with a horizontal air intake at the bottom not less than 10 square feet (0.93 m2) in area and leading to the exterior of the building unless abutting a yard or public way. The construction of the air intake shall be as required for the court walls of the build- ing, but in no case shall be less than one-hour fire-resistive. Habitable space shall have a ceiling height of not less than 7 feet 6 inches (2286 mm) except as other- wise pennitted in this section. Kitchens, halls, bathrooms and toi- let compartments may have a ceiling height of not less than 7 feet (2134 mm) measured to the lowest projection from the ceiling. Where exposed beam ceiling members are spaced at less than 48 inches (1219 mm) on center, ceiling height shall be measured to the bottom of these members. Where exposed beam ceiling mem- bers are spaced at 48 inches (1219 mm) or more on center, ceiling height shall be measured to the bottom of the deck supported by these members, provided that the bottom of the members is not less than 7 feet (2134 mm) above the floor. If any room in a building has a sloping ceiling, the prescribed ceiling height for the room is required in only one-half the area thereof. No portion of the room measuring less than 5 feet (1524 mm) from the finished floor to the finished ceiling shall be in- cluded in any computation of the minimum area thereof. If any room has a furred ceiling, the prescribed ceiling height is required in two thirds the area thereof, but in no case shall the height of the furred ceiling be less than 7 feet (2134 mm). 503.2 Floor Area. Dwelling units and congregate residences shall have at least one room that shall have not less than 120 square feet (11.2 m2) of floor area. Other habitable rooms, except kitch- ens, shall have an area of not less than 70 square feet (6.5 m2). Where more than two persons occupy a room used for sleeping purposes, the required floor area shall be increased at the rate of 50 square feet (4.65 m2) for each occupant in excess of two. EXCEPTION: Nothing in this section shall prohibit the use of an efficiency living unit within an apartment house meeting the following requirements: A. The unit shall have a living room of not less than 220 square feet (20.4 m2) of superficial floor area. An additional 100 square feet (9.3 m2) of superficial floor area shall be provided for each occupant of such unit in excess of two. B. The unit shall be provided with a separate closet. C. The unit shall be provided with a kitchen sink, cooking appliance and refrigeration facilities, each having a clear working space of not less than 30 inches (762 mm) in front. Light and ventilation confonning 10 this code shall be provided. D. The unit shall be provided with a separate bathroom containing a water closet, lavatory, and bathtub or shower. 503.3 Width. No hahitahle room olher Ihan a kitchen shall be less than 7 feet (2134 mm) in any dimension. Each water closet stool shall be located in a clear space not less than 30 inches (762 mm) in width and a clear space in front of the water closet stool of not less than 24 inches (610 mm) shall be pro- vided. SECTION 504 - LIGHT AND VENTILATION 504.1 General. For the purpose of detennining the light or ven- tilation required by this section, any room may be considered as a portion of an adjoining room when one half of the area of the com- mon wall is open and unobstructed and provides an opening of not less than one tenth of the floor area of the interior room or 25 square feet (2.3 m2), whichever is greater. Exterior openings for natural light or ventilation required by this section shall open directly onto a public way or a yard or court located on the same lot as the building. EXCEPTIONS: I. Required windows may open into a roofed porch where the porch: I.J Abuts a public way, yard or court; 1.2 Has a ceiling height of not less than 7 feet (2134 mm); and 1.3 Has a longer side at leasl 65 percent open and unobstructed. 2. Skylights. 504.2 Light. Guest rooms and habitable rooms within a dwell- ing unit or congregate residence shall be provided with natural light by means of exterior glazed openings with an area not less than one tenth of the floor area of such rooms with a minimum of 10 square feet (0.93 m2). 504.3 Ventilation. Guest rooms and habitable rooms within a dwelling unit or congregate residence shall be provided with natu- ral ventilation by means of openable exterior openings with an area of not less than 1120 of the floor area of such rooms with a minimum of 5 square feet (0.46 m2). In lieu of required exterior openings for natural ventilation, a mechanical ventilating system may be provided. No mechanical fan in bathroom. ELECTRICAL Outlets are not properly spaced. Too few. Lights in closets are not spaced correctly from shelves. No GFCI outlets. Open junction box in the mechanical room. NOTE: Both units are served by single gas service to one furnace and water heater. No building permits for a past conversion were on record.
