1. This permit was issued base on t -fie m ormation provided in the permit application and accompanying plans and specifications and is
subject to the compliance with those documents, and all applicable statutes, ordinances, regulations, policies and procedures.
2. This permit shall expire 365 days after the date of issuance regardless of activity. Requests for extension must be made in writing and
received prior to the date of expiration. An extension of no more than 1.80days made be granted at the discretion of the Chief Budding
Official and may be subject to a fee equal to one-half of the original permit fee.
3. If this permit expires, a new permit may be required to be obtained. Issuance of a new permit shall be subject to the standard
requirements, fees androcedures for approval of any new permit. Re -issuance or extension of expired permits is at the sole discretion of
the Chief BudOfficial

In order to pass a final inspection on commercial elastomeric or similar type roofing, a
letter of inspection and approval from the manufacturer technical representative stating
that "the application of the roof at (project address) has been applied in accordance with
the installation instruction for (roof material brand name) roof covering" is required to
be on site at the time of final inspection.
Effective December 1, 2014, asphalt shingle installations require an approved midroof
inspection, conducted when 25-75 percent of the roof covering is installed, prior to final
approval. Installation of roof sheathing (new or overlay) is required on the entire roof
when spaced or board sheathing with ANY gap exceeding one half inch exists. Sheathing and
Mid -roof inspections may be called in at the same time, 100 percent of the sheathing must
be complete and 25-75 percent of the midroof may be complete. Asphalt shingles are required
to be fastened to the roof deck with a minimum of 6 nails per shingle. A ladder extending 3
feet above the roof eave and secured in place is required to be provided for all roof
inspections. Roof ventilation is required to comply with applicable codes and/or
manufacturer installation instructions, whichever is more stringent.

LETTER OF INTENT

This Letter of Intent ("Letter") states the contingencies upon which ECO Roof and Solar, Inc.
("Contractor") will provide restoration construction services on behalf of:
Kendall Street Apartments
for their property located at the following address,
("Client")
4295 Kendall St. Wheat Ridge ("Property"),
as a result of the claim with Lloyds of London "Carrier".)
and specifically referenced by Claim ��;, 4 `� 3Y ("Claim").
Approval of any damage to the Property by the Client's Carrier, obligates the Client to enter into a full and
binding restoration contract ("Contract") with the Contractor for the restoration of the Property, This
Contract will be fully drafted, negotiated and executed within 30 days ("Execution Date") of notice from
the Carrier of approval of the Claim. The Client must provide a copy of the Adjuster's Claim Report
("Report") and any additional Claim documentation provided by the Carrier as requested by Contractor.
The executed Contract will be in a form that is consistent with the terms set forth in this Letter, and in all
respects is mutually satisfactory to both Contractor and Client. The terms in the Letter are not to be
considered comprehensive and it is expected that any additional terms will be incorporated into the
negotiated Contract.

The basic terms of this Letter are as follows:
1. Scone of Work:
• After the signing of the Contract, the Contractor shall contact the claims representative for the
Carrier to identify any and all preliminary damage which the Contractor considers to have
resulted from the insured casualty. The Contractor will also come to an agreement with the
Carrier on the work necessary to repair such damage, and obtain written commitment from the
Carrier to pay for the cost of repairing such damage. If only a portion of the damage is covered
by the Carrier, the Contractor will work with the Carrier to come to acceptable terms for the
Client. Contractor agrees to furnish all materials and labor required to restore the Property
based upon the approved by the Carrier and the Client ("Work"). Contractor shall tie the
exclusive provider of restoration services to the Property. Contractor also reserves the right of
refusal to restore additional portions of the Property requiring contractor services as a result of
the Claim.
2. Work Schedule:
• The Contractor shall begin restoration of the Property in a reasonable amount of time after
reaching an initial agreed price with the insurance carrier and finding a mutually agreed!; upon
schedule with the Client. The Contractor will work in an uninterrupted manner to complete the
restoration unless such completion is not possible due to circumstances outside the Contractor's
control (i.e. — weather, war, acts of God, change of Client's schedule).
3. Representations and Warranties:
• Licensing: Contractor is fully qualified and licensed, to the extent necessary, to do business in
the vicinity of the project.
• Standard of Work: All materials supplied by Contractor shall be new. All Work shall be
performed in a good and workmanlike manner, free from faults and defects, and in accordance
with the highest standards of the trade, in the Front Range Metro Area and in accordance with
the Plans and Specifications, and applicable governmental building codes and other laws, rules,
ordinances, requirements and regulations applicable to the Work. Contractor shall furnish all
tools, equipment, supplies and materials necessary to perform the Work.
• Property Protection and Rubbish: Contractor shall take all reasonable measures to protect
the Property for damage during the restoration. Contractor will also remove all restoration
related rubbish, debris, and waste material arising from the Work upon completion of the
project.
• Safety: Contractor shall take all reasonable safety precautions with respect to the Work, shall

public authority for the safety of persons or property.
• Delivery of Work: Contractor shall deliver the Work to the Client in good condition, free and
clear of all claims, liens and encumbrances arising by acts of Contractor.
• Avoidable Damage due to Restoration: Contractor shall be responsible for all avoidable
damage or injury arising from Contractor's performance of the Work.
• Insurance: Contractor shall, in a manner satisfactorily to the Client, maintain at its own
expense until the completion of the Work and final payment: 1) Worker's Compensation and

Employer Liability Insurance; 2) Comprehensive General Liability Insurance, and; 3)
Comprehensive Automotive Liability Insurance.
Indemnification: Contractor shall indemnify the Client against any and all loss, damage,
liability or, claims arising from the activities of Contractor on or about the Property.
Workmanship Warranty: Contractor shall warrant that all workmanship performed shall be
free from defects for a period of 5 years (the "Warranty Period") on Flat and Steep Roofs from
the date of Client signing Contractor's Certificate of Completion ("Certificate of Completion").
4. Compensation:
• A final payment schedule for the Work performed by the Contractor will be included m the
Contract and will be based upon the initial and final Adjuster's Report(s). Any ;other
considerations for payment schedule will be determined during the Contract negotiation
between the Contractor and the Client and will be mutually agreed upon at that time.

these permits.
I would like to cancel the following permits & we do not need a refund of the $50 permit fee.

We had originally pulled these permits so that we could submit the asbestos lab reports & remove some drywall to see
what we would or would not be able to do here.
We since decided, with the costs we received from vendors, that this potential project would not fit into the budget we

We have updated the units with new paint, flooring, cabinets & countertops & will not be pursuing any additional
construction in these units.

NOTICE
The property owner, and all current occupants, are hereby notified that the undersigned
Building Official of Wheat Ridge, Colorado, has found the building located on the above
described real property to be Substandard Housing within the meaning of Section 1001 of
the Uniform Housing Code, 1997 edition, as adopted by the City of Wheat Ridge,
Colorado ("Code"), as more particularly set out below:
The building is being used for dwelling purposes and is in violation of the Uniform
Housing Code, sections in bold are those sections that this property is in violation of.
SECTION 301 - GENERAL
For the purpose of this code, certain terms, phrases, words and their derivatives shall be construed as
specified in either this chapter or as specified in the Building Code or the Housing Code. Where terms are
not defmed, they shall have their ordinary accepted meanings within the context with which they are used.
Webster's Third new International Dictionary of the English Language, Unabridge, copyright 1986, shall
be construed as providing ordinary accepted meanings. Words used in the singular masculine gender
include the feminine and the feminine the masculine.
BUILDING CODE is the International Code Council, as adopted by this jurisdiction.
DANGEROUS BUILDING is any building or structure deemed to be dangerous under the provisions of
Section 302 of this code.
HOUSING CODE is the Uniform Housing Code promulgated by the International Conference of building
Officials, as adopted by this jurisdiction.
INTERNATIONAL PROPERTY MAINTENANCE CODE is the 2003 International Property
Maintenance Code promulgated by the International Code Council, as adopted by this jurisdiction.
SECTION 302 - DANGEROUS BUILDING
For the purpose of this code, any building or structure which has any or all of the conditions or defects
hereinafter described shall be deemed to be a dangerous building, provided that such conditions or defects
exist to the extent that the life, health, property or safety of the public or its occupants are endangered.
1. Whenever any door, aisle, passageway, stairway or other means of exit is not of sufficient width or
size or is not so arranged as to provide safe and adequate means of exit in case of fire or panic.
2. Whenever the walking surface of any aisle, passageway, stairway or other means of exit is so
warped, worn. Loose, tom or otherwise unsafe as to not provide safe and adequate means of exit in
case of frre or panic.
3. Whenever the stress in any materials, member or portion thereof, due to all dead and life loads, is
more than one and one half limes the working stress or stresses allowed in the Building Code for
new buildings of similar structure, purpose or location.
4. Whenever any portion thereof has been damaged by fire, earthquake, wind, flood or by any other
cause, to such an extent that the structural strength or stability thereof is materially less than it was
before such catastrophe and is less than the minimum requirements of the Building Code for new
buildings of similar structure, purpose or location.
5. Whenever any portion or member or appurtenance thereof is likely to fail, or to become detached
or dislodged, or to collapse and thereby injure persons or damage property.
6. Whenever any portion of a building, or any member, appurtenance or ornamentation on the
exterior thereof is not of sufficient strength or stability, or is not so anchored, attached or fastened
in place so as to be capable of resisting a wind pressure of one half of that specified in the building
Code for new buildings of similar structure, purpose or location without exceeding the working
stressed permitted in the Building Code for such buildings.
7. Whenever any portion thereof has wracked, warped, buckled or settled to such an extent that walls
or other structural portions have materially less resistance to winds or earthquakes than is required
in the case of similar new construction.
8. Whenever the building or structure, or any portion thereof, because of (i) dilapidation,
deterioration or decay; (ii)faulty construction; (iii) the removal, movement or instability of any
portion of the ground necessary for the purpose of supporting such buildings; (iv) the
deterioration, decay or inadequacy of its foundation; or (v) any other cause, is likely to partially or
completely collapse.
9. Whenever, for any reason, the building or structure, or any portion thereof, is manifestly unsafe
for purpose of which it is being used.
10. Whenever the exterior walls or other vertical structural members list, lean or buckle to such an
extent that a plumb line passing through the center of gravity does not fall inside the middle on
third of the base.
II. Whenever the building or structure, exclusive of the foundation, shows 33 percent or more damage
or deterioration of its supporting member or members, or 50 percent damage or deterioration of its
non-supporting members, enclosing or outside walls or coverings.
12. Whenever the building or structure has been so damaged by fIre, wind, earthquake or flood, or has
become so dilapidated or deteriorated as to become (i) an attractive nuisance to children; (ii) a
harbor for vagrants, criminals or immoral persons; or as to (iii) enable persons to resort thereto for
the purpose of committing unlawful or immoral acts.
13. Whenever any building or structure has been constructed, exists or is maintained in violation of
any specifIc requirement or prohibition applicable to such building or structure provided by the
building regulations of this jurisdiction, as specifIed in the Building Code or Housing Code, or of
any law or ordinance of this state or jurisdiction relating to the condition, location or structure of
buildings.
14. Whenever any building or structure which, whether or not erected in accordance with a all
applicable laws and ordinances, has in any non-supporting part, member or portion less than 50
percent, or in any supporting part, member or portion less the 66 percent or the (i) strength, (ii)
flTe-resisting qualities or characteristics, or (iii) weather-resisting qualities or characteristics
required by law in the case of a newly constructed building of like area, height and occupancy in
the same location.
15. Whenever a building or structure, used or intended to be used for dwelling purposes, because of
inadequate maintenance, dilapidation, decay, damage, faulty construction or arrangement,
inadequate light, air or sanitation facilities, or otherwise, is determined by the health officer to be
unsanitary, unfIt for human habitation or in such a condition that is likely to cause sickness or
disease.
16. Whenever any building or structure, because of obsolescence, dilapidated condition, deterioration,
damage, inadequate exists, lack of sufficient fIre-resistive construction, faulty electric wiring, gas
connections or heating apparatus, or other cause, is determined by the fIre marshal to be a fIre
hazard.
17. Whenever any building or structure is in such a condition as to constitute a public nuisance known
to the common law or in equity jurisprudence.
18. Whenever any portion or a building or structure remains on a site after the demolition or
destruction of the building or structure or whenever any building or structure is abandoned for a
period in excess of six months so as to constitute such building or portion thereof an attractive
nuisance or hazard to the public.
The 1997 Uniform Housing Codes states:
SECTION 1001 - DEFINITIONS
1001.1 General. Any building or portion thereof that is determined to be an unsafe building in accordance
with Section 102 of the Building Code, or any building or portion thereof, including any dwelling unit,
guest room or suite or rooms, or the premises on which the same is located, in which there exists any of the
conditions referenced in this section to an extent that endangers the life, limb, health, property, safety or
welfare of the public or the occupants thereof, shall be deemed and hereby are declared to be substandard
buildings.
1001.2 Inadequate Sanitation. Buildings or portions thereof shall be deemed substandard when they are
when they are in sanitary. Inadequate sanitation shall include, but not be limited to, the following:
I. Lack of or improper water closet, lavatory, bathtub or shower in a dwelling unit or lodging house.
2. Lack of or improper water closets, lavatories, and bathtubs or showers per number or guests in a
hotel.
3. Lack of or improper kitchen sink in a dwelling unit.
4. Lack of hot or cold running water to plumbing fixtures in a hotel
5. Lack of hot or cold running water to plumbing fixtures in a dwelling unit or lodging house.
6. Lack of adequate heating facilities.
7. Lack of or improper operation or required ventilating equipment.
8. Lack of minimum amounts of natural light and ventilation require by this code.
9. Room and space dimensions less than required by this code.
10. Lack of required electrical lighting.
II. Dampness of habitable rooms.
12. Infestation of insects, vermin or rodents as determined by the health officer.
13. General dilapidation or improper maintenance.
14. Lack of connection to required sewage disposal system.
15. Lack of adequate garbage and rubbish storage and removal facilities as determined by the health
officer.
1001.3 Structnral Hazards. Buildings or portions thereof shall be deemed substandard when they are or
contain structural hazards. Structural hazards shall include, but not be limited to, the following:
I. Deteriorated or inadequate foundations.
2. Defective or deteriorated flooring or floor supports.
3. Flooring or floor supports of insufficient size to cany imposed loads with safety.
4. Members of walls, partitions or other vertical supports that split, lean, list or buckle do to defective
material or deteriorations.
5. Members of walls, partitions or olber vertical supports that are of insufficient size to carry
imposed loads with safety.
6. Members of ceilings, roofs, ceiling and roof supports, or olber horizontal members that sag, split
or buckle due to defective material or deterioration.
7. Members of ceilings, roofs, ceiling and roof supports, or other horizontal members Ibat are of
insufficient size to carry imposed lads with safety.
8. Fireplaces or chimneys that list, bulge 0 settle due to defective material or deterioration.
9. Fireplaces or chimneys that are of insufficient size or strength to cany imposed loads wilb safety.
1001.4 Nuisance. Buildings or portions thereof in which there exists any nuisance as defined in this code
are deemed substandard bnildings.
1001.5 Hazardous Electrical Wiring. Electrical wiring that was installed iu violation of code
requirements in erfect at the time of installation or electrical wiring uot Installed In accordance with
generally accepted construction practices in areas where no codes were in effect or that has not been
maintained in good conditlou or that is not being used in a safe manner shall be considered
substandard.
1001.6 Hazardous Plumbing. Plumbing that was installed in violation of code requirements in effect at
the time of installation or plumbing not installed in accordance with generally accepted construction
practices in areas where no codes were in effect or that has not been maintained in good condition or that is
not being used in a safe manner shall be considered substandard.
1001.7 Hazardous Mechanical. Mechanical equipment that was installed in violation of code
requirements in effect at the time of installation or mechanical equipment not installed In accordance
with generally accepted construction practices In areas where no codes were in effect or that bas not
been maintained in good condition or that is not being used in a safe manner shall be considered
substandard.
1001.8 Faulty Weather Protections. Buildings or portions thereof shall be considered substandard
when they have faulty weather protections, which shall include, but not be limited to, the following:
1. Deteriorated, crumbling or loose pIaster.
2. Deteriorated or ineffective waterproofing or exterior walls, roof, foundations or floors,
including broken windows or doors.
3. Defective or lack of weather protection for exterior wall coverings, including lack of paint,
or weathering due to lack of paint or other approved protective covering.
4. Broken, rotted, split or buclded exterior wall coverings or roof coverings.
1001.9 Fire Hazard. Any building or portion thereof, device, apparatus, equipment, combustible waste, or
vegetation that, in the opinion of the chief of the fIre department, is in such a condition as to cause a fIre or
explosion or provide a ready fuel to augment the spread and intensity of fIre or explosion arising from any
cause shall be considered substandard.
1001.10 Faulty Materials of Construction. The use of materials of construction, except those that are
specifIcally allowed or approved by this code and the Building Code, and that have been adequately
maintained in good and safe conditions, shall cause a building to be substandard.
1001.11 Hazardous or Insanitary Premises. The accumulation of weeds, vegetation, junk, dead organic
matter, debris, garbage, offal, rat harborages, stagnant water, combustible materials, and similar materials
or conditions on a premises constitutes fire, health or safety hazards that sball be abated in accordance with
the procedures specifIed in Chapter II of this code.
1001.12 Inadequate Exits. Except for those buildings or portions thereof that have been provided with
adequate exit facilities conforming to the provisions of this code, buildings or portions thereof whose exit
facilities were installed in violation of code requirements in effect at the time of their construction or whose
exit facilities have not been increased in number or width in relations to any increase in occupant load due
to alterations, additions or change in use or occupancy subsequent to the time of construction shall be
considered substandard.
Notwithstanding compliance witb code requirements in effect at the time of their construction,
buildings or portions thereof sball be considered substandard wben the building official fmds that an unsafe
condition exists through an improper location of exits, a lack of an adequate number or width of exits, or
wben other conditions exist that are dangerous to human life.
1001.13 Inadequate Fire-Protection or Fire-Fighting Equipment. Buildings or portions tbere of shall
be considered snbstandard when they are not provided with the fire-resistive construction or fire-
extinguishing systems or equipment required by this code, except those buildings or portions thereof
that conformed with all applicable laws at the time of their construction and whose fire-resistive
integrity and fire-extinguishing systems or equipment has been adequately maintained and improved
in relation to any increase in occupant load, alteration or addition, or any change in occupancy.
1001.14 Improper Occupancy. All buildings or portions thereof occupied for living, sleeping, cooking or
dining purposes that were not designed or intended to be used for such occupancies shall be considered
substandard.
The following is a list of items that shall be fixed to meet code:
I. Bedroom windows do not meet egress requirements of the
Uniform Building Code or the International Building Code as
required in Section R31 O.
2. Need smoke detectors in each bedroom and one in the living
room.
3. Domestic Hot water shall have a circulation pump to provide
all units with hot water.
4. All penetrations through fire separation walls, ceilings and
floors shall be rated or fire calked.
5. Signs shall be put on Mechanical room doors stating,
"Mechanical Room".
6. Need Boiler Certification from the State of Colorado..
7. Crawlspace vents shall be re-installed to provide ventilation.
8. Boiler rooms shall be provided with outside make up air.
9. Un used gas lines shall be capped off in mechanical room.
10. Electrical Breaker Boxes shall be labeled.
11. Rooms with electrical disconnect shall be labeled, "Main
Electrical Disconnect".
12. Need door knobs on doors.
13. Crawlspace access shall be 1 hour fire rated door and
assembly.
14. Rotten wood holding up gutters.
15. Exterior bricks have fallen off or are missing.
16. Faulty hot water heater ventilation.
17. Faulty weather protection over doors and windows.
ORDER
The City of Wheat Ridge Building Official has determined the building referenced above
to be a Substandard Housing and to constitute a health hazard if not fixed. The owners
are ordered to pull a building permit to fix the deficient items. If such items are not fixed
by June 30, 2005, the Building Department will post 4295 Kendall Street in Wheat Ridge
CO. 80033 as Substandard Housing. All existing tenants may stay in the building as
long as a permit is pulled to fix the issues. When a tenant moves out of the rental unit,
that unit shall not be leased out until all items are brought to code. Pursuant to Code
future tenants shall not be permitted to occupy these units until all issues are brought up
to code and are inspected by the City of Wheat Ridge Building Department. This is
therefore required in order to protect life, health and safety of the public.
The property owner and all future occupants (not current occupants) are hereby
ORDERED TO CEASE AND DESIST occupancy and use of the above described
building. The Building Official shall cause the property to be posted with the
attached Notice after June 30, 2005 and shall take action to remove all future
occupants from the building until the building is brought up to code.
REMEDIAL ACTION
1. The property owner must apply for and obtain a City of Wheat Ridge building permit
to correct the following deficiencies.
I. All deficiencies shall be fixed but are not limited to the items on this list.
APPEAL OF THIS NOTICE AND ORDER
Any person having record title or other legal interest in the above described premises may
appeal this Notice and Order or any action ofthe Building Official to the Building Code
Advisory Board or known as the Board of Appeals pursuant to section 112 of the Code,
provided that the appeal is made in writing as provided in the Code and filed with the
Building Official within ten (10) days from the date of service of this Notice and Order.
Failure to appeal will constitute a waiver of all rights to an administrative hearing and
determination of this matter. FILING OF AN APPEAL SHALL NOT STAY THE
EFFECTIVENESS OF THIS NOTICE AND ORDER.
It is a misdemeanor to occupy this building, or to remove or deface this notice.

4. Lack of hot or cold running water to plumbing fixtures in a hotel
5. Lack of hot or cold running water to plumbing fixtures in a dwelling unit or lodging house.
6. Lack of adequate heating facilities.
7. Lack of or improper operatiou or required ventilating equipment.
8. Lack of minimum amounts of natural light and ventilation require by this code.
9. Room and space dimensions less than required by this code.
10. Lack of required electrical lighting.
11. Dampness of habitable rooms.
12. Infestation of insects, vennin or rodents as detennined by the health officer.
13. General dilapidation or improper maintenance.
14. Lack of connection to required sewage disposal system.
15. Lack of adequate garbage and rubbish storage and removal facilities as determined by the health
officer.
1001.3 Structural Hazards. Buildings or portions thereof shall be deemed substandard when they are or
contain structural hazards. Structural hazards shall include, but not be limited to, the following:
1. Deteriorated or inadequate foundations.
2. Defective or deteriorated flooring or floor supports.
3. Flooring or floor supports of insufficient size to carry imposed loads with safety.
4. Members of walls, partitions or other vertical supports that split, lean, list or buckle do to defective
material or deteriorations.
5. Members of walls, partitions or other vertical supports that are of insufficient size to carry
imposed loads with safety.
6. Members of ceilings, roofs, ceiling and roof supports, or other horizontal members that sag, split
or buckle due to defective material or deterioration.
7. Members of ceilings, roofs, ceiling and roof supports, or other horizontal members that are of
insufficient size to carry imposed lads with safety.
8. Fireplaces or chimneys that list, bulge 0 settle due to defective material or deterioration.
9. Fireplaces or chimneys that are of insufficient size or strength to carry imposed loads with safety.
1001.4 Nuisance. Buildings or portions thereof in which there exists any nuisance as defined in this code
are deemed substandard buildings.
1001.5 Hazardous Electrical Wiring. Electrical WIrlDg that was installed in violation of code
requirements in effect at the time of iustallation or electrical wiring not installed in accordance with
generally accepted construction practices in areas where no codes were in effect or that has not been
maintained in good condition or that is not being used in a safe manner shall be considered
substandard.
1001.6 Hazardous Plumbing. Plumbing that was installed in violation of code requirements in effect at
the time of installation or plumbing not installed in accordance with generally accepted construction
practices in areas where no codes were in effect or that has not been maintained in good condition or that is
not being used in a safe manner shall be considered substandard.
1001.7 Hazardous Mechanical. Mechanical equipment that was installed in violation of code
requirements in effect at the time of installation or mechanical equipment not installed in accordance
with generally accepted construction practices in areas where no codes were in effect or that has not
been maintained in good condition or tbat is not being used in a safe manner sball be considered
substandard.
1001.8 Faulty Weather Protections. Buildings or portions thereof shall be considered substandard
when they bave faulty weatber protections, wbich shall include, but not be limited to, the following:
1. Deteriorated, crumbling or loose plaster.
2. Deteriorated or ineffective waterproofing or exterior walls, roof, foundations or floors,
including broken windows or doors.
3. Defective or lack of weather protection for exterior wall coverings, including lack of paint,
or weathering due to lack of paint or other approved protective covering.
4. Broken, rotted, split or buckled exterior wall coverings or roof coverings.
1001.9 Fire Hazard. Any building or portion thereof, device, apparatus, equipment, combustible waste, or
vegetation that, in the opinion of the chief of the fIre department, is in such a condition as to cause a fire or
explosion or provide a ready fuel to augment the spread and intensity of fIre or explosion arising from any
cause shall be considered substandard.
1001.10 Faulty Materials of Construction. The use of materials of construction, except those that are
specifIcally allowed or approved by this code and the Building Code, and that have been adequately
maintained in good and safe conditions, shall cause a building to be substandard.
1001.11 Hazardous or Insanitary Premises. The accumulation of weeds, vegetation, junk, dead organic
matter, debris, garbage, offal, rat harborages, stagnant water, combustible materials, and similar materials
or conditions on a premises constitutes ftre, health or safety hazards that shall be abated in accordance with
the procedures specifIed in Chapter II of this code.
1001.12 Inadequate Exits. Except for those buildings or portions thereof that have been provided with
adequate exit facilities confonning to the provisions of this code, buildings or portions thereof whose exit
facilities were installed in violation of code requirements in effect at the time of their construction or whose
exit facilities have not been increased in number or width in relations to any increase in occupant load due
to alterations, additions or change in use or occupancy subsequent to the time of construction shall be
considered substandard.
Notwithstanding compliance with code requirements in effect at the time of their construction,
buildings or portions thereof shall be considered substandard when the building official fInds that an unsafe
condition exists through an improper location of exits, a lack of an adequate number or width of exits, or
when other conditions exist that are dangerous to human life.
1001.13 Inadequate Fire-Protection or Fire-Fighting Equipment. Buildings or portions there of shall
be considered substandard when they are not provided with the fire-resistive construction or fire-
extingnishing systems or equipment required by this code, except those buildings or portions thereof
that conformed with all applicable laws at the time of their construction and whose fire-resistive
integrity and fire-extinguishing systems or equipment has been adequately maintained and improved
in relation to any increase in occupant load, alteration or addition, or any change in (K;cupancy.
1001.14 Improper Occupancy. All buildings or portions thereof occupied for living, sleeping, cooking or
dining purposes that were not designed or intended to be used for such occupancies shall be considered
substandard.
The following is a list of items that shall be fixed to meet code:
I. Bedroom windows do not meet egress requirements of the
Uniform Building Code or the International Building Code as
required in Section R31 O.
2. Need smoke detectors in each bedroom and one in the living
room.
3. Domestic Hot water shall have a circulation pump to provide
all units with hot water.
4. All penetrations through fire separation walls, ceilings and
floors shall be rated or fire calked.
5. Signs shall be put on Mechanical room doors stating,
"Mechanical Room".
6. Need Boiler Certification from the State of Colorado..
7. Crawlspace vents shall be re-installed to provide ventilation.
8. Boiler rooms shall be provided with outside make up air.
9. Un used gas lines shall be capped off in mechanical room.
10. Electrical Breaker Boxes shall be labeled.
11. Rooms with electrical disconnect shall be labeled, "Main
Electrical Disconnect".
12. Need door knobs on doors.
13. Crawlspace access shall be I hour fire rated door and
assembly.
14. Apartments in basement of 9295 lack proper egress, egress out
of basement needs to be fixed, need to extend hallway to
exterior wall.
15. Standing water in mechanical room.
16. Rotten wood holding up gutters.
17. Lack of exterior bricks.
18. Faulty hot water heater ventilation.
19. Faulty weather protection over doors and windows.
ORDER
The City of Wheat Ridge Building Official has determined the building referenced above
to be a Substandard Housing and to constitute a health hazard ifnot fixed. The owners
are ordered to pull a building permit to fix the deficient items. If such items are not fixed
by June 30, 2005, the Building Department will post 4295 Kendall Street in Wheat Ridge
CO. 80033 as Substandard Housing. All existing tenants may stay in the building as
long as a permit is pulled to fix the issues. When a tenant moves out of the rental unit,
that unit shall not be leased out until all items are brought to code. Pursuant to Code
future tenants shall not be permitted to occupy these units until all issues are brought up
to code and are inspected by the City of Wheat Ridge Building Department. This is
therefore required in order to protect life, health and safety of the public.
The property owner and all future occupants (not current occupants) are hereby
ORDERED TO CEASE AND DESIST occupancy and use of the above described
building. The Building Official shall cause the property to be posted with the
attached Notice after June 30, 2005 and shall take action to remove all future
occupants from the building until the building is brought up to code.
REMEDIAL ACTION
I. The property owner must apply for and obtain a City of Wheat Ridge building permit
to correct the following deficiencies.
1. All deficiencies shall be fixed but are not limited to the items on this list.
APPEAL OF THIS NOTICE AND ORDER
Any person having record title or other legal interest in the above described premises may
appeal this Notice and Order or any action of the Building Official to the Building Code
Advisory Board or known as the Board of Appeals pursuant to section 112 of the Code,
provided that the appeal is made in writing as provided in the Code and filed with the
Building Official within ten (10) days from the date of service of this Notice and Order.
Failure to appeal will constitute a waiver of all rights to an administrative hearing and
determination of this matter. FILING OF AN APPEAL SHALL NOT STAY THE
EFFECTIVENESS OF THIS NOTICE AND ORDER.
It is a misdemeanor to occupy this building, or to remove or deface this notice.

On March 18, 2005 T was a waken by some pounding on what
sounded like the water pipes under the apartments. When 1 got out of bed to
try and wash up a little there was no water as it had been shut off for some
time. About one hour later I check it again to see ifT would be able to take a
shower, the water was back on and the hot water came out for about five
seconds then went to a lukewarm temperature. The next day I went to take a
shower again and the water started out lukewarm then went cold a short time
later. T have not had hot water since this time. T talked to one of my
neighbors and her if she had been without hot water as welL She told me
that she has been without hot water for about the same period oftime. She
also told me that she had contacted our leasing agent ( KLOS Real Estate
Services, Inc ) about this by phone twice and once through another tenant
that takes care of the lawn. On March 31, 2005 I had told her that I had e-
mailed KLOS about the situation and they had until the fifteenth to get it
fixed. As of April 6, 2005 I still have not heard from anyone at the otftce of
KLOS R.E.S.in regards to what is being done. While talking to her we were
checking out some of the exterior of the building and noticed that it looks
like the roof is sagging in several areas over different units and that the brick
work is starting crumble in the areas right under the bathroom windows.
1 contacted your office on April 5, 2005 and left a message, you
returned my call the next morning at which time T explained my situation.
After getting of the phone with you I checked my water and got hot water for

about two seconds and it went to lukewann again for about five seconds
then started dropping in temperature for there. I am writing you this brief
summery of the situation upon your request. At the bottom of this summery
