SUBJECT: Presence of two single-family homes on the property
The property at 2868 Benton Street is zoned Residential -One C (R -1C) and consists of three
nonconforming lots of record, each 25 feet wide, for a total width of 75 feet and totaling
approximately 9,975 square feet. These lots were platted in 1890 as part of the Lakeside Resub.
The property contains two single-family homes built in approximately 1917 and 1919. The City
has recognized both homes as legal dwelling units, most recently in 2006 when Certificates of
Occupancy were provided for both structures after life safety issues were brought up to code.
The houses are also recognized by the Jefferson County Assessor as separate single-family
homes. Each home has been assigned an address that is recognized by the City, County, and
USPS.
Based on these findings, the presence of two single-family homes on this property is considered
a "legally nonconforming" condition and subject to the protections and limitations of Section
26-120 of the zoning code. The R -1C zone district only allows one single-family home per
property. If one single-family home is voluntarily demolished, it could not be replaced with an
additional primary dwelling unit. If both homes are voluntarily demolished, one new single-
family home could be built on the property after approval of a consolidation plat (to remove the
internal lot lines) and a building permit. Because the two homes are on one property, they may
not be sold separately.

SECTION 301 - GENERAL
For the purpose of this code, certain tenns, phrases, words and the" derivatives shall be construed as
specified in either this chapter or as specified in the Building Code or e Housing Code. Where tenns are
not defined, they shall have their ordinary accepted meanings within t context with which they are used.

BUILDING CODE is the International Code Council, as adopted by t . s jurisdiction.
DANGEROUS BUILDING is any building or structure deemed to b dangerous under the provisions of
Section 302 of this code.
HOUSING CODE is the Uniform Housing Code promulgated by the ternational Conference of building
Officials, as adopted by this jurisdiction.
INTERNATIONAL PROPERTY MAINTENANCE CODE is the 2003 International Property
Maintenance Code promulgated by the International Code Council, as opted by this jurisdiction.
SECTION 302 - DANGEROUS BIDLDING
For the purpose of this code, any building or structure which has an or all of the conditions or defects
hereinafter described shall be deemed to be a dangerous building, pro ided that such conditions or defects
exist to the extent that the life, health, property or safety of the public 0 its occupants are endangered.

deterioration, decay or inadequacy of its foundation; or (v) an other cause, is likely to partially or
completely collapse.
9. Whenever, for any reason, the building or structure, or ny portion thereof, is manifestly
unsafe for purpose of which it is being used.
10. Whenever the exterior walls or other vertical structural me ers list, lean or buckle to such an
extent that a plumb line passing through the center of gravi does not fall inside the middle on

or has become so dilapidated or deteriorated as to bee me (i) an attractive nuisance to
children; (il) a harbor for vagrants, criminals or immo al persons; or as to (iii) enable
persons to resort thereto for the purpose of committing unl wful or immoral acts.
13. Whenever any building or structure has been coostru ted, exists or is maintained in
violation of any specific requirement or prohibition applic ble to such building or structure
provided by the building regulations of this jurisdiction, a specified in the Building Code or
Housing Code, or of any law or ordinance of this sta or jurisdiction relating to the
condition, location or structure of buildings.
14. Whenever any building or structure which, whether or no erected in accordance with a all
applicable laws and ordinances, has in any non-supporting p , member or portion less than 50
percent, or in any supporting part, member or portion less th 66 percent or the (i) strength, (ii)
fIre-resisting qualities or characteristics, or (iii) weather-r sisting qualities or characteristics
required by law in the case of a newly constructed building 0 like area, height and occupancy in
the same location.
15. Whenever a building or structure, used or intended to be used for dwelling purposes,
because of inadequate maintenance, dilapidation, decay damage, faulty construction or
arrangement, inadequate light, air or sanitation facilities, r otherwise, is determined by the
health officer to be unsanitary, unfit for human habitati n or in such a condition that is
likely to cause sickness or disease.
16. Whenever any building or structure, because of obs lescence, dilapidated condition,
deterioration, damage, inadequate exists, lack of sufficien fire-resistive construction, faulty
electric wiring, gas connections or heating apparatus, or ther cause, is determined by the
fire marshal to be a fire hazard.
17. Whenever any building or structure is in such a condition as to constitute a public nuisance
known to the common law or in equity jurisprudence.
18. Whenever any portion or a building or structure remains on a site after the demolition or
destruction of the building or structure or whenever any buil . g or structure is abandoned for a
period in excess of six months so as to constitute such buil ing or portion thereof an attractive
nuisance or hazard to the public.
The 1997 Uniform Housing Codes states:
SECTION 1001 - DEFINITIONS
1001.1 General. Any building or portion thereof that is determined to e an unsafe building in accordance
with Section 102 of the Building Code, or any building or portion reof, including any dwelling unit,
guest room or suite or rooms, or the premises on which the same is loc ed, in which there exists any of the
conditions referenced in this section to an extent that endangers the Ii e, limb, health, property, safety or
welfare of the public or the occupants thereof, shall be deemed and he eby are declared to be substandard
buildings.
1001.2 Inadequate Sanitation. Buildings or portions thereof shall be deemed substandard when they are
when they are in sanitary. Inadequate sanitation shall include, but not b limited to, the following:
1. Lack of or improper water closet, lavatory, bathtub or sh wer in a dwelling nnit or lodging
house.
2. Lack of or improper water closets, lavatories, and bathtubs 0 showers per number or guests in a
hotel.
3. Lack of or improper kitchen sink in a dwelling unit.
4. Lack of hot or cold running water to plumbing fixtures in a h el

6. Lack of adequate heating facilities.
7. Lack of or improper operation or required ventilating eq 'pment.
8. Lack of minimum amounts of natural light and ventilatio require by this code.
9. Room and space dimensions less than required by this code.
10. Lack of required electrical lighting.
11. Dampness of habitable rooms.
12. Infestation of insects, vermin or rodents as determined by the ealth officer.
13. General dilapidation or improper maintenance.
14. Lack of connection to required sewage disposal system.
15. Lack of adequate garbage and rubbish storage and removal Ii cilities as determined by the health
officer.
1001.3 Structural Hazards. Buildings or portions thereof shall be de med substandard when they are or
contain structural hazards. Structural hazards shall include, but not be I .ted to, the following:
I. Deteriorated or inadequate foundations.
2. Defective or deteriorated flooring or floor supports.
3. Flooring or floor supports of insufficient size to carry imposed oads with safety.
4. Members of walls, partitions or other vertical supports t t split, lean, list or buckle do to
defective material or deteriorations.
5. Members of walls, partitions or other vertical supports th are of insufficient size to carry
imposed loads with safety.
6. Members of ceilings, roofs, ceiling and roof supports, or 0 er horizontal members that sag,
split or buckle due to defective material or deterioration.
7. Members of ceilings, roofs, ceiling and roof supports, or her horizontal members that are
of insufficient size to carry imposed lads with safety.
8. Fireplaces or chimneys that list, bulge 0 settle due to defective material or deterioration.
9. Fireplaces or chimneys that are of insufficient size or strength 0 cany imposed loads with safety.
1001.4 Nuisance. Buildings or portions thereof in which there exi s any nuisance as defined in this
code are deemed substandard buildings.
1001.5 Hazardous Electrical Wiring. Electrical wIrIng that w s installed in violation of code
requirements in effect at the time of installation or electrical wirin not installed in accordance with
generally accepted construction practices in areas where no codes ere in effect or that has not been
maintained in good condition or that is not being used in a s fe manner shall be considered
substandard.
1001.6 Hazardous Plumbing. Plumbing that was installed in violat n of code requirements in effect
at the time of installation or plumbing not installed in acco dance with generally accepted
construction practices in areas where no codes were in effect or tha has not been maintained in good
condition or that is not being used in a safe manner shall be conside ed substandard.
1001.7 Hazardous Mechanical. Mechanical equipment that wa installed in violation of code
requirements in effect at the time of installation or mechanical equi ment not installed in accordance
with generally accepted construction practices in areas where no co es were in effect or that has not
been maintained in good condition or that is not being used in a afe manner shall be considered
substandard.
1001.8 Faulty Weather Protections. Buildings or portions thereof hall be considered substandard
when they have faulty weather protections, which shall include, but ot be limited to, the following:
1. Deteriorated, crumbling or loose plaster.
2. Deteriorated or ineffective waterproofing or exterior wa Is, roof, foundations or floors,
including broken windows or doors.
3. Defective or lack of weather protection for exterior wall c erings, including lack of paint,
or weathering due to lack of paint or other approved protec ve covering.
4. Broken, rotted, split or buckled exterior wall coverings or r f coverings.
1001.9 Fire Hazard. Any building or portion thereof, device, app ratus, equipment, combustible
waste, or vegetation that, in the opinion of the chief of the fire depart ent, is in such a condition as to
cause a fire or explosion or provide a ready fuel to augment the pread and intensity of fire or
explosion arising from any cause shall be considered substandard.
1001.10 Faulty Materials of Construction. The use of materials of co struction, except those that are
specifically allowed or approved by this code and the Building Code and that have been adequately
maintained in good and safe conditions, shall cause a building to be s bstandard.
1001.11 Hazardous or Insanitary Premises. The accumulation of weeds, vegetation, junk, dead
organic matter, debris, garbage, offal, rat harborages, stagnant wa er, combustible materials, and
similar materials or conditions on a premises constitutes fire, health or safety hazards that shall be
abated in accordance with the procedures specified in Chapter 11 of t is code.
1001.12 Inadeqnate Exits. Except for those bnildings or portions t ereof that have been provided
with adequate exit facilities conforming to the provisions of this cod bnildings or portions thereof
whose exit facilities were installed in violation of code requirement in effect at the time of their
construction or whose exit facilities have not been increased in Dum er or width in relations to any
increase in occupant load due to alterations, additions or change in u e or occupancy subsequent to
the time of construction shall be considered substandard. Notwith anding compliance with code
requirements in effect at the time of their construction, building or portions thereof shall be
considered substandard when the building official finds that an uns fe condition exists through an
improper location of exits, a lack of an adequate number or width f exits, or when other conditions
exist that are dangerous to human life.
1001.13 Inadequate Fire-Protection or Fire-Fighting Equipment. uildings or portions there of shall

1001.14 Improper Occupancy. All buildings or portions thereof ace pied for living, sleepiug, cooking
or dining purposes that were not designed or intended to be us d for such occupancies shall be
considered substandard.
The following is a list of items that shall be fixed to meet co e:
1. The siding shall be repaired.
2. Broken windows shall be fixed.
3. Openings to the building shall be overed.
4. The roof shall be fixed or replace
5. Siding is falling off.
6. Electrical wiring shall be fixed to ode 2002 NEe.
7. Structural elements shall be fixed.
8. Need steps for the back door.
9. Need to have running water and p wer for sanitation per
building code at all faucets and si s.
10. All faulty weather protection shall e fixed.
11. All Plumbing shall meet 2003 lPC d IRC.
12. Bedrooms shall be supplied with 0 e egress window per
bedroom.
13. All bedrooms shall be supplied wit smoke detectors that are
hardwired in per 2003 IRC.
14. All bedrooms shall be supplied wi Arcfault circuit breakers.
15. All rotten wood shall be replaced.
16. Stairs shall meet code if the go to bitable space.
17. No more than three unrelated peop per residence.
18. All windows shall be fixed to meet code.
19. All rotten flooring and decking sha I be replaced.
20. Bathrooms shall be fixed to meet c de and bathroom floors are

ORDER
I. The City of Wheat Ridge Building Official has dete ined the building
referenced above to be a Dangerous Building. The uilding Department will
post the building as a Dangerous Building due to the amount of life safety issues.
Pursuant to Code all occupants shall be required to v cate the property with 3
days ofthis Notice February 15, 2006. This is there ore required in order to
protect life, health and safety of the public.
II. The owners are ordered to pull a building permit to the deficient items. The
Building Department will post the building as a Dan erous Building due to the
amount oflife safety issues. Pursuant to Code all oc upants shall be required to
vacate the property. This is therefore required in ord to protect life, health and
safety of the public.
III. Ifthe structure has not been brought to code or demo ished by March 15,2005.
Section 801 in the Uniform Code for the Abatement f Dangerous Buildings
states, "801.1 Procedure. When any work of repair 0 demolition is to be done
pursuant Section 701.3, Item 3, ofthis code, the buil ing official shall issue an
order thereof to the director of public works and the ork shall be accomplished
by personnel of this jurisdiction or by private contrac under the direction of said
director. Plans and specifications therefore may be pr pared by said director, or
the director may employ such architectural and engin ering assistance on a
contract basis as deemed reasonably necessary. If an part of the work is to be
accomplished by private contract, standard public wo ks contractual procedures
shall be followed." Section 801.2 states, "801.2 Cost The cost of such work shall
be paid from the repair and demolition fund, and may be made a special
assessment against the property involved, or may be ade a personal obligation
of the property owner, whichever the legislative body of this jurisdiction shall
determine is appropriate."
The property owner and all occnpants are hereby ORD RED TO CEASE AND
DESIST occupancy and use of the above described buil ng. The Building Official
shall cause the property to be posted with the attached otice and shall take action
to remove all future occupants from the building until t e building is brought up to
code.
REMEDIAL ACTION
1. The property owner must apply for and obtain a City of eat Ridge building permit
to correct any deficiencies.
N. All deficiencies shall be fixed but are not limited to e items on this list.
APPEAL OF THIS .NOTICE AND ORDER
Any person having record title or other legal interest in the bove described premises may
appeal this Notice and Order or any action ofthe Building fficia1 to the Building Code
Advisory Board or known as the Board of Appeals pursu to section 112 ofthe Code,
provided that the appeal is made in writing as provided in t e Code and filed with the
Building Official within ten (10) days from the date of servi e of this Notice and Order.
Failure to appeal will constitute a waiver of all rights to an dministrative hearing and
determination ofthis matter. FILING OF AN APPEAL S ALL NOT STAY THE
EFFECTIVENESS OF THIS NOTICE AND ORDER.

percent, or in any supporting part, member or portion less th 66 percent or the (i) strength, (ii)
fIre-resisting qualities or characteristics, or (Hi) weather-r sisting qualities or characteristics
required by law in the case of a newly constructed building 0 like area, height and occupancy in
the same location.
15. Whenever a huilding or structure, used or intended to he used for dwelling purposes,
because of inadequate maintenance, dilapidation, decay damage, faulty construction or
arrangement, inadequate light, air or sanitation facilities, r otherwise, is determined by the
health officer to he unsanitary, unfit for human hahitati n or in such a condition that is
likely to cause sickness or disease.
16. Whenever any building or structure, because of obs lescence, dilapidated condition,
deterioration, damage, inadequate exists, lack of sufficien fire-resistive construction, faulty
electric wiring, gas connections or heating apparatus, or ther cause, is determined by the
fire marshal to be a fire hazard.
17. Whenever any huilding or structure is in such a condition as to constitute a public nuisance
known to the common law or in equity jurisprudence.
18. Whenever any portion or a building or struchlre remains on a site after the demolition or
destruction of the building or structure or whenever any buil ing or structure is abandoned for a
period in excess of six months so as to constitute such buil . g or portion thereof an attractive
nuisance or hazard to the public.
The 1997 Uniform Housing Codes states:
SECTION 1001 - DEFlNITIONS
1001.1 General. Any building or portion thereof that is determined to e an unsafe building in accordance
with Section 102 of the Building Code, or any building or portion th reof, including any dwelling unit,
guest room or suite or rooms, or the premises on which the same is IDea ed, in which there exists any of the
conditions referenced in this section to an extent that endangers the Ii e, limb, health, property, safety or
welfare of the public or the occupants thereof, shall be deemed and he eby are declared to be substandard
buildings.
1001.2 Inadequate Sanitation. Buildings or portions thereof shall be eemed substandard when they are
when they are in sanitary. Inadequate sanitation shall include, but not b limited to, the following: .
1. Lack of or improper water closet, lavatory, bathtub or sh wer in a dwelling unit or lodging
house.
2. Lack of or improper water closets, lavatories, and bathtubs 0 showers per number or guests in a
hotel.
3. Lack of or improper kitchen sink in a dwelling unit.
4. Lack of hot or cold running water to plumbing fIxtures in a h el
5. Laek of hot or cold running water to plumbing fIxtures in dwelling unit or lodging house.
6. Lack of adequate heating facilities.
7. Lack of or improper operation or required ventilating eq pment.
8. Lack of minimum amounts of natural light and ventilatio require by this code.
9. Room and space dimensions less than required by this code.
10. Lack of required electrical lighting.
11. Dampness of habitable rooms.
12. Infestation of insects, vermin or rodents as determined hy the ealth offIcer.
13. General dilapidation or improper maintenance.
14. Lack of connection to required sewage disposal system.
15. Lack of adequate garbage and rubbish storage and removal f cilities as determined by the health
officer.
10013 Structural Hazards. Buildings or portions thereof shall be de med substandard when they are or
contain structural hazards. Structural hazards shall include, but not be I .ted to, the following:
I. Deteriorated or inadequate foundations.
2. Defective or deteriorated flooring or floor supports.
3. Flooring or floor supports of insuffIcient size to carry imposed oads with safety.
4. Members of walls, partitions or other vertical supports t t split, lean, list or buckle do to
defective material or deteriorations.
5. Members of walls, partitions or other vertical supports th are of insufficient size to carry
imposed loads with safety.
6. Members of ceilings, roofs, ceiling and roof supports, or 0 er horizontal members that sag,
split or buckle due to defective material or deterioration.
7. Members of ceilings, roofs, ceiling and roof supports, or 0 her horizontal members that are
of insufficient size to carry imposed lads with safety.
8. Fireplaces or chimneys that list, bulge 0 settle due to defective terial or deterioration.
9. Fireplaces or chimneys that are of insufficient size or strength t carry imposed loads with safety.
1001.4 Nuisance. Buildings or portions thereof in which there exis s any nuisance as defined in this
code are deemed substandard buildings.
1001.5 Hazardous Electrical Wiring. Electrical WIrIng that w s installed in violation of code
requirements in effect at the time of installation or electrical wirin not installed in accordance with
generally accepted construction practices in areas where no codes ere in effect or that has not been
maintained in good condition or that is not being used in a s fe manner shall be considered
substandard.
1001.6 Hazardous Plumbing. Plumbing that was installed in violat on of code requirements in effect
at the time of installation or plumbing not installed in acco dance with generally accepted
construction practices in areas where no codes were in effect or tha has not been maintained in good
condition or that is not being used in a safe manner shall be conside ed substandard.
1001.7 Hazardous Mechanical. Mechanical equipment that w s installed in violation of code
requirements in effect at the time of installation or mechanical equi ment not installed in accordance
with generally accepted construction practices in areas where no c des were in effect or that has not
been maintained in good condition or that is not being used in a safe manner shall be considered
substandard.
1001.8 Faulty Weather Protections. Buildings or portions thereo shall be considered substandard
when they have faulty weather protections, which shall include, but not be limited to, the following:
1. Deteriorated, crumbling or loose plaster.
2. Deteriorated or ineffective waterproofing or exterior w lls, roof, foundations or floors,
including broken windows or doors.
3. Defective or lack of weather protection for exterior wall verings, including lack of paint,
or weathering due to lack of paint or other approved prote tive covering.
4. Broken, rotted, split or buckled exterior wall coverings or of coverings.
1001.9 Fire Hazard. Any building or portion thereof, device, a aratus, equipment, combustible
waste, or vegetation that, in the opinion of the chief of the fire depa tment, is in such a condition as to
cause a fire or explosion or provide a ready fuel to augment th spread and intensity of fire or
explosion arising from any cause shall be considered substandard.
1001.10 Faulty Materials of Construction. The use of materials of onstruction, except those that are
specifically allowed or approved by this code and the Building Co e, and that have been adequately
maintained in good and safe conditions, shall cause a building to be ubstandard.
1001.11 Hazardous or Insanitary Premises. The accumulation f weeds, vegetation, junk, dead
organic matter, debris, garbage, offal, rat harborages, stagnant ater, combustible materials, and
similar materials or conditions on a premises constitutes fire, heal h or safety hazards that shall be
abated in accordance with the procedures specified in Chapter 11 0 this code.
1001.12 Inadequate Exits. Except for those buildings or portions thereof that have been provided
with adequate exit facilities conforming to the provisions of this c e, buildings or portions thereof
whose exit facilities were installed in violation of code requirem nts in effect at the time of their
construction or whose exit facilities have not been increased in nu ber or width in relations to any
increase in occupant load due to alterations, additions or change i use or occupancy subsequent to
the time of construction shall be considered substandard. Notwi hstanding compliance with code
requirements in effect at the time of their construction, buildi gs or portions thereof shall be
considered substandard when the building official finds that an u safe condition exists through an
improper location of exits, a lack of an adequate number or width f exits, or when other conditions
exist that are dangerous to human life.
1001.13 Inadequate Fire-Protection or Fire-Fighting Equipment. uildings or portions there of shall
be considered substandard when they are not provided with the flIe.resistive construction or flIe.
extinguishing systems or equipment required by this code, except tho e buildings or portions thereof that
conformed with all applicable laws at the time of their construction a d whose flIe.resistive integrity and
flIe.extinguishing systems or equipment has been adequately maint. ed and improved in relation to any
increase in occupant load, alteration or addition, or any change in oecu ney.
1001.14 Improper Occupancy. All buildings or portions thereof oc upied for living, sleeping, cooking
or dining purposes that were not designed or intended to be us d for such occupancies shall be
considered snbstandard.
The following is a list of items that shall be fixed to meet c de:

2. Broken windows shall be fixed.
3. Openings to the building shall be overed.

ORDER
I. The City of Wheat Ridge Building Official has dete ined the building
referenced above to be a Dangerous Building. The uilding Department will
post the building as a Dangerous Building due to the amount of life safety issues.
Pursuant to Code all occupants shall be required to cate the property with 3
days ofthis Notice February 15, 2006. This is there ore required in order to
protect life, health and safety of the public.
II. The owners are ordered to pull a building permit to x the deficient items. The
Building Department will post the building as a Dan erous Building due to the
amount oflife safety issues. Pursuant to Code all oc upants shall be required to
vacate the property. This is therefore required in ord r to protect life, health and
safety of the public.
III. If the structure has not been brought to code or dem lished by March 15,2005.
Section 801 in the Uniform Code for the Abatement fDangerous Buildings
states, "801.1 Procedure. When any work of repair 0 demolition is to be done
pursuant Section 701.3, Item 3, of this code, the buil ing official shall issue an
order thereofto the director of public works and the ork shall be accomplished
by personnel of this jurisdiction or by private contra t under the direction of said
director. Plans and specifications therefore may be p epared by said director, or
the director may employ such architectural and engi eering assistance on a
contract basis as deemed reasonably necessary. If an part of the work is to be
accomplished by private contract, standard public w rks contractual procedures
shall be followed." Section 801.2 states, "801.2 Cos s. The cost of such work shall
be paid from the repair and demolition fund, and ma be made a special
assessment against the property involved, or may be made a personal obligation
of the property owner, whichever the legislative bod of this jurisdiction shall
determine is appropriate."
The property owner and all occupants are hereby ORD RED TO CEASE AND
DESIST occupancy and use of the above described build ng. The Building Official
shall cause the property to be posted with the attached tice and shall take action
to remove all future occupants from the building until t building is brought up to
code.
REMEDIAL ACTION
1. The property owner must apply for and obtain a City of eat Ridge building permit
to correct any deficiencies.
IV. All deficiencies shall be fixed but are not limited to e items on this list.
APPEAL OF THIS.NOTICE AND ORDER
Any person having record title or other legal interest in the bove described premises may
appeal this Notice and Order or any action of the Building fficial to the Building Code
Advisory Board or known as the Board of Appeals pursuan to section 112 of the Code,
provided that the appeal is made in writing as provided in t Code and filed with the
Building Official within ten (10) days from the date of servi e of this Notice and Order.
Failure to appeal will constitute a waiver of all rights to an ministrative hearing and
determination ofthis matter. FILING OF AN APPEAL S ALL NOT STAY THE
EFFECTIVENESS OF THIS NOTICE AND ORDER.
