Two separate thermometers inside your refrigerator both give a reading of 38 degrees. Several appliance dealers/repainnan state that normal interior temperature for a properly working refrigerator is 38-42 degrees. You have lobbied me repeatedly to replace your refrigerator ever since you moved into the apartment. I won't replace a properly functioning refrigerator. If you intentionally damage the refrigerator in an attempt to force me to replace it you will be subject to immediate eviction. As I've stated in the past, I will allow you to break your 12 month lease, which expires on July 31 S\ and relocate to another apartment if you wish. You need only ask. Sincerely, Ray Magee (YI cv;- 2 I, o;z. To whom it may concern; I moved into my apartment on August 1 2001. There was red water in our sinks and shower Ray replaced the water tank but our water is still1~:11dfn the shower. I also told Ray about a smell that I noticed in one comer of the house that it was very musty smelling. All he would say is that it must be my cat box. When you enter the house you can smell the musty odor but it does not smell like cat. My cat goes to the carpet comer and scratches at it like it has the odor of cat or dog on it. From September to January Ray kept telling me that I must have been doing something to make the basement leak although I have no access to the basement. I don't feel I did anything to flood the basement all I did was regular living we didn't put water down the vents or anything such as that, we did take daily showers, do laundry, wash dishes ' - To make my living conditions even worse on February 3rd 2002 I heard a big bang that shook my bedroom so I called 911 and the fire department came out. The fire captain asked what all the water was by the water heater? I told him that the owner knows about it but rather than doing anything about it he just blames me and lets it go. They shut off my gas that day stating that there was a leak or something. I know they red tagged it. The next day Ray and his maintenance man came over to fix the problem and they turned the gas back on. While Ray was at my house he must of picked up the red tag and that means he went through all my mail and bills that I had on my coffee table because the tag was in the bottom of a big pile of papers and the tag was not there when I got home from work. In approximately 2 or 3 weeks latter I noticed the smell of gas in the living room I called the city and county to see if Ray had got a permit to turn the gas back on and they told that he did not go through them and that they never authorized the work done. They sent a public service worker over. I warned him about all the water in the basement and told him how the owner said it was my fault that I was doing something to flood it. Ray was called over and when he got here the public service man asked him what all the water was from. Ray told him that he doesn't have a sub-pump so where was the water to go? At this time my daughter started having allergy problems. She has runny nose, itchy eyes, and has been coughing. I moved my entertainment center from the area that 1 complained about the smell coming from to pack up things so that when I find a place to move to I will be ready. When I moved it the smell was so bad I started coughing and I felt as though I couldn't breathe. There was an odor of mold coming from under the part of carpet I had exposed. I coughed all night and felt as I was dying. I went to the doctor and told her what had happened she advised me to move immediately away from that place. My daughter slept on the floor the next night to help me in case I needed her because of my problems and she woke up unable to breathe. I took her 'r" /H' D"c. fe:- . to have her checked we are now both on inhalers to help us breathe better and have been advised by 2 doctors to move. I told Ray about the drain for the washing machine leaking and I was worried about being electrocuted also because the leak was by the outlet. !Z h o{ d' .IO,n<-guys out to fix it. They had to go into the basement and they really complained about the smell also. So this leaves me to believe that this problem has been going on for a long time. It has gotten so bad that I borrowed an ice chest from a friend to keep my food in so that it will last longer. In September Ray was cutting a tree in the yard and we watched through the window and I saw him take my dolly and load it into his car. I couldn't keep milk in it at all without it spoiling. I told Ray about this problem and I kept telling him about my food spoiling. He told me there was nothing wrong with the refugerator and that I just wanted him to spend money on a new one so that it would look better. For 5 months I bought food at least weekly so that it wouldn't spoil before we used it. I called someone in February to fix my fudge; he came over and gave Ray an estimate. He came back and fixed the fudge. I confronted him about a month later when I saw him again and he told me he had put it back. I know this was not true so I '. ended up going to the police and they went to get it. I feel that if he would steal from the outside he would more than likely steal from the inside of our apartments also. I also have a problem with the kitchen light. I have to flip the switch quite a few times before it will work, it seems like a hundred or so, it gets very fiustrating. When I told Ray about it he replaced the light bulb and said there was nothing wrong with it. All the windowsills are moldy and I have,....windowflhat is broken and has been broken since we moved in. When it is cold outside the windows ice up on the in side and it gets very cold to go even near the windows. The floor in one of the bedrooms feels as if there is nothing under it for support like it is going to cave in at any time. The only thing that keeps us from falling through the floor is the carpet. Ray wrote me a letter and stated in that letter that I could move out any time I wanted that he would not hold me to the lease. Then when I put a deposit on an apartment and told him I would be out by May 1st or 2nd he told me that I couldn't move because I didn't give him enough notice. I really feel living in this apartment is bad for our health and I can't afford to rent two places so that I can move out any sooner. I am now getting thousands of nats coming up through the vents my whole house is full of them and you can see them coming up through the vents.
