Box 8101 Arvada, CO 80001-810 1 RE: Apartments - Owner: Karl Koch 4462 thru 4476 Jay Street Arvada, CO To Whom It May Concern: It has been brought to our attention concerns of the structural adequacy of the floor joist and crawl spaces for the above reference property. A site visit and inspection of the crawl spaces were made on March 3, 2005. We had previously inspected the property December 9, 1997. It is our understanding that is some concern as to the condition of the floor joist, ventilation of the crawl spaces, and the use of a vapor barrier over the soil. In general the condition of the crawl spaces with respect to water migration and/or dampness has improved greatly since the previous inspection. The following is our assessment of the present condition: -We do not recommend the use of a vapor barrier over the soil. The vapor barrier will prevent the soil from drying out and trap moisture near the foundation system. -Proper ventilation is necessary. The crawl spaces are vented but the vents are either block and are vent openings as constructed do not allow for sufficient air flow. We recommend that the present vents be opened by removing the blockage. -We did not observe any floor joist that were deteriorated beyond the point were they were not able to carry the intended load.. If any deterioration has occurred, reinforcement of the floor joist can be accomplished by nailed a new section of joist to the existing. It is the intent of our investigation to examine these areas only and in no way implies a complete inspection of the apartments or any other concems within the apartments. Nor does it intend to discredit other opinions or analysis. We feel that the floor systems are adequate at this point, have experienced many different types of loads through the years and have serve the test of time well, and will continue to do so . Wheat Ridge Colorado 80033 NOTICE The property owner, and all current occupants, are hereby notified that the undersigned Building Official of Wheat Ridge, Colorado, has found the building located on the above described real property to be a Dangerous Building within the meaning of Section 302 of the Uniform Code for the Abatement of Dangerous Buildings, 1997 edition, as adopted by the City of Wheat Ridge, Colorado ("Code"), as more particularly set out below: The building is being used for dwelling purposes and is in violation of the following Code Sections 302.13 in the 1997 edition of the Uniform Code for the Abatement of Dangerous Buildings. 1. 302.13 states, "Whenever any building or structure has been constructed or is maintained in violation of any specific requirements or prohibition applicable to such building or structure provided by the building regulations of this jurisdiction, as specified in the Building Code or Housing Code, or of any law or ordinance of this state or jurisdiction relating to the condition, location or structure of buildings." The 1997 Uniform Housing Codes states; a) Section 1001.6 state, "Hazardous Plumbing. Plwnbing that was installed in violation of code requirements in effect at the time of installation or plwnbing not installed in accordance with generally accepted construction practices in areas where no codes were in effect or that has not been maintained in good condition or that is not free of cross-connections or siphon age between fixtures shall be considered substandard." b) Section 1001.8 states, "Faulty Weather Protection. Buildings or portions thereof shall be considered substandard when they have faulty weather protection, which shall include, but not be limited to, the following: 1. Deteriorated, crumbling or loose plaster. 2. Deteriorated or ineffective water proofing of exterior walls, roof, foundations or floors, including broken windows or doors. 3. Defective or lack of weather protection for exterior wall coverings, including lack of paint, or weathering due to lack of paint or other approved protective covering." 4. Broken, rotten, split or buckled exterior wall coverings or roof coverings. " The following is a list of items that shall be fixed to meet code. I. Bedroom windows do not meet egress requirements of the Uniform Building Code or the International Building Code as required in Section R3l O. 2. Dish washer does not work properly and plumbing was not installed according to code. 3. Fix faulty drainage so water does not enter into building from outside. 4. Need additional crawlspace ventilation with a vapor barrier on the ground in the crawlspace. 5. Floor joist are rotting out where they have come in contact with the concrete foundation. These floor joist should be looked at to prevent further decay that would make this structure a Dangerous Building. ORDER The City of Wheat Ridge Building Official has determined the building referenced above to be a Dangerous Building and to constitute a health hazard ifnot fixed. The owners are ordered to pull a building permit to fix the deficient items. If such items are not fixed by March 10,2005, the Building Department will post 4462 Jay Street, Wheat Ridge Colorado as a Dangerous Building. All existing tenants may stay in the building as long as a permit is pulled to fix all issues. When a tenant moves out of the rental unit, the unit shall not be leased out until all items are brought to code. Pursuant to Code future tenants shall not occupy the apartments in this complex until all issues are brought up to code and are inspected by the City of Wheat Ridge Building Department. Therefore this is required in order to protect life, health and safety of the public. The property owner and all future occupants are hereby ORDERED TO CEASE AND DESIST occupancy and use ofthe above described building. The Building Official shall cause the property to be posted with the attached Notice after March 10,2005 and shall take action to remove all future occupants from the building. REMEDIAL ACTION 1. The property owner must apply for and obtain a City of Wheat Ridge building permit to correct the following deficiencies. I. All deficiencies shall be fixed but are not limited to the items on this list. APPEAL OF THIS NOTICE AND ORDER Any person having record title or other legal interest in the above described premises may appeal this Notice and Order or any action of the Building Official to the Board of Appeals pursuant to section 205 of the Code, provided that the appeal is made in writing as provided in the Code and filed with the Building Official within ten (10) days from the date of service of this Notice and Order. Failure to appeal will constitute a waiver of all rights to an administrative hearing and determination of this matter. FILING OF AN APPEAL SHALL NOT STAY THE EFFECTIVENESS OF THIS NOTICE AND ORDER.
