Brougham, Kent Davis, Dnn Eafanti, Phil Edwards, Tony FIasco, hon Selstad, and Bill Shanley Larry Merkl was absent Also ~resent City Clerk, ~anda Sang, City Aaministrator, Mike Smith, City Attorney, John Hayes, Public works Director, Bob Goebel, Chief of Police, Jack Hurst, staff, and interested citizens APPROVAL OF MINUTES of December 10, 1990 Hot ion by fc1r Eafanti for the approval of the Minutes of December 10, 1990, seconded by Mr Selstad, carried 7-0 CITIZENS' RIGHTS TO SPEAK There was no one present to speak PUBLIC HEARINGS AND ORDINANCES ON SECOND READING Item 1 TEFRA hearing for Mountain Vista Health Center, Inc (tn be tabled indefinitely) Motion by Mr FIasco to table this item indefinitely, seconded by Mr Davis, carried 7-0 Item 2 TEFRA hearing for Baptist Home Association of the Rocky ~jountains Floyd Harrison was present to answer questions speak Mr Hayes stated that since no one was complied with the Internal Revenue Code anj no necessary No one was present to present to speak, we had further action was Item 3 Council bill 81 - An Ordindnce amending Section 13-2 of the Code of Laws ,)f tl-Je City of Wheat Ridge, to eliminate an inconsistency with other provisions of the Wheat Ridge Code of Laws Council Bill 81 was intrJduced on second reading by Mr Edwards, title read by the Clerk, Ordinance Nn 857 assigned Motion by i"ir Edwards for the adoption of Council Bill 81 (Ordinance 857), seconded by Mr FIasco, carried 7-0 CITY COUNCIL MINUTES January 14, 1991 Page -2- Item 4 Council Bill 82 - An Ordinance providing for the approval of a Special Use Permit to allow the parking of ten (10) Semi Tractor/Trailers in a Commercial-One Zone District on property located at 10101 West 1-70 Frontage Road North, City of Wheat Ridge, County of Jefferson, State of Colorado (Case No SUP-90-7) (Sandra Monks) Motion by Mr Eafanti that Council Bill No 82, a request of a Special Use Permit to allow the parking of more than semi-tractors and trailers on property located at 10101 W Road North, be continued to January 28, 1991, seconded by carried 7-0 f,)r approval three 1-70 Frontage r,] r S h anI e y , DECISIONS, RESOLUTIONS, AND MOTIONS Item 5 Resolution 1236 - authorizing the Jefferson County Open Space Ufficials to secure a survey, title commitment, negotiate for the acquisition and to acquire the property consisting of approximately 86 of an acre, located at 4220 Kipling Street, Wheat Ridge, Cnlorado Chair declared that tl-Jis item will be discussed during an Executive Session and heard later on in the meeting Item 6 Motion re Extension of Contract Time, Project M-MON-90 Motion by Mr Edwards that the 1990 Contract with Sellards and Grigg for providing professional services in performance of the City-wide Monumentatinn Program be extended thr'ugh June 31, 1991 I further move that Capital Projects Fund be amended to include Account No 30-303-883 for 1991 I furtl-Jer move that $26,735 19 be transferred from Capital Projects Fund 30-607-795 to Capital Projects Fund 30-303-883 and that expenditures on the extended contract with Sellards and Grigg be limited to that amount, seconded by Mr Eafanti Mr FIasco will vote No, because this was bid 7 years ago and should be put out to bid again This project has been going on forever hot ion Mrs Brougham for an amendment that we have a presentation by Sellards and Grigg to explain why this program has taken so long, what they are doing, and what they hope to accomplish, seconded by Mr FIasco, carried 5-2 with Kr Shanley and Mr Davis voting No Oribinal Motion carried 6-1 with Mr FIasco voting No Item '( Motion re 1991 Traffic Signal Maintenance Program, T-TSM-91 Motion by Mr Shanley that the 1991 Traffic Signal Maintenance Program, T-TSM-91 be awarded to wL Contractors, Inc in the amount of their unit price bid ($9,019 00) and that all costs associated with this project be charged to Account 01-302-704, seconded by Mr FIasco, carried 7-0 CITY COUNCIL MINUTES January 14, 1991 Page -3- Item 8 Motinn re Underground fuel at 44th & Newland Street Motion by Mr FIasco that the maynr be authorized to sign the attached letter of acceptance of the effluent from the air stripper which allows ground water to be decontaminated at the 44th and Newland site Said stripper to be operated by Total Petroleum until sucl-J time as the groundwater no longer requires treatment as determined by the Colorado Department of Health, seconded by Mr Davis, carried 7-0 Kevin McNeill, Project Engineer, representing Total Petroleum, was present and answered Council's questions Motion by Mr FIasco tl-Jat an agreement be drafted between the City of Wheat Ridge and Total Petroleum to allow discharge of air stripper treated groundwater into tl-Je :ity's storm sewer system The effluent shall meet the requirewents of the Public Works Department, Environmental Protection Agency, and Colorado Department of Health, as listed in the attached letter, seconded by Mr Davis, carried 7-0 Item 9 Motion by Mr FIasco that Section 41 B 1-2 of tl-Je City of Wheat Ridge Personnel Policies and Procedures be amended by deleting the existing language and inserting new language as attached, seconded by Mr Shanley, carried 7-0 Item 10 Bid Award for Trash Removal Services, 1991 (RFB #90-46) Motion by Mr Davis that the contract for the Trash Removal Services for 1991, (RFB #90-46) be awarded to Arvada Rubbish Removal for their bid of $4,080 00 per year for annual service and $892 00 estimated for seasonal service, with all costs to be charged to the various approved budget accounts for utilities by tl-Je affected departments, seconded by Mr Shanley, carried 7-0 Item 11 Bid Award for Astro CargJ Van for Police Dept (RFB #91-09) Motion by Mr Shanley that Burt Chevrolet be awarded the purchase of one Astro Cargo Van with options fnr the amount of $11,834 39 and that all costs be charged to Acct No 01-201-807, seconded by Mrs Brougham, carried 7-0 I tern 12 Bid Award for Radar Guns (RFB #91-08) Motion by Mr FIasco that Kustom Signals, Inc be awarded the purchase of three Radar Guns less trade-ins for their quoted price of $3,173 50 and that all costs be charged to Acct No 203-809, seconded by Mr Shanley, carried 7-0 CITY ATTORNEY'S MATTERS John Hayes informed Council and Public that there was nothing tl-Je City nf Wheat Ridge could do about the proposed increase in Cable TV fees Hlwever, we could I-Jold a review hearing about tl-Je entire Cable Permit CITY COUNCIL MINUTES January 14, 1991 Page -4- Mr Hayes asked for an Executive Session under Sections 5 7(b)(1)(A) and 5 7(b)(1)(B) of the Charter to consider appraisal and to discuss a settlement offer Mr FIasco so looved, seconded by Mr Shanley, carried 7-0 ELECTED OFFICIALS' MATTERS Councilmembers agreed to have RTD gave a presentation on a light rail project and that tl-Jis be scheduled for either 6 or 6 30 p m prior to a Council meeting in February Elise Brougham asked that Cnuncil be more responsive to citizens and that one of the ways to accomplish this w~uld be to televise Study Sessions She also wondered why citizens couldn't comment durinb Study Sessions Mrs Brougham asked for consensus tl-Jat a review of the Council Rules be put on a Study Session, seconded by Mr Selstad, failed 2-5 with Mrs Brougham and Mr Selstad voting yes Mrs Brougham asked for a consensus that we televise our Study Sessions and work this out with the Cable Company, consensus was 5-2 with Mr Shanley and Mr FIasco voting No Tony FIasco informea Council that he had received a letter from CML informing him that he had been nominated to be on the steering committee for National Lea6ue of Cities Policy Committee TI-Jis position would require some additional travel He gave update on MTDC He asked the Mayor to give a brief presentation on the Metro Forum that he had attended Mayor hilde informed Council of what had transpired at the forum Mr FIasco stated that an alternate fuel vehicle was currently being tested by the Public Works Department and encouraged Council to try it Kent Davis moved that the attached information only item be put on the next agenda for a show cause motion, seconded by Mr FIasco, carried 7-0 Motion by Mr Flasc' tJ bring in a Resolution to the next meeting urging the General Assembly to repeal the prohibition against local regulation nf Underground Storage Tanks, secnnded by Mr Selstad, carried 7-0 EXECUTIVE SESSION WAS HELD Item 5 Ivlotion by Hr Selstad for the adoption of Resolution 1236, seconded by Mrs Brougham, carried 7-0
