Installation of roof sheathing (new or overlay) requires an approved inspection prior to installation of ANY roof coverings and is require on the entire roof when spaced or board sheathing with ANY gap exceeding one half inch exists. Asphalt shingles are required to be fastened to the roof deck with a minimum of 6 nails per shingle. Ice and water shield is required. Eave and rake metal is required. A ladder extending 3 feet above the roof eave and secured in place is required to be provided for all roof inspections. Roof ventilation is required to comply with applicable codes and/or manufacturer installation instructions, whichever is more stringent. GLOBAL CONSTRUCTION CONSULTANT �l THIS IS A BINDING CONTRACT -- I/we ("Owner') agree to retain Global Construction a general contractor, to replace and/or repair the roof, gutters, siding and additional work as detailed in this agreement. This contract is contingent upon Global Construction and my insurance carrier's agreement as to the full scope of work and payment amount to have said work completed. Upon agreement between Global Construction and the insurance carrier, Global Construction may immediately begin the work detailed above. Owner grants full access to property for staging and execution of work unless otherwise agreed. The specified work and quoted price above is subject to change upon discovery of any hidden defect. Any alteration or deviation from specifications outlined in this agreement involving additional cost will be executed upon written change orders from the Owner. GENERAL CONTRACTOR -- Homeowner acknowledges Global Construction as a general contractor and as such shall be entitled to io% overhead and io% profit, as allowed by insurance industry standards. This only applies if the insurance company allows for overhead and profit. FORWARDING OF DOCUMENT -- Owner agrees to provide all necessary documentation for an insurance property loss claim. Owner agrees to provide all pertinent documentation to facilitate funds being disbursed from the insurance carrier and/or mortgage holder. Furthermore, owner agrees to forward to Global Construction any estimate or correspondence from the insurance carrier and/or mortgage holder related to the work agreed upon. DELAYS -- Owner hereby acknowledges that Global Construction may be subject to delays occasioned by inclement weather, labor disputes, mortgage endorsement or funding disputes, inspections and material supply shortages all of which are beyond the control of Global Construction. The Owner hereby accepts any delays occasioned by one or all of these circumstances. WORKMANSHIP -- Global Construction provides a 5 YEAR WORKMANSHIP LABOR WARRANTY. Such warranty is expressly limited to labor, and does not extend to materials. Warranty does not include damaged caused by lightning, gale (50 mph or greater) force winds, hurricane, tornado, hailstorm impact or foreign objects or other cracking due to settlement distortion, failure or cracking of walls or foundation of building. Global Construction shall supervise and direct work, using its best skill and attention. All work to be completed in a workman like manner according to standard industry practices. Global Construction makes no other warranty, expressed or implied, including merchantability and fitness for particular purpose. WARRANTY IS NOT VALID UNTIL PAID IN FULL. COLLATERAL / UNFORESEEN DAMAGES -- Should property owner become aware of damage to said property by Global Construction, its subcontractors, agents or employees during the course of installation of any trade item, said damage should be immediately brought to the attention of Global Construction. If owner fails to notify Global Construction of said damage within 5 days of occurrence, owner shall waive all rights against contractor concerning said damage Global Construction is not responsible for damage to driveways or sidewalks during delivery of materials or construction. Further Global Construction is not responsible for ANY interior damage caused during construction. This includes but is not limited to nail pops or cracks in drywall, broken light fixtures, damaged personal property or any other interior damage that is a result of improper initial installation, deterioration or poor overall interior material quality. PAYMENTS — Upon material delivery, Owner will provide Global Construction with the Actual Cash Value (ACV) portion of the scope of loss in addition to their policy's deductible. Upon completion of work and final settlement of damages with the insurance carrier, Global Construction will provide the Owner(s) with an itemized invoice. These remaining proceeds will be due to Global Construction \ within 5 days of the funds being available from the insurance carrier or mortgage holder. Property owner's out-of-pocket expense will not exceed Owner(s) insurance deductible for work agreed upon between the insurance carrier and Global Construction unless upgrades or change orders are approved during installation. Global Construction suggests a Licensed HVAC Technician inspect and certify that no Carbon Monoxide leak has occurred during the construction of your new roofing system. Contractor cannot and will not conduct these services for the customer and will not bill nor be responsible for the charges that are incurred by the customer. Contractor suggests that as a matter of consumer safety, customer purchase and install a Carbon Monoxide Detector in their home per Manufacturer Specifications. Global Construction shall not be held liable for any injury or death related to a Carbon Monoxide leak in the home due to work performed. NOTICE OF CANCELLATION -- Notice with Respect to Residential Property Located in Colorado as applicable under C.R.S. 6-22-iot et seq.: Property Owner may rescind this Contract Pursuant to Section 6-22-104, Colorado Revised Statutes. 4 If you are notified by your insurer that all or any part of the claim or contract is not a covered loss under the insurance policy, you may cancel the contract by mailing or delivering a signed and dated copy of this cancellation notice or any other written notice to Global Construction located at 5711 EAST EVANS AVE., DENVER, CO 80222 any time prior to midnight on the 5th business day after you have received such notice from your insurer. If you cancel, any payments made by you under the contract, except for certain emergency work already performed by the Global Construction, work already in progress or materials delivered to the job site, will be returned to you within ten business days following receipt by the contractor of your cancellation notice. 4 In the event that the Insurance Company only agrees to pay for repairs, neither party is bound by this contract. Customer agrees to provide a copy of Insurance Claim Report to Global Construction upon receipt. Acancellation fee of 2o% will be charged ifcustomer cancels contract after insurancecompanyhas agreedto replacethe roof. 4 The Following Special Provisions Apply Only to Roofing Work on Residential Property in Colorado as provided under C.R.S. 6-22-1o1 et seq.: Notice with Respect to Residential Property Located in Colorado as applicable under C.R.S. 6 -22 -tor et seq.: Property Owner may rescind roofing contract pursuant to Section 6-22-104, Colorado Revised Statutes. 4 Notice with Respect to Residential Property Located in Colorado as applicable under C.R.S. 6-22-101 t seq.: If Property Owner plans to use the proceeds of a property and casualty insurance policy issued pursuant to Part 1 of Article 4 of Title 1o, Colorado Revised Statutes, to pay for the roofing work, pursuant to Section 6-22-105, C.R.S., the roofing contractor cannot pay, waive, or rebate, or promise to pay, waive, or rebate all or part of any insurance deductible applicable to the insurance claim for payment of roofing work on the covered residentialproperty. 4 Notice with Respect to Residential Property Located in Colorado as applicable under C.R.S. 6-22-ioi et. seq.: THE COMPANY SHALL HOLD IN TRUST ANY PAYMENT FROM THE PROPERTY OWNER UNTIL THE COMPANY HAS DELIVERED ROOFING MATERIALS AT THE RESIDENTIAL PROPERTY SITE OR HAS PERFORMED A MAJORI'T'Y OFTHE ROOFING WORK ON THE RESIDENTIAL PROPERTY. MISCELLANEOUS -- In the event of default by Owner, or legal fees are incurred for the collection of any sum due under this contract, Owner shall be responsible for all attorneys' fees, costs and expenses of collection. Global Construction may file a supplemental claim with owner's insurer as a result of material or labor price increases due to market conditions or errors / omissions in the initial insurance scope of work. Global Construction shall have the right to assert a mechanics lien for any sums due for the improvements to the property but unpaid. + Failure of this contractor to pay those persons supplying materials or services to complete this contract ca n result in the filing of a mechanic's lien on the property which is the subject of this contract. To avoid this result, you may ask this contractor for "Lien Waivers" from all persons suppling materials or services for the work described in this contract. Failure to secure lien waivers may result in you paying for all labor and materials. PENAL'T'IES — Existing Colorado statute related to property insurance fraud (CRS 18.13.119.5) states that paying, waiving or rebating a property owner's insurance deductible is a CLASS 2 MISDEMEANOR. This bill goes farther to say that if it is proven a deductible was paid/waived/rebated, the insurance company does not have to consider the estimate from any contractor violating the provision, and the property owner or the insurer may sue the contractor for any damages related to same. Damages may include just the deductible amount, or the cost difference between appropriate roofing materials and any lesser quality materials that a contractor may have used in order to offset the cost of the deductible, etc. Recoverable damages would be case specific. 4 A contract lacking S1138's specific written provisions maybe found to be unenforceableby either party. �SUlL!
