HomeMy WebLinkAbout01/28/1991 CITY COUNCIL MINUTES CITY OF WHEAT RIDGE, COLORADO January 28, 1991 The City Counnil Meeting was called to urder by the Mayor at 7 30 p m Counnilmembers present Elise Bruugham, Kent Davis, Don Eafanti, PI-Jil Edwards, Tony Flasno, Larry Merkl, Ron Selstad, and Bill Shanley Alsn prese~t City Clerk, Wanda Sang, City Administrator, Mike Smith, City Attorney, Juhn Hayes, Public Wurks Directur, Bob Goebel, Director of Planning & Development, Glen Gidley, Director uf Parks & Recreatiun, Gary Wardle, Chief of Police, Jank Hurst, staff, and interested citizens APPROVAL OF MINUTES of January 14, 1991 Motion by Mr Eafanti for the approval of the Minutes uf January 14, 1991, seconded by Mr Davis, carried 8-0 CITIZENS' RIGHTS TO SPEAK There was no one present to speak LOCAL LIQUOR LICENSING AUTHORITY MATTERS Item 1 Applination fur a new Class G - Hotel & Restaurant Liquor License for The 3250 Corpuration, dba "Las Carretas", 3250 Youngfield Street, Wheat Ridge Jake Valdez, attorney for the applicant, Manuel Corral, applinant, Luis Oriv~, interpreter for applicant, all were sworn in by the Mayor Mr Valdez asked for approval of the application, stated that Mr Curral was familiar witl-J the Liquor Code, I-Jad been operating a Restaurant at tl-Jat lonation for several years, but felt he now wanted a liquor linense Mr Valdez stated tl-Jat I-Je had gone over the liquor code witl-J Mr Corril nnd was nonfidant that Mr Corral understJoi the law However, he was certain that Mr Corral would like to attend the City Clerk's seminar regarding the liquor law Motion by Mr Shanley to approve tl-Je application for a new Class G _ Hotel & Restaurant Liquor Linense for The 3250 Corporation, dba "Las Carretas" at 3250 Youngfield Street, Wheat Ridge, for the following reasons 1 All applinations and fees required by statute I-Jave been filed and paid 2 Nutice of hearing and pusting of the premises I-Jave been accomplished according to statutory requirements 3 The applicant will be entitled to uccupancy uf the premises by virtue of a signed lease assignment dated November 1, 1990 CITY COUNCIL MINUTES January 28,1991 Page -2- 4 The appli0.ants I-Jave been r.leared by the Police Department 5 TI-Je evidence adduced at the Publi0. seconded by Nr Davis, carried 8-0 Item 2 Motion to set a Notice of Hearing and Order to Shuw Cause fur the Rockette Bar, 10006 W 44th Avenue, wheat Ridge Motion that a Notir.e of Hearing and Order to SI-Jow Cause be executed by the Mayor and City Clerk and be issued t the Rockette Bar, 10006 W 44tI-J Avenue, wheat Ridge, for FebrUdry 2S, 1991 at 6 30 pm, based upon the allegations contained in tl-Je attached Offense Report, seconded by Mr FIasco, carried 8-0 PUBLIC HEARINGS AND ORDINANCES ON SECOND READING Item 3 Council Bill 82 - An Ordinance providing for the approval of a Special Use Permit to allow the parking of ten (10) Semi Tra0.tor/Trailers in a Commercial-One Zone Distri0.t on property located at 10101 West 1-70 Frontage Road North, City of Wheat Ridge, County of Jefferson, State of Colorado (Case No SUP-90-7) (Sandra Munks) (Continued from January 14, 1991) Council Bill 82 was intruduced on second reading by Mr Eafanti, title read by the Clerk, Ordinance No 858 assigned Mr Gidley presented the case, entered documents into the record and answered Council's questions Maurice Fox, appli0.ant's attorney, was swurn in by tl-Je Mayor, asked for approval of the Spe0.ial Use Permit and answered Coun0.il's questions Motion by Mr Eafanti that Coun0.il Bill 82 (Ordinance 858), a request for approval of a Spe0.ial Use Permit to allow the parking of more than three semi-tra0.tors and trailers on property located at 10101 W 1-70 Frontage Road North, be approved for the following reasons 1 The 0.riteria for review support approval of this request 2 Staff and Planning Commission recommend approval With tl-Je following condition 1 That tl-Je number of semi-tractors and trailers be limited to ten, se0.onded by Mr Shanley Motion by Mr Selstad for an amendment that if, in any r.unse0.utive 12-month period, 10 complaints of verifiable violation are received! a revucation hearing be set before Planning Commission and City CounCIl ser.onded by Mrs brougham, carried 5-3 with Counr.ilwembers Shanley, Eafanti, and ~1erkl voting No CITY COUNCIL MINUTES January 28,1991 Page -3- Original Motion as amended carried 8-0 Item 4 DECISIONS, RESOLUTIONS, AND MOTIONS Resolution 1238 - A Resolution of the City of Wheat Ridge urging the General Assembly of the State uf Colurado to repeal the prohibition against local regulation of underground storage tanks as set furth in CRS 8-2-508 and repealing the limits on finannial liability of operators or uwners of petroleum underground storage tanks as set furth in Sention 8-20-509, CBS Resolution 1238 was intruduced by Mr Flasno, title read by the Clerk Motion by Mr FIasco for the adoption of Resolution 1238, seconded by Mr Selstad, carried 7-1 with Mr Davis voting No Mrs brougl-JHm asked tl-Jat a nopy of this Resolution be sent via representatives on tl-Jis Council to the Colorado Muninipal League, DRCOG, and Jeffco Gover~ments, so these other entities can perhaps take the same action Item 5 Resolution 1239 - appruving proposed amendment relating to Authority Board Membership to Intergovernwental Agreement noncerning implementation of an E911 Emergency Telephone Service Resolution 1239 was introduced by Mr Merkl, title read by the Clerk Motion by Mr Merkl for lhe adoption of Resolution 123Y, seconded by Mr Shanley, carried 5-3 with Counnilmembers Edwards, Selstad, and Flasno voting No Mr Flasno feels tl-Jat 4 years is a long enough term and 8 years might cause I-Jard feelinbs with otl-Jer cities that are not represeYJted Item 6 Discussion of undergrounding of utilities on West 38th Avenue between Pierce 3treet and SI-Jeridan Blvd (backup material will not be available until Monday eveYJing) Mr Edwards informed Council that Public Servine I-Jad miscalculatea the costs for undergrounding on 38th Avenue and tl-Jat the cost was $125,000 more than estimated Mr Goebel explained that on 38th Avenue between Wadsworth and Pierce antual expenses were $470,000 TI-Je distance between Pierce and Sheridan is double than what the distance was between Wadsworth and Pierce TI-Jis leads them tu tl-Je conclusion that the remaining $548,000 in the fund is not going to be enuugl-J to do the remaining undergrounding Storm Sewer work between Harlan and Ames should begin sometime in Marcl-J Undergrounding deadline to be completed is June 1, after that street work will begin Motion by Mr FIasco that the West 38th Avenue project from Pierce to Sheridan will be done in this fiscal year and be completed by October 1, 1991 By the next meeting options be brougl-Jt to us that require before CJuncil at the next Study Session, February 4, 1991, and give an explanation on where they stand, what kind of time frame we nan expect and if their materials will be available on time Mr FIasco and second accepted this Motion carried 8-0 Item 7 Redesignation uf Funds in 1991 Budget (Police Dept ) Commander, Ed Ray, referred to his memo, marked Item 7 un this Agenda Nution by Mr SI-Janley to approve the redesign at ion of funds as outlined in the memo and tl-Je total dollar amount available for this project would be as follows City Budget, Accuunt #202-802 $3,045, VALE Grant, Account #202-802, $2,210 , total available $5,255, seconded by Mrs brougham, carried 7-1 with Mr FIasco voting No Item 8 Membership Dues/Contributions Motion by Mr Flascu that payment be authorized in tl-Je fullowing amounts DRCOG $6,300 (102-710), CML $111,131 (102-710, Natiunal League of Cities, $2,036 (102-710), Jeffersun Animal Shelter, $10,614 86 (610-721), Jeffersun County Hazardous Substance Authority, $2,504 90 (124-704), DRCOG Elevator & Inspection, $6,392 (122-704), Fheat Ridge Art League, $800 (610-799), Jefferson Center for Mental Health, $2,500 (610-799), Volunteers of America, $~,024 (010-799), Arvada Center for the Arts and Humanities, $10,000 (610-799), The Denver Center for the Performing Arts, $5,000 (610-799), Senior's Resource Center, $10,000 (610-799), Regional Air agreement, dated November 19, 190, setting forth the terms of the 1991 Elevator and Escalator Safety Inspection Program, be accepted, seconded by Mr Davis Mr Edwards moved for an amendment to give the Wheat Ridge Historinal Society $800 to be charged to Acct No 610-799, seconded by Mr Eafanti, narried 6-2 witl-J Mr Davis and Mr FIasco voting No Vote on original motion as amended carried 8-0 Item 9 Purchase of Fountain for the Richards-Hart Estate Motion by Mr Merkl that Robinsun Iron be awarded the fountain, model Ruman Fluted for the amount of $3,998 costs be charged to Acct No 601-890, seconded by Mr 8-0 iJurchase of one 50 and that all Davis; carried Item 10 Bid Award for prufessional land surveying servines Motion by Nr FIasco that this item be tabled for 1 week until tl-Je next regular meeting and that before that time we be given nomplete information ,,(1 the bids, whu received and requesterJ bids, who responded, and a copy of the bids themselves, so we can see them, lRFB #91-06) Motion by Mr Flas0-o that Vickery Motorsports, Inc be awarded the purchase of 1 Kawaski Police Pursuit MotorcY0-1e for the amount of their bid of $7,465 00 and tl-Jat $0,000 00 be charged to Account No 01-204-807 and $1,465 0 be chargerl to An0-uunt No 01-204-809, seconded by Mr Shanley, carri",j r,_" with Mr Merkl and Mr Selstad voti'16 ,j" It ellJ 12 Motion to appoint Ge Irge J from District III Langdon to the Planning Commission Motion by Mr Eafanti to appoint George J Langdon to the Plan~in6 Commission from District III, term tu expire 3/2/94, seconded by Mr Davis, carried 8-0 Motion by Mrs Brougham to table this until the vacancies 0-an be advertised in the paper This is tl-Je only application we have received su far, but there really hasn't been any advertising so far We can wait at least two weeks until the appointments are made She also asked tl-Jat this be City policy to publish vacancies on 0-ommittees so the Public will be notified Have tl-Jem posted on bulletin boards, se0-u'ltjed by Mr Selstad, failed 2-6 with Mrs Brougham and Mr Selstad voting yes Motion by Mrs Brougham to specifically advertise for vacancies, as they come up, by the District and the Commission and also post it on bulletin boards, in City Hall and the Anderson Building, also ask Cable TV to run it, seconded by Mr Eafanti, Mr Davis moved for an amendment to run this only quarterly, seconded by Mr Shanley, carried 7-1 with Mrs Gr"ugham vvting No Vote on original motion as amended carrieJ S-O CITY ADMINISTRATOR'S MATTERS Mike Smith advised Coun0-il that 4 items woultj be on the
