This memo does not address a similar fixture at the rear of the house, for which a building pen-nit was issued in 2009 and has not received final inspection approval. • The fixture was approved with the permit referenced above. • The fixture was installed with an approved building permit, which correctly cross referenced various sections of the municipal code, including the City Zoning Regulations. However, no specific references were made to zoning code sections or specific design requirements related to exterior lighting. • The fixture exceeds 100 watts and therefore is required to be fully shielded and not visible from adjacent properties, per municipal code section 26-503. The fixture, as installed does not meet the shielding requirement. • The property owner was cited into court in 2007 and the property owner pled guilty to the violation and was ordered to correct the fixture to address the requirement for full shielding. • The fixture was subsequently witnessed by a city code enforcement officer and was not turned on and therefore deemed to be compliant with municipal code requirements. • In 2008, the fixture was observed in violation of the requirement (fixture was turned on) and was cited into court. At that time, the attorney for the property owner made a claim of equitable estoppel based on the approved building permit lacking specificity and the case was dismissed by the municipal court judge. • In 2009, the issue of the lack of shielding was again brought to the attention of City code enforcement officials. The fixture has been witnessed and continues to be in violation of the full shielding requirement. • While the ongoing violation of the full shielding requirement continues to be a violation of municipal code section 26-503, given the relatively recent court action dismissing the case based on the equitable estoppel claim, the City is not pursuing further court action at this time. However, as a matter of law, to the extent the fixture is not modified to comply with the shielding requirement of 26-503, it will continue to be a code violation that the City could, at any time, pursue through a municipal court citation. He has called and received numerous inspections documenting the progress of the project. The last was for a drywall screw inspection on 02/26/08. He is aware that the permit is due to expire on 0426/08. He is hereby requesting an extension of such permit in order to complete the work and schedule final inspections. He had hoped to finish the work by this time but has encountered some unexpected financial difficulties. Since most of the remaining work is on the interior. he is hopeful that satisfactory progress has been made for you to grant an extension. This is the first such request. The work remaining includes: . Completion of electrical tie-in to sub panel (receptacles and switches and covers have been installed . Final moving and setting of existing kitchen appliances. cabinets, and counters (existing kitchen is operational) . Finish floor covering installed (tape, texture and paint have been completed) . East gable end siding installation . Probably because you are sick of hearing from us. Perhaps you didn't realize that we would be calling every night of your shift! Maybe it would be better if you just drove by to verify his usage each night before you go home. I have left you messages on your voice mail. Even though you indicated Kruger was told to shut the light off, we all know he'll remain defiant. Next, I wanted you to know that NOW he is using the front., west side light. How is that possible? We thought he didn't have any electrical wiring connected to it. So, we are at the point where we are back to not being able to sleep because we are 30 feet from a light that envelopes the entire house, which light covers 19,000 square feet. I hope the building department wasn't so ill-informed as to issue him an electrical permit for a light that does not conform to code. That would certainly be shipshod. I have enclosed an updated calendar of usage for your file, as well as photos_ The photos are dated and each depiction is listed. Both lights have now been on for three (3) nights solid - all night long! Every check mark on that calendar is a complaint. Is the June 7th date still on the docket? Please confirm that with us. Chief Building Official ~ 4l ~~M~\-_ October 24, 2006 Dear Mr. and Mrs. Kruger: Pursuant to advice from our attorney, we are to make an offer of settlement with respect to the dispute that has arisen between us over property on the Quelette Ditch Company Easement, which would negate the need for litigation. You are claiming that the boundary line between our two properties is where you have posted your "property line" sign and no trespassing signs, which signs you have posted on the new fence. We consider the old fence on the south side of the ditch easement as the boundary line. You have not given us the courtesy of a copy of the survey from which you base your claim, nor have you contacted us with your concerns. Y Oil, instead, have taken a different obtuse approach and have made no effort whatsoever to constructively communicate. The old decrepit fence has been considered the boundary line between 4240 and 4210 Garland since the mid-1950's. When we purchased the property this was reiterated by Mrs. Lines at our closing, as well as stating that we were responsible for maintaining the ditch easement. Through investigation, the fence was built by the original owner of your property in 1955/56 and has been considered the boundary between the two properties, notwithstanding the 6' ditch easement, which ditch has been in existence since the 1880's. We can obtain Affidavits from longtime residents of the neighborhood familiar with not only the ditch easement, but the old fence itself stating its history. This has been arranged with certain neighbors and individuals who lived with Mrs. Lines, the original owner of our property. Also, the City of Wheat Ridge issued a permit for the location of our new house based on the measurement from the house to the old fence to adhere to the 10' set back requirement; and issued a permit with permission of the easement owner, Ouelette Ditch Company, to build the new fence, again on the belief that the old fence is the boundary line. Since before our purchase of 4240 Garland Street, it was the homeowner of 4240 Garland that maintained the property north of the old fence, including the ditch easement. That has been our responsibility as welL Access to the easement is only through our property at the east and west ends because of trees and blockage by the old fence on your property. During our occupancy we have continued to maintain the ditch and improve the same as a result of erosion, attrition, etc., all of which has been approved by Ouelette Ditch Company, owner of. the easement. According to Ouelette, the easement's south oerimeter runs along the north side of the old fence, and extends in some places a foot or so further south of the old fence. We improved the ditch and water flow with a culvert in May, 2006; we replaced the old fence following as close as possible the easement line with a new fence along the edge of said easement in September, 2006; and have made said improvements to the easement at no cost to vou. You have taken no interest in anything regarding the easement up until the placement of the culvert. In pursuit of a non-judicial resolution, we propose that any land south of the new fence be yours, that you may benefit from a new fence replacing the old fence. This would include the southeastern comer of property that the new fence does not encwnber, but is still encwnbered by the old fence. The property north of the new fence would be ours. We would continue to maintain the easement. It is widely known that you have no water rights, but that should you 1 acquire the same at a later date, the opening at the east end of the fence would be used as a conduit for water. This offer of settlement is good for a period of ten (10) days from the date of this letter. Whenever the building or structure, exclusive of the foundation, shows 33 percent or more damage or deterioration of its supporting member or members, or 50 percent damage or deterioration of its non-supporting members, enclosing or outside walls or coverings. 12. Whenever the building or structure has been so damaged by fire, wind, earthquake or flood, or has become so dilapidated or deteriorated as to become (i) an attractive nuisance to children; (ii) a harbor for vagrants, criminals or immoral persons; or as to (iii) enable persons to resort thereto for the purpose of committing unlawful or immoral acts. 13. Whenever any building or structure has been constructed, exists or is maintained in violation of any specific requirement or prohibition applicable to such building or structure provided by the building regulations of this jurisdiction, as specified in the Bnilding Code or Housing Code, or of any law or ordinance of this state or jnrisdiction relating to the condition, location or structure of buildings. 14. Whenever any building or structure, because of obsolescence, dilapidated condition, deterioration, damage. inadequate exists, lack of sufficient fire-resistive construction, faulty electric wiring, gas connections or heating apparatus, or other cause, is detennined by the fire marshal to be a fire hazard. 17. Whenever any building or structure is in such a condition as to constitute a public nuisance known to the common law or in equity jurisprudence. 18. Whenever any portion or a building or structure remains on a site after the demolition or destruction of the building or structure or whenever any building or structure is abandoned for a period in excess of six months so as to constitute such building or portion thereof an attractive nuisance or hazard to the public. The 1997 Uniform Housing Codes states: SECTION 1001 - DEFINITIONS 1001.1 General. Any building or portion thereof that is determined to be an unsafe building in accordance with Section 102 of the Building Code, or any building or portion thereof, including any "dwelling unit, guest room or suite or rooms, or the premises on which the same is located, in which there exists any of the conditions referenced In this section to an extent that endangers the life, limb, health, property, safety or welfare of the public or the occupants thereof, shall be deemed and hereby are declared to be substandard buildings. 1001.2 Inadequate Sanitation. Buildings or portions thereof shall be deemed substandard when they are when they are in sanitary. Inadequate sanitation shall include, but not be limited to, the following: 1. Lack of or improper water closet, lavatory, bathtub or shower in a dwelling unit or lodging house. 2. Lack of or improper water closets, lavatories, and bathtubs or showers per number or guests in a hotel. 3. Lack of or improper kitchen sink in a dwelling unit. 4. Lack of hot or cold running water to plumbing fIxtures in a hotel 5. Lack of hot or cold running water to plumbing fIxtures in a dwelling unit or lodging house. 6. Lack of adequate heating facilities. 7. Lack of or improper operation or required ventilating equipment. 8. Lack of minimum amounts of natural light and ventilation require by this code. 9. Room and space dimensions less than required by this code. 10. Lack of required electrical lighting. 11. Dampness of habitable rooms. 12. Infestation of ins eels, vermin or rodents as determined by the health offIcer. 13. General dilapidation or improper maintenance. 14. Lack of connection to required sewage disposal system. 15. Lack of adequate garbage and rubbish storage and removal facilities as determined by the health officer. 1001.3 Structural Hazards. Buildings or portions thereof shall be deemed substandard when they are or contain structural hazards. Structural hazards shall include, but not be limited to, the following: 1. Deteriorated or inadequate foundations. 2. Defective or deteriorated flooring or floor supports. 3. Flooring or floor supports of insuffIcient size to carry imposed loads with safety. 4. Members of walls, partitions or other vertical supports that split, lean, list or buckle do to defective material or deteriorations. 5. Members of walls, partitions or other vertical supports that are of insuffIcient size to carry imposed loads with safety. 6. Members of ceilings, roofs, ceiling and roof supports, or other horizontal members that sag, split or buckle due to defective material or deterioration. 7. Members of ceilings, roofs, ceiling and roof supports, or other horizontal members that are of insufficient size to carry imposed lads with safety. 8. Fireplaces or chimneys that list, bulge 0 settle due to defective material or deterioration. 9. Fireplaces or chimneys that are of insuffIcient size or strength to carry imposed loads with safety. 1001.4 Nuisance. Mechanical equipment that was installed in violation of code requirements in effect at the time of installation or mechanical equipment not installed in accordance with generally accepted construction practices in areas where no codes were in effect or that has not been maintained in good condition or that is not being used in a safe manner shall be considered substandard. 1001.8 Faulty Weather Protections. Buildings or portions thereof shall be considered substandard when they have faulty weather protections, which shall include, but not be limited to, the following: 1. Deteriorated, crumbling or loose plaster. 2. Deteriorated or ineffective waterproofing or exterior walls, roof, foundations or floors, including broken windows or doors. 3. Defective or lack of weather protection for exterior wall coverings, including lack of paint, or weathering due to lack of paint or other approved protective covering. 4. Broken, rotted, split or buckled exterior wall coverings or roof coverings. 1001.9 Fire Hazard. Any building or portion thereof, device, apparatus, equipment, combustible waste, or vegetation that, in the opinion of the chief of the fIre department. is in such a condition as to cause a fIre or explosion or provide a ready fuel to augment the spread and intensity of fIre or explosion arising from any cause shall be considered substandard. 1001.10 Faulty Materials of Construction. The use of materials of construction, except those that are specifically allowed or approved by this code and the Building Code, and that have been adequately maintained in good and safe conditions, shall cause a building to be substandard. 1001.11 Hazardous or Insanitary Premises. The accumulation of weeds, vegetation, junk, dead organic matter, debris, garbage, offal, rat harborages, stagnant water, combustible materials, and similar materials or conditions on a premises constitutes fIre, health or safety hazards that shall be abated in accordance with the procedures specifIed in Chapter II of this code. 1001.12 Inadequate Exits. Except for those buildings or portions thereof that have been provided with adequate exit facilities conforming to the provisions of this code, buildings or portions thereof whose exit facilities were installed in violation of code requirements in effect at the time of their construction or whose exit facilities have not been increased in number or width in relations to any increase in occupant load due to alterations, additions or change in use or occupancy subsequent to the time of construction shall be considered substandard. Notwithstanding compliance with code requirements in effect at the time of their construction, buildings or portions thereof shall be considered substandard when the building official finds that an unsafe condition exists through an improper location of exits, a lack of an adequate number or width of exits, or when other conditions exist that are dangerous to human life. 1001.13 Inadequate Fire-Protection or Fire-Fighting Equipment. Buildings or portions there of shall be considered substandard when they are not provided with the fIre-resistive construction or fire- extinguishing systems or equipment required by this code, except those buildings or portions thereof that conformed with all applicable laws at the time of their construction and whose fire-resistive integrity and [lIe-extinguishing systems or equipment has been adequately maintained and improved in relation to any increase in occupant load, alteration or addition, or any change in occupancy. 1001.14 Improper Occupancy. All buildings or portions thereof occupied for living, sleeping, cooking or dining purposes that were not designed or intended to be used for such occupancies shall be considered substandard. The following is a list of items that shall be fixed to meet code: 1. Wiring is illegal to outside lights. 2. Fascia on eves on rotting off building and has birds nest in roofing. 3. Abandoned fridge is outside dangerous for children. 4. Siding needs to be replaces it has rotted through in spots. 5. All broken windows shall be fixed. 6. Flood lights shall point down not to cast light onto neighboring properties. 7. Storage room on rotten deck on east side of home shall be removed immediately. 8. Noted foundation work with out a permit on garage. 9. Steps to doors are not to code and or are missing. 10. Weather port has no building permit needs to be removed or need to apply for a permit. II. Exterior lights maybe illegal for residential zoned property and are casting light onto neighboring properties. 12. All vents need to have weather caps covering them. 13. Need to fix fence. 14. The site shall be cleaned up and all items shall be addressed by the Community Service Unit along with the Building Division. IS. Note these may not be the only items that need to be addressed to meet code. ORDER I. The City of Wheat Ridge Building Official has determined the building referenced above to be a Dangerous Building. The Building Department will post the building as a Dangerous Building due to the amount of life safety issues. Pursuant to Code all occupants shall be required to vacate the property with 30 days of this Notice or November 1, 2006 unless a building permit is pulled and the life safety items are addressed. This is therefore required in order to protect life, health and safety ofthe public. II. The owners are ordered to pull a building permit to fix the deficient items. The Building Department will post the building as a Dangerous Building due to the amount of life safety issues. Pursuant to Code all occupants shall be required to vacate the property. This is therefore required in order to protect life, health and safety of the public. III. If the structure has not been brought to code or demolished by January 1,2006. Section 801 in the Uniform Code for the Abatement of Dangerous Buildings states, "801.1 Procedure. When any work of repair or demolition is to be done pursuant Section 701.3, Item 3, ofthis code, the building official shall issue an order thereof to the director of public works and the work shall be accomplished by personnel of this jurisdiction or by private contract under the direction of said director. Plans and specifications therefore may be prepared by said director, or the director may employ such architectural and engineering assistance on a contract basis as deemed reasonably necessary. If any part of the work is to be accomplished by private contract, standard public works contractual procedures shall be followed." Section 801.2 states, "801.2 Costs. The cost of such work shall be paid from the repair and demolition fund, and may be made a special assessment against the property involved, or may be made a personal obligation of the property owner, whichever the legislative body of this jurisdiction shall determine is appropriate." The property owner and all occupants are hereby ORDERED TO CEASE AND DESIST occupancy and use of the above described building. The Building Official shall cause the property to be posted with the attached Notice and shall take action to remove all future occupants from the building until the building is brought up to code. REMEDIAL ACTION 1. The property owner must apply for and obtain a City of Wheat Ridge building permit to correct any deficiencies. IV. All deficiencies shall be fixed but are not limited to the items on this list. APPEAL OF THIS NOTICE AND ORDER Any person having record title or other legal interest in the above described premises may appeal this Notice and Order or any action ofthe Building Official to the Building Code Advisory Board or known as the Board of Appeals pursuant to section 112 of the Code, provided that the appeal is made in writing as provided in the Code and filed with the Building Official within ten (10) days from the date of service ofthis Notice and Order. Failure to appeal will constitute a waiver of all rights to an administrative hearing and determination of this matter. FILING OF AN APPEAL SHALL NOT STAY THE EFFECTIVENESS OF THIS NOTICE AND ORDER. It is a misdemeanor to occupy this building, or to remove or deface this notice.
