View it in your browser. ♦SII City Of c�7�IheatR�dge COMMUNITY DEVELOPMENT Memorandum TO: Address File FROM: Zareen Tasneem, Planner I Lauren Mikulak, Planning Manager DATE: May 30, 2019 SUBJECT: 3815 Dudley — Setback Determination The purpose of this memo is to inform the determination of applicable setbacks related to the property at 3815 Dudley Street which is unusual in shape and orientation. • The property at 3815 Dudley is zoned Residential -One (R-1). Setbacks in the R-1 zone district are as follows and have been such since at least 1989: — Front setback: 30 feet — Side and rear setbacks: 15 feet — Front setbacks for structures on lots or portions of lots which abut cul-de-sacs may be reduced to ten (10) for those portions of lots which abut a cul-de-sac bulb. • In 1995, the applicant's family subdivided property (8701 W. 38a' Ave.), creating the subject lot (Case No. MS -95-03). The case report states that the lots meet the minimum requirements of the R-1 zoning, meaning the lots were at least 12,500 square feet in size and 100 feet wide. There is no discussion of setbacks in the case file for the subdivision and no reference to which lot line was considered front or rear. Because the 1995 case is silent to defining the lot lines, staff has used several documents to determine the applicable setbacks: 1. The lot is not considered a cul-de-sac lot because it does not have at least 30 feet of street frontage on the cul-de-sac, which has been required by code since at least 1989 (the arc length is only 22 feet). "Width of a lot' is the shortest distance between two points intersected by the front setback line. Again, because the subdivision case indicated the lot complied with the R-1 standards, it would imply that either the north or south property line is the front. The subdivision clearly shows that the structures existing at the time did not meet a 30 -foot setback from the southern property line, therefore, based only on the subdivision case, it would appear the north property line was considered the front property line. 2. Subsequently, however, staff identified two building permits from 2005 and 2006, respectively, which appear to indicate a different interpretation. Staff utilizes an internal worksheet when reviewing building permits, and notes appearing on this sheet as well as on the approved the site plan, indicate that rear setbacks were applied to the western property line and side setbacks were applied to the northern and southern property line. A structure was approved to be built 15 feet from the northern property line. 3. Based on this sequence of approvals, it appears that the most recent interpretation in 2005 and 2006 determined the western property line to be the front. In 1996, the neighbor to the north (Barbara Sileo, 3845 Dudley St.) applied for side and rear setback variances (Case No. WA -96-25). The BOA approved some relief from the setback requirements, but not the full request. It is staff's opinion that this case has no bearing on the determination of setbacks on the subject property. • Even though this lot does not qualify as a cul-de-sac lot, because the front lot line is defined as the boundary line between an interior lot and a street and the lot line that abuts the cul-de-sac is the only lot line that borders a street, it is considered the front lot line. Furthermore, the front setback for portions of lots which abut cul-de-sacs may be reduced to ten (10) feet for those portions of lots which abut a cul-de-sac bulb. • The rear lot line is defined as the boundary line of a lot which is most nearly opposite the front lot line. In this case, that would mean the southern property line is the rear lot line. The northern property line has been confirmed to have a 15 -foot setback based on the issuance of permits for structures with this setback. It is considered a side lot line since a side lot line is defined as any boundary line of a lot other than the front or rear lot line. The western and eastern property lines are also, therefore, considered side lot lines. Because of the unusual and nonconforming nature of this lot, Exhibit 4 clearly delineates the applicable setback distances, as well as subdivision easements. Any area colored in red or green cannot be built upon. IL SUBDIVISION DESIGN The property in question is zoned R-1, is roughly .8 acre in area and is a through -lot with frontage on both West 38th Avenue and Dudley Street. There is an existing house on the southern two-thirds of the property plus several accessory structures. The applicant is requesting approval of a two -lot subdivision so the northern one-third can be used as a separate building site. Lot 1 (southern lot) would be 23,716 square feet and Lot 2, which has access from Dudley Street, would be 12,500 square feet. All minimum requirements of the R-1 zone district regulations have been met. A 20 -foot -wide cross access easement has been provided over and between the two lots. II I ~.:.::-.-....- February 9th 2005 Travis, Relating to our earlier conversation this morning at City Hall and for your further information, I spoke to my parents, Phil & Claudia Callas (owner's of 3815 Dudley Street), to get the details from them on how thev would intend to use & what thev would intend to store in the outbuilding under discussion for permitting. Their list includes: Storage of antique 1880's One-Horse Open Sleigh (up above rafters). Storage of a large collection of antique baskets (hung below rafters). Storage of vintage 1930's Flower Push Cart3'x4' wI large spoke wheels and other smaller collectables (in loft area) Shelter for large gardening equipment including riding mower, push mowers, rotor tiller, weed whacker, etc. Storage of numerous gardening implements including shovels, trowels, rakes, picks, axes, hoses, stakes, fencing, etc. Seasonal storage (out of weather) for 7' long x 6' high Garden Swing including frame, swing, cushions, and canopy. Seasonal storage (out of weather) of lawn chairs, hammocks, swings, etc. Seasonal storage of 5-6 bicycles of various sizes. Use for gardening of a large Potting Bench located in shade under the porch area. Use for gardening of a Workbench inside building for mending tools, etc. We thank you for your consideration on this matter and understand that this building's design (as it combines fann-like outbuilding features in keeping with the historic character of the property) does not fit exactly into the City's precise specifications for "shed" or "garage".
