writing and received prior to the date of expiration. An extension of no more than 180 days may be granted at the
discretion of the Chief Building Official and may be subject to a fee equal to one-half of the original permit fee.

To Whom It May Concern:
Our fencing contractor, D & G Ironworks contacted us regarding your concerns
over the use of 6' cedar picket fencing within the floodplain. They relayed to us
that you suggested either having the fencing put l' above grown, or to have
alternating pickets, or a breakaway section to the design of the fencing. This
came as quite a surprise as we already have 6' picket fencing on the south and
west (or side and back) sides of our property built by the previous owner. We
wanted to extend the picket fence to finish the back and include the other side (or
north side). Included are photos and a copy of our lOG with fencing plans for
your perusal.
Our next door neighbors at4275 Garrison Street put in 6' cedar picket fencing to
the north and east (or front and side) sides of their property in spring of 2001; this
was under permit and approved by your department. Also, there are other
homes in the floodplain on Garrison Street that have 6' picket fencing. They
include 4358 and 4360 Garrison Street - each with fencing on north, east, south
and west sides. The house next to 4358 and 4290 Garrison Street (could not
see the number from the street) also has 6' picket fencing on the north, east, and
west sides. There is also the house at 4271 Garrison Street, which appears to
have picket fencing on all sides enclosing the back, and 4261 Garrison Street
has a 6' picket fence as well.
In addition, Anderson Park of the City of Wheat Ridge Parks & Recreation has a
6' cedar picket fence constructed around the north, east, south and west sides of
a storage area, which is directly behind houses on Garrison Street. All the
fences mention above are standard side-by-side 6' picket cedar or wood fences,
all are tOUChing and anchored into the ground. All these fences have areas
where there is some clearance from the ground due to uneven grating, and worn
areas where animals, such as foxes and skunks, have dug under. Each of these

required attachments; either a break-away design, or the staggering of pickets, or other

fences also has spacing between the pickets due to shrinkage; the spaces range
from y.. of an inch up to almost Yo an inch.
My wife and I are concerned that we are being singled out for some reason when
it is clear that all the homes and park described above contain the type of fencing
we have planned on, Included is a map Of the floodplain area around Garrison
Street showing the houses and park mentioned above.
We tend to feel a bit wary for we have had problems with people in the
neighborhood since first moving in. Problems have included: someone breaking
in and letting our horse out and lighting firecrackers to watch him flip out;
subsequent break-ins making the horse so frightened that he wouldn't go into his
stall; having the pump to our well ripped out; having neighbors telling us that we
are hated by everyone and are not welcome here; lighting illegal fireworks
purposely in front of our property; threatening us with statements such as "Will
you move out of the neighborhood if your horse was dead?" We are hoping that
there are no acquaintances of these individuals working in your department who
would further harass us through unfair practices.
We really love our home and living in Wheat Ridge despite the rough start. We
sincerely hope any confusion can be straitened out as we plan to make more
improvements in the future to our home and look forward to working with you in
that endeavor.

Fence Permit, 4285 Garrison Street
The application for a fence permit for the referenced property will require an application
for a Class I Special Exception to the Flood Plain. The entire property is within the 100
year flood plain Zone A and falls under the requirements of our Flood Plain Ordinance.
Specifically, Section 26-806.C.1 and therefore also Section 26-806.F.16. Both are
attached for reference. The wrought iron fence is permissible as it wiil ailow flood flows
to pass through it. The proposed six food solid cedar fence must be constructed In a
break-away design or the bottom to be placed one foot above the base flood elevation.
This latter requirement would place the bottom of the fence approximately two feet
above the ground which, of course, is not practical. Alternative designs would be to
stagger the fence pickets from one side of the fence rail to the other leaving a one to
two inch gap between the pickets on each side, or to simply leave a 2 inch gap between
pickets. This ailows for some privacy, yet also allows the free flow of water through and
around the pickets. I will review the application for the special exception with the
required attachments; either a break-away design, or the staggering of pickets, or other
method of ailowing flood flows to pass through.
