The R -I zone district requires a side and rear yard setback of at least IS feet for accessory structures, After researching the City building permit files, a valid building permit for the shed could not be located. This does not necessarily mean that a permit was not granted. It is possible that a permit was granted, and the City inadvertently did not keep a copy of the permit. Further, the City aerial photographs were examined to try to determine the setback for the existing shed. While it is difficult to get a truly accurate measure of setback due to foliage and inaccuracy of digital property lines on the aerial photographs, Staff does acknowledge that the shed does not meet current setback regulations in the R-I zone district. Given this information, Staff determines that the shed is considered a non-conforming structure. It is unclear if the shed was permitted at one time, and ifit met the setback regulations at the time of construction. Pursuant to Section 26-120 of the Wheat Ridge Code of Laws, non-conforming structures are allowed to remain, but the extent of non-conformity may not be enlarged, Therefore, the City cannot force the property owners to move the shed to comply with the current regulations.
