We have given until the end of the November 2009 before the converted third unit is required to be vacated.
Margaret asked if a variance was an option. Upon speaking with our planning division, the lot is zoned R-3,
however, does not meet the required lot size for a tri-plex.
Option 1: A lot size variance of 1432 ss feet would need to be initiated. Secondly, should a variance be
approved, plan submittal, approval, permit issuance and inspections would be required to properly separate all
services (water, sanitation, gas, electric, etc) and all building code requirements would need to be met (ie: fire
separation, egress, etc,)
Option 2: A permit can be obtained to properly convert the structure back to the original duplex floor plan and
egress windows from the basement bedrooms would be required, as well as compliance on additional code
violation that may exist.
Depending on the option you choose, either a variance needs to be applied for immediately (to be followed
immediately with permit application if approved) or the third unit shall be vacated by the end of this month and a
permit pulled to convert the structure back to a duplex with proper egress, etc, Please let me know of your
decision and I will make a determination as to a deadline.

The application of the 2003 IRC and 2005 NEC is based on the code itself, which requires all
new work
o, with current codes, The work to convert the duplex to a three unit structure
was neither permitted nor approved, and as such, was performed in violation of municipal and
building codes, The work that will be necessary to convert the structure from its' current state
back to a duplex is required to comply with currently adopted codes, thus, the reference to the
2003 IRC and 2005 NEC.
The requirement for installation of egress windows is based on the creation of a life -safety
violation of the code during the unpermitted alteration of the basement. Again, alteration of the
space will require compliance with current codes, I do not believe that application of current
codes to new work is subject to interpretation and would not serve as a basis for appeal.
The vague nature of items 4 and 5 is necessary due to our inability to access all areas of t
structure during our inspection. A more specific and detailed list can be provided if and wh
access to the entire structure is obtained. I

Sec. 302.9 Whenever, for any reason, the building or structure, or any portion thereof,
manifestly unsafe for the purpose for which it is being used. I
Sec. 302.13 Whenever any building or structure has been constructed, exists or is
maintained in violation of any specific requirement or prohibition applicable to such building
or structure provided by the building regulations of this jurisdiction, as specified in the
Building Code or Housing Code, or of any law or ordinance of this state or jurisdiction
relating to the condition, location or structure of buildings.
Sec. 302.15 Whenever a building or structure, used or intended to be used for dwelling
purposes, because of inadequate maintenance, dilapidation, decay, damage, faulty
construction or arrangement, inadequate light, air or sanitation facilities, or otherwise, is
determined by the health officer to be unsanitary, unfit for human habitation or in such a
condition that is likely to cause sickness or disease.
2003 International Property Maintenance Code
Sec. 304.1 General. The exterior or a structure shall be maintained in good repair,
structurally sound and sanitary so as not to pose a threat to the public health, safety
welfare. I
Sec. 305.1 General. The interior of a structure and equipment therein shall be maintained
in good repair, structurally sound and in a sanitary condition.
Sec. 504.1 Plumbing general. All plumbing fixtures shall be properly installed and
maintained in working order, and shall be kept free from obstructions, leaks and defects
and be capable of performing the function for which such plumbing fixtures are designed.
All plumbing fixtures shall be maintainedsafe, sanitary and functional condition.
Sec, 603.1 Mechanical appliances. All mechanical appliances, fireplaces, solid fuel -
burning appliances, cooking appliances and water heating appliances shall be properly
installed and maintained in a safe working condition, and shall be capable or performing the
intended function.
Sec. 603.1 Electrical installation. All electrical equipment, wiring and appliances shall be
,�troperly installed and maintained in a safe and approved manner,
Sec. 704.2 Smoke alarms. Single or multiple -station smoke alarms shall be installed and
maintained in Groups R-2, R-3, R-4 and in dwellings not regulated in Group r occupancies,

the immediate vicinity of bedrooms, 2. In each room used for sleeping purposes,
each story within a dwelling unit, including basements and cellars.,.
2003 International Residential Code
R310.1 Emergency escape and rescue required. Basements with habitable space and
every sleeping room shall have at least one openable emergency escape and rescue
opening. Where basements contain one or more sleeping rooms, emergency egress and
rescue openings shall be required in each sleeping room, but shall not be required in
adjoininT areas of the basement. Where emergency escape and rescue openings are
provided they shall have a sill height of not more than 44 inches above the floor.
R310.1.1 Minimum opening area. All emergency escape and rescue openings shall
have a minimum new clear opening of 5.7 square feet. Exception: Grade floor openings
shall have a minimum new clear opening of 5 square feet.
The ordered actions and repairs are:
1. Provide plans and apply for building permit to convert structure back to
original Duplex Residence. (Structure is currently being utilized as an illegal
triplex, without building permit(s)/approval for conversion and in violation of
code(s) for a legal multi -family unit.)
2. Means of egress shall be to code from basement bedrooms.
3. Smoke detectors required.
4. Structure shall comply with 2003 IRC and 2005 NEC.
5. Any additional items found to be in violation of the adopted codes.
