Installation of roof sheathing (new or overlay) is required on the entire roof when spaced or board sheathing with ANY gap exceeding one half inch exists. Sheathing and mid -roofs may be called in at the same time, one hundred percent of the sheathing must be complete and 25-75 percent of the mid -roof may be complete. Asphalt shingles are required to be fastened to the roof deck with a minimum of 6 nails per shingle. Ice and water shield is required. Eave and rake metal is required. A ladder extending 3 feet above the roof eave and secured in place is required to be provided for all roof inspections. Roof ventilation is required to comply with applicable codes and/or manufacturer installation instructions, whichever is more stringent. In order to pass a final inspection of elastomeric or similar type roof coverings, a letter of inspection and approval from the manufacturer technical representative stating that "the application of the roof at (project address) has been applied in accordance with the installation instruction for (roof material brand name) roof covering" is required to be on site at the time of final inspection. Roof inspections for ROOFS OVER 6/12 PITCH: 3rd party inspection will be required, the 3rd party inspection report will be collected at final roof inspection performed by City of Wheat Ridge. (Section 1603, 2012 IBC and City of Wheat Ridge policies and procedures). 2) Please provide a commentary describing the nature of person, who will be receiving custodial care in this residence, and if they are capable of self-preservation to deten if the occupancy classification is an R-4 or 1- 1, . (Section 310.6, 2012 113C). 3) The Structural note plan page is hard to read because of light print and blurriness of print, Please replace with readable print, (Section 107.2.1, 2012 IBC). 7) An exterior balcony load of 60 PSF is noted on the building code analysis section yet, a balcony is not shown on the plans; is an exterior balcony going to be constructed on this p�roject? The work described on the hand -written application was "addition and remodel converting a single family home to an Alzheimer's group home for 8 patients ". See Exhibit #1 Page 2 On February 5, 2015, an email with an attached letter was sent to the Building Division Plans Examiner, Michael Abruzzi. This letter was intended to clarify the intended use of the facility. The letter stated that the structure was "being remodeled and converted to a 6 bedroom home for 8 seniors with dementia." The letter acknowledges some memory loss on the part of the occupants. See Exhibit #2 An email from Russ Udelhofen, Administrator with Jaxpointe, the firm that will operate this facility, was received on February 9, 2015, in which Mr. Udelhofen stated that "these are not mental illness patients" and that "they can seek self - preservation." He also requested information on the occupancy classification of other facilities within the City. See Exhibit #3 On February 11, 2015, I responded to Mr. Udelhofen's email by providing an official determination that, based on the information provided during the application process, the criteria set forth in the International Building Code for determining occupancy classification, and information obtained from the National Institute on Aging and the Alzheimer's Association as it relates to Alzheimer's and dementia, the applicants are not capable of self - preservation for the purposes of determining an occupancy classification and therefore the classification has been determined to be an I -2, or Institutional occupancy group, Class 2. See Exhibit #4. On February 12, 2015, an email from Mark Klatke of Klatke Construction was received stating that they were "re- designing per I -2 occupancy as fast as possible." See Exhibit #5 On February 18, 2015, a request for appeal of the occupancy classification was received. See exhibit #6 At issue is whether the occupants of this facility are "capable of self - preservation ", which is the primary factor in differentiating between occupancy classifications and determining whether the facility should be designed as a residential structure or as an institutional occupancy. An I -2 occupancy, as described in the IBC, "shall include buildings and structures used for medical care on a 24 -hour basis for more than five persons who are incapable of self - preservation." Incapable of self - preservation, as defined in the IBC, is "persons because of age, physical limitations, mental limitations, chemical dependency, or medical treatment who cannot respond as an individual to an emergency." The original application for permit stated that the patients suffer from Alzheimer's, a specific form of dementia. The subsequent letter from Jaxpointe administrator Russ Udelhofen stated simply that the patients suffer from dementia. Correspondence received subsequent to the I -2 determination stated that the "general health [of the patients] is usually normal." The same correspondence also stated that patients have "memory loss in some areas" and states that if the patients' conditions worsen they will be moved. However, the Jaxpointe website promotes Jaxpointe as a place where patients can "live ...through the remainder of there lives (no worries about additional moves). See Exhibit #7 National organizations agree that both dementia and Alzheimer's, once diagnosed, will worsen. On February 19, 2015, a video on the Jaxpointe site was observed in which patients are being supervised in the taking of medication, followed by Mr. Udelhofen describing an incident with a resident in which the resident experienced difficulty discerning which door to use within the facility. These portions begin approximately 2 minutes into the video. The video on the Jaxpointe website clearly indicates that at least some of the patients suffer from memory loss, some severe enough that they experience difficulty discerning in which room they are. The video also demonstrates that the physical and mental condition of the patients makes supervision while performing the most basic tasks a necessity. Those needs for assistance with daily tasks and reasoning indicate that the ability to respond as an individual in an emergency situation is likely compromised. The National Institute on Aging's Alzheimer's fact sheet states that even in mild stages of Alzheimer's problems for patients can include getting lost, using poor judgment, and taking longer to accomplish normal tasks. See Exhibit #8 The Alzheimer's Association states that in order for a person to be diagnosed with dementia, they must be "significantly impaired" in two of five core mental functions, including memory, reasoning and judgment, visual perception and ability to focus and pay attention. See Exhibit #9 These impairments present a great likelihood that an individual suffering from Alzheimer's or dementia would experience difficulties related to self - preservation in an emergency situation. Based on the requirements of capability of self - preservation established in the IBC, the information provided by the applicants in permit application documents, correspondence and their website, and the information published by well - respected national organizations charged with studying and educating the public about the conditions related to Alzheimer's and dementia, The Building Division believes the likelihood exists that patients within the facility would not be capable of self - preservation and therefore assigned the occupancy classification of I -2 in lieu of R -4 as requested by the applicant. The Building Division respectfully requests that the board uphold the occupancy classification of 1 -2 assigned to this structure and require that the structure be constructed and remodeled in accordance with the requirements for such occupancy classification. We have regular fire drills monthly to help the residents understand exiting the house in an emergency. We have found that despite memory loss in some areas, their basic self - preservation instincts still prevail and they move out of the house quickly. If residents decline to the point where our facility and staff is no longer appropriate, then the resident would have to move to a different setting, usually a higher level of care like a skilled nursing or hospice facility. The facility's ability to meet resident needs shall be based upon a comprehensive preadmission assessment of the resident's physical, health, and social needs; preferences; and capacity for self -care. A facility shall not admit or keep any resident requiring a level of care or type of service that the facility does not provide or is unable to provide (and in no event shall a facility admit or keep a resident who is consistently uncontrollably incontinent unless the resident or staff is capable of preventing such incontinence from becoming a health hazard); is totally bedridden with limited potential for improvement; needs medical or nursing services on a 24 -hour basis; needs restraints; has a communicable disease or infection unless the resident is receiving a medical or drug treatment for the condition and the admission is approved by a physician; or has a substance abuse problem unless it is no longer acute and a physician determines it is manageable. A facility may keep a resident that becomes bedridden while residing in it if there is documented evidence of the following: an order from a physician describing the services required to meet the resident's health needs (including the frequency of assessment and monitoring by the physician or other licensed medical professionals); ongoing assessment and monitoring by a licensed or certified home health agency or hospice (at least weekly assessment); and adequate staffing by individuals trained in the provision of care to bedridden residents. This makes it very clear that the facility licensure is continually checked to insure that only residents capable of "self- preservation" are allowed in an assisted living facility and transferred to a nursing home when their conditions warrants the move. CONCLUSION: After you review the data and attached websites, we believe this appeal will be granted. We respect your concern for the safety of these residents but believe you have misunderstood the condition of the residents that will be admitted. People requiring the care of an 1 -2 level institution pay more because the care is far more intense and the facilities are more expensive to construct. We believe our level of care provides an essential option to people with early onset Alzheimer's and other minor levels of dementia. Colorado has the highest level of early onset Alzheimer's of any State in the United States and there is a very high need for these types of "affordable" care options. Please do not discriminate against this program. An assisted living facility is prohibited by Colorado State law to keep people who cannot self - preserve; therefore an operator must transfer any patient that regresses to this point to a nursing home or other medical care facility equipped to handle their condition. (ii) Evidence in the resident's record that the facility has: (A) established the legal authority by guardianship, court order, medical durable power of attorney, health care proxy, or other means allowed by Colorado law, for the use of such device; (B) conducted an assessment, prior to use, that evaluates the appropriateness of the device and reassessment(s) within 3 calendar days of a significant change in the resident's condition that warrants intervention or different care needs. The assessment and reassessment shall include written findings and their basis. The assessment and reassessment(s) shall be completed by a qualified professional, such as the resident's physician, a social worker, physician's assistant or nurse practitioner.
