On March 22, Council tabled it. I have reviewed CRS-31-12-501/503 (copy attached) and find no reason to inform the State or County prior to the City Council hearing. If Council approves the ordinance, then we must file the ordinance with the Jefferson County Clerk and Recorder, who subsequently files with the State Division of Local Government. Hence, Council Bill 5 should be republished by the Clerk for a public hearing to be held September 20, 1993. "~ - ~ CITY COUNCIL MINUTES: February 22, 1993 Page -b- '~ Phil Edwards will vote against this, it is a luxury during the budget ~` crunch we are faced with and we don't need this. ~4, Vance Edwards will vote against this, it comes out of Council Contingency, we shorted some charities that deliver daily services to the citizens of Wheat Ridge and he doesn't find this essential whatsoever. Mr. Flasco will also vote against this for the same reasons Mr. Davis stated. Mr. Selstad will vote against this for the same r=axons Mr. Davis stated. Motion failed 2-b with Mr. Shanley and Mr. Eafanti voting yes. Mr. Shanley moved to appropriate $1,250 for a half page ad; seconded by Mr. Eafanti; failed 2-b with Mr. Shanley and Mr. Eafanti voting yes. Item 6. Discussion of City Attorney interview process. Mr. Flasco explained that the 5 person committee appointed by the Mayor to select candidates, had met several times. They read all the applications, rated them from 1 to 5, added up the scores, cut about half, started again, came up with 8 candidates, interviewed all 8, and narrowed it down to 3 people who will be brought in to City Council to interview. If Council is not satisfied with the 3, the additional 5 could be brought in. Motion by hir. Flasco that the applications be distributed to City Council so they can look them over and be brought back in to the next Council Meeting or the Council set up a date so they can interview those three people publicly before they make their decision; seconded by Phil Edwards; ;lance Edwards asked for a friendly amendment that this meeting be set as a Special Meeting for March 15,1993 at 7:30 p.m. Mr. Flasco and second accepted this; carried 8-0. NEW BUSINESS ORDINANCES ON FIRST READING Item 7. Council Bill 5 - An Ordinance providing for the disconnection of a parcel of land located within the City of Svheat Ridge. Council Bill 5 was introduced by Mrs. Brougham on first reading; title read by the Clerk. Motion by htrs. Brougham that Couneil Bill 5 be approved on first reading, ordered published, public hearing be set for Monday, March 22, 1993 at 7:30 p.m. in City Council Chambers, Municipal Bldg., and if approved on second reading, take effect 15 days after final publication; seconded by Vance Edwards. Mr. Flasco will against this due to the letter he has received from Mr. Middaugh. Mr. Davis will also vote against this. APPROVAL OF MINUTES of March 8, 1993 Motion by Mr. Eafanti for the approval of the Minutes of March 8, 1493; seconded by Mr. Davis; carried 8-0. CITIZENS' RIGHTS TO SPEAK William Fallert, 9~t63 W• 47th Avenue, was sworn in by the Mayor; he complained about excessive noise from the Boat House and problems brought about by that business; they are out of business now and he asked Council for land restrictions so that a similar business won't open there. Eva Kay Stalie, 3525 Estes Street, was sworn in by the Mayor; she asked what it would take to get DARE Officers for Junior Highs. (Chief Hurst is working on this). Carl Schiele, 7101 W. 38th Avenue, Principal of Wheat Ridge Middle School, 7101 W. 38th Avenue, home address 7032 Quail Street, Arvada, was sworn in by they Mayor; he thanked Council and Police Chief Hurst for the DARE program in elementary schools; it is his opinion that young people in Middle Schools need a continued DARE program; asked that Council and Police implement this program in both Middle Schools in Wheat Ridge. We believe that there should be some guarantee put in place that should the City wish to re-stripe the project to a 4-lane roadway additional public input would be mandatory. We realize this Council cannot bind further, Council but if the approval of this could be made an Ordinance which would require Council action to change, then we believe protection would be in place that would allow the citizens to have some assurance the City would not re-stripe the street without additional public input. Motion by Mrs. Brougham to approve Council Bill 25 (Ordinance No. 940), order it published, and that it take effect 1 day after final publication; seconded by Vance Edwards; carried $-0. Item 4. Mr. Middaugh explained that Mr. Barnhill had asked to be disconnected from the City for a variety of valid reasons that had been discussed at length in previous Council meetings. Motion by Mrs. Brougham that Council Bill 5 (Ordinance 941) be approved on second reading and ordered published and take effect upon the required filing with the Jefferson County Clerk and Recorder; seconded by Uance Edwards; carried $-0.
