Re: Three-lot minor subdivision 3490 lay Street Dear Mr. Moberg: In our capacity as engineers for the Wheat Ridge Sanitation District, we aze responding to your request for comments in regazd to the above referenced action. We have reviewed the plat submitted by your office and are concerned that the existing District sanitary sewer line which crosses the property will partially fall outside of the proposed right-of-way for Jay Street. If indeed this is the case, the District will need to maintain an easement across Lot 1 for that portion of the sanitary sewer main which is outside of the proposed right-of--way. We are requesting that additional information be provided which shows the location of the existing sanitazy sewer main in relation to the proposed right-of--way for Jay Street. Assuming that the existing sanitary sewer main falls within the proposed right-of-way or that the owners of the property aze willing to provide the District with an easement covering the segment of sanitary sewer main outside of the proposed right-of--way, then the District can provide sanitary sewer service to the proposed subdivision within the rules and regulation of the District. Drainage report and plan are not required- since two of the three lots have been developed as single family and the third lot. is anticipated to be similar. 2. Sidewalk will be required for the undeveloped lot at the time of building permit request. 3. We have checked the legal._description and closure of the plat and have conveyed our comments to the PLS who prepared it. 4. We are interested_in vacating the unused right-of-way por- tion and are currently preparing the necessary documents. Please advise us of the time frames involved or any other required document(s) needed for this process. REQUEST The applicant requests approval of a two-lot minor subdivision for property zoned Residential-Two and located at 3490 Jay Street. In addition, a vacation for an unused portion of Jay Street is also being requested. II. SUBDIVISION DESIGN The applicant proposes a two-lot minor subdivision. Lot 1 will be approximately 14,394 square feet in area and will contain the two existing residences. Lot 2 will be approximately 7,262 square feet in area and will provide an additional building site. Under current zoning regulations a Residential-Two zoned lot must have a minimum width of 75 feet and a total area of 9,000 square feet to allow a single-family residence. Because of the two detached dwellings located on Lot 1 and the substandard area on Lot 2 neither lot meets the current zoning standards. Since the Lot 2 is substandard, a variance is required to allow the subdivision. Though this requirement has not been completed prior to the Planning Commission meeting, Commission can approve the proposed plat with the condition that a variance be applied for and prior to the public hearing before City Council. Additionally, vacation of an unused portion of Jay Street right- of-way is being requested (see exhibit "C"). This request is being initiated by the City of Wheat Ridge. III. ALTERNATE SUBDIVISION DESIGNS The applicant originally submitted a request for a three-lot minor subdivision (see Exhibit "A"). Staff reviewed this plat and indicated to the applicant that a recommendation of approval was highly unlikely due to each lot being substandard to the current zoning, and the fact that no lots of the proposed size are in existence within the immediate area. The applicant then submitted another plat (see Exhibit "B"). This plat was more in line with what staff had indicated would be recommended for approval. Now the applicant has submitted another version of a two-lot subdivision (see 24" by 36" blueline copy). This is the version that he would like to have approved. IV. VACATION REQUEST- __ _ This is a City-initiated request for approval of a right-of- way vacation for an unused portion of Jay Street between Kendall Street and West 35th Avenue. This street vacation would apply with any of the three subdivision iterations. Exhibit 'C' locates current improvements related to the existing right-of-way. As indicated, the existing right-of-way Planning Commission Staff .Report Case No. MS-93-1/WV-93-5/Littlejohn Page 3 does not line up with Jay Street north of West 35th Avenue, however, current improvements do. Approval of the vacation in conjunction with the requested subdivision would rectify the situation where road improvements are not located on the City- owned right-of-way. V. AGENCY REFERRALS The request for subdivision and right-of-way vacation was reviewed by all outside agencies. All responding agencies either have no problem with the request or their concerns have been addressed by the applicant. Wheat Ridge Sanitation District had a concern as to the location of their existing sanitary sewer line, however the applicant has addressed this concern. by locating the line on the plat. Public Works has reviewed the request and has asked for an agreement to construct sidewalk when/if the additional lot is developed. VI. CONCLUSIONS AND RECOMMENDATIONS _ REQUESTED TWO-LOT SUBDIVISION Staff concludes that all agencies can serve the property and that -- all requirements of the Subdivision Regulations have been met. However, Staff believes the developer has not submitted the best design as far as the zoning of the property is concerned. Lot 2 is substandard in lot size area and two main structures are located on Lot 1. Residential-Two .zoning requires 9,000 square feet per lot for a single-family structure and does not allow more than one main structure per lot. In addition, there are no other lots of this. size or type in the immediate neighborhood. Therefore., Staff would recommend that the applicant's proposed subdivision submittal (24" by.36" blueline) be_DENIED and that the design based on "Exhibit "B" be APPROVED, as this design meets all zoning requirements. REQUESTED RIGHT-OF-WAY VACATION Staff concludes that_the unused portion of Jay Street will never be used. In addition, the current location of the Jay Street improvements is more desirable, since the intersection of Jay Street-and West 35th Avenue would be offset should the existing right-of-way were improved. For these reasons, a recommendation of APPROVAL is given to vacate the unused portion of Jay Street to the adjacent property owners. WV-93-5 DATE: October 19, 1993 Attached please find a staff report and supporting materials for-a two-lot minor subdivision being request by Mr. Roy T. Littlejohn of 3490 Jay Street. Also attached please find a copy of Council Bill No. 29 vacating a portion of Jay Street in the immediate vicinity of Mr. Littlejohn's subdivision request. The subdivision and right of way vacation are directly related and as such, are described in a common memorandum even though they require separate City Council actions. At the present time, Mr. Littlejohn owns a parcel. of property in the vicinity of 35th and Jay Street that contains multiple dwellings. Mr. Littlejohn approached the City of Wheat Ridge to subdivide the property so as to allow each of his homes to have a separate identifiable parcel of property. At the time of Mr. Littlejohn's request, it was recognized that there was also an opportunity for the City to correct a right of way problem that exists with Jay Street in the immediate vicinity. The subdivision request has been reviewed and recommended for approval by both the Planning Commission and the City staff. As part of the subdivision, Mr. Littlejohn is dedicating right of way for the current alignment of Jay Street south of its intersection with 35th Avenue. The right of way vacation has been initiated by the City to recognize that it is not possible to build Jay Street on right of way as currently dedicated. The right of way for Jay Street is currently utilized by Rocky Mountain Ditch. In addition, if the City were to attempt to place Jay Street on the existing right of way, it would result in a situation in which Jay intersected 35th Avenue with an offset from the northern leg of Jay Street at its intersection with 35th Avenue. It is suggested~~hat the current right of way be vacated and that Jay Street be recognized in its current location via the subdivision previously described. Motions to approve the subdivision request and the right of way vacation request are found in the attached staff report. A copy of Council Bill 29 is also included for City Council reference. REQUEST The applicant requests approval of a two-lot minor subdivision for property zoned Residential-Two and located at 3490 Jay Street. In addition, a vacation for an unused portion of Jay Street is also being requested. II. SUBDIVISION DESIGN The applicant proposes a two-lot minor subdivision. Lot 1 will be approximately 9,026 square-feet in area and will contain one of the existing residences (the northern most residence). Lot 2 will be approximately 12,629 square feet in area and will contain the southerly most residence. Under current zoning regulations a Residential-Two zoned lot must have a minimum width of 75 feet and a total area of 9,000 square feet to allow a single-family residence and a width of 100 feet and a total area of -12,500 square feet to allow a two-family residential dwelling. Therefore lot 2 could support the addition of an attached dwelling to the existing. Additionally, the existing alignment of Jay Street is being dedicated and vacation of an unused portion of Jay Street right- of-way is being requested (see exhibit 'A'). The request for street vacation is being initiated by the City of Wheat Ridge. III. VACATION REpUEST This is a City-initiated request for approval of a right-of- way vacation for an unused portion of Jay Street between Kendall Street and West 35th Avenue. Exhibit 'A' locates current improvements related to the existing right-of-way. As indicated, the existing right-of-way does not line up with Jay Street north of West 35th Avenue, however, current improvements do. Approval of the vacation in conjunction with the requested subdivision would rectify the situation where road .improvements are not located on the City-owned right-of-way. IV. AGENCY REFERRALS The request for subdivision and right-of-way vacation was reviewed by all outside agencies. All responding agencies either have no problem with the request or their concerns have been addressed by the applicant. Wheat Ridge Sanitation District had a concern as to the location of their-existing sanitary sewer line, however the applicant has addressed this concern by locating the line on the plat. Public Works has reviewed the request and has asked for an agreement to construct sidewalk when/if the additional lot is developed. City Council Staff Report Case No. MS-93-1/WV-93-5/Littlejohn V. PLANNING ACTION Page 3 Planning Commission reviewed these cases at a public hearing held on August 12, 1993. A recommendation of Approval was made for Case No. MS-93-1, a Two-Lot Minor Subdivision, for the following reasons: 1. All agencies can serve the property; and 2. All requirements of the Subdivision Regulations have been met. With the Following condition: 1. The property be developed in accordance with Exhibit 'A'. A recommendation of Approval was made for Case No. WV-93-5, vacation of an unused portion of Jay Street between Kendall Street and West 35th Avenue, for the following reasons: 1. No utilities in the right-of-way; 2. No improvements exist in the right-of-way; 3. The approval of Littlejohn Subdivision dedicates right-of-way that will eliminate the need for the existing right-of-way; and 4. Staff recommends approval. VI. CONCLUSIONS AND RECOMMENDATIONS REQUESTED TWO-LOT SUBDIVISION Staf-f concludes that all agencies can serve the property and that all requirements of the Subdivision Regulations and Zoning Ordinance have been met. Therefore, Staff would recommend that Case No. MS-93-1 be APPROVED. REQUESTED RIGHT-OF-WAY VACATION Staff concludes that the unused portion of Jay Street will never be used. In addition, the current location of the Jay Street improvements is more desirable, since the intersection of Jay Street and West 35th Avenue would be offset should the existing right-of-way were improved. For -- these reasons, a recommendation of APPROVAL is given to vacate the unused portion of Jay Street to the adjacent property owners. The City Council hereby finds, determines, and declares that this ordinance is promulgated under the general police power of the City of Wheat Ridge, that it is promulgated for the health, safety, and welfare of the public, and that this Ordinance is necessary for the preservation of health and safety and for the protection of public convenience and welfare. The ,City Council further determines that the ordinance bears a rational relation to the proper legislative object sought to be attained. Section 4. Severability. if_any clause, sentence, paragraph, or part of this Ordinance or the application thereof to any person or circumstances shall for any reason be adjudged by a court of competent jurisdiction invalid, such judgment shall not affect, impair or invalidate the remainder of this ordinance or its application to other persons or-circumstances. Section 5. This Ordinance shall take effect one day after final publication.
