UFC 88 32.107 3. No Smoking signs shall be posted at each tent area and shall not be permitted inside the tents. UFC 88 32.108(a) 4. No open flame or devices capable of creating a glow that is capable of igniting combustibles will be permitted in the tents. UFC 88 32.108(b). 5. Fire extinguishers having a 4-A rating or 10-1b unit shall be placed each 2,000 lineal feet. UFC 88 32.109 6. At least one 40-BC rated extinguisher shall be provided for each kitchen, generator or transformer or where flammable liquids are stored. UFC 88 32.109. 7. A minimum of 4 exits will need to be provided for each tent. UFC 88 Table 32.11. 8. Exits will need to be provided with lighted exit signs. UFC 88 32.113. 9. Cooking equipment if provided at the site will need to be a minimum of 30 feet from any structure. UFC 88 32.117 10. Adequate sanitary facilities. must be provided. It is proposed that chemical toilets be used on site. The numbers proposed appear to be adequate, however a more detailed review will be conducted when final plans are submitted. 2. An adequate supply of potable water, meeting State requirements, must be provided. If water is transported to the site it shall be from an approved source and shall be stored and dispensed in an approved manner. 3. Sink and shower facilities are being proposed for this site. The type and use of these facilities will require review by this agency. 4. Adequate refuse disposal containers must be provided on site. These shall be designed to prevent odors, insects, rodents or other nuisance conditions from occurring. 5. Noise levels at the perimeter of the site must be kept 55 dB(A) between 7:00 A.M. and 7:00 P.M. and 50 db(A) at all other times. 6. At night, light level intensities on site should be at least five foot candles for safety purposes. ;~~ Recycled Paper 7. An approved kitchen facility must be used for the preparation of meals. This kitchen must be sized adequately to handle the number of meals being prepared The proper equipment such as handsinks, three (3) compartment sink or disinfecting dishwasher, a mopsink, a prep sink and adequate refrigeration must be provided. All foods must be held at the proper temperatures and must be properly protected. Any mobile coolersand/or warmers used must be approved. Food preparers must use -thermometers (with alcohol swabs) to monitor food temperatures. This department will require review of the type of menu to be used for the week. Not only will the types of foods be reviewed but also whether foods are cooked to order, or are leftovers to be stored for future consumption. This is a brief overview of our concerns regarding this proposal. The property in question has Agricultural-One zoning and will require a Temporary Use approval by the Board of Adjustment. Although the application was submitted by Frank Morris, there is additional paperwork needed to meet our requirements. The Planning and Development Department will require the following items prior to any case processing: 1. $50 filing fee; 2. Evidence of ownership for the property; 3. A list of adjacent property owners which we require for notification purposes; and 4. Detailed site plan (see commentary below). In regard to the site plan submitted with your September 22 letter, it does .not have enough detail for us to adequately review it. Please find attached the requirements for a Type I site plan. At a minimum, your submittal for the site plan should meet these standards. I did refer your letter and initial site plan to outside agencies and have attached their responses. All concerns expressed need to be met. Once your plan is closer to fruition, I would recommend that we meet with the affected agencies to discuss their requirements. Keep in mind that I would like the public hearing in front of the Board of Adjustment to occur by May or June of 1993. All details must be resolved by the public hearing. I would appreciate advance notice prior to your next stop in Denver so I can organize a "round-table" discussion with the various agencies. Code Institute/ Western Fire Chiefs, regarding Article 32 of the 1988 Edition of the Uniform Fire Code, Tents-.and Air Supported Structures. I requested information on determination of capacity of tents in relationship as to the number of required exits. After researching the code. Mr. Biz al stated that_Article 32 is intended to be used for tents being used-.for assembly purposes, performances or displays. This article is not intended for use for tents for sleeping purposes. Mr. Bizal felt that if we used this article to base our comments on the proposed sleeping areas that in the event of an accident or fire that both .the City and the Fire District conid-have liability. Mr. Bizal-felt that-the following steps be followed. to limit liability. 1. A-Technical Assistance Report as specified in Section 2.302 of the 1988 Edition of the Uniform Fire Code be provided by a Fire Protection Engineer. This report would need to include the. maximum occupant load of the tent, required exits, and width, spacing between cots and aisle width to exits, spacing between tents and fire access aisles. We should also be able to obtain any additional information that we may need to address any concerns of -the Building Department. 2. The Special Use Permit state that the tents shall be put up on a specific date and must be removed by a specific date. 3. Information and training of the Security and Fire Watch personnel to be on site at all times and procedures to be followed. .. Page Two 4. Fire detection devices be placed within the individual tents and additional fire fighting appliances be placed within the tents and around the site. 5. A letter be provided by a Structural Engineer as to the structural stability of the tent including winds. 6. Is the City Council aware of the. possible liabilities and are they willing to except that liability as the Fire code is adopted by City Ordinance. I feel that in talking with Mr. Bizal that if we cannot- be provided with the information requested that we should not allow the proposed use at this site. .. The World Youth Day event. is advertised as an International Gathering of Youth and Young Adults. The age group of the participants will range from 13 to 39. In the past the average age of the participants has been 25 to 30. While we are in Denver/Wheatridge we will have constant on-site security. Youth will be chaperoned at a ratio of 5 youth (ages 13- 18) to 1 adult (minimum age 25). Our Archdiocesan guidelines mandate that the chaperons be in attendance at ALL times. In addition to the chaperons we will be providing 2 adult Event Moderators per every 42 participants. Part of the Event Moderator's job is to assist the chaperons, oversee the tent site, assist in the loading/unloading of the buses etc. And .finally, the school will be having people on ,site helping to coordinate distribution of meals. This brings the on site ratio of security personal to approximately 5 to 2. 2838 E. While at the tent site we will have full access to the office and the phones. We will be using the school for our office needs. There will be staff on site at all times. In addition to the phone access the school will be the base for the on-site first aid station. All of the Event Moderators will and chaperons will be trained in first aid and CPR. We currently have several Physicians registered as participants who have agreed to volunteer their services. We will be providing identifying apparel to make these people easily recognizable at all times. We will also be providing our foreign language translators with a identifying apparel. The parents and staff of the academy are donating their services for meal preparation. They will be providing both breakfast and lunch and both will be a brown bag or box lunch type of meal with no actual on-site food preparation taking place. The meals will then be brought to the tent site and distributed. Mr. Ed Mason of the Prop Shop is in charge of both the sanitation and water sources. There will be portable chemical toilets, water for drinking, and on-site showers. The showers are a completely self contained unit on a semi-truck. Both fresh and waste water are contained within the truck itself. A dumpster will be located at the end of the school adjacent to the lot where the buses will be parked. The schedule for site operation will be: Wednesday, August 11, approximate arrival at site, 11 am. Departure for downtown Denver approx 3 pm. Return to site approx li pm-12 am. For August 12- 13, departure, 7-8 am, return to site 11 pm-12 am. On Saturday, August 14, the participants would depart again at 7-8 am but would not be back on site until the following day, Sunday, August 15 at approximately 6-7 pm. The following morning the buses would load and leave by 9-10 am. Because of the amount of time the participants would be off site the hours of lighting would be minimal. We are anticipating needing lighting from 10 pm-2 am during the time participants are actually on-site. We have arranged with The Brannon Sand & Gravel Co. who own the vacant lot ,between the Colorado Catholic Academy and Prospect Park to use their lot for bus parking. This will allow participants to load and unload off the public street. This will minimize the impact of their presence on the normal traffic pattern. I hope I have addressed all your concerns. The City is requiring a Temporary Use Permit. Colorado Catholic Academy is requesting use of 43rd and' Pierson for an emergency vehicle entrance. The people using the "tent city" will only be on the site from 11 p.m. to 6 a.m., and will be traveling to and from the site by bus. After-discussion, it was determined this would create little impact on the park other. than some additional traffic. The following motion was made. Motion by Betty Day that the World Youth Day group be allowed to use 43rd and Pierson for emergency vehicle access only. Seconded by Edgar Johnson. Passed unanimously. SIGN VARIANCE AT 10010 W. 27TH AVENUE_The station on the corner of Kipling and 27th would like to put in a larger sign. Concerns were if the larger sign would block the view of the park sign from north bound traffic on Kipling or block site of entrance to park. Where are they planning on placing the sign? TUP-93-1 I.• REQUEST Page 2 The applicant request a one-week temporary use permit to allow a group tent lodging for up to 1200 occupants at 11180 West 44th Avenue. The tent lodging is being requested to accommodate participants in World Youth Day which is being held in Denver the week of August 11-15. World Youth Day is being held in conjunction with the Pope's visit on August 15 which culminates with a Papal mass held at Cherry Creek Reservoir. Up to one million people will be coming to the metropolitan area to attend the events with temporary housing set up in motels, tent cities, private homes and other facilities. According to one of the World Youth's Day organizers, all of the hotel rooms between Fort Collins and Colorado Springs have been reserved for the event. Aside from the mass at Cherry Creek Park, the majority of the events will be held within Denver proper at Mile High Stadium, Civic Center Park, the Coliseum and other large special events facilities. Nevertheless, the surrounding suburbs will be affected by the large scale of the event and most of them will have at least one "tent city", similar to what is being proposed with this request. II. SITE PLAN The applicant has proposed a site plan for the property located directly behind the Colorado Catholic Academy. The actual school building which is not shown on the site plan will be used as a "command post" for the temporary shelter with an office, telephones and emergency services. Two large tents (60' x 270') will provide sleeping quarters for 500+ people each along the east and west sides of the vacant property. Sleeping cots will be erected in the tents so participants are not sleeping directly on the ground. A smaller, central tent will be used for meals, special announcements, etc. Temporary showers and ports-potties will be located within the center of the site. The restrooms will be provided and pumped by a private contractor. The interior of the tent city will be lighted until approximately 2 a.m. every night. It is imperative that light poles be no more than 25' in height with standards of the down-cast variety. Although not shown on the site plan, electrical generators and dumpsters should be located at the extreme northwestern part of the property, away from the residences along Pierson Street. The breakfasts and lunches will be of the "box lunch" variety prepared in private homes, then brought to the tent city for distribution. Although the academy property has enough parking to accommodate roughly 30 cars, the 25 buses required for transportation for the participants will be parked on the vacant property to the west. Prospect Park will not be available for overflow parking. A secondary access from West 43rd Avenue will be for emergencies only. Please refer to the applicant's Exhibit "A" which is an explanation of the request. 222. ADJACENT ZONING AND LAND USE Zoning surrounding the property is Agricultural-One and Commercial-One to the north, Agricultural-One to the south, Residential-Two and Commercial-One on the east and Agricultural-One on the west. Corresponding land uses include a commercial contractor adjacent and east of the school building, and low density residential abutting the tent city site on the east along Pierson Street. There is vacant, City-owned property on the south side. On the west is a vacant privately-owned parcel and municipal parkland developed into baseball fields. Staff concludes that in light of the adjacent land-use, the temporary shelter will have minimal impact on adjacent property owners. In design of the site, consideration was given to the residential area along Pierson Street by orienting on-site activities toward the middle of the property. IV. AGENCY REFERRALS Staff has had several meetings with representatives from the Archdiocese and affected utility companies. Arvada Fire District will require certification of the sleeping tents in regard to fire rating. Smoke detectors, fire extinguishers and lighted exit signs will be required in the tent. Wheat Ridge Police are concerned with security on-site and traffic control when the buses depart from and return to the site. Parks and Recreation Commission will allow emergency access across the parkland to the south from West 43rd Avenue. SOARD OF ADJUSTMENT STAFF REPORT CASE NO. TUP-93-1 Page 4 V. CRITERIA Staff has the following comments regarding the criteria to evaluate an application for Temporary Use Permit: 1. Will this request have a detrimental effect upon the general health, welfare, safety and convenience of persons residing or working in the neighborhood of the proposed use. The proposed tent city, and the entire World Youth Day event will have a detrimental effect on the convenience of the population of the entire Denver metropolitan area. There will not be an affect on the general health, safety, and welfare if proper precautions are followed by the tent city facilitators. The City is working closely with the organizers to ensure as little detrimental impact as is possible.. 2. Will this request adversely affect the adequate light and air, or cause significant air, water or noise pollution, or cause drainage problems for the general area. The tent city will not adversely affect the adequate light and air, cause air or water pollution or cause drainage problems since there will be strict control by the City and other affected governing outside agencies. 3. Will this request result in undue traffic congestion or traffic hazards, or unsafe parking, loading, service or internal traffic conflicts to the detriment of persons whether on or off the site. There will be some traffic congestion when the buses are leaving to and returning from events. The applicant will be employing Wheat Ridge off-duty police-officers for traffic control at these times. Parking and loading will occur on-site and should not affect the public street system. 4. Will this request be appropriately designed, including setbacks, heights, parking bulk, buffering, screening and landscaping, so as to be in harmony and compatible with character of the surrounding areas and neighborhood, especially with adjacent properties. The use of the site has been designed as appropriately as possible considering the temporary situation. All activities on-site have been focused towards the center of the tent city. The tents themselves provide buffers from activities on-site, as well as lighting. BOARD OF ADJUSTMENT STAFF REPORT CASE NO. TUP-93-1 Page 5 5. Will this request overburden the capacities of the existing streets, utilities., parks, schools, and other pubiic facilities and services.. Since this is a temporary situation, there should be no affect on schools in the area. The applicant is working closely with the appropriate utility companies regarding services and surcharges for those services. A fence will be built around the temporary shelter to separate it from the adjacent parkland. The capacities of the streets should be affected only before and after each day's events. VI. CONCLUSION AND Staff concludes that the entire World Youth Day event will be on such a scale that all of the metropolitan area will be affected. Recognizing that, it is the City's responsibility to participate by accommodating housing for the event. Staff concludes that the proposal at this location will have minimal impact on surrounding property owners and that the design is such that buffering, as much as possible, occurs for the residential area to the east. For the reasons stated above, Staff gives a recommendation of APPROVAL with the following conditions: 1. All on-site activities be oriented toward the middle of the property. 2. There be no lighting on the eastern perimeter and that what lighting there is be oriented toward the central activity area (i.e., poles no higher than 25' with down-cast fixtures). 3. Electrical generators and dumpsters be located at the northwestern corner of the property. 4. The applicant continue working with utility companies and City departments to ensure minimal negative impacts from the temporary shelter. They will be providing both breakfast and lunch and both will be a brawn bag or box lunch type of meal with no actual on-site food preparation taking place. Board Member BERNHART wanted to know if that would meet the requirements of the letter from the code enforcement officer, and Mr. Moberg answered it probably does not meet the 55', but that it would certainly take care of the sight triangle. Discussion followed. Mr. Moberg asked Board Member ABBOTT if the motion allows the existing height to remain the same and any additional fence being build outside of the sight triangle could remain at 6'6" and 7'2", and Board Member ABBOTT answered that is correct; the only constructed section affected by this would be the western most section. Board Member BERNHART felt they need to deal with the nine criteria for granting a variance, and his concern is that -- one of the criteria used was actually a reason to deny a variance and asked if in this instance is that appropriate, and Board Member ABBOTT stated what was said was "it would be injurious to allow the applicant to build it at his requested variance", and they are going under his requested variance by asking him to remove two sections of block. Mr. Moberg added it should be specified in the resolution that this is dealing only with the section of fence that is existing, whereas the rest of the fence at 6'6" and 7'2" will not be a problem with the neighborhood. Motion carried 8-O. Resolution attached. Chairman HOWARD called for a five minute recess. C. Case No. TUP-93-1: ...An application by Colorado Catholic Academy for approval of a one week temporary shelter for up to 1200 persons on property located at 11180 W. 44th Avenue. Meredith Reckert presented the-staff report. All pertinent documents were entered into record, which Chairman HOWARD accepted. Board Member ABBOTT said it was mentioned that the Arvada Fire District will be handling this and wanted to know if they will coordinate with the City, and Ms. Reckert answered the jurisdiction is Arvada Fire ,District, however. they will coordinate with Wheat Ridge because their duties will overlap. Board Member HOWARD noted when this was presented to the Parks & Recreation commission their concern was parking, and Ms. Reckert'said yes, at one point the applicant had CITY OF WHEAT RIDGE BOARD OF ADJUSTMENT MINUTES OF MEETING: January 28, 1993 Page 11 discussed possible overflow into Prospect Park. However, that is not really an option now considering the amount of outdoor activities that occur in that park during the summer. There is adequate room on the property to the west (vacant land) for their bus parking. Another issue was using West 43rd Avenue as an emergency access which would mean they would have to cross a little bit into the Lovejoy property which is City owned, however the commission did give their approval for that. Board Member HOWARD questioned the commission having no problem with up to 1,000 people using the park facilities, and Ms.'Reckert replied she does not think the people will have a lot of opportunity to do that because their days are very tightly planned with not a lot of excess time. No further questions were asked of staff. The applicant, Tom Stein, 1319 SW Chastain Place, Brett, OR, was sworn in. Mr. Stein stated this request is part of World Youth Day and the group that will be coming here is from the Archdiocese of Portland which will be about 1,000 people. They are looking at about 25 buses and they do have permission to use the land to the west for parking, also we are using a local tent company to construct the tents, local water and sewer and utility companies.. The shower trucks are coming from Washington because that is the only place they could be found. Mr. Stein said the buses will leave the park between 7-8 a.m. and will not return till between 10 p.m. and midnight. There will be a 5-1 ratio to anyone under the age of 18, and added the group will average between 20-30 years of age city wide. Board Member ABBOTT said he calculated the occupant load at 650 per tent and wanted to know if they would be using any ' other part of this facility for sleeping, and Mr. Stein replied part of the group is looking'at using some of the classrooms in the school building. One of the classrooms will be a first aid station, and the present office will be used as a 24-hour office. The Colorado Air Guard has donated 1500 cots for the event. Chairman HOWARD asked the applicant if the diesel generators are necessary, and Mr. Stein said they will be used for lights because there are no outlets on the outside of the building. There will only be 1 or 2 generators and they will be placed by the school building. Chairman HOWARD asked if there was any way to get a temporary power hook-up from Public Service, and Mr. Stein replied they will look. into that. CITY OF WHEAT RIDGE BOARD OF ADJUSTMENT MINUTES OF MEETING: January 28, 1993 Page 12 Chairman HOWARD asked what day of the week will this start, and Mr. Stein answered Wednesday, August 11th. They will arrive ,about mid-morning and will register, pick up packets, bunk assignment, and so on. The events will begin each morning at 9:00 downtown area. The English speaking people will be going to Mile Hi Stadium, the Spanish speaking will be going to McNichols Arena, and-other languages will go to different places in the city. The people will stay downtown all day basically, with no shuttles back until the evening events are over which will be around 10:00 p.m. Chairman HOWARD commented basically the only time the teenagers will be in the area is between 10:00 p.m. and 6:00 a.m., and Mr. Stein answered yes, and added they will not be here at all Saturday night because that is the night before the event at Cherry Creek Park. The youths will be walking to the park and camping out overnight. The whole ideal of this event is pilgrimage and they will be walking about eight miles each day. Board Member ABBOTT asked if there would be cooking on the site, and Mr. Stein .answered no, the school, faculty and parents have volunteered to put together bag lunches that will be pre-assembled and will be picked up in the morning along with fruit and perhaps muffins for breakfast. Mr. Stein noted all of the people at this site will be from Oregon, and the other sites will have people from all over the world. Board Member JUNKER asked where will these people eat their dinners, and Mr. Stein answered downtown. There will be around 400 to 500 food vendors in the Civic Center park area; nothing will be sold for more than one dollar and a food bank will be established for people that do not have money to buy food. No further questions were asked of staff or the applicant. Although this approval granted use of the land, it does not mean everything has been finalized.
