WHEREAS, the applicant was denied permission by an Administrative Officer; and WHEREAS, Board of Adjustment Application, Case No. TUP-93-2 _ is an appeal to this Board from the decision of an Administrative -- Officer; and WHEREAS; the property has been posted the required 15 days by law and there WERE protests registered against it; and WHEREAS; the relief applied for MAY be granted without detriment to the public welfare and without substantially impairing the intent and purpose of the regulations governing the City,of Wheat Ridge. NOW, THEREFORE, BE IT RESOLVED that Board of Adjustment Application Case No. TUP-93-2 be and hereby is APPROVED. REQUEST: Temporary Use Permit PURPOSE: To allow a commercial venture that would charge a fee to allow fishing on a private lake. FOR THE FOLLOWING REASONS: 1. Because the property is zoned commercial and surrounded on three sides with commercial-industrial property and is a large vacant site, this request will not result in undue traffic congestion or hazards, unsafe parking, or loading. 2. It provides a necessary family recreation facility. 3. The site is currently and totally unsupervised. CASE NO. TUP-93-2/Resolution Page 2 WITH THE FOLLOWING CONDITIONS: 1. The parking area of no less than 30 spaces shall be located on the west half of the site and shall be surfaced with road base or other all-weather material that must be approved by the Public Works Department. 2. No fish shall be cleaned on site. 3. The hours of operation shall be from 7:00 a.m. to 8:00 p.m. There shall be no radios or other loud activities allowed on this site. 4. The applicant shall furnish a liability insurance policy that will cover any accidents that would occur on the site which is satisfactory to the City. 5. If it is found that the number of parking spaces provided is inadequate, additional spaces shall be provided. 6. Portable toilet facilities and dumpsters shall be adequate and maintained in a clean condition, with the toilets being cleaned weekly or more often as necessary. 7. The general layout of improvements to the property will not vary substantially from the drawing submitted by the applicant. No fishing shall be allowed on the south or east bank, or facilities on the south and east bank. No fishing on the west bank until June lst. 8. No alcoholic beverages will be allowed on the property. 9. Handicap access shall be provided. 10. Trash and construction debris currently dumped on the site shall be buried or otherwise satisfactorily removed from the site. 11. The fence on the east side shall be repaired. 12. This use shall be for six months. 13. The owner's boat shall be the only boat allowed on the lake. VOTE: YES: Abbott, Albertsen, Bernhart, Dooley, Howard, Junker and Rossillon. TUP-93-6 Page 2 REQUEST On April 22, 1993 the applicant was approved a Temporary Use permit to allow a commercial fishing lake wherein people will pay to fish. Approval was based on the Following conditions: 1. The parking area of no less than 30 spaces shall be located on the west half of the site and shall be surfaced with road base or other all-weather material that must be approved by the Public Works Department. 2. No fish shall be cleaned on site. 3. The hours of operation shall be from 7:00 a.m. to 8:00 p.m. There shall be no radios or other-loud activities allowed on this site. 4. The applicant shall furnish a liability insurance policy that-will cover any accidents that would occur on the site which is satisfactory to the City. 5. If it is found that .the number of parking spaces provided is inadequate, additional spaces shall be provided. 6. Portable toilet facilities and dumpsters shall. be adequate-and maintained in a clean condition, with the toilets being cleaned weekly or more often as necessary. 7. The general layout of improvements to the property will not vary substantially from the drawing submitted by the applicant. No fishing shall be allowed on the south or east bank, or facilities on the south and east bank. No fishing on the west bank until June lst. 8. No alcoholic beverages will be allowed on the property. 9. Handicap access shall be provided. 10. Trash and construction debris currently dumped on the site shall be buried or otherwise satisfactorily removed from the site. 11. The fence on the east ,side shall be repaired. 12. This use shall be for six months. 13. The owner's boat shall be the only boat allowed on the lake. BOARD OF ADJUSTMENT STAFF REPORT CASE NO. TUP-93-6 Page 3 The applicant would like Conditions #3 and #7 to be altered. The applicant would like Condition #3 to be changed to allow fishing from 6:00 a.m. to 9:00 p.m. and Condition #7 would be altered to allow fishing along the south bank. The reason for the increase in operation hours is that catfish tend to bite more at sundown and sunup and restricting the hours of operation from 7:00 a.m. to 8:00 p.m. restricts when the fishing is best. As far as the condition that no fishing be allowed on-the south bank, during the public hearing no one spoke against the proposed use nor did anyone contact staff that lived to the south of the lake. The applicant recently approached the residences along the south bank and has reported that they did not care if people fished along the south bank. CONCLUSION AND RECOMMENDATION As Staff recommended "approval" on the original request and the recommendation had no conditions, Staff feels that the change in conditions requested by the applicant are justified and should be approved. This case was withdrawn by applicant. D. Case No TUP- -h: An application by Floyd Gibson for approval of a change of conditions for a previously approved Temporary Use Permit to allow a commercial venture that would charge a fee to allow citizens to fish on a private lake located at approximately 4950 Independence Street. Board Member ABBOTT said the 'rubble' is still there even though it was of the conditions was it would be buried or flattened, and is the City finding this condition unworkable, Mr. Moberg answered that condition does not really lend itself to forcing the applicant to do that. The situation we are dealing with is an applicant who is not paying the owner any kind of fee to use the property. If we tell the owner that if the rubble is not removed we will have the applicant stop doing what he is doing would not do anything. When staff found out there was some illegal dumping, Code Enforcement took action. That process takes a fairly long time but if the rubble is still there the Code Officer .needs to go out and take a look and decide if Tom Yang has done what he was supposed to do. Staff allowed the applicant to occupy the property and start his business because of this long process. Chairman HOWARD asked staff why did they feel there was enough changes to warrant hearing this case, and Mr. Moberg replied because the conditions were numerous and at the end of the meeting things were a little disoriented, staff feels that is reason enough to have the Hoard re-look at the conditions and either approve them or not. The Board has jurisdiction to re-look at the conditions (not re-hearing the case) that were placed and decide if they are still applicable or should they be altered. Mr. Moberg said if the Board feels they should not hear this case, then they could entertain a motion. Chairman HOWARD called for a motion and hearing none, informed the Board to proceed. No further questions were asked of staff. The applicant, Floyd Gibson, 44 Garrison Street, Lakewood, CO, was sworn in. Mr. Gibson said he hasn't too much to add but 'did want to inform the Board that the rubble on the north side has been removed and/or flattened. All other conditions placed on the previous case have been met except for the changes in conditions requested tonight. Board Member ABBOTT quoted £rom the minutes saying one of the reasons for not fishing on the south bank was due to the wildlife, and asked the applicant if that was not an issue anymore. Mr. Gibson said the wildlife is still there on all sides but have not been bothered or disturbed at all by the fishing and people. Board Member ABBOTT wanted to know if he is requesting for people to fish on that south bank now, and Mr. Gibson replied yes. Mr. Moberg said the state department representative went out to the lake and reported no wildlife would be bothered by the fishing, and felt the geese could take care of themselves just fine. Marilyn Rogers, 4400 So. Independence Trail, Evergreen, CO, was sworn in. Mrs. Rogers owns the property at 9545 W. 49th Avenue, which is property located on the south side. She could not be present at the previous meeting, however she believes fishing would be hazardous on a portion on the south side because the trail has a 12 foot drop-off. Mrs. Rogers also feels letting people fish back there will reduce her property value. Board Member ABBOTT stated this is a safety issue and a property value issue both. He asked Mrs. Rogers if she feels it would be unsafe to fish on any portion of the south bank or just a portion, and Mr. Rogers answered just from the corner up four lots. Board Member ABBOTT asked if she has any problem with the current hours of operation and Mrs. Rogers said she has been out of town and does not know but she will ask her tenants. ,_ CITY OF WHEAT RIDGE BOARD OF ADJUSTMENT MINUTES OF MEETING: June 25, 1993 Page 9 Chairman HOWARD asked if she was living on the property at the present time, and Mr. Rogers answered no, the property is leased. Chairman HOWARD asked the Rogers if they were aware this is only a temporary use that has been allowed. Mrs. Rogers asked for how long was the use, and Chairman HOWARD answered six months. William L. Rogers, 4400 So. Independence Trail, Evergreen, CO, was sworn in. Mr. Rogers said they have owned the property for 14 years but might possibly want to sell the property and anything that interferes with the value is of particular interest to them. The most concern is the hazard with the 12' sheer drop off, and Mr. Rogers feels it is not a safe place for the public to be fishing. They are not concerned with the present hours of operation and their tenants said there were no problems. No questions were asked of Mr. Rogers. Mr. Moberg said he felt it should be pointed out that the Rogers' property is zoned Restricted-Commercial and could be converted to commercial property without any requirements. Board Member ABBOTT asked if the City has received any complaints and Mr. Moberg answered the only complaint was in the first week which had to do with the location of the toilet (San-O-Let) and the piles of dirt and rubble not being removed. No further questions were asked. Motion was made by Board Member ABBOTT, that Case No. TUP- 93-6, an application by Floyd Gibson, be APPROVED for the following reasons: 1. A Division of Wildlife officer reported fishing from the south bank will not impact wildlife. 2. No complaints related specifically to the conditions have been received by staff. A City official will visit the south bank and determine if a potential life/safety hazard exists, and if so such areas will not be allowed to be used by the applicant.
