WA-93-20 Page 2 REQUEST The applicant is requesting approval of a 2.89 percent variance to the 30 percent maximum allowed building coverage for property zoned Residential-Two. The purpose of this request is to allow the continued existence of a shed. SITE The subject site has an approximate area of 14,000 square feet with an existing 3,669 square foot single-family residence. On November 11, 1993 a building permit was issued for a 660 square foot detached garage that was to be located on the southwest corner of the property. At the time of approval it was ascertained that the proposed building coverage exceeded the maximum allowed percentage by approximately 3.3 percent. The permit was issued with the understanding that a 276 square foot shed would have to be removed. Upon further examination it has been found that the total building coverage, with the shed remaining, is only 32.89 percent. Therefore, the applicant is requesting a 2.89 percent variance not a 3.3 percent. FINDINGS OF FACT No variance shall be granted unless the Board of Adjustment finds, based on evidence that: 1. Can the property in question yield a reasonable return in use, service or income if permitted to be used only under the conditions allowed by the regulations for the district in which it is located. Because the property has an existing residential use and denial of this request will not obstruct the continuation of the use, the property can yield a reasonable return, and will continue to if permitted to be used under the conditions allowed by the Residential-Two regulations; and 2. Is the plight of the owner due to unique circumstances. The plight of the owner is not due to unique circumstances, as the existing size of the parcel is average for the --- neighborhood; and 3. If the variation were granted, would it alter the essential character of the locality. It is difficult to ascertain if any other properties within the immediate area exceed the maximum building coverage. However, it is felt that a 2.8 percent increase would be difficult if not impossible to visually perceive and therefore, should not alter the essential character of the local neighborhood; and BOARD OF ADJUSTMENT STAFF REPORT page 3 CASE NO. Would the particular physical surroundings, shape or topographical condition of the specific property involved result in a particular hardship upon the owner as distinguished from a mere inconvenience, if the strict letter of the regulations were carried out. There are no particular physical surrounding, shape or topographical conditions of the property involved that would result in a particular hardship, therefore this request is for the convenience of the owner; and 5. Would the conditions upon which the petition for a variation is based be applicable, generally, to the other property within the same zoning classification. Is the purpose of the variation based exclusively upon a desire to make more money out of the property. The purpose of this variance is not based exclusively upon the desire to make money; and 7. Would the granting of the variation be detrimental to the public welfare or injurious to other property or .improvements in the neighborhood in which the property is located. The granting of this variance would not be detrimental or injurious to property or improvements within the neighborhood; and 9. Would the proposed variation not impair the adequate supply o£ light and air to adjacent property or substantially increase the congestion in the public streets or increase the danger of fire or endanger the public safety and substantially diminish or impair property values within the neighborhood. The granting of this variance would not impair the adequate supply of light or air to adjacent properties nor increase traffic congestion or endanger public safety. It is felt that a 2.89 percent increase would be difficult if not impossible to visually perceive and therefore, should not alter the essential character of the local neighborhood; and 2. The purpose of this variance is not based exclusively upon the desire to make money; and 3. The applicant has not created any hardship; and 4. The granting of this variance would not be detrimental or injurious to property or improvements within the neighborhood; and 5. The granting of this variance would not impair the adequate supply of light or air to adjacent properties nor increase traffic congestion or endanger public safety. Based on the conclusions derived from the preceding, staff would recommend that Case No. WA-93-20 be APPROVED. WHEAT RIDGE BOARD OF ADJUSTMENT MINUTES OF MEETING: January 27, 1994 Page 9 ~ C. Case No. WA-93-20: An application by Thomas R, and Bonnie Jean Paul for approval of a 3.3$ variance to the maximum allowed building coverage to allow the construction of a detached garage. Said property is located at 3375 Flower Street. Greg Moberg presented the staff report. All pertinent documents were entered into record, which Chairman HOWARD accepted. Chairman HOWARD asked what is the size 'of the shed, and Mr. Moberg replied it is 276 square feet; or 12,' x 23'. No further questions were asked of staff. The applicant, Tom Paul, 3375 Flower Street, was sworn in. Mr. Paul told the Board when he moved into'the property last year he had the garage built, however the shed was already on the property. The house has no basement or no attic and with two households (Mr. Paul's mother lives with them) there is very little storage. The shed is very important to them to have a place to store their belongings. Mr. Paul entered into record photos of the shed, labeled Exhibit 'A'. Mr. Paul continued saying the shed is not really visible from the front or the north side. He also talked with neighbors and they had no objections. Board Member ABBOTT apologized saying he did not hear the first answer and asked again who built the shed, and Mr. Paul replied he built the garage but the shed was already in place when he bought the house. Mr. Paul said he also plans on doing more landscaping this year and the shed will even be more concealed and pleasing to the eye. Chairman HOWARD asked when the building permit was issued there was a notation on it saying the shed must be removed, and Mr. Paul said at the time he contracted the garage to be built he was not aware the shed had to be removed. The contractor came back saying it had to be removed but understood he could apply for a variance so decided to proceed that way. No further questions were asked of the applicant. Don Donner, 3385 Flower Street, was sworn in. Mr. Donner is the neighbor directly north of the applicant and said Mr. Paul is a blessing to the neighborhood. Mr. Donner said the shed is more like a very nice outbuilding on a slab that is dry-walled and has electricity WHEAT RIDGE BOARD OF ADJUSTMENT MINUTES OF MEETING: January 27, 1994 Page 10 Mr. Donner said he can't see the shed and it is right next to his fence line. No questions were asked of Mr. Donner. Chairman HOWARD noted a letter was received from a resident on Flower Street stating no objection, and asked to have it entered into record. Motion was made .by Board Member ABBOTT, that Case No. WA-93- 20, an application by Thomas R. and Bonnie Jean Paul, be APPROVED for the following reasons: 1. A 2.89 increase would be impossible to visually perceive and therefore shall not alter the essential character of the neighborhood. 2. The granting of this variance would not be detrimental or injurious to property or improvements in the neighborhood as the shed is essentially invisible to the neighbors. Two immediate neighbors reacted positively for the variance. 3. Granting of this variance will not impair the adequately supply of light or air to adjacent properties nor increase traffic congestion or endanger the public safety. D, Casa No. WA-93-21: An application by Ernest Rodenberg for approval of a 5 foot variance to the required 5 foot side yard setback to allow an existing detached shed to remain. Said property is located at 4520 Reed Street. Greg Moberg presented the staff report. All pertinent documents were entered into record, which Chairman HOWARD accepted. Board Member ROSSILLON said he understood the applicant tore down the existing shed, and Mr. Moberg said 2-3 years ago permits were not required for anything under 120 square feet. Setbacks were still required however, and we started realizing by not requiring permits there were a lot of sheds being built without proper setbacks. No permit has been granted for this shed, since the applicant did not know he needed one. Board Member ROSSILLON asked if the applicant could have just upgraded the shed without a permit, and Mr. Moberg answered i~ the remodeling is more than 50%, it is a new building as far as the City is concerned.
