'rlheat Aid Re, Colorado 80033 423-703 Po Whom It May Concern: I am writing this letter in response and protest to the decision to have the shed located at 4520 Reed St. removed and the work stopped, After the devastating hail. storm of 1990 -this shed was completely destroyed. Las t,~.the owner decided to rebuild the shed on the same site it had been oriR~na~`~y. Phe owner asked me.his next door neighbor, if there would be a problem. We both agreed that there would be none. Phe shed was almost completed when the inspectors had the work~.• stopped. Phe owner was also told that the shed would have to be removed from its original site. It seems to me a grave in,~ustice since the shed w: rebuilt on the same site as before the storm. I sincerely hope that the commission *aould reconsider and allow the shed to be completed and remain on the same site. BOARD OF ADJUSTMENT STAFF REPORT CASE NO. WA-93-21 Page 2 I. REQUEST The applicant is requesting a 5 foot variance to the 5 foot side yard setback required for a shed on property zoned Residential- Two. II. SITE The property is approximately 10,470 square feet in area has a 1,929 square foot residence and has a half built shed located on the south side of the property. it is this shed that requires approval of the requested variance. The applicant began construction of the shed without a permit and was issued a Stop Work Order. When the applicant applied for a permit it was found that the shed encroached into the required side yard setback. The applicant is now asking to be allowed to complete the shed in the current location. III. FINDINGS OF FACT No variance shall be granted unless the Board of Adjustment finds, based on evidence that: 1. Can the property in question yield a reasonable return in use, service or income if permitted to be used .only under the conditions allowed by the regulations for the district in which it is located. Because the property has an existing residential use and denial of this request will not obstruct the continuation of the use, the property can yield a reasonable return, and will continue to if permitted to be used under the conditions allowed by the Residential-Two regulations; and 2. Is the plight of the owner due to unique circumstances. A unique circumstance could be considered as the applicant tore down an old shed and was rebuilding a new shed in the same location; and 3. If the variation were granted, would it alter the essential character of the locality. The granting of this variance would not alter the essential... character of the local neighborhood as there are other setback encroachments, by sheds, within the required 5 foot side yard setback; and 4. A unique circumstance could be considered as the applicant tore down an old shed and was rebuilding a new shed in the same location; and 2. The granting of this variance would not alter the essential character of the local neighborhood as there are other setback encroachments, by sheds, within the required 5 foot side yard setback; and 3. The purpose of this variance is not based exclusively upon the desire to make money; and 4. The difficulty or hardship has not been created by the applicant as a shed in the same location existed prior to the shed currently under construction; and 5. The granting of this variance would not be detrimental or injurious to property or improvements within the neighborhood; and 6. The granting of this variance would not impair the adequate supply of light or air to adjacent properties nor increase traffic congestion or endanger public safety. Based on the conclusions derived from the preceding, staff would recommend that Case No. WA-93-21 be APPROVED. " Case No. WA-93-21: An application by Ernest Rodenberg for approval of a 5 foot variance to the required 5 foot side yard setback to allow an existing detached shed to remain. Said property is located at 4520 Reed Street. Greg Moberg presented the staff report. All pertinent documents were entered into record, which Chairman HOWARD accepted. Board Member ROSSILLON said he understood the applicant tore down the existing shed, and Mr_. Moberg said 2-3 years ago permits were not required for anything under 120 square feet. Setbacks were stiii.required however, and we started realizing by not requiring permits there were a lot of sheds being built without proper setbacks. No permit has been granted for this shed, .since the applicant did not know he needed one. Board Member ROSSILLON asked if the applicant could have just upgraded the shed without a permit, and Mr. Moberg answered if the remodeling is more than 50$, it is a new building as .far as the City is concerned. Mr. Reuben is attorney for the applicant. Mr. Reuben said the existing shed was destroyed by the hail storm in 1990 and the applicant decided to put up a new shed in its place. Mr, Reuben said the shed is a permitted accessory use and' the materials are very compatible with what is in the neighborhood. He then entered into record, photos of the shed, labeled Exhibit 'A', and a list of addresses and a map of properties in the neighborhood that have sheds similarly located, labeled Exhibits 'A', 'B', and 'C'. Mr. Reuben said they would request that the application be approved as applied for. Mr. Rodenberg wants to store wheelbarrows, lawnmowers, large garden tools, ladders, things that cannot be stored in a basement or garage. No questions were asked of Mr. Reuben. Len Capra, 4510 Reed Street. Mr. Capra spoke in favor o£ this request saying the shed looks nice and the applicant has done very good work. He hopes the Board will approve this shed. No questions were asked of Mr. Capra. The applicant Ernest Rodenberg, 4520 Reed Street, was sworn in. Board'Member ABBOTT asked the applicant if he had a chance to talk to any of his neighbors and said he would feel a lot- better if he had signatures next to the names of the submitted list, and Mr. Rodenberg answered only Mr. Capra.
