CUP-95-1 EXHBIT 'A' April 12, 1995 Dear City Hall Neighbors: Thank you for attending the neighborhood meeting regarding the expansion of the police department on Tuesday, April 11th. As a result of the discussion at the neighborhood meeting, I will not be recommending that the City Council authorize the construction of a new parking lot on the southeast corner of the City's property. The concerns and the questions which were raised during our neighborhood meeting were both positive and constructive. The neighborhood discussion of this particular parking lot helped to clarify some very viable options for the City to pursue that may result in a longer term solution than the proposed parking lot. My very sincere thanks to all of you for participating in the neighborhood meeting in such a positive and constructive fashion. This neighborhood meeting was a wonderful example of how the City can and should work with neighborhoods to identify and solve potential problems before they become problems. I would still encourage you to attend the City Council meeting on April 24, 1995. During the Council discussion of the Police Department expansion, the question of the storm drainage from City property will be raised and discussed. It will be important for members of the City Council to hear directly from the residents how you are affected by the City Hall storm drainage, and to help clarify the concerns which were expressed during our neighborhood meeting.' In November of 1994, the citizens of Wheat Ridge passed a temporary sales tax increase to finance an addition to the City Hall Police Department. Plans for the expansion include an approximate 7000 square foot, two-story addition on the east side of City Hall and expansion of the employee parking lot to the northeast- To solicit input regarding the proposal from the surrounding neighborhood, the City has scheduled a neighborhood meeting on Tuesday, April 11, 1995 at 7:00 p.m. The meeting will be held at City Ha11, located at 7500 West-29th Avenue... Prior to application for rezoning or special use permit, the developer is responsible for holding an informal neighborhood meeting. The purpose of the meeting is to provide the opportunity for citizens to become aware of a proposed development in their neighborhood and to allow the developer to respond to citizen concerns in the design of their project.- All residents within 600 feet are required to be notified of the meeting. Planning Division Staft Report Case No. CUP-95-1/City of Wheat Ridge REQUEST Page 2 The applicant requests approval of a Conditional Use Permit to allow for the expansion of a public facility (City Hall) in a Residential-Two zone district. A government building is an allowed conditional use in an R-2 zone. In November of 1994, the citizens of Wheat Ridge approved a temporary sales tax increase to finance a new communications system and police department addition for City Hall. The entire project would cost roughly 2.2 million dollars. A 3500 square foot, two-story addition is being proposed at the northeast corner of the building, adjacent to the existing police department. Roughly 15 spaces of the existing police parking is being displaced by the addition. To compensate for the displacement, additional parking is provided on the perimeters of the fountain site and circular walking area. An additional parking area extension was proposed extending toward Vance Street with emergency access. This area was removed from the plan as a result of the neighborhood meeting. See Exhibit 'A'. All minimum requirements for a public facility in an R-2 zone have been met. Staff would note that City Hall property has street frontages on three sides -Vance, Wadsworth and West 29th Avenue. Vance is classified as a local street but has only 25 feet of width. The west half was vacated around 1978 to prevent a future access point. There is curb, gutter and sidewalk on Vance Street. West 29th Avenue meets the standard width for a public street but has no public improvements. Wadsworth is sub-standard in width by 20 feet and has curb and gutter, but no walk. As with any other development, Staff recommends that West 29th and Wadsworth Blvd. brought into conformance for public improvements. A sidewalk constructed along Wadsworth Blvd. would cost approximately $25,000. Curb, gutter and asphalt patch, and undergrounding of the irrigation ditch along West 29th Avenue is estimated to cost $18,000. 11. The neighborhood to the east is receiving the full impact. Why not expand parking on the fountain land or toward Wadsworth? Will the expanded parking area affect the capacity of the detention pond or the play area? Will the expanded parking on the pathway parcel affect the path? Is any access to Vance Street being allowed? One of the conditions of sale of the property was no access (even emergency) to Vance St. Where will the staging area/construction parking be? Is the legal protest provision applicable toward a CUP approval? The heavy volume of cars on court days does not justify intrusion into the neighborhood to the east. The following alternatives were offered from the neighborhood: - Make the parking lot "extension" smaller - Buffering with landscape materials to lessen the impact - Employees take City cars home at night so there are fewer vehicles in the lot - Staggering court times - City should pursue a joint parking agreement with Beth Eden in trade for the use of the City's park land for the school's physical education program - Move the court offices into vacant office buildings in the City - Do the building expansion first and re-assess parking needs at a later date Included under Exhibit 'A' is a letter from the City Administrator's office deleting the parking lot extension toward Vance Street from the project. III. CONDITIONAL USE PERMIT CRITERIA Before a conditional use permit is approved, the applicant shall show and the Planning Commission shall find that the proposed conditional use: 7. Will not have a detrimental effect upon the general health, welfare, safety and convenience of persons residing or working in the neighborhood of Ure proposed use. Approval of the conditional use permit and resultant expansion will not have a detrimental affect on the general health of persons in the area and should have a positive affect on safety and welfare. The convenience of persons in the area could be affected if inadequate parking is provided, creating overflow parking in the adjacent neighborhood. Planning Division Staff Report Case No. CUP-95-1(City of Wheat Ridge Page 4 2 Will not adversely affect the adequate IigM and air, nor cause significant air, water or noise pollution. The amount of light and air to adjacent properties will not be affected as the addition will be 150 feet to the closest property line (south}. Water and air pollution is 4ypically not an issue with a public facility used as office. Any increased drainage would be handled by a new storm sewer in 28th Avenue built as apart of the project. There would be a perceived increase in noise generated if parking is pushed closer to Vance Street. 3. Is consistent with the Comprehensive Plan. The Comprehensive Plan designates this property as parks and open space on the edge of public/semi- public. Staff concludes the City hall property with park land on the north half is consisten4 with the designation. 4. Wilt not resuR in undue traffic congestion or traffic hazards, or unsafe parking, loading, service or internal iraffic conflicts to the detriment of persons wheUier on or off the site. If inadequate parking is provided, there could be resultant traffic congestion on the property and on adjacent streets. 5. Will be appropriately designed, including setbacks, heights, parking, bulk, buffering, screening and landscaping, so as to be in harmony and compatible with the character of the surrounding areas and neighborhood, especially with adjacent properties. The building addition has been designed to be compatible with the existing structure. Screening of the employee parking area with vegetation needs to occur on the east side. 6. Will not overburden the capacities of the existing streets, utilities, parks, schools and other public facilities and services. The conditional use will not negatively affect utilities, parks and schools. ft could affect the capacity of adjacent streets if inadequate overflow parking is provided forcing visitors to use on-street parking. Staff concludes that the criteria used for evaluation supports approval of this request, however, there could be detrimental affects on the neighborhood if there is inadequate parking on site. IV. STAFF CONCLUSIONS AND RECOMMENDATIONS Staff concludes that a government building is a conditional use in the R-2 zone district and that the minimums established for that use have been met. Staff further concludes that the evaluation criteria supports approval of this request, although we feel that parking may be inadequate. For these reasons, Staff recommends Approval of the Conditional Use with the following conditions: 1. The parking lot extension at the southeast corner be eliminated. 2. That West 29th Avenue and Wadsworth be brought into compliance for public improvements by construction of a sidewalk along Wadsworth Blvd. and curb/gutter along West 29th Avenue. A vertical landscaped buffer be provided along the eastern edge of the parking lot. V. That the overall drainage-from the site be addressed and that it start from the parking lot itself to the drainage pond into 28th & Vance, eventually ending up in the Sloans Lake Drainage Pond. .That.. Wadsworth be brought into compliance with a development agreement and that we put the sidewalk in at that particular time; seconded. by Mrs. Dalbec. Mr. Siler will vote against this motion because 29th Avenue and Wadsworth improvements were not included in this motion. We require everybody else to comply with requirements, but governments exempt themselves from compliance.
