The Public Works Department has reviewed the referral dated
August 2, 1995 for the above referenced project and has the
following comments:
1. We will need a drainage study.
2. We will need a completed dumping/landfill permit application
submitted to determine if an erosion control plan may be
required.
3. No improvements will be required to be constructed on W. 38th
Avenue or Dudley Street.
4. There are no traffic related comments at this time.
4. The plat submitted for this site has been forwarded to Chuck

Public Service Company of Colorado (PSCo) acknowledges receipt of the plot plan of
Callas #MA-95-3
Project Title
PSCo has examined the proposed plot plan of the above-captioned project and suggest that defining
easements for electric and gas service should be delayed at this time.
Easements cannot be adequately delineated at this time due to the uncertainty of the service needs
and locations to allow for the most desirable and economic system design.
Easements shall be granted to PSCo when service locations are made known for the construction,
operation, maintenance, and replacements of their facilities as may be necessary to provide service
within this subdivision or property contiguous thereto, through, over, across, and under streets, utility
easements, and other public places or common areas.
Approval of electric and/or gas service to this property is subject to PSCo rules, regulations and
tariffs on file and in effect with the State Public Utilities Commission, State of Colorado.
Please note, PSCo has overhead electric distribution facilities in this area. The developer should
contact Dick Miller at 425-3811 regarding utilization or relocation of the existing facilties. Psco
would also like to remind the developer to have all utilities located prior to construction.

1. REQUEST
The applicant requests approval of a two-lot minor subdivision for property located at 8701 West 38th
Avenue.
II. SUBDIVISION DESIGN _ ,
The property in question is zoned R-1, is roughly .8 acre in area and is a through-lot with frontage on
both West 38th Avenue and Dudley Street. There is an existing house on the southern two-thirds of the
property plus several accessory structures.
The applicant is requesting approval of a two-lot subdivision so the northern one-third can be used as a
separate building site. Lot 1 (southern lot} would be 23,716 square feet and Lot 2, which has access from
Dudley Street, would be 12,500 square feet. All minimum requirements of the R-1 zone district
regulations have been met.
A 20-foot-wide cross access easement has been provided over and between the two lots. A note has
been added allowing free movement through the easement to both Dudley and West 38th Avenue by the
owners of both lots. No right-of-way dedications are required.
All minimum requirements of the Subdivision Regulations have been met.
111. STAFF RECOMMENDATION
Staff has concluded that the proposed subdivision is consistent with the minimums established in the R-
fzone district regulations. Staff further concludes that all requirements of the Subdivision Regulations
have been met. For these reasons, a recommendation of Approval is given for Case No. MS-95-3.
IV. RECOMMENDED MOTIONS ,
