The First Bank building at Wadsworth Boulevard and West 44th Avenue and the Vectra Bank building on West 38th Avenue have established certain common design elements and features that should be incorporated into future development or redevelopment throughout the balance of the Wheat Ridge Town Center. It is not intended that new/redeveloped buildings try to clone or recreate these buildings, but rather to utilize some of the design elements so that it functions and appears to be a unified Town Center. Those common elements and features that are to be used as unifying design features include the following: a. Use of brick of a similar size and color for facing or accent. b. Use of non-glare glass with bronze metal frames and casings. c. Use of horizontal bands of complementary the or brick as architectural accent. d. Use of round pillars, where pillars are used, as design feature. e. Use of landscape materials near building entrances and against large blank walls. ' 2. The use of metal, smooth-faced block or concrete as primary _„ ,,, architectur~l_features on exposed walis,of .buildings shall be kept to.a minimum. No more than 20$ of the exposed walls of buildings should incorporate such materials. 3. Generally, the color of buildings, including walls and roof should be earth tones with complementary accents. 4. Building components such as windows, doors, eaves, parapets, and canopies should be visually attractive in proportion, scale and relationship as related to other parts of the same building or adjacent buildings. 5. Mechanical equipment, trash storage areas, outside storage areas, loading docks and other similar elements which tend to be unsightly, shall be appropriately screened or enclosed so as not to be visible from adjacent properties or public streets. 6. Provide an attractive transition and buffer around the street perimeter. b. Provide both separation and buffering adjacent to residential areas. c. Provide visual corridors to delineate mayor,entrances and mayor interior drives. d. Provide visual breaks within large expanses of parking lots and to reduce storm water runoff and heat buildup. 7. Exterior lighting within parking lots and along major interior drives should be uniform throughout the Town Center. Area light standards of the type and color as used within the Town Center Park should be used. Light should not be directed towards or allowed to bleed onto adjacent residential properties. 8. Mayor access points and associated drives, as well as mayor interior drives should be designed to achieve the following: a. Physical separation and delineation from parking stalls and sidewalks next to buildings by use or curbs and landscaping. b. Protection for pedestrians at mayor store entrances by use of pavement markings, texture and or optional pavement materials, and through use of appropriate signage. This notice is intended to inform you of the process involved in land use development applications. Prior to application for rezoning or special use permit the developer is responsible for holding an informal neighborhood meeting. The purpose of the meeting is to provide the opportunity for citizens to become aware of a proposed development in their neighborhood and to allow the developer to respond to citizen concerns in the design of their project. All residents within 600 feet are required to be notified of the meeting. A staff planner will attend the meeting to discuss City policy and regulations and the process involved, however, the planner will remain impartial regarding viability of the project. Keep in mind that this is not a public hearing. Although a synopsis of the meeting will be entered as testimony, it is the public hearings in front of Planning Commission and City Council where decisions are rendered. If you want input in the decision- making process, it is imperative that you attend the public hearings. The public hearings you will be attending are quasi-judicial in nature. REQUEST The applicant requests approval of a Special Use Permit to allow a manned semi-trailer as a donation station within the Time Square shopping center parking lot. This shopping center is in the process of an interior remodel to accommodate a 12,000 square foot Goodwill sales outlet. The applicant is requesting the Special Use to allow a manned donation on the south side of the Time Square parking lot, adjacent to the Town Center park retaining wall. The trailers would be ten feet by 30 feet in size, 12 feet in height, and are manned 10:00 a.m. to 6:00 p.m., seven days per week. During unmanned hours, a nighttime service is used for cleaning and picking up items left when the trailer is unattended. Donations of appliances and furniture are not allowed. Empty trailers are traded-out with filled trailers as needed. The applicant hasn't specified an exact location, however, it was indicated that it would abut against the park's retaining wall along the south property line. There is only 44 feet of separation between the post drop and the curb/retaining wall along the common property line with the park. II. NEIGHBORHOOD MEETING A meeting for neighborhood input was held on March 30, 1995. Those in attendance were: Meredith Reckert, staff Ann Pitinga, Director of EDARC Kathleen Ferguson, Goodwill Industries Russell Santoya, Goodwill Industries Casey Elliott, Goodwill Industries Loren Fodness, Goodwill Industries Tim Weller, Goodwill Industries Frank Palmeri, 7891 West 39th Avenue Concern was expressed for bad circulation in the parking lot made worse because of the trailer and poor sight distance at the intersection of the parking lot and the connector drive. Also, the potential for items such as mattresses and couches being left off during unmanned hours and possible negative impact on the adjacent park land. A letter of objection has been included under Exhibit'A'. 111. CRITERIA CRITERIA TO SUPPORT A SPECIAL USE PERMR 1. Will meet a proven public need in that it will fill a void in necessary services, products or facilities especially appropriate at the location proposed, considering available alternatives. There is an existing retail sales facility within a mile whose profits are for charity and who takes donations. Also, donations are collected throughout the Metro area at other sides and by other means. These collections can be brought to the proposed Goodwill store at Times Square by truck. 2. Will not have a detrimental effect upon the general health, welfare, safety and convenience of persons residing or working in the neighborhood of the proposed use. The proposed donation station would not have a detrimental effect on the health and welfare of area residents. It could negatively affect safety and convenience by displacing required parking and further congesting the bad traffic circulation in the parking lot. There is roughly 44 feet of separation between the mail drop station and the face of the curb/retaining wall. If approved, Staff recommends the trailer be located at least 50 feet west of the connector drive. No "night lighting" if the trailers will be allowed. 3. Will not create or contribute to blight in the neighborhood by virtue of physical or operational characteristics of the proposed use. There could be a potential blighting affect on the center if debris and unwanted items are left during unmanned hours. 4. Will not adversely affect the adequate light and air, nor cause sign'rficant air, water or noise pollution. Since the trailers are only t2 feet in height, there should be no negative affect on the amount of light and air to adjacent properties. There could be litter and debris accumulation if the station is not kept clean. 5. Is consistent with the comprehensive plan. The Comprehensive Plan designates this area as Commercial Activity Center and as being within the Wadsworth Town Center Master Plan area. Two of the stated goals of the Wadsworth Town Center Master area are: "to improve or eliminate conditions of blight" and "to improve safety for vehicular and pedestrian circulation and access". Staff concludes that if the donation station is not properly placed or maintained it could negatively affect the appearance of the shopping center and exacerbate the vehicular circulation problem and, therefore, be inconsistent with the Wadsworth Town Center Master Plan. Recently, the City adopted guidelines for development in the Town Center Master Plan area. The proposal is inconsistent with these established guidelines. See attached under Exhibit'C'. 6. Will not result in undue traffic congestion or Uraffic hazards, or unsafe parking, loading, service or internal traffic conflicts to the detriment of persons whether on or off the site. Planning Division Staff Report Page 4 Case No. SUP-95-2/Goodwill Industries The proposed donation trailer could create traffic congestion with vehicles using the postal drop as there is only 44 feet of separation between the drop station and the curb/retaining wall. Because of this, the trailers should be located as far west as possible (at least 50 feet west of the connector drive). If approved, the trailer should not be "traded out" during rush-hour and when the mail-drop is being unloaded. It also appears that the proposed trailer location is within a 30-foot-wide ingress/egress easement for the Time Square subdivision. The City cannot allow this easement to be violated, therefore a new location must be found. 7. Will be appropriately designed, including setbacks, heights, parking, bulk, buffering, screening and landscaping, so as to be in harmony and compatible with the character of the surrounding areas and neighborhood, especially with adjacent properties. The trailers are painted blue and white to create a "signage" affect. As such it will not blend in with the surrounding area. At a minimum, if the Special Use Permit is approved, the trailer undercarriage should be screened from view with afour-foot-high solid fence. 8. Will not over burden the capacities of the existing streets, utilities, parks, schools and other public facilities and services. The donation trailers will not overburden the streets in the area or utilities, parks or schools. IV. AGENCY REFERRALS Public Works Department has no problems. Building Department has no problems. EDARC has many concerns relating to parking, circulation and potential blighting. See attached Exhibit 'B'. The trailer is located in an existing access easement. V. STAFF CONCLUSIONS AND RECOMMENDATIONS „ Staff has concluded that the proposed location of the trailer is within a 30-foot-wide ingress/egress easement along the southern property line of the Time Square subdivision. We also conclude that other locations or means of collection may be more appropriate, rather than the proposed site. Staff further concludes that the proposal is inconsistent with the Town Center Design Guidelines, and, in general, the Town Center Master Plan. For these reasons a recommendation of Denial is given: If a recommendation of Approval is given, Staff recommends the following restrictions apply: 1. It be for no more than one year. At that time the case returns to a public hearing in front of Planning Commission for review. 2. The trailer be located outside of the existing ingress/egress easement. The Design Guidelines, which are attached as Exhibit , are clearly not satisfied. Most importantly, there is a specific restriction that no more than 20~ of the exposed walls of buildings should incorporate metal. Also there are no unifying design features. 3. Paragraph 5. of the Design Guidelines recommend screening for mechanical equipment, loading docks etc. This guideline should definitely be applied to the trailer mechanical equipment. 4. EDARC would be most concerned if a property right, either real, personal or intangible, was created by granting Goodwill Industries a special use permit. The City Council has designated this area as an area to encourage redevelopment. Therefore, additional property rights which might deter redevelopment should not be added. If this permit is granted, EDARC would request that it be subject to revocation upon the approval of a redevelopment site plan by City Council for Time Square. 5.
